Sunnyoaks Ave. Dear Mr. Martin: Thank you for your submittal of a Conditional Use Permit application for the continued use of a Sprint PCS wireless communications facility located at 125 E. Sunnyoaks Avenue. This application will be considered by the Planning Commission at a public hearing. Your application has been deemed incomplete. Additional information/documents must be submitted before your application can be deemed complete and scheduled for a public hearing. These items are as follows: 1. Planning Commission Contribution Disclosure Form: Please complete the enclosed contribution disclosure form. 2. Additional Information: The Community Development Director may require applicants to submit additional documentation which the Director deems necessary to evaluate the site and facility. The Telecommunications Ordinance requires that if technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment, the service provider shall be required to replace or upgrade the approved facility upon application for a new Conditional Use Permit application to minimize any adverse visual effects. The application proposes to install radomes over the existing antennas to camouflage the antennas from view. The Director finds that the current proposal does not provide a less visually obtrusive facility and that other stealth techniques should be investigated. Other preferred mounting techniques should be investigated besides roof-mounted equipment due to the high visibility of the roof of this building from San Tomas Expressway. Sunnyoaks Avenue Dear Mr. Davies: The Planning Division is hereby informing Sprint that Conditional Use Permit No. UP 96-10 expired on October 8, 2001. The Conditional Use Permit cannot be extended by the Community Development Director. The Planning Commission has the authority to reinstate an expired use permit; however, the antenna facility must meet all the requirements of the City's Telecommunications Facility Ordinance, which was adopted in 1998. Specific requirements applying to this facility include: Section 21.60.045 (8): Upgrading of Facility Required. If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment, the service provider will be required to replace or upgrade the approved facility upon application for a new Use Permit application to minimize adverse effects related to land use compatibility, visual resources, public safety or other environmental factors. 21.60.070 (4): Roof Mounted. Roof-mounted antennas and associated equipment shall be located as far back from the edge of the roof as technically possible to minimize visibility from street level locations. Where appropriate, construction of a roof-top parapet wall or other appropriate screening to hide the facility may be required. (6): Stealthing:, The applicants are encouraged to consider providing architectural treatments and to use "stealth techniques" to reduce potential visual impacts for all telecommunication facilities, and especially for those proposed in areas easily visible from a major traffic corridor or commercial center or in residential areas. Stealth techniques can be required as Conditions of Approval when determined to be necessary to mitigate adverse visual impacts. 21 60 140 (5): Minimize Visual Impacts. All roof mounted antennas shall be located in an area of the roof where the visual impact is minimized. Rooftop equipment installations shall be setback such that they are not viewed from the street. Screening panels may be used to mitigate visual impacts but must be designed to blend with the architecture of the building in terms of scale, material and color. Sunnyoaks Avenue March 8 2002 Page 2 visual equipment shall not by itself provide justification to install visible equipment or antennas. (8): Antenna Height. Notwithstanding Subsection 4 of this Section, no roof mounted antennas, including support structures, shall exceed 6 feet in height above the parapet of the roof. The Wireless Telecommunications Facility Ordinance requires the facility to meet all these requirements in conjunction with the reinstatement of the Conditional Use Permit. Sprint will be required to meet the requirements of the Ordinance listed above immediately, including the requirement that the antennas shall not exceed 6 feet in height above the parapet of the roof. This letter serves as a notice of 30 days to submit a complete application and fees for the reinstatement of the expired Conditional Use Permit.
