At an Administrative Hearing on January 4, 2001, the Community Development Director
conditionally approved the above-referenced tentative parcel map to create two parcels.
This approval is based upon the attached findings and is subject to the attached conditions
of approval. The effective date of this approval is ten (10) days following the
Community Development Director's decision and is valid for twenty-four (24) months
and will expire on January 4,2003.

Associates, Inc., for approval of a Tentative Parcel Map (PLN2000-
169) to create two parcels from a single lot on property located at
649 Creekside Way in an P-D (Planned Development) Zoning
District.
STAFF RECOMMENDATION
That the Director of Community Development take the following action:
1. APPROVE the Tentative Parcel Map (PLN2000-169) to allow the creation of two
(2) lots, incorporating the attached findings and subject to the attached conditions
of approval.
ENVIRONMENTAL DETERMINATION
This project qualifies as a Class 15 Categorical Exemption of the provisions of the California
Environmental Quality Act (CEQA). Class 15 consists of the division of property in urbanized areas
into four or fewer parcels when the division is in conformance with the City's General Plan and
Zoning.

DISCUSSION
Applicant's Proposal: The applicant is seeking approval of a Tentative Parcel Map to subdivide the

subject property into two (2) lots located at 649 Creekside Way. The proposed lot configuration
consists of one lot located at the corner of Creekside Way and the northbound Highway 17 off-ramp
(Parcel No.2) and one interior lot (Parcel No.1) with approximately 240 feet of frontage along
Creekside Way.
Background: A Planned Development Permit (pLN 2000-88) allowing the construction of a
170,000 square foot office building 210 room hotel and two parking structures was approved for the
property on December 11, 2000 by the City Council by Ordinance No. 1998.
GENERAL PLAN AND ZONING CONSISTENCY
General Plan Designation: The General Plan land use designation for the project site is Commercial.
The proposed subdivision to accommodate a hotel and office uses is consistent with the General
Plan land use designation.
Zoning Designation: The subject property is zoned P-D (Planned Development). The P-D Zoning
District does not require a minimum lot area or minimum lot width.
ANALYSIS
Subdivision Design: The proposed parcels are configured as a corner lot and interior lot. Access to
the site would be via a 24 foot shared access easement located on Parcel No.2 (Office Parcel). The
owners of the two properties would have joint responsibility for the parking garage on Parcel No.2
and the access drive. The project will have CC&R's to insure the long term maintenance and
operation of these shared facilities.
Street Design and Improvements: The subject property is subject to the Conditions of Approval for
Planned Development Permit No. PLN 2000-88. The Conditions of Approval require the
installation of a fully signalized intersection at the project driveway and related improvements to
Creekside Way. A financial contribution to the Smart Corridor Project and Campisi Way Extension
project is also required.
Tree Preservation: The site contains several mature trees and vegetation. The approved PD permit
(PLN 2000-88) provides for tree protection and replacement measures.

Findings for Approval ofa Tentative Parcel Map to allow the creation of two parcels.
The Director of Community Development finds as follows with regard to project number
PLN 2000-169:
1. The development of the proposed parcel map will result in two parcels, which is consistent
with the General Plan designation of Commercial for the property.
2. The proposed parcel map is consistent with the development standards of the approved
Planned Development Permit (PLN 2000-88).
3. The proposed subdivision layout allows for shared vehicular access.
4. The project qualifies as a Class 15, Categorically Exempt project, per Section 15315
(Minor Land Divisions) ofthe California Environmental Quality Act.
Based upon the foregoing findings of fact, the Director of Community Development finds
and concludes that:
1. The proposed subdivision is consistent with the General Plan, the Zoning Ordinance and
the approved Planned Development Permit (PLN 2000-88).
2. The proposed subdivision does not impair the balance between the transportation needs of
the region and the public service needs of its residents and available fiscal and
environmental resources.
3. The design of the subdivision provides, to the extent feasible, for future passive or
natural heating or cooling opportunities.
4. The proposed project will aid in the enhancement and the harmonious development of the
immediate area.

The applicant is hereby notified, as part of this application, that he/she is required to meet
the following conditions in accordance with the Ordinances of the City of Campbell and
the State of California. Additionally, the applicant is hereby notified that he/she is
required to comply with all applicable Codes or Ordinances of the City of Campbell and
the State of California that pertain to this development and are not herein specified.
COMMUNITY DEVELOPMENT DEPARTMENT
1. Approved Project: Approval is granted for a Tentative Parcel Map allowing the
creation of two lots on property located at 649 Creekside Way. The map shall
substantially conform to the map prepared by Kier & Wright dated December, 2000,
except as may be modified by the Conditions of Approval herein.
2. Planned Development Permit: The applicant shall comply with all of the Conditions
of Approval of the approved Planned Development Permit (PLN 2000-88). The
Conditions of Approval shall apply individually and jointly to Parcels 1 & 2.
3. Property Maintenance: The property shall be maintained free of any combustible
trash, debris and weeds, until the time that actual construction commences.
4. Structural Removal: All existing structures shall be demolished or removed from the
property prior to recordation ofthe final map.
5. Utility Boxes and Back-Flow Preventers: Applicant shall submit a plan to the
Community Development Department, prior to installation of PG&E utility
(transformer) boxes and SJ. Water back-flow preventers, indicating the location of
the boxes and screening (if boxes are above ground) for approval of the Community
Development Director.
6. CC&R's: Provide proposed Condition, Covenants and Restrictions (CC&R's) to the
Community Development Director for review and approval prior to recordation of the
Parcel Map.
PUBLIC WORKS DEPARTMENT
7. Parcel Map: Prior to issuance of any building permits for the project, the applicant
shall submit a Parcel Map for recordation upon approval by the City. The current
plan check fee is $1,170.00 plus $25 per parcel.

8. Preliminary Title Report: Prior to recordation of the Parcel Map, the applicant shall
provide a current Preliminary Title Report.
9. Monumentation for Parcel Map: Prior to recordation of the Parcel Map, all
Monuments shown on the map shall be set.
10. Water Meter(s) and Sewer Cleanout(s): Existing and proposed Water Meter(s) and
Sewer Cleanout(s) shall be installed on private property behind the public right-of-
way line.
11. Utilities: All new on-site Utilities shall be installed underground per Section
20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or
additions. Applicant shall comply with all plan submittals, permitting, and fee
requirements of the serving utility companies.
12. Storm Drain Area Fee: Prior to recordation of the Parcel Map, the applicant shall pay
the required Storm Drain Area fee which is $2,500 per acre.
