DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Conditional Use Permit to allow
the establishment of a restaurant with late night operational hours on Fridays and a general on-
sale liquor license in a previously approved mixed use commercial/residential building currently
under construction at 175-201 East Campbell Avenue. The proposed restaurant improvements
and operation are more fully described in (Attachments #3 and # 4).
Background: The City Council previously approved a Zone Change from C-3-S (Central
Business District) to C-PD (Condominium Planned Development), a Planned Development
Permit to allow the construction of a three-story mixed use commercial/residential building and a
Tentative Subdivision Map to create 23 condominium lots (22 residential units and one
commercial floor) on the project site. The applicant is requesting approval of a Conditional Use
Permit to allow late night operational hours and a liquor license in conjunction with a proposed
restaurant in the easterly portion of the building previously approved for retail/restaurant space.
Proiect Location: The subject property is located at the northwest comer of East Campbell
Avenue and North Second Street. The applicant intends to occupy the easterly portion of the
retail/restaurant space with a proposed restaurant of 4,420 square feet.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is Central
Commercial. The proposed late night operational hours and general on-sale liquor license in
conjunction with a restaurant is consistent with this land use designation. Restaurants and retail
uses are encouraged in the Downtown Area.
Zoning Designation: The zoning designation for the project site is C-PD (Condominium Planned
Development). The C-3 Zoning District allows late night activities occurring between 11 :00
p.m. and 6:00 a.m. with approval of a Conditional Use Permit. The establishment of a new use
in a previously approved building may be approved by the Community Development Director
through an Administrative Planned Development Permit; however, a liquor establishment
requires approval of a Conditional Use Permit.
Late Night Activities: The applicant is requesting approval to operate a restaurant between the
hours of 10:00 a.m. to 10:00 p.m. (Monday through Thursday), 7:30 a.m. to 12:30 a.m. (Fridays)
and 7:30 a.m. to 10:30 p.m. (Saturdays and Sundays).
Staff is supportive of the requested operational hours. Other businesses in the Downtown have
received approval to be open until 2:00 a.m., as specified in the attached table which lists the
other businesses that have approval to operate past 11 :00 p.m. (Attachment #5).
Staff Report - Planning Commission Meeting of January 24,2006
PLN2005-162 -175-201 E. Campbell Avenue
Page 3
Liquor License: The applicant is also requesting approval of an on-sale general liquor license in
conjunction with his restaurant. The bar seating area is shown with 54 seats and is incidental to
the main restaurant use.
The establishment of a restaurant with a general on-sale liquor license does not represent an over
concentration of such uses at this location. The Sonoma Chicken Coop Restaurant and Cardiff
Lounge are the two other general on-sale liquor license establishments in the general vicinity of
the proposed restaurant.
Outdoor Activities: Staff is recommending Conditions No.9 & 10 of approval that require an
outdoor seating permit, restricts the times and levels of any outdoor music system and prohibits
the installation of an outdoor public address system. Staff believes these conditions are
warranted, due to the approved residential uses above the proposed restaurant.
Redevelopment Agency Review: The Redevelopment Agency has reviewed the application and
is supportive of the proposed late night activities on Fridays and a liquor license in conjunction
with the proposed restaurant.
Police Department Review: The Campbell Police Department has reviewed the application and
has no concerns or objections to the proposed late night activities nor the general on-sale liquor
license in conjunction with the proposed restaurant use.
Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application, as there are no architectural changes to the exterior of the building or
site configuration.
