RESOLUTION NO. 3678
BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT
(PLN2005-100) TO ALLOW RETAIL AUTO SALES AT AN EXISTING
AUTO REPAIR SHOP ON PROPERTY OWNED BY MR. HAB SIAM
LOCATED AT 2921 S. WINCHESTER BOULEVARD IN A C-2
(GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF
MR. JOHN LANCASTER, ON BEHALF OF BRITISH EUROPEAN.
FILE NO. PLN2005-100.
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application PLN2005-100:
1. The proposed project consists of retail auto sales in an existing commercial building.
2. The establishment of the proposed use will result in a use that is consistent with the
General Plan land use designation of General Commercial for the property.
3. The proposed retail auto sales is consistent with the C-2 (General Commercial)
zoning designation for the site with approval of a Conditional Use Permit and is
compatible with the existing auto repair on the site and the surrounding uses.
4. The subject property is currently developed with asingle-story commercial building
constructed in approximately 1965.
5. The project site is located on the west side of Winchester Boulevard between West
Sunnyoaks Avenue and Bedal Lane and is surrounded by commercial/industrial uses
to the north, south, and east and percolation ponds to the west.
6. The proposed landscape improvements include increasing the landscape area along
the southern property line and street frontage, removing the existing landscaping
(with the exception of the existing trees) and replacement with new lawn and shrubs,
and the installation of an irrigation system to serve the landscaped areas.
7. The allowed operational hours are from 6:00 a.m. to 11:00 p.m. seven days a week.
8. When a legally established use is changed to one that requires more off-street
parking than the existing or previous use, then only the difference in the required
number of parking spaces for the new use and existing use need to be provided.
Since the existing parking area provides 22 parking spaces, the applicant is required
to provide a total of 25 required parking spaces for the establishment of the new use.
The applicant has shown the required 25 parking spaces on the site plan.
Planning Commission F~.,~olution No. 3678

9. The project qualifies as a Categorically Exempt project per Section 15301, Class 1
(Existing Facilities) of the California Environmental Quality Act (CEQA).
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
1. The proposed project is consistent with the General Plan.
2. The proposed use is allowed within the applicable zoning district with Conditional
Use Permit approval, and complies with all other applicable provisions of this Zoning
Code and the Municipal Code.
3. The proposed site is adequate in terms of size and shape to accommodate the
fences and walls, landscaping, parking and loading facilities, yards, and other
development features required in order to integrate the use with uses in the
surrounding area.
4. The proposed site is adequately served by streets of sufficient capacity to carry the
kind and quantity of traffic the use would be expected to generate.
5. The design, location, size, and operating characteristics of the proposed use are
compatible with the existing and future land uses on-site and in the vicinity of the
subject property.
6. The establishment, maintenance, or operation of the proposed use at the location
proposed will not be detrimental to the comfort, health, morals, peace, safety, or
general welfare of persons residing or working in the neighborhood of the proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
7. No substantial evidence has been presented which shows that the project, as
currently presented and subject to the required conditions of approval, will have a
significant adverse impact on the environment.
8. There is a reasonable relationship and a rough proportionality between the
conditions of approval and the impacts of the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a
Conditional Use Permit (PLN2005-100) to allow retail auto sales at an existing auto
repair shop on property owned by Mr. Hab Siam located at 2921 S. Winchester

DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Conditional Use Permit to allow
retail auto sales at an existing auto repair shop located at 2921 S. Winchester Boulevard.
Staff Report -Planning Cu~~unission Meeting of October 11, 2005
PLN2005-100 - 2921 S. Winchester Blvd.
Page 2
Background: The subject property is currently developed with asingle-story commercial
building constructed in approximately 1965.
Project Location: The project site is located on the west side of Winchester Boulevard between
West Sunnyoaks Avenue and Bedal Lane. The project site is surrounded by commerciaUindustrial
uses to the north, south, and east and percolation ponds to the west.
ANALYSIS
General Plan Desi ation: The General Plan land use designation for the project site is General
Commercial. The proposed retail auto sales is consistent with this land use designation.
Zoning Desi ation: The zoning designation for the project site is C-2 (General Commercial).
The C-2 Zoning District allows motor vehicle sales for new and used cars with approval of a
Conditional Use Permit. The proposed project would be consistent with the Zoning Ordinance
with approval of a Conditional Use Permit.
Use: The applicant is requesting approval of a Conditional Use Permit to allow retail auto sales
at an existing auto repair shop. The auto repair shop currently specializes in British European
vehicle repair and the applicant would like to convert 1,050 square feet of the interior of the
existing building into a showroom for the sale of select used vehicles that are consistent with the
types of vehicles being repaired on site. No vehicles for sale would be stored outside the
building in the parking lot but would be located inside the building in the showroom area. The
business hours for the existing auto repair business and proposed vehicles sales would be
Monday through Friday from 8:00 a.m. to 5:00 p.m. The C-2 Zoning District allows businesses
to be open between the hours of 6:00 a.m. and 11:00 p.m., seven days a week.
The business, including auto repair and the retail sale of vehicles, was previously located on the
adjacent property to the north at 2875 South Winchester Boulevard for seven years. The
business received approval of a Condition Use Permit from the Planning Commission in 1999 for
retail auto sales in conjunction with the auto repair use. No complaints were received for this
business during their occupancy at this location.
Landscaping: The project site currently has landscaping along the street frontage and along a
portion of the southern property line adjacent to the parking lot area. The proposed landscape
improvements include increasing the landscape azea along the southern property line and street
frontage, removing the existing landscaping (with the exception of the existing trees) and
replacement with new lawn and shrubs, and the installation of an irrigation system to serve the
landscaped areas.
The total landscaping area for the property is five percent, which does not meet the minimum
requirement of 10 percent of the net site azea as required by Chapter 21.26 (Landscaping
Requirements). Since the building and site layout aze existing, staff believes that the enlazgement
of the existing landscape areas and the improvement of these areas with new landscaping are
sufficient to serve the proposed use.
Staff Report -Planning Commission Meeting of October 11, 2005
PLN2005-100 - 2921 S. Winchester Blvd.
Page 3
Exterior BuildinQ/Site Modifications: The applicant is proposing site improvements as part of the
application which include repainting the building earth toned colors, re-striping the parking area to
accommodate additional spaces, including a new accessible parking space, and constructing a new
trash enclosure to house the existing trash receptacle.
Parking: The existing property is deficient in parking spaces based on the current parking
standards for auto repair use. However, the auto repair use was legally established on site and the
approved number of parking spaces is 22 spaces. Pursuant to Section 21.28.040 of the Campbell
Municipal Code (Number of Parking Spaces Required), when a legally established use is
changed to one that requires more off-street parking than the existing or previous use, then only
the difference in the required number of parking spaces for the new use and existing use need to
be provided.
Retail auto sales requires one space per each 200 square feet of gross floor area and auto repair
requires one space per each 350 square feet of gross floor area. The difference in the required
number of parking spaces for the retail auto sales use and the existing auto repair use is three
spaces. Since the existing parking area provides 22 parking spaces, the applicant is required to
provide a total of 25 required parking spaces for the establishment of the new use. The applicant
has shown the required 25 parking spaces on the site plan.
Site and Architectural Review Committee: The Site and Architectural Review Committee
(SARC) reviewed this application at their meeting on September 27, 2005. SARC requested that
the applicant provide a preliminary landscape plan for the Planning Commission to review. The
applicant has provided a preliminary landscape plan and the plan is included in the project plan
set.

Re: Exclusive British European
Use Permit @ 2921 So. Winchester Blvd.
To: Planning Department
I am applying for a modification of an existing Use Permit at 2921 So. Winchester Blvd. The
property currently has a use permit for automotive repair and maintenance. I am seeking to convert
a portion of the existing premises to sell selected used vehicles consistent with my particular repair
service. We have an indoor showroom to display all vehicles for sale. There are no physical
changes to the premises planned.
We have occupied an adjacent location at 2875-A for seven years. That location has housed both
my repair operations and an indoor showroom to display Jaguars and Land Rovers and associated
accessories for retail sale. The location has a current Use Permit that covers both uses.
We have relocated the business to the new- location as it better serves my needs for both uses. We
will operate in the same fashion as we have at the previous location and expect no changes in either
traffic or other impacts related to the operation of the business.
Proposed business hours will remain Monday through Friday, 8:00 am to 5:00 pm. We will have
the same number of employees and expect our customer level to remain the same.
Our "showroom" will include an existing repair area at the front of the property that will house
several vehicles at a time as well as a display counter for accessories and parts. We will make
cosmetic repairs to the existing building and properly maintain the existing landscaping.
In our opinion, this application seeks to permit a use that is consistent with the City's goals of
increasing retail activity on this portion of Winchester while remaining consistent with the uses and
impacts that are currently present on the street. Additionally, our presence will serve to improve
the appearance of this particular property as a whole as we will occupy the entire property.
I appreciate your consideration of this application. If you have any questions please contact me
directly at (408) 374-0131.
Sincerely
Lancaster
