My client is in contract to purchase the property that is referenced above as APN# 282-17-018. I have reviewed your letter of March 1, 2006 to Los Trancos Systems, LLC and your memorandum of February 28, 2006 regarding the DRC application. I am writing to ask for clarification on the process that you have described. As I understand it, the City of Campbell is not supportive of a lot line adjustment that would result in access to the subject property across the property at 1321 Porgy Court. Apparently, the ,:,ity is rPl _?ctar_± ±c supYCrt u lot :ine adjustment that would include property in the City of San Jose. Your letter and memo are unclear as to how the access problem would be solved. It seems to me that the simplest solution is for the subject property to be developed as a flag lot with the access being an easement running parallel with the northern boundary of the property located at 1321 Porgy Court. I enclose herewith an assessor's parcel map with the suggested easement location shown with a yellow highlight. Brand March 1, 2006 Mr. Charles Prael Los Trancos Systems, LLC 2375 Adele Avenue Mountain View, CA 94043 Re: Preliminary Application Comments File No: PRE2006-07 Parcel #: 282-17-018 (no address) & 282-17-020 (1321 Porgy Court) Dear Mr. Prael: Thank you for your submittal of a preliminary application for a lot line adjustment which would allow vehicular access to a land locked parcel located on the above referenced property. The subject property is presently zoned R-1-6 (Single-Family Residential) and is designated as Low Density Residential (less than 6 units per gross acre) on the City's General Plan Land Use Map. The City of Campbell City Attorney has previously determined that the subject property was illegally created by a grant deed in 1964. The enclosed letter from the City Attorney, William R. Seligmann, to the property owner, Winston Chew, dated June 13, 2000 addresses the legality of the lot and the requirement to obtain a Conditional Certificate of Compliance to legalize the lot. Please see the enclosed comments from the Public Works Department regarding the requirements for a Conditional Certificate of Compliance. In addition to the Public Works Department requirements, the subject lot would need to meet all applicable zoning and subdivision regulations including minimum lot size, lot width and access requirements to a public right-of--way. The City is not supportive of a lot line adjustment and a jurisdictional boundary change to accommodate a new 15-foot access driveway from the subject property across the adjacent property, which is located within the City of San Jose, to Porgy Court. Additionally, the City's Subdivision Regulations stipulate that lots may not be divided by a City boundary line.
