Dear Ms. Estes:
Thank you for your letter dated March 4, 2005, wherein you request a determination that
the proposed use of the fourplex at 617 Beta Ct. by the Salvation Army does not meet the
City's definition of Transitional Housing.
After the review of the definition in the Zoning Ordinance and Development Standards
for such uses, the City Attorney has concluded that the proposed use, assuming it
provides one on one case management, would meet the definition of Transitional
Housing and consequently would be subject to the Development Standards and the
Conditional Use Permit Application process.
He further adds that Campbell Municipal Code in section 21.36. 230 D, limits stay at the
"Transitional housing use to a maximum of six months." Consequently, this section
would prohibit the stays of between six months and two years, contrary to your intended
use.

Subject: Transitional Housing - 617 Beta Court
Please find attached a letter from The Salvation Army requesting a determination regarding a
Transitional Housing Use versus a multiple family residential four-plex and the need to process a
Conditional Use Permit.
The Zoning Ordinance has the following provisions:
21.36.230 Transitional housing.
This section provides locational and operational standards for the establishment of transitional housing
uses, in compliance with Article II (Zoning Districts and Allowable Land Uses), which shall be subject to
the following criteria and standards:
A. Conditional use permit required. Transitional housing uses shall be allowed by conditional use permit
and subject to all of the provisions of the applicable zoning district;
B. Conformance. The facility shall conform to all property development standards of the zoning district in
which it is located;
C. Separation requirements. A minimum separation of 300 feet shall be required from a proposed
transitional housing facility and another similar facility or asingle-family residentially zoned or occupied
parcel;
D. Maximum stay. The duration of stay shall be limited to a maximum of six months. (Ord. 2043 §1(part),
2004).
Definitions:
"Transitional housing" means a facility designed or operated as temporary living quarters for homeless
persons for up to two years. Residents are also provided with one-on-one case management, education
and training, employment assistance, mental and physical services, and support groups. Transitional
housing shall comply with the provisions of Section 21.36.230.
The maximum stay provision of section 21.36.230 is not consistent with the definition. The pre-
application submittal from The Salvation Army described the use of 617 Beta Court as transitional stay
of up to 24 months.
The pre-application response letter to this application is also attached.

The Salvation Army is currently in the process of acquiring an existing fourplex at 617 Beta Court with
the objective of providing housing to homeless families and sing':e adults in substance abuse recovery for
a period of twenty-four months. A total of twelve individuals at any one time would reside in the
apartments following purchase of the property.
On January 17, 2005, The Salvation Army submitted a prela,minary application to the City of Campbell
for the establishment of transitional housing use within this fourplex through approval of a Conditional
Use Permit. In response to the preliminary application, The Salvation Army received a letter dated
February 11 from Mr. Tim Haley indicating that the project parcel is located within 300 feet of residential
zoned parcels on Marilyn Drive and Kenneth Avenue, and, thus, would not be in compliance with the
development standards of the zoning district.
At this time, The Salvation Army is seeking a letter of determination from the City of Campbell
indicating that the proposed use of the property at 617 Beta Court does not meet the City's definition of
transitional housing, and, as a result, would not require a Conditional Use Permit. The housing program
proposed by The Salvation Army would provide an extended stay of up to twenty-four months. This
length of stay is inconsistent with the City of Campbell zoning ordinance criteria for transitional housing,
~o~hich limits the stay to a maximum of six u~or~~~ts.
The Salvation Army has extensive experience in providing housing for families and single adults in Santa
Clara County. As noted in the pre-application, applicants to the proposed housing program will
participate in an extensive screening process by The Salvation Army to determine their appropriateness
for alonger-term, structured program.

Thank you for your submittal of a preliminary application for the establishment of
transitional housing use within an existing fourplex at 617 Beta Court in Campbell. The
establishment of a transitional housing use will require the approval of a Conditional Use
Permit by the Planning Commission at a public hearing.
Based upon your description, the Salvation Army intends to operate a transitional
housing facility for homeless families and single adults in a substance abuse recovery
program. It would be helpful to identify a maximum number of persons anticipated in the
four apartments units. Additionally, the provided description indicates that a senior client
in the transitional program would be the on-site manager. The zoning ordinance provides
the following criteria for transitional housing:

1. Conditional Use Permit: The Conditional Use Permit approves the proposed use, site
plan and elevations for the subject property. The purpose of the Conditional Use
Permit review is to allow consideration of uses on a case-by-case basis. This
approval process takes into consideration the location of the use as well as on-site
improvements. An application fora Conditional Use Permit is enclosed. A
processing time of 45-60 days is typical for a Conditional Use Permit and requires
consideration by the Planning Commission through a public hearing process.
The Planning Commission's consideration includes a review of compliance with the
development standards of the zoning district where the use is proposed. Additionally,
the Planning Commission reviews the concentration of similar uses within 300 feet of
the proposed transitional housing facility or asingle-family zoned parcel. The
project parcel is located within 300 feet of residential zoned parcels on Marilyn
Drive and Kenneth Avenue.
Consequently, the staff would not recommend the establishment of a transitional
housing use at this location.
2. Zonin :The subject property is zoned R-2-S (Multiple-family residential) and is
designated as a Medium Density Residential land use on the City's General Plan
Land Use Map.
Your pre-application was distributed to the Public Works Department, Building Division,
Police Department and the County Fire Department. No comments were received from
these departments.
