The Planning Commission of the City of Campbell convened this day in regular
session at the regular meeting place, the Council Chambers of City Hall, 70 N.
First St., Campbell, California.

Subcommittee, with Commissioners Dickson and Stanton as alternates.

R 88-O1/M 88-08 Continued review of parking circulation plan
S 86-21 - Pruneyard Inn - 1875 S. Bascom Ave.
Planning Director Kee reviewed the Staff Report of September 27, 1988, noting
that Staff is recommending approval as redlined.
Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. The Committee is recommending approval as
redlined. The applicant is in agreement with the redlining of the presented
plans which indicates the accentuation of ingress/egress points of circulation.
M/S: Dickson, Stanton - That the Planning Commission approve the
parking circulation plan, as redlined, for S
86-21/M 88-08/R 88-01 for the Pruneyard Inn.

Planner II Haley reviewed the Staff Report of September 27, 1988, noting which -~
of the requested signage Staff is recommending be approved.
Mr. Morris Stark, applicant, noted that it was agreed to remove an island sign;
however, it was requested that "Hotel Parking Only" be allowed on the wall.
Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. The Committee is recommending approval per
Staff's recommendations, and would also support Mr. Stark's request to be
included in Staff Recommendation "C".

Staff is recommending approval of this request.
Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. The Committee is recommending approval per the
Staff Report, with the screening trees to be relocated to an appropriate

PUBLIC HEARINGS
ZC 88-07 Continued public hearing to consider the
PD 88-11 application of Maison Construction for
Maison Construction approval of a zone change from R-M-S
(Multiple Family Residential) to P-D (Planned
Development) and approval of a Planned
Development Permit, plans, elevations and
development schedule to allow the
construction of 6 townhomes on property known
as 600 W. Sunnyoaks Ave. in an R-M-S
(Multiple Family/Low Medium Density
Residential) Zoning District.
Planner II Haley reviewed the Staff Report of September 27, 1988, noting that
Staff is recommending approval of this application. The distance between the
buildings is typical of the R-M-S zoning district; however, there are lesser.
setbacks proposed in two areas as a result of the turret element and it's
height of 20 feet.

Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. The Committee discussed the issues of the
long, narrow driveway and common open space. It is the opinion of the
Committee that the driveway issue is addressed with landscaping elements. --
Although there is no usable common open space on the site, the Committee is of
the opinion that private open space would be more beneficial to the residents,
since the amount of common open space which could be provided would be
insignificant. Additionally, the Committee feels that the lesser setbacks
resulting from the turret element are considered acceptable. Therefore, the
Site Committee is recommending approval of this application.
Chairman Christ opened the public hearing and invited anyone to speak on this
item.

be closed. Motion carried unanimously

M/S: Olszewski, Stanton - 1. That the Planning Commission recommend
.that the City Council accept the Negative
Declaration which has been prepared for this
project; and
2. That the Planning Commission adopt
Resolution No. 2551, incorporating the "~
attached findings, recommending that the City
Council approve a zone change from R-M-S to --
PD; and
3. That the Planning Commission adopt
Resolution No. 2552, incorporating the
attached findings, recommending that the City
Council approve a Planned Development Permit
for this project, subject to the attached
conditions.
Discussion on motion
Commissioner Olszewski expressed a concern about the percolation ponds located
behind this project, noting that they are potentially dangerous as they
currently exists. He suggested that the time has come for the property to be
used for mixed recreational uses, in light of the need for common open space.
Commissioner Dickson opposed the motion because it is at the high end of the
density range and does not have extra amenities as it should for a PD zoning.
Additionally, the driveway is not sufficiently broken up, there is no common
open space, and the PD should not allow lesser setbacks.
Chairman Christ opposed the motion, noting that this major concern was about
parking. The parking has been increased; however, the density is being kept at
the higher end. Chairman Christ commented that the community is being paved
over, and that open space and greenery. is needed; and, although the project
design is quite good, he would rather see the density decreased. -

