After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and. opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2007-135. 1. The proposed on-sale beer and wine sales and late night activities in conjunction with a restaurant are consistent with the Neighborhood Commercial General Plan land use designation. 2. The proposed on-sale beer and wine sales and late night activities in conjunction with a restaurant will be compatible with the C-1 (Neighborhood Commercial) zoning designation with approval of a Conditional Use Permit. 3. The project site consists of a restaurant (Round Table Pizza) in an existing 5,582 square foot commercial building. The space for the restaurant use would be 3,980 square feet. 4. The existing 48 parking spaces will adequately address the parking needs of the subject site and proposed use. 40 parking spaces are proposed for the restaurant use and a total of 37 spaces are required. 5. The project site is located near the southwest corner of West Campbell Avenue and Kim Louise Drive. The proposed project is surrounded by commercial uses on three sides, and an adjacent residential apartment complex to the south. 6. The proposed project is consistent with other developments and uses in the surrounding area. 7. The hours of operation shall be restricted to 9:00 a.m. to 11 :00 p.m., Sunday through Thursday, and 9:00 a.m. to 12:00 a.m., Friday and Saturday. 10. The project qualifies as a Categorically Exempt project per Section 15301, Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA). Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan. 2. The proposed use is allowed within the applicable zoning district with Conditional Use Permit approval, and complies with all other applicable provisions of this Zoning Code and the Municipal Code. 3. The proposed site is adequate in terms of size and shape to accommodate the fences and walls, landscaping, parking and loading facilities, yards, and other development features required in order to integrate the use with uses in the surrounding area. 4. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic the use would be expected to generate. 5. The establishment of beer and wine sales will not result in an over con centration of such uses in the area. 6. The establishment of beer and wine sales, as conditioned, will not create a nuisance due to litter, noise, traffic, vandalism, or other factors. 7. The establishment of beer and wine sales, as conditioned, will not significantly disturb the peace and enjoyment of the nearby residential neighborhood. 8. The establishment of beer and wine sales will not significantly increase the demand on City services. 9. The design, location, size, and operating characteristics of the proposed use are compatible with the existing and future land uses on-site and in the vicinity of the subject property. 10. The establishment, maintenance, or operation of the proposed use at the location proposed will not be detrimental to the comfort, health, morals, peace, safety, or general welfare of persons residing or working in the neighborhood of the proposed Planning Commission Resu'Lltion No. 3844 PLN2007-135 - 1400 W. There is a reasonable relationship and a rough proportionality between the conditions of approval and the impacts of the project. THEREFORE, BE IT RESOLVED that the Planning Commission approves a Conditional Use Permit (PLN2007-135) for an on-sale beer and wine license and late night activities in conjunction with a restaurant (Round Table) on property owned by Green Valley Development located at 1400 W. Campbell Avenue in a C-1-S (Neighborhood Commercial) Zoning District. Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division 1. Conditional Use Permit Approval Expiration: The Conditional Use Permit approval shall be valid for one year from the date of final approval. Within this one-year period, the use must be established on the property and the conditions of approval satisfied. Failure to meet this deadline will result in the Conditional Use Permit being void. 3. Revocation of Permit: Operation of the use in violation of the Conditional Use Permit or any standards, codes, or ordinances of the City of Campbell shall be grounds for consideration of revocation of the Conditional Use Permit by the Planning Commission. Propertv Maintenance: The owner/operator of the subject property shall maintain all exterior areas of the business free from graffiti, trash, rubbish, posters and stickers placed on the property. 8. Sianaae: No signage is approved as part of the development application approved herein. All signage shall be installed and maintained consistent with the provision of the Sign Ordinance, Chapter 21.30 of the Campbell Municipal Code. 9. Outdoor Storaoe: No outdoor storage is permitted on the subject property. No equipment, materials or business vehicles shall be parked and/or stored outside the building or within the parking lot. 10. Live Entertainment: No live entertainment is approved as part of the development application approved herein, including live music, disc jockey, karaoke, and dancing. 