After considering public testimony and following City Council discussion and deliberation, the Ciry Council took the following action: Adopted Resolution No. 10687 amending the Campbell General Plan by repealing the Downtown Development Plan, dated February 1996, subject to the incorporated findings; 2. Adopted Resolution No.10688 finding that the Environmental Impact Report (State Clearinghouse Number 2001042063, dated July 26, 2001) prepared for the City of Campbell's General Plan provides full and adequate environment review for approval of the Downtown Development Plan Update 2006 pursuant to CEQA Guidelines Section 15162, subject to the incorporated findings; and 3. Adopted Resolution No. 10689 amending the Campbell general Plan by approving the Downtown Development Plan Update 2006, subject to the incorporated findings. A certified copy of the above mentioned Resolutions is attached for your records. After notification and public hearing, as specified by law on the proposed amendments to the City of Campbell General Plan Appendices, and after presentation by the Community Development Director, proponents and opponents, the City Council did determine that the repeal of this document is warranted based upon the following findings: 1. The existing Downtown Development Plan was adopted in February 1996. 2. Since adoption of the 1996 Plan, many of the programs have been achieved. 3. Facts and circumstances in the Downtown have therefore changed since the Plan was adopted in 1996. 4. The General Plan was amended in 2001 and contains polices and strategies applicable to the Downtown that should be incorporated into the Downtown development Plan. 5. Repealing the existing Plan will allow for adoption of a comprehensive update to the Downtown Development Plan. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. The existing plan must be repealed in order to adopt a Resolution to approve the Campbell Downtown Development Plan 2006. 2. The Planning Commission of the City of Campbell recommends that the City Council adopt a Resolution to repeal the Resolution that enacted the Campbell Downtown Development Plan 1996 in preparation for the adoption of the Campbell Downtown Development Plan 2006. After notification and public hearing, as specified by law on the proposed amendments to the Campbell Downtown Development Plan, and after presentation by the Community Development Director, proponents and opponents, the City Council did determine that: 1. On November 20, 2001, the City Council of the City of Campbell certified an Environmental Impact Report (EIR) (Resolution No. 9956) for the update of the City's General Plan; 2. Pursuant to CEQA Guidelines Section 15162, a previous Environmental Impact Report contains full and adequate review for the Downtown Development Plan Update 2006 as no new impacts are created for consideration; 3. No substantial changes are proposed in the Downtown Development Plan Update 2006 which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; 4. No substantial changes have occurred with respect to the circumstances under which the Downtown Development Plan Update 2006 is undertaken which will require major revisions of the previous EIR due to the involvement of new significant, environmental effects or a substantial increase in the severity of previously identified significant effects; 5. No new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete shows any of the following: a. The project will have one or more significant effects not discussed in the previous EIR; b. Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project; or d. Mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR would substantially reduce one or more significant effects on the environment. 6. The Environmental Impact Report prepared for the City of Campbell General Plan serves as a Program EIR pursuant to CEQA Guidelines Section 15168(a)(4). 7. The findings set forth in Environmental Impact Report (EIR) (Resolution No. 9956), pursuant to CEQA Guidelines Section 15150(d), Incorporation by Reference, as follows: a. The project will not adversely affect water or air quality or increase noise levels substantially; b. The project will not have adverse impacts on the flora or fauna of the area; c. The project will not degrade the aesthetic quality of the area; d. The project will not have adverse impacts on traffic or land use; e. The project will not create impacts which have the potential to degrade the quality of the environment. f. The project will not create impacts which achieve short-term to the disadvantage of long-term environmental goals. g. The project will not create impacts for a project which are individually limited, but cumulatively considerable. h. The project will not create environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. Based upon the foregoing findings of fact, the City Council