V 88-06 Continued public hearing to consider the
Leinwetter, P. application of Mr. Paul Leinwetter for a
variance to the side and rear yard setbacks
and a variance to the requirement allowing
only one accessory building over 200 sq.ft.
in size in order to allow the construction of
a detached carport on property known as 1171
E1 Solyo Ave. in an R-1 (Single Family
Residential) Zoning District.
Planner II Haley reviewed the Staff Report of September 27, 1988, noting that
Staff is recommending denial of this variance.
Chairman Christ opened the public hearing and invited anyone to speak on this
item.
Mr. Gary Lord, 1150 Arroyo Seco, opposed the variance noting that the already
constructed carport is the complete focus from every room of his home, and it
is very unaesthetic and undesirable.
Mr. Paul Leinwetter, applicant, stated that he is now requesting only two
variances - a variance from the requirement to pave the portion where the
vehicles are parked, and a variance to the number of structures on the lot.
Mr. Leinwetter spoke at length regarding the requirements for a variance and
why his situation is unique. He feels that the size of the property justifies
another structure; that a denial would deprive him from enjoying his property;
a denial would deny him the personal satisfaction of his hobby of collecting
cars; that the carport is not detrimental to the public welfare; that removal
fo the structure would result in a hardship on his part; that it is not
economically feasible for him to attach the structure to his house; that this
is a precedent case that cannot be compared to other situations in the same
zoning district since no one else has expressed an interest in having a carport
of this size in their back yard; and, that he is not creating a problem that
affects safety, welfare, etc. of this zoning district. Mr. Leinwetter
continued that he is sympathic to his neighbors complaints regarding aesthetics
of the structure, and he would mitigate these problems by planting trees,
however, he cannot afford to plant mature vegetation. He continued that the
other neighbors are not much affected by his proposal, and they hardly see the
structure because of vegetation in their yards.

Planning Director Kee noted that it would appear from the applicant's testimony -
that he is submitting a plan which has not been reviewed by Staff, and it would
be appropriate to continue the matter so that Staff could review it and prepare
a report for the Commission. Mr. Kee noted that 907 of the structure is
complete - without permits of any kind.
Commissioner Olszewski stated that he did not see any hardship in this matter,
and that the fact that the lot was twice as big as most other lots is not a
hardship. Additionally, there does not appear to be much happening to rectify
the situation. Commissioner Olszewski felt that the residents of the
neighborhood deserved a decision on this matter.
Commissioner Walker noted his sympathy for the applicant because of the strange
location of his property; however, this situation is occuring in one of
Campbell's premier neighborhoods and it not appropriate in-this location.
Commissioner Walker continued that although he would lean towards denial of
this request, he would like to see something worked out between the applicant
and the neighbors.
Commissioner Dickson stated this is an R-1 neighborhood, and a second accessory
building is not allowed in an R-1 area.
Chairman Christ expressed his concern with the aesthetics of the structure and
the fact that it does not meet code. He noted that he would like to see '~
something that the neighbors do not object to - something with screening that
is architecturally compatible with the neighborhood.
Commissioner Stanton noted that this issue has been dragged on for some time,
and the neighbors deserve a decision.
Discussion ensued regarding possihle actions on this matter.

Discussion
Commissioner Stanton opposed the motion, noting that he was not sure that the
applicant could make a final answer available to the Commission in one month.
Commissioner Dickson noted that the applicant would still have to request a
variance.
Commissioner Walker supported a longer continuance so that the applicant could
seek professional advise.
Mr. Leinwetter felt that the one month continuance would be adequate. he
indicated that the variances he is applying for have changed since originally
submittal, and that it would not be economically feasible for him to have
professional assistance. He asked how the Staff would feel about granting him
a permit to have the structure until spring, at which time he would consider
removing it.
Vote on motion for continuance

