Council Ordinances - 2001MEMORANDUM To: Sharon Fierro Community Development Director From: J emsley e uty City Clerk Date: November 29, 2001 Subject: Ordinance repealing existing General Plan Elements and Ordinance approving an Amendment to Zoning Map At the regular meeting of November 20, 2001, the City Council adopted the following Ordinances: Ordinance 2013 repealing existing General Plan Elements: Land Use, Circulation, Noise, Open Space, Air Quality, Conservation, Scenic Highways, Seismic and Safety; and Ordinance 2014 approving an amendment to the Zoning Map. A certified copy of these two Ordinances is attached for your records. The Ordinances will become effective 30 days from the date of adoption and were published in the Campbell Express dated November 28, 2001. ORDINANCE NO. 2013 BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL REPEALING ORDINANCES ENACTING NINE EXISTING GENERAL PLAN ELEMENTS (LAND USE, CIRCULATION, NOISE, OPEN SPACE, AIR QUALITY, CONSERVATION, SCENIC HIGHWAYS, SEISMIC AND SAFETY) IN PREPARATION FOR THE ADOPTION OF THE DRAFT GENERAL PLAN. After notification and public hearing, as specified by law on the proposed amendments to the City of Campbell Draft General Plan, and after presentation by the Community Development Director, proponents and opponents, the City Council did determine that the repeal of these Ordinances is warranted based upon the following findings: 1. The City has completed a comprehensive update of six required General Plan Elements (Land Use, Circulation, Open Space, Noise, Safety, and Conservation Elements) and added an optional Public Facilities Element. 2. The following existing General Plan elements were adopted and amended as listed below: a. Land Use Element -Adopted by Ordinance on May 19, 1983 and last amended on November 16, 1993. b. Circulation Element -Adopted by Ordinance on May 19, 1983 and last amended on November 16, 1993. c. Noise Element -Adopted by Ordinance on February 24, 1975. d. Open Space Element -Adopted by Ordinance on November 20, 1990. e. Air Quality Element -Adopted by Ordinance on June 8, 1987. f. Conservation Element -Adopted by Ordinance December 26, 1972. g. Scenic Highways Element - Adopted by Ordinance December 26, 1972 h. Seismic Element -Adopted by Ordinance on October 14, 1975. i. Safety Element -Adopted by Ordinance on October 14, 1975. 3. The Air Quality Element is no longer required under section 65302 of the California Government Code. 4. The Scenic Highways Element is no longer required under section 65302 of the California Government Code. 5. The Seismic Element has been incorporated into the Safety Element pursuant to section 65302 of the California Government Code. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. Nine existing General Plan Elements (Land Use, Circulation, Noise, Open Space, Air Quality, Conservation, Scenic Highways, Seismic and Safety) must be repealed in order to adopt a Resolution to approve the Draft General Plan. The Planning Commission of the City of Campbell recommends that the City Council adopt an Ordinance to repeal ordinances enacting nine existing General Plan elements (Land Use, Circulation, Noise, Open Space, Air Quality, Conservation, Scenic Highways, Seismic And Safety) in preparation for the adoption of the Draft General Plan. The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the following Ordinances provisions be repealed: a. Land Use Element -Adopted by Ordinance on May 19, 1983 and last amended on November 16, 1993. b. Circulation Element -Adopted by Ordinance on May 19, 1983 and last amended on November 16, 1993. c. Noise Element -Adopted by Ordinance on February 24, 1975. d. Open Space Element -Adopted by Ordinance on November 20, 1990. e. Air Quality Element -Adopted by Ordinance on June 8, 1987. f. Conservation Element -Adopted by Ordinance December 26, 1972. g. Scenic Highways Element -Adopted by Ordinance December 26, 1972. h. Seismic Element -Adopted by Ordinance on October 14, 1975. i. Safety Element -Adopted by Ordinance on October 14, 1975. SECTION TWO: This Ordinance shall become effective thirty (30) days following its passage and adoption and shall be published, one time within fifteen (15) days upon passage and adoption in the Campbell Express, a newspaper of general circulation in the City of Campbell, County of Santa Clara. After notification and public hearing, as specified by law on the proposed amendments to the Zoning Map of the City of Campbell, and after presentation by the Community Development Director, proponents and opponents, the City Council did determine that the amendments shown in the attached Exhibit A should be made to the City of Campbell Zoning Map based upon the following findings: 1. Section 65103 of the California Government Code requires that the City implement the General Plan through actions including the Zoning Ordinance and Map. 2. The proposed Zoning Map amendments are required to bring the Zoning Map into consistency with the Draft General Plan pursuant to Section 65860 of the California Government Code. 3. Section 65862 of the California Government Code stipulates that the public hearings for the purpose of bringing zoning into consistency with the General Plan, as required by Section 65860, may be held at the same time as hearings held for the purpose of amending the General Plan. 4. Public Review and Notice of the amendments to the Zoning Map including two public hearings has been provided pursuant to Section 65854 of the California Government Code. 5. A Final Environmental Impact Report was prepared for this project and no significant environmental impacts have been identified as a result of the proposed amendments to the Zoning Map. 6. There are no effects on the environment that are peculiar to the amendments to the zoning map or parcels being rezoned that were not addressed in the EIR; and 7. There are no potentially significant off-site cumulative impacts that were not addressed in the EIR. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. The proposed zoning map amendments will be compatible with the surrounding zoning and land uses. 2. The proposed amendments will implement the goals, policies and strategies set forth in the Draft General Plan. City Council Ordinance Approving Amendments to the Zoning Map Page 2 3. The proposed Zoning Map amendments will not be detrimental to the health, safety or welfare of the City's neighborhoods or the City as a whole. 4. The Planning Commission of the City of Campbell recommends approval of amendments to the City of Campbell Zoning Map, as shown on the attached Exhibit A, pursuant to Section 65855 of the California Government Code. The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map be amended per attached Exhibit A. SECTION TWO: This Ordinance shall become effective thirty (30) days following its passage and adoption and shall be published, one time within fifteen (15) days upon passage and adoption in the Campbell Express, a newspaper of general circulation in the City of Campbell, County of Santa Clara.