further finds and concludes that no substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented will have a significant adverse impact on the environment. The proposed project is consistent with all six elements of the City of Campbell's General Plan. Specifically, the Downtown Development Plan Update 2006 supports the following General Plan Policies and Strategies: Strategy LUT-2.2d supports traffic calming measures in the Downtown; Strategy LUT-3.1 c allows higher residential densities along transit corridors; Strategy LUT-5.3e encourages community and cultural events in the Downtown; Strategy LUT-5.3f facilities Downtown revitalization; Strategy LUT-5.3g encourages day and evening activities in the Downtown; Policy LUT-6.1 a encourages gateway treatments; Policy LUT-8.1 supports historic preservation; Strategy LUT-13.2a plans for sufficient parking; Strategy LUT-13.2b plans for efficient parking; Policy LUT-18.1 mandates consistency of new development with the Redevelopment Plan; Policy CNR-1.1 supports historic preservation; Strategy CNR-2.1 aencourages apedestrian-friendly atmosphere; and, Strategy CNR-2.1 b encourages historic amenities. 3. The proposed project is consistent with the Municipal Code. The Downtown Development Plan Area includes properties which are zoned Public Facilities/Open Space, Planned Development, Central Commercial, and General Commercial. The Downtown Development Plan Update 2006 is consistent with all development standards established for these zoning districts. The Plan Update also corrects the Downtown Development Plan, February 1996 by specifying a maximum allowable floor area ratio which is consistent with the zoning code. 4. The Environmental Impact Report prepared for the City of Campbell General Plan provides full and adequate environmental review for adoption of the Downtown Development Plan Update 2006. The proposed project complies with all applicable provisions of this Zoning Code and the Municipal Code. 3. No substantial evidence has been presented which shows that the proposed project, as currently presented, will have a significant adverse impact on the environment. 4. There is a reasonable relationship and a rough proportionality between the Downtown Development Plan 2006 and CEQA requirements. 5. The Custodian of the Record for the Campbell Downtown Development Plan 2006 is the City Clerk of the City of Gampbell, located at 70 North First Street, Campbell, California. 6. The City Council approves a comprehensive amendment to the Campbell Downtown Development Plan 1996 of the General Plan, including the text and diagram amendments as illustrated in the Campbell Downtown Development Plan 2006. 7. The Downtown Development Plan Update provides a vision for Downtown Campbell and a framework for the physical development, business development and preservation of the historic downtown. This plan looks to position the Downtown for success in the 21St century and to enhance its role as a community gathering place and symbol as the heart of the City. PLANNING COMMISSION RECOMMENDATION The Planning Commission recommends that the City Council take the following actions: 1. Adopt a Resolution, incorporating the attached findings, amending the Campbell General Plan by repealing the Downtown Development Plan, February 1996. 2. Adopt a Resolution, incorporating the attached findings, finding that the Environment Impact Report (State Clearinghouse Number 2001042063, July 26, 2001) prepared for the City of Campbell's General Plan provides full and adequate environment review for approval of the Downtown Development Plan Update 2006 pursuant to CEQA Guidelines Section 15162. 3. Adopt a Resolution, incorporating the attached findings, amending the Campbell General Plan by approving the Downtown Development Plan Update 2006. ENVIRONMENTAL DETERMINATION In accordance with the California Environmental Quality Act (CEQA), the City reviewed the Downtown Development Plan Update and determined that no significant impacts would be created as a result of this project which has not already been considered by the environmental review prepared for the General Plan. Based upon this fact, staff recommends that the Planning Commission incorporate by reference the Environmental Impact Report prepared for the General Plan. BACKGROUND The Downtown Development Plan (DDP) is an Appendix to the Campbell General Plan. The DDP was originally published in February of 1988, and an updated DDP was published in February of 1996. The purpose of the document is to provide a vision for Downtown Campbell and a framework for the physical development, business development, and preservation of the historic downtown. The draft DDP Update includes the following sections: Background, Introduction, Vision, and Goals, Policies and Strategies. The Goals, Policies and Strategies section has been reformatted to be consistent