(b) Amount of Fee. The amount of the fee shall be no greater than the fair market value of commercial and residential land within the city on a per acre basis, multiplied times the acreage of land required to be dedicated pursuant to this chapter, plus the total cost of improvements necessary to develop said property for park and recreation purposes. (c) Determining Fair Market Value. The city manager ofhis/her designee shall determine the fair market value of residential land, as defined in Section 20.24.020(f), on a per acre basis and the cost of park improvements in the city, and this determination shall be used in determining the maximum amount of the fee. (d) Partial In-Lieu Fee Payment. Payment of an in-lieu fee shall be required for any subdivision that does not dedicate and improve sufficient land to satisfy the requirements of Section 20.24.050. The difference between the dedication standard and the amount of land dedicated shall be paid as an in-lieu fee, as defined in this chapter. When a full or partial fee is required, the park acreage standard not satisfied by land dedication shall be multiplied times the cost of land and improvements to determine the amount of the fee." SECTION TWO: This Ordinance shall become effective thirty (30) days following its passage and adoption shall be published once within fifteen (15) days upon passage and adoption in the Campbell Express, a newspaper of general circulation in the City of Campbell, County of Santa Clara, State of California. Following discussion and deliberation, the City Council introduced Ordinance No. 2058 amending Section 13.08.080 and 20.24.080 of the Campbell Municipal Code establishing Park In-Lieu Fees for first reading. This Ordinance will receive second reading and final adoption at the regular City Council meeting scheduled for August 2, 2005. The City Council took further action to adopt Resolution No. 10550 approving an Adjustment to the Park In-Lieu Fees for Fiscal Year 2005-06. This adjustment will become effective 60 (sixty) days from the date of adoption - September 19, 2005. Please find a certified copy of this Resolution attached for your records. Anne Bybee, City Clerk RESOLUTION NO. 10550 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL, APPROVING AN ADJUSTMENT TO THE PARK IN-LIEU FEE. After notification and public hearing as specified by law on the consideration for approval of an adjustment to the Park In-Lieu Fee as referenced in the above heading and after presentation by the City Manager, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows, with respect to amending the Park In-Lieu Fees: 1. The fees herein established are for the purpose of acquisition and improvement of parks, in keeping with the General Plan goal of providing four (4) acres of usable park lands for every one-thousand (1,000) residents of the City; 2. The increase to the Park In-Lieu Fee is necessary because the fee has not been updated since 1995 and the fee increase is necessary to reflect current year 2005 land acquisition and park facility improvement costs; 3. To maintain the current park acreage ratio and achieve the goals of the General Plan, new development must contribute it's fair share for future park improvements through payment of a Park In-Lieu Fee reflective of current market rate costs when actual facilities are not improved as part of a project.; 4. The funds will be used for park acquisition and improvement in keeping with the General Plan of the City; 5. New development will add additional residents resulting in increased demand for park facilities and exacerbate the deficiency of 4 acres per 1,000 unless new development is required to pay its fair share of the cost to improve park facilities. 6. The cost of the fee is directly proportionate to the cost of land and improvement of park facilities which are needed to accommodate the new population demand as a result of new development. Based upon tfie foregoing findings of fact, the City Council further finds and concludes that: 1. The Park In-Lieu Fee is established pursuant to Chapters 13. 08 and 20.24 of the Campbell Municipal Code as amended; CITY COUNCIL RESOLUTION Park In-Lieu Fee Page 2 2. An adjustment to increase the Park In-Lieu fees is warranted given current market values and facility improvement costs for the year 2005; 3. There is a reasonable relationship between the fees use for the public facility and the type of development project on which the fee is imposed. 4. There is a reasonable relationship between the need for the public facility and the type of development project on which the fee is imposed; 5. There is a reasonable relationship between the amount of the fee and the cost of the public facility or portion of the public facility attributable to the development on which the fee is imposed. The AB 1600 (Cortese) portion. of the Mitigation Fee Act applies to fees charged in connection with the approval of development projects to defray the cost of public facilitie$. Residential development is required to either dedicate land for park purposes, or pay an in- lieu fee. Park In-Lieu fees are charged for new residential development when the actual dedication of a fully improved park is not part of the project. This fee applies to both subdivisions (CMC Sec. 20.24.030) and the construction of new dwlelling units (CMC Sec. 13.08.030). It should be noted that the fee does not apply to new fesidential construction that is developed to replace a demolished unit as long as the lot is nat vacant for more than two years. Park In-Lieu Fee Page 2 of 6 July 19, 2005 The fee collected is used to acquire land and construct park facilities in an effort to maintain the City's adopted level of park service at 4 acres per 1,000 population. Park In- Lieu fees were last updated in 1995 and it is recommended that the City Council increase the level of Park In-Lieu fees to better reflect