First Street, Building B12 San Jose, CA 95134-1906 Re: Fence Exception Application File No: PLN2006-190 182 Poplar Avenue Dear Mr. Funk, Thank you for your submittal of a Fence Exception application for a new wooden sound wall fence located at the above referenced location. The Fence Exception provides for a new twelve- forot tall wood fence,_where a six-foot fence is allowed. The Community Development Director has determined that the requested Fence Exception: 1. Will not impair vehicular or pedestrian safety; 2. Will result in a more desirable site layout; 3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of the change.; and 4. Will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Therefore, your request for a Fence Exception has been approved, subject to the following conditions of approval: 1. The development of the project shall substantially conform to the plans stamped as approved on January 18, 2007. Any modifications to the approved plans shall be reviewed and approved by the Director. 2.
