Dear Mr. Perry and Mr. Hams,
Since June 6, 2001 the City of Campbell has had a Use Permit application on file to establish an
office use in the building at 209 Railway Avenue. The application was lacking a complete site
plan and architectural drawings for tenant improvements and on July 10, 2001 a letter was sent to
both of you explaining what was needed in order to consider the application complete. A
deadline of August 10, 2001 was given to do one of two things: submit a complete application
with detailed building and site improvements or remove the office tenant from the building.
Neither of these actions has taken place.
On August 14, 2001, Bill Bruckart, the City Building Official, and I met with you both at the site
to discuss again what was needed to complete the Use Permit application process. We left with
the confirmation that Mr. Harris would be responsible for securing an architect to determine
exactly what work would need to be done to make the building suitable for an office tenant and
to develop a workable site plan that addressed issues of parking, landscaping, etc. More than one
month has passed and little progress has been made. I understand that Mr. Perry has contacted an
architect to take a look at the project and his review will begin in early October.
To date, the City has been exceedingly lenient in allowing more than adequate time for this entire
process to advance. This letter is to inform you of the City's intent to consider the Use Permit
application withdrawn by default if it is not completed by November 1, 2001. At that point, the
property owner and occupants of the building could be subject to additional enforcement that
may include issuance of a misdemeanor citation, notice to appear and/or a recorded notice of
non-compliance, which may be placed on the title of the above-referenced property. The tenant
may also receive a citation for operating a business without a current business license.