with the format of the Campbell General Plan. The Downtown Development Staff Report ~ City Council Meeting of October 3, 2006 Downtown Development Plan Update Pa e 2 of 4 Plan area remains unchanged from the 1996 Plan. The primary purpose of the Update is to recognize the goals of the 1996 Plan that have been completed and to continue to support the established community vision for the Downtown. REVIEW HISTORY Planning Commission Study Session: Staff conducted a Study Session with the Planning Commission on the Downtown Development Plan Update on June 27, 2006 (reference Attachment 7). The Update was briefly reviewed by the Planning Commission. Comments received from and discussion with the Planning Commission included: • The Updated Plan brings the document current, and continues to support the community vision for the Downtown. • In specificity, the Updated Plan falls between the General Plan and the Zoning Code. The Commission would eventually like to have more detailed design guidelines prepared for the Downtown. • In considering upcoming plan development for the East Downtown Gateway and Winchester Boulevard, the extension of the character of Downtown should be carefully considered to avoid a Disney-like mimicking. • There was considerable discussion about how the Commission might provide input regarding the Central Commercial areas (e.g. having the Commissioners photo-document areas and features which appeal to them). • The Commission would like to have design guidelines prepared for Bascom Avenue. Campbell Downtown Business Association: Redevelopment staff presented the DDP Update to the Campbell Downtown Business Association at their meeting of July 5th, and provided two hard copies of the draft document. On July 7th staff e-mailed the draft document to seven business owners that requested copies. No comments have been received. Planning Commission Public Hearing: A Public Hearing before the Planning Commission was held on August 8, 2006 to consider the DDP Update 2006 (reference Attachment 9, Planning Commission Minutes). The Planning Commission expressed a desire to have a more in depth visioning process occur for a future Downtown Development Plan Update. Staff reiterated that the purpose of this Plan Update is to update a 10-year-old document that is an appendix to the General Plan. Reviews by Other Departments/Agencies: The Downtown Development Plan 2006 Update was also reviewed by Planning, Redevelopment and Public Works. Staff Report ~ City Council Meeting of October 3, 2006 Downtown Development Plan Update Page 3 of 4 DISCUSSION The vision for Downtown Campbell is to continue to reinforce its place as the center for community activity, cultural and civic events, and as a vibrant central business district. It is intended that the Downtown be an active, walkable central business district that attracts local residents and visitors to experience a variety of retail businesses and restaurants. Downtown Campbell is unique because of its small town, historic character. Furthering its growth while keeping its heritage intact will be accomplished through partnership between the City and its stakeholders. By implementing the Goals, Policies and Strategies outlined in the 2006 Update, Downtown Campbell will continue to flourish as a vital and successful central business district. Accomplishments: Since the first Downtown Development Plan was adopted 18 years ago, a number of identified revitalization projects have been completed (reference Attachment 11, pages 6-7 for more detail). These major projects include: • Underground Utilities • Streetscape Improvements • Ainsley House Relocation • Traffic Enhancements • Public Parking • Light Rail • Mixed Use • Storefront Improvement Program Plan Changes: The Downtown Development Plan 2006 Update changes the following items from the 1996 Plan: • Reduces the maximum allowable floor area ratio from 2 to 1.25, and up to 1.5 with approval of the Planning Commission, to provide consistency with the Campbell Zoning Code. • Adds emphasis on ground level retail and restaurants, community activities, and residential presence. Staff Report ~ City Council Meeting of October 3, 2006 Downtown Development Plan Update Page 4 of 4 ANALYSIS The draft DDP Update is consistent with the City's General Plan and Zoning Code. The Plan Update is consistent with the General Plan in that the Plan Update complies with General Plan Policies and Strategies related to transportation, housing, economic development, design, cultural resources, parking and civic events. The Plan Update is consistent with all applicable Zoning Codes, with approval of the proposed revision to the maximum allowable floor area ratio. FISCAL IMPACT There is no fiscal impact associated with adoption of the Plan Update. NOTICING Notice of this Public Hearing was advertised in the Campbell Express. Attachments: 1.