11. Liauor License: The applicant shall obtain a license for a Type 41 (On-Sale Beer and Wine License for Bona Fide Public Eating Place) from the State Department of Alcoholic Beverage Control prior to the sale of alcoholic beverages. 12. Food Service: Food service shall be available at all times alcoholic beverages are served. 13. Loiterino: There shall be no loitering allowed outside the business in the rear parking lot or the side parking lot areas. The business owner is responsible for monitoring the premises to prevent loitering. 14. Noise: a. Campbell Avenue (reference Attachment 3, Applicant's Written Statement). Business hours will be from 11:00 a.m. to 10:00 p.m., Sunday through Thursday, and 11:00 a.m. to 11:00 p.m., Friday and Saturday. Hours of operation will be from 9:00 a.m. to 11 :00 p.m., Sunday through Thursday, and 9:00 a.m. to 12:00 a.m., Friday and Saturday. Background: On January 23, 2007, a Site and Architectural Review Permit (PLN2006-150) was approved to allow a remodel and fa9ade improvement to an existing single-story commercial building and interior improvements to accommodate space for three retail tenants. Round Table Pizza would locate their restaurant in two of the three tenant spaces for a total of 3,980 square feet, and the remainder retail space of 1,529 square feet would be for future retail use. The building was previously a Straw Hat Pizza restaurant. Project Location: The project site is located near the southwest corner of West Campbell Avenue and Kim Louise Drive. The proposed project is surrounded by commercial uses on three sides, and an adjacent residential apartment complex to the south (reference Attachment 5, Location Map). ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Neighborhood Commercial. The proposed on-sale beer and wine sales and late night activities in conjunction with a restaurant are consistent with this land use designation. Zoning Designation: The zoning designation for the project site is C-l (Neighborhood Commercial). Restaurants are allowed by right in the C-1 Zoning District. The C-1 Zoning District would allow for on-sale beer and wine sales and late night activities with approval of a Conditional Use Permit. The proposed project would be consistent with the Zoning Ordinance with approval of a Conditional Use Permit. Parking: Pursuant to the Campbell Parking and Loading Ordinance, one parking space is required for each three seats for a restaurant use for a total of 22 parking spaces. The proposed on-sale beer and wine sales would be for consumption on site and would not be available to take off site. With the recommended conditions of approval, staff finds that the proposed on-sale beer and wine sales is incidental to the restaurant operation, is compatible with the surrounding uses and properties within the area, and does not represent an over concentration of such establishments. Police Department Review: The Campbell Police Department has reviewed the application and has no objections to the proposed allowance of beer and wine sales and late night activities in conjunction with a restaurant. The use of the Premises shall be for the ownership and operation of a Round Table Pizza restaurant with the sale of beer and wine. The restaurant will be.owned and operated by Round Table Development Company and will be the sole tenant of the Premises. The first Round Table Pizza restaurant was founded in 1959 and over the years, our corporation has grown to include over 500 Round Table Pizza locations. Our corporation is committed to offering top quality pizza. Despite tremendous growth over the years, Round Table Pizza has held onto that standard, never wavering from offering consumers pizza prepared daily with the freshest ingredients. Today, Round Table Pizza is the nation's fifth largest pizza franchise firm. We are a chain of more than 500 restaurants, operating in the Western U.S. and internationally. We offer our guests great-tasting pizza via in-store dining, take-out, and delivery service. We take pride in our ethnically diverse group of franchisees who participate in local community activities. We offer an affordable and delicious way for fam ilies to enjoy a night out. We have been a responsible liquor licensee in the State of California for many years (on- sale type 41 license). We have also owned and operated another Round Table Pizza restaurant in the City of Campbell since June 2002. Our restaurants offer many employment opportunities for young individuals in the area. Our operations do not cause undue parking congestion or noise level issues, are family-oriented and close relatively early (hours of operation are Sun-Thurs 11arn-10pm and Fri-Sat 11 pm-11 pm). We anticipate hiring appr'oximately 32 restaurant employees. The restaurant will have approximately 38 tables and 65 chairs. Our sales tax revenues help our local communities. For all of these reasons, we believe our restaurant serves public convenience or necessity for the purpose of granting a City of Campbell Use Permit for the operation of a Round Table Pizza restaurant with beer and wine sales.
