The property is presently zoned R-1-10 (Single Family Residential, 10,000 square foot minimum lot size) and is designated as Low Density Residential (Less than 3.5 units per gross acre) on the City's General Plan Land Use Map. The subject property is located within the San Tomas Neighborhood and is subject to the development standards and design guidelines of the San Tomas Area Neighborhood Plan (STAND). Your application was distributed to the Public Works Department, Building Division, Planning Division, and Fire Department. In addition to the Planning Division's comments contained in this letter, please find enclosed comments from the Public Works Department. Comments from the Fire Department and Building Division were not available at the time of this mailing and will come under separate cover. Please note that these comments are meant to be preliminary. A two-lot subdivision would require the approval of a Tentative Parcel Map by the Community Development Director. The Community Development Director is not supportive of the proposed subdivision as presented for the following reasons: 1. The STAND requires that the minimum lot width for a cul-de-sac property in the San Tomas Neighborhood is 60-feet. The existing lot width on the cul-de-sac is 47.46 feet. In order for the project to be approved, each cul-de-sac lot would need to have a minimum width that does not go below 60-feet at any point. 2. The City's Subdivision Regulations require that the side lot lines for new lots shall be at right angles to street radials. The proposed purchase of property from the adjacent property and lot line adjustment would modify the lot line that currently meets this requirement and make it non-conforming. 3. If the lot configuration were to be approached as a regular lot and a flag lot, the rear lot would need to be a true flag lot.
