The Planning Department is currently processing a annexation for two
properties which are located at 271 dt 295 N. San Tomas Aquino Road. The
two properties are currently located within the City of San Jose's jurisdiction.
The particular application will be filed with the Local Agency Formation
Commission (LAFCO), and will involve an adjustment to the City's
boundary, the sphere of influence, and the urban service area boundary. The
two properties are currently designated Single Family Residential within San
Jose's jurisdiction, and would be prezoned R 1-6 (Low Density Residential) in
Campbell.
It would be helpful if your department mold review the issue of the proposed
annexation, and forward any comments or conditions to the Planning
Department so that it may be incorporated into the staff analysis of this
proposal.
This item has been scheduled for the Planning Commission meeting of
February 11,1992.

The City of Campbell has received the attached response from the City of San
Jose regarding possible de-annexation from the City of San Jose and
annexation to the City of Campbell for the above referenced parcels.
In order for this process to proceed it will be necessary for the two property
owners involved to initiate an action with the County of Santa Clara Local
Agency Formation Commission (LAFCO). LAFCO will have to approve a
boundary reorganization request.
Letters from both jurisdictions supporting your request are attached.

Please excuse the delay in responding to the original letter from then
Mayor Ashworth to Mayor McEnery regarding this matter. The letter was
either not received or misplaced in his office prior to the beginning of
~ tenure as Mayor.
According to Mayor Ashworth's letter, the owners of the properties at 271
and 295 North San Tomas Aquino Road, located within San Jose's
jurisdiction, have petitioned the City of Campbell for annexation. You
mention the property owners have cited as reasons their mailing address
in Campbell and problems with police and fire service. It is my
understanding that this request is at the behest of the property owner at
255 North San Tomas Aquino, located in Campbell.
The property owner at 255 North San Tomas Aquino had contacted the City
of San Jose at an earlier date to inquire about de-annexing a portion of
the adjoining parcel (located in San Jose). That portion of the
adjoining parcel, together with his existing lot area, would have allowed
the property owner at 255 North San Tomas Aquino to apply for a two-lot
subdivision. City of San Jose staff extensively reviewed the situation;
however, there was and is no method to subdivide such a small portion
under any zoning lot size criteria. The property owner was also informed
that such a change would require the concurrence of the City of Campbell,
the City of San Jose and as a Boundary Adjustment Local Agency Formation
Commission (LAFCO) approval.

Although it is the policy of the City of San Jose to support
de-annexations only in those situations where there is a reciprocal
exchange of like territory, population, or tax base, we are willing to
support the de-annexation of both 271 and 295 North San Tomas Aquino
Road. The reasons for support of the de-annexation are based on the
extremely small size of this parcel, its triangular configuration, which
is surrounded on two of three sides by the City of Campbell, and
potential confusion about address ranges in an emergency situation.
According to our Communications staff, there is an ongoing problem with
address ranges in the North San Tomas Aquino Road area. This matter has
been brought to the attention of the City of Campbell in the past. I
hope this de-annexation will ensure that there is no misunderstanding in
the future.
In reviewing this request, it was determined that these properties are
located adjacent to an "Autoaid" area, and fire services would be
provided by the City of San Jose regardless of the jurisdiction in which
the parcels are located. I would like to emphasize that differing legal
jurisdictions and mailing addresses are common throughout the Bay Area,
and Boundary Adjustments should not be made based solely on this criteria.

The owners of property at 271 and 295 North San Tomas Aquino Road have
requested that their properties, which are currently in the City of San Jose,
be annexed into the City of Campbell. Reasons cited for their request include
the fact that the properties have a Campbell mailing address, and that some
problems have arisen regarding the provision of police and fire protection to
the area. Their request also cites that annexation of their properties to
Campbell would "clean up" the boundaries between the two jurisdictions.
As you are aware, approval of a boundary reorganization of this nature requires
the approval of both cities as well as the Local Agency Formation Commission.
At its meeting of May 15, 1990, the Campbell City Council took minute action
indicating our City's willingness to anaex the two parcels should the San Jose
City Council agree to deannexation. In addition, the Campbell Council
authorized me to send this letter to you and to request that you indicate your
position with regard to deannexing the area.

STAFF RECOMMENDATION:
That the City Council take the following actions:
1. Take minute action indicating the City's willingness to initiate
reorganization (i.e. annexation) of the two parcels shown in Exhibit
"A", if the City Council of the City of San Jose agrees to deannex the
properties.
2. Authorize the Mayor to send the attached letter to the San Jose City
Council requesting San Jose to consider deannexing the two properties.
STAFF DISCUSSION:
Background:
Staff has received a letter dated April 17, 1990, in which property owners on
North San Tomas Aquino Road indicate their desire to have two parcels of land
annexed to the City of Campbell. The two parcels, as shown in Exhibit "A", are
currently in the City of San Jose. '
Should the Council agree to annexing the area into the City of Campbell, the
following procedures will be necessary in order to bring about the change in
jurisdiction:
1. The Campbell City Council must indicate its willingness to accept the
area for annexation, and must formally request the San Jose City
Council to agree to deannex the property.
2. If both cities agree to the reorganization, then an application for the
exchange of territory will be filed with LAFCO for approval (or
denial).
Mayor Issues•
Public: As stated in the letter from the property owners, the parcels are
in the City of San Jose but have a Campbell mailing address. This
situation has caused some problems for at least one of the property owners.
In addition, street improvements (curb, gutter ~ permanent sidewalk) are
not installed on San Tomas Aquino Road in front of the subject properties.

Staff: The annexation of the two parcels to the City of Campbell will
straighten the boundaries between the two cities, and should simplify the
provision of urban services.
Costs: The proponents of the reorganization have been advised that they
will be responsible for all costs incurred in these proceedings. These
costs will include preparation of the map and legal description, fees
required by the County Surveyor's Office, LAFCO filing fees, and fees to
the State Board of Equalization.

Dear Mr. Staford;
I am writing in regard to our recent discussion of Annexation of a portion
of 271 N. San Tomas Aquino Road from San Jose to the City of Campbell. I have
contacted San Jose on this issue and their response was that they would only
consider de-annexation of the complete parcel, (APN 307-18-051), copy attached.
Since our telephone conversation last week, I have reviewed this matter in
some detail. It appears to me to be more desirable to all parties concerned to
annex the two parcels (APN 307-18-051 and 307-18-050). This would clean up the
city boundries in this area along with a number of other benefits.
The owners of these two parcels are very favorable to this change. The
Waltons have an on going problem with police and fire protection, etc., do to
their property being in San Jose and their mailing address being Campbell.
Please advise me of the necessary steps to take to annex this property.
