Dear Applicant:
Thank you for your submittal of a preliminary application for the establishment of towing service
use within an existing industrial building at 180 East Sunnyoaks Avenue. The establishment of a
towing service use will require the approval of a Conditional Use Permit by the Planning
Commission at a public hearing.
Based upon your description, Lima Towing intends to use this location for storage purposes in the
building and side yard of the building. No truck maintenance is proposed at this site and tow
trucks will be dispatched and stored from your Santa Clara location. The zoning ordinance
requires approval of a Conditional Use Permit and provides the following criteria for towing
services
21.36.240 Towing service and vehicle dismantling.
This section provides location and operational standards for the establishment of towing service
uses, in compliance with Article II (Zoning Districts and Allowable Land Uses), which shall be
subject to the following criteria and standards:
A. Location. The location of the proposed use shall not be detrimental to the adjoining area and
shall not be located within 100 feet of residentially zoned property.
B. Storage of vehicles. The storage of wrecked or abandoned vehicles shall be kept at all times
within an area completely enclosed by a 6-foot high solid wall or sight-obscuring fence. There
shall be no stacking of wrecked or abandoned vehicles.
C. Enclosed building. All auto dismantling activities shall be conducted wholly within an
enclosed building.
D. Fire access. Minimum gate opening of 12 feet in width shall be provided and a minimum of 12
feet to be maintained between rows of automobiles to provide room for fire equipment.
E. Paving required. Storage yard to be paved as required by Chapter 21.28, (Parking and
Loading). (Ord. 2043 § 1(part), 2004).

Conditional Use Permit: The Conditional Use Permit approves the proposed use, site plan
and elevations for the subject property. The purpose of the Conditional Use Permit review is
to allow consideration of uses on a case-by-case basis. This approval process takes into
consideration the location of the use as well as on-site improvements. An application for a
Conditional Use Permit is enclosed. A processing time of 45-60 days is typical for a
Conditional Use Permit and requires consideration by the Planning Commission through a
public hearing process.
The Planning Commission's consideration includes a review of compliance with the
development standards of the zoning district where the use is proposed.
2. Zoning: The subject property is zoned M-1-S (Light Industrial) and is designated as an
Industrial land use on the City's General Plan Land Use Map.
Staffwill recommend the following improvements in conjunction with the use permit application:
• That a new solid wall or sight obscuring fence shall be installed adjacent to the
building replacing the existing cyclone fence with razor wire;
• Recommended a condition of approval that prohibits the storage of vehicles in the
front parking area except for customer and employee parking;
• Recommend that the dismantling and parting of vehicles is not permitted;
• Requires a storage yard layout with a minimum drive aisle access of 12 feet; and
• Requires the screening of any exterior trash containers.
Your pre-application was distributed to the Public Works Department, Building Division, Police
Department and the County Fire Department. The Fire Department comments are enclosed.
