Fence Exception Denied 2008April 10, 2008 Keith & Kimberly Cox 1234 Colleen Way Campbell, CA 95008 Re: Fence Exception Application File No: PLN2008-18 -1234 Colleen Way Dear Mr. & Mrs. Cox, Thank you for your submittal of a Fence Exception application for a seven foot high fence (one foot retaining wall, five foot solid wood and one foot of lattice) along the rear portion of the street yard adjacent to the sidewalk along La V onne Drive. After the ten-day public comment period, the Acting Community Development Director, upon a recommendation from the City Engineer under the authority of the Director of Public Works, has denied your request for a fence exception to allow a street side yard fence to be placed on the property line where a five foot setback is required by City Ordinance. The Acting Community Development Director's decision is based upon the following findings: 1) The change would impair pedestrian safety by limiting the effective width of the sidewalk; 2) Would not result in a more desirable site layout than permitted if a 5 foot setback was provided; 3) Would be detrimental to the safety of persons residing in the neighborhood; and 4) Would be detrimental to property and improvements in the neighborhood. This action is effective in ten calendar days, unless appealed in writing to the City Clerk including a $100.00 appeal filing fee by 5:00 p.m. on April 21, 2008. 70 North First Street . CITY OF CAMPBELL Community Development Department March 19, 2008 NOTICE OF FENCE EXCEPTION APPLICA TION Notice is hereby given that the Community Development Director of the City of Campbell has received an application for a Fence Exception File No.: PLN2008-18 Applicant: Keith & Kimberly Cox Project Address: 1234 Colleen Way Zoning District: R-1-6 (Single-family residential, 6,000 sq. ft. min. lot size) Project Description: Fence exception requested to construct a seven foot side yard fence along the rear portion of the eastern side of the property. The fencing consists of one foot retaining wall, five foot wood panels and one foot of lattice). The ten day comment period for this application shall begin on March 19, 2008 and end on March 29, 2008. Any comments regarding this application shall be submitted in writing to the Planning Division before 5:00 p.m. on March 29, 2008 as a decision will be rendered after this date. Plans and letter of request are available for public review at the Planning Division Office. Decisions by the Community Development Director are final in 10 calendar days following the date of approval, unless an appeal is received in writing at the City of Campbell City Clerk's Office, 70 N.