present day values and costs for acquiring land and improving park facilities in-lieu of the actual dedication of a fully improved park by a project applicant. Section 20.24.080 of the CMC sets forth the formula for computing the amount of Park-In- Lieu fees. Pursuant to this section of the municipal code, the fee calculation accounts for two variables that include the fair market value of commercial and residential land on a per acre basis and the estimated present value cost to improve and construct park facilities. The existing Park In-Lieu fees (adopted in 1995) are based on the fair market value of land and improvement costs of $20.09 per square foot (1995 value). The computed present value (2005) fair market land cost is estimated at $40 per square foot or $1.74 million per acre. This current fair market value of both commercial and residential land has been established through the review of recently performed property appraisals as specified in Section 20.24.080 of the CMC. Improvement costs for park facilities are estimated at $13.30 square foot. This cost was derived by using the average cost for actual park development, escalated to current costs, for the following four parks improved since January 1999: Campbell Park, Edith Morley Park, JDM (Budd Side); and Virginia Park. When land costs and improvement costs are added together, the computed actual Park In-Lieu fee to cover the full cost of land acquisition and park improvements within the City is estimated at $53.30/per square foot or $2,321,748 per acre. Section 20.24.060 provides the formula which is derived from the number of persons per household based on general plan density ranges. This results in the acreage requirement for purposes of computing the fee. The following Table presents that actual cost per unit given fair market land values, cost to improve park facilities and the acreage requirements per unit. In addition to completing the computations as reflected in the various sections of the CMC, Staff conducted a park in- lieu fee comparison survey of seven other cities within Santa Clara County. Attachment 3 provides a table comparing the fees of surrounding cities. As reflected in this attachment current (1995) adopted Park in-lieu. fees range from $955 to $5,129/ per unit lower than the average fees currently charged by surrounding cities depending on density. The average fees charged by surrounding communities range between $6,590 per unit for high density residential.( >21 units/acre) to $16,119 per unit for low density residential (<6 units/acre). The exception to this is the Medium Density category (13 to <21 units/acre) where the current Campbell fee is only $1.00 less than the average of surrounding cities. Given this, despite the fact that the allowable fee is significantly higher, it is recommended that the Park In-Lieu Fee be raised to reflect the averages of the surrounding cities. Annual monitoring and possible fee increases to the park In-lieu fee will be needed to close the gap between .the in-lieu fee and the actual cost of park land and park improvements. Attachment 2 provides the Resolution for adoption by the City Council to increase the Park In-Lieu fees as recommended. Campbell Municipal Code Amendments Currently, under Sections13.080.080 and 20.24.080 of the Campbell Municipal Code (CMC), the amount of the Park In-Lieu Fee is established pursuant to a formula based on current land value and construction costs to improve park facilities on a per acre basis. Pursuant to these code provisions the amount of Park In-Lieu fees are set administratively by the City Manager. The CMC does not provide the authority for the City Council to adopt the fee or if the Council desires to use discretion in the adoption of the Park In-Lieu fee at a Park In-Lieu Fee Page 4 of 6 July 19, 2005 rate less than the computed fee. It is therefore recommended that that the CMC be amended such that the City Council is provided the authority to set the actual fee amount, not to exceed the amount determined by using the existing formula and include the fee in the Schedule of Fees and Charges adopted by the Council annually. Amendment to Sections 13.08.080 and 20.24.080 of the Campbell Municipal Code Sections 13.08.080 (construction of units) and 20.24.080 (subdivision of land to create a parcel) of the CMC set forth the provision for the amount of fee in-lieu of park dedication. It is recommended that these sections be amended such that the fee amount is established by the City Council and incorporated as part of the citywide Schedule of Fees and Charges considered and adopted annually by the City Council. As theses sections currently provide, the authority to set the amount of the fee rests with City Manager. These amendments would establish the authority for the City Council rather than the City Manager to set the amount of the actual Park In-Lieu fee. This action would be consistent with how other fees and charges are adopted in the City. (Refer to Attachment 1). FISCAL IMPACTS The revenues generated by development impact fees are dependent on the level of new construction. Housing production objectives as identified in the adopted and State Certified Housing Element project an additional 777 residential units. The average difference between the current fee and proposed fee increase is $2,126 per unit. If the fee increase is adopted as recommended, the City could realize additional revenue of approximately $275,000 annually. This estimate is based on the adopted housing element need of 130 new residential units per year over six years. Since revenues are entirely dependant on actual development, if growth does not occur as projected, actual revenues received will be less. Park In-Lieu Fees are accounted for separately and are not part of the General Fund. ALTERNATIVES 1. Adopt in-lieu fees that reflect the actual cost for park improvements. 2.