UP 88-09 Public hearing to consider the application of
Lazares, D. Mr. David Lazares for approval of a
conditional use permit to allow the
conversion of an existing health spa to an
office building on property known as 577
Salmar Ave. in an Interim Zoning District.
Planner II Haley reviewed the Staff Report of September 27, 1988, noting that
Staff is recommending approval of this application.
Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. Discussion entailed additional landscaping
along the north and west elevations, and this will be addressed in landscaping
plans to be reviewed by the Committee. The Committee is of the opinion that
this is an exceptional design, therefore, approval is recommended.
Mr. Haley, responding to questions from the Commission, indicated that Staff
feels the parking is adequate and is similar to other office projects approved
by the Commission.
Commissioner Walker asked about the proposed tenant for the building, noting
that the site has a potential parking problem and there is no on-street parking
in this area.
Chairman Christ opened the public hearing and invited anyone to speak on this

Mr. David Lazares, applicant, stated he did not feel parking would be a problem -.
in that the parking ratio for this project is similar to his building at 851 E. ~
Hamilton Ave. and there is never a parking problem (with only 50~ of the spaces
being utilized during peak hours).
M/S: Olszewski, Stanton - That the public hearing on UP 88-09 be

M/S: Dickson, Stanton - That the Planning Commission accept the
Negative Declaration which has been prepared
for this project; and, that the Commission
adopt Resolution No. 2553, incorporating
findings and conditions indicated in the
Staff Report of September 27, 1988, approving
UP 88-09; and, that this Use Permit be
forwarded to the City Council for

PD 88-13 Mr. Steve Saraydpour, on behalf of NADCON
NADCON Development Development, for a zone change from
Saraydpour, S. R-1-8 (Single Family Residential) to PD
(Planned Development), and approval of a
Planned Development Permit, plans,
elevations, and development schedule to allow
construction of~4 single family homes on
property known as 1231 Hacienda Ave.
Planner II Haley reviewed the Staff Report of September 27, 1988, noting that
the presented plans address the concerns indicated in the report. Staff is,
therefore, recommending approval.
Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. The Committee is also recommending approval.
The suggested redesign of the greenhouse is minor, and can be approved by
Staff .
Chairman Christ requested clarification of the elevations along Hacienda Ave.;
expressed a concern that the fencing on the east elevation, between the
residential properties, be provided with some type of architectural element;
and, asked about the proposed street improvements.
Engineering Manager Helms indicated that the street improvements would be
standard, with restriping of the frontages. It is Staff's opinion that the `
ingress/egress should work satisfactorily.

Mr. Steve Saray, NADCON Development, indicated that the fence will have a
stucco column every 6 feet on the east elevation; and, the buildings have been
designed to prevent a straight vertical appearance from the street elevation.

GP 88-04 Public hearing to consider the application of
Ainsley Development Ainsley Development, Inc. for an amendment to
the Land Use Element of the General Plan from
Industrial/Low-Medium Density Residential to
Commercial for properties known as 31 & 49
Page St. and from Industrial to Commercial
for properties known as 32 & 42 Foote St.
Planning Director Kee reviewed the Staff Report of September 27, 1988, noting
that Staff is recommending approval.
Commissioner Olszewski asked if this matter was referred to the Redevelopment
Agency; and, expressed his concern with housing in this area, noting that by
changing the General Plan there is some low-medium density residential lost.
Mr. Kee responded that this application was referred to the Redevelopment
Department, and plans will be forthcoming after review by an independent
architect through the Redevelopment Agency. Additionally, Staff's
recommendation for: this redevelopment area is for high density.
~ Discussion ensued regarding the scope of the redevelopment area, and the
directions the Specific Plan proposes relating to traffic measures.

Ms. Carrie Williams, 600 Maple Ave., supported the application and supported
redevelopment of the site. Ms. Williams noted that the bµilders are working
with the neighborhood; that the neighborhood has concerns about the traffic and
overflow parking; significant landscaping is requested on the site; and no
access to Page Avenue would be preferred.
Mr. Jeff Wyatt, Ainsley Development, noted that the project would begin as soon
as possible, and that the existing Shoe Fair store will be removed.

