Annexation - 1994RESOLUTION NO. 8636 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING A REORGANIZATION OF CERTAIN REAL PROPERTY PURSUANT TO THE CORTESE-KNOX LOCAL GOVERNMENT REORGANIZATION ACT OF 1985, DESIGNATED AS WHITEOAKS 94-01. After notification and a Public Hearing as specified by law for approval of a reorganization to allow the annexation of property located at 1410 Sharp Avenue (APN: 414-033-028) and 1426 Sharp Avenue (APN: 414-033-027), and, after presentation by the City staff, proponents and opponents, the hearing was closed. After due consideration of all the evidence presented the City Council did find as follows with respect to Whiteoaks 94-01: 1. The proceedings for reorganization described in said Resolution are designated as Whiteoaks 94-01. 2. The subject properties are contiguous to existing City limits and are inhabited as defined by LAFCO. 3. The City will request that the Local Agency Formation Commission expand the City of Campbell's Sphere of Influence and Urban Service Area Boundary to include the subject parcels. 4. The subject properties will be annexed into the City of Campbell Landscape and Lighting Assessment District. 5. The proposed reorganization does not split lines of assessment or ownership. 6. The proposed reorganization is consistent with the proposed General Plan Amendment being processed concurrently with the proposed reorganization. 7. The proposal does not create island or areas in which it will be difficult to provide municipal services. 8. Annexation of the subject sites creates a more logical boundary between Campbell and San Jose and eliminates confusion about jurisdictional boundaries in emergency situations. The exterior boundaries of the territory to be annexed are all that real property situated in the County of Santa Clara, State of California, illustrated in the map, Exhibit "A", attached hereto. 10. The territory described in said Resolution is ordered reorganized to include the following changes or organization: A. Annexation to the City of Campbell B. De-annexation from the City of San Jose. C. Annexation in to the City of Campbell Landscape and Lighting Assessment District. D. Expansion of the City of Campbell Sphere of Influence. E. Expansion of the City of Campbell Urban Service Area Boundary. 11. Land improvements within the territory annexed shall be liable for the general indebtedness of the City of Campbell existing at the time of annexation. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. The proposed reorganization would not be detrimental to the health, safety, welfare of the neighborhood or the City as a whole. 2. The reorganization would be compatible with the proposed General Plan amendment and will aid in the harmonious development of the immediate area.