Facilities) Zoning District.
Planner II Haley reviewed the Staff Report of September 27, 1988, noting that
this item is recommended for continuance in order that a Subcommittee could
meet with adjacent property owners and the School District, as directed by the
City Council.

Tree Preservation Committee
Commissioner Olszewski reported that the summary of the report and
recommendations are indicated under "Recommendation ~i3", with details to be
worked at later in the process. Committeemembers have encountered a number of
situations where there has been a need for retaining walls and trees are not
located where they were indicated on the presented plans. The Committee is of
the opinion that accurate information is needed on the presented plans.
Additionally, this type of ordinance would be a good way to be sensitive to
neighborhoods and enhance the environment.
Commissioner Walker asked that the circumference of the trees to be retained be
25 inches even, rather than the 25.1 inches as indicated in Recommendation ~~1.
Additionally, he asked if a full topographic survey was really needed, noting
that this would, mean the provision of two maps -- one for the existing and one
for the developed 'site. In conclusion, Commissioner Walker liked
Recommendation ,~4 the most.

Commissioner Stanton noted that the topo maps would serve the Planning
Commission for drainage information as well as tree preservation.
Engineering Manager Helms reported that the Public Works Department currently
reviews the on-site drainage plans and requires detailed grading plans in the
"after" condition showing existing contours and finished grades. This is a
little different from a topo map in that it doesn't locate all existing
features. The Commission should be aware that requiring a topo map would add
approximately X2,000-3,000 to the processing costs of an application, and can
be very burdensome to get a topo map for a preliminary application.
Commissioner Dickson stated that Recommendation 4t1 appears to be too much of an
intrusion on privacy of homeowners, and will also be reflected back onto new
lots. Commissioner Dickson stated that he was against tree permits for
existing lots. Recommendation 4i2 is going in the wrong direction in that home
costs are out of sight now and this would only add to those high costs.
Commissioner Dickson felt that there was no scarcity of trees in the area, and
therefore could not support the recommendation.
Chairman Christ agreed with Commissioner Dickson, especially regarding
Recommendation 4~2; noted that he can understand why accurate tree locations is
necessary; agreed that a method is needed to protect trees on property prior to
development; disagreed with the expense of the topo survey; agreed with the
recommendation for a grading ordinance; :and, agreed with some type of policy to'~
deal with replacement of trees.
Commissioner Olszewski indicated that the Committee's conclusion is that the
recommendation should be adopted and presented to the City council to direct
Staff to take action in establishing an ordinance based on recommendations of
the advisory committee and the intent to be flexible.
Mr. Helms stated that the Public Works Staff has some concerns about some of
the items in the report and it would be helpful for the Public Works, Building,
and Planning Staff to go through the existing ordinances to see how much could
be accomplished through existing ordinances.

The Planning Commission finds as follows:
1. The property at 256 Calado Avenue has been
operating as a Large Family Day Care Home;
2. Conditional upon making the existing garage
available for parking, the property provides two (2) covered
parking spaces and three (3) additional parking spaces are
available on the adjoining street. Given the relatively low
traffic on the street, the available parking provides a safe and
acceptable means of drop-off and pickup, and reasonable vehicular
and pedestrian circulation. The parking provides for more than
three (3) available parking spaces in addition to those required
for residential use, including one (1) for each employee and two
(2) for loading and unloading of children;
3. There is no evidence that would indicate that the
noise generated by the Day Care operation in unreasonably
offensive to the senses or obstructs the free use of neighboring
properties so as to interfere with the comfortable enjoyment of
~ such adjoining properties;
4. The Day Care Home complies with the regulations _
the State Fire Marshall;
5. No known day care center or other large family day
care home is located within three hundred (300) feet of the
applicants home;
6. The day care home is designed so that the normal
residential surroundings are preserved and the integrity of the
residential neighborhood is p-reserved; and the home is the
principal residence of the applicant;
7. The home consists of 1,740 square feet, located on
a 6,450 square foot lot, which provides adequate indoor living
space and outd oor open space to meet the needs of the children.
Based on the foregoing findings, the Commission further
finds and concludes:
