MINUTES MARCH 22, 1988 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Kasolas, Stanton, Perrine, Olszewski, Walker, Dickson, Christ; Planning Director Arthur Kee, Planner II Marty Woodworth, Engineering Manager Bill Helms, City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent None. APPROVAL OF MINUTES M/S: Walker, Stanton That the minutes of the Planning Commission meeting of March 8, 1988, be approved as submitted. Motion carried (6-0-0-1, with Commissioner Dickson abstaining due to absence from the March 8, 1988, meeting). COMMUNICATIONS Planning Director Kee noted that communications received pertained to specific items on the agenda. ORAL REQUESTS Chairman Christ asked if anyone wished to address the Commission on an issue that was not agendized. There being no one, the Chairman proceeded with the set agenda. PUBLIC HEARINGS UP 87-22 Continued public hearing to consider the Maj, S. application of Ms. Susan Maj for a use permit to allow the establishment of a "hobby kennel" (3-6 dogs) on property known as 948 Crockett Ave. in an R-1 (Single Family Residential) Zoning District. Planning Director Kee reviewed the Staff Report of March 22, 1988, noting that Staff is recommending denial of the applicant's request. Commissioner Kasolas asked what factual basis exists for the wording "may be detrimental" in the recommendation for denial. -2- Mr. Kee responded that Staff would indicate that the use "may" be detrimental, based on the small lot size and four dogs being confined to the small area. Additionally, there has been testimony from neighborhood residents in opposition to the proposed use at previous meetings; however, Staff's recommendation is not based on previous testimony, but rather is based on the opinion that the area of the lot (10,000 sq.ft.) is not adequate to support the maintenance of four dogs. Commissioner Olszewski reported that this issue was discussed at the Site and Architectural Review Committee meeting, at which the applicant was not in attendance. The Committee is coming forth without a recommendation; however, it is the Committee's opinion that the dog run is in the most advantageous location as it relates to the entire site and adjacent neighbors, and that the dog run not being set back 5 feet from the property line would not be a problem relating to the site itself. A concern was expressed about the possibility of any residential development being constructed next door having to be situated near the dog run area. Commissioner Dickson indicated that the structure still does not satisfy the minimum setback requirement, noting that the issue may be one of a variance request to address the setback issue. Mr. Kee noted that the code would call for afire wall if the dog run is determined to be a structure and is more than 6 feet in height. Chairman Christ opened the public hearing and invited anyone in the audience to _ speak on this item. Ms. Susan Maj, 948 Crockett Ave., responding to questions from the Commission, stated that she is only asking to be able to keep four dogs, rather than two as allowed under the City ordinances; the top of the dog run will be removed, making it a chainlink fenced-in area, rather than a "structure"; that the dogs are trained to keep barking to a minimum and are corrected if they do bark; that there have been no complaints to the police regarding her animals; and, that she is well experienced and qualified in the handling and training of dogs. Mr. Tony Ferranti, 948 Crockett Ave., noted that the dogs wear state-of-the-art electronic collars to insure that they do not bark when no one is home; that the proper training is given to the dogs to ensure they are not a problem; that the dogs are show dogs, and have been on the property for several years without causing any problems. Kasolas, Walker - That the public hearing on UP 87-22 be closed. Motion carried unanimously (7-0). Kasolas, Walker - That the Planning Commission adopt Resolution 2519 approving UP 87-22, with the additional condition requiring a review of the use gezmit at 3 months and again at six months. -3- Tli cr»cci nn Commissioner Dickson noted that although the applicant is clearly an excellent trainer with an good background, the neighborhood is very much against this use. Crockett Ave. is an area where the City would like to see improvements and a dog kennel might not be in the best interests of upgrading the neighborhood. Commissioner Dickson also felt that the lot was too small for this type of use, and opposed the motion. Commissioner Perrine stated that he would also be opposing the motion for the same reasons as stated by Commissioner Dickson. Commissioner Olszewski stated that he would be supporting the motion, in that he felt this type of use was an attribute to the community. Vote on motion AYES: Commissioners: Kasolas, Olszewski, Walker, Christ NOES: Commissioners: Stanton, Perrine, Dickson ABSENT: Commissioners: None * ~ Commissioner Walker left the Chambers at 8:25 p.m. for a family emergency. ~ ~ M 88-01 Continued public hearing to consider the Hansell, R. application of Mr. Rod Hansell for approval of a modification to a previously approved Planned Development Permit to allow the construction of a residential addition to an existing structure located on property known as 1405 Harriet Ct. in a PD (Planned Development/Low Density Residential, less than 4.5 units per gross acre) Zoning District. Planner II Woodworth reviewed the Staff Report of March 22, 1988, noting that Staff is recommending a continuance of this item so that a revised plan may be submitted. Chairman Christ opened the public hearing and invited anyone to speak on this item. M/S: Perrine, Stanton - That the public hearing on M 88-01 be continued to the Planning Commission meeting of April 12, 1988. Motion carried unanimously (6-0-1). ~ ~ ~ -4- S 87-05 Continued public hearing to consider the Paisley, M. application of Mr. Marty Paisley approval of plans and elevations to allow the construction of an industrial building on property known as 786 McGlincey Lane in an M-1-S (Light Industrial) Zoning District. Planning Director Kee reviewed the Staff Report of March 22, 1988, noting that Staff is recommending approval. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval as redlined, which includes a stucco wall going around to the trash enclosure, an increase in the setback of the structure from McGlincey Ln., an additional parking space, and a relief accent band around the building. Chairman Christ opened the public hearing and invited anyone to speak on this item. M/S: Kasolas, Stanton - That the public hearing on S 87-05 be closed. Motion carried unanimously (6-0-1). M/S: Kasolas, Stanton - That the Planning Commission adopt the findings and conditions of approval as indicated in the Staff Report of March 22, 1988, and approve S 87-05. Bascom Ave. in a P-0 (Professional Office) Zoning District, and the construction of two single family homes on property known as 1956 Whiteoaks Rd. in an R-1 (Single Family Residential) Zoning District. Planning Director Kee reviewed the Staff Report of March 22, 1988, noting that Staff is recommending approval. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee did take into consideration previous testimony from neighbors regarding this project, and is of the opinion that the concerns have been addressed, particularly with the amount of landscaping to be provided on the site; therefore, approval is recommended. -5- Commissioner Walker entered the Chambers at 8:40 p.m. Chairman Christ opened the public hearing and invited anyone to speak on this item. Mr. Kurt Anderson, applicant, stated his concurrence with the Staff recommendation and conditions. M/S: Olszewski, Stanton - That the public hearing on S 87-09 be closed. Motion carried unanimously (7-0-0). M/S: Perrine, Stanton - That the Planning Commission accept the Negative Declaration which has been prepared for this project; and that the Planning Commission adopt the findings and conditions as indicated in the Staff Report of March 22, 1988, and approve this S 87-09. Motion carried with the following roll call vote: AYES: Commissioners: Kasolas Stanton, Perrine, Olszewski, Walker, Dickson, Christ NOES: Commissioners: None ABSENT: Commissioners: None. ~ ~ ~ TA 87-04 Continued public hearing to consider a City-initiated City-initiated text amendment to Sections 21.61.070 and 21.50.050 of the Campbell Municipal Code establishing standards and procedures for review of Large Family Day Care Homes which provide family day care facilities for 7-12 children, including children who reside at the home, in residential zoning district. Planner II Woodworth reviewed the Staff Report of March 22, 1988. Commissioner Kasolas noted that there should be nothing to prohibit caring for children in the evening hours. Mr. Woodworth indicated that there is nothing in the presented ordinance limiting hours of operation; however, if problems become evident, this issue could be addressed with a series of conditions. Chairman Christ opened the public hearing and invited anyone to speak on this item. Mrs. Flo Firouke, California Department of Social Services, questioned the revised parking issue, and asked what fees would be charged. -6- Commissioner Dickson noted that statements need to be included in this _ ordinance to preserve the character of the single family neighborhood, and suggested the following changes: D. Development Standards. (Add) 5. Traditional Family Environment. The development shall be designed so that normal residential surroundings are preserved and the integrity of the residential neighborhood is preserved. a. .The facility is the principle residence of the provider and the use is clearly incidental and secondary to the use of the property for residential purposes. b. No structural changes are proposed which will alter the character of the single-family residence. (Add) 6. Square Footage. a. At least 50 square feet of living space shall be available for each child. This shall not include bathroom, kitchen, hallway, or garage footage. b. At least 80 square feet of open space shall be available for each child. E. Permit Process. (Use the Alternative Permit Process - E1) Commissioner Kasolas noted his agreement with Commissioner Dickson and suggested that a revised draft incorporating these changes be brought back to the Commission for review. Commissioner Walker also noted his agreement. City Attorney Seligmann indicated reservation about some of the comments, noting that he would submit comments. M/S: Kasolas, Perrine - That the public hearing on TA 87-04 be continued to the Planning Commission meeting of April 12, 1988. Motion carried unanimously (7-0-0). It was noted that under D(1)(b), the word "on-site" should be eliminated. ~ ~ ~ UP 88-01 Public hearing to consider the application of Recovery Inn Dr. Harvey Knoernschild, on behalf of Recovery Inn of Los Gatos, for approval of a Conditional Use Permit to allow the construction of a 20-bed post-operative care facility on properties known as 3751 & 3777 S. Bascom Ave. in an R-3-S (Multiple Family Residential) Zoning District. Planning Director Kee reviewed the Staff.Report of March 22, 1988, noting that Staff is recommending approval of this project. - -7- Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is also recommending approval, with redlining which indicates the relocation of the trash enclosure and a realignment of the walkway. Revised plans are to come back to the Committee for approval along with the landscaping plan. Chairman Christ opened the public hearing and invited anyone to speak on this item. Dr. Knoernschild, applicant, appeared before the Commission to answer questions. He indicated that the name of the facility was such in order to avoid any confusion with the Campbell Inn. M/S: Olszewski, Stanton - That the public hearing on UP 88-01 be closed. Motion carried unanimously (7-0-0). M/S: Olszewski, Stanton - That the Planning Commission accept the Negative Declaration which has been prepared for this project; and, that the Planning Commission adopt Resolution No. 2520, including findings and conditions as indicated in the Staff Report of March 22, 1988, and approve UP 88-01. Motion carried with the following roll call vote: AYES: Commissioners: Kasolas, Stanton, Perrine, Olszewski, Walker, Dickson, Christ NOES: Commissioners: None ABSENT: Commissioners: None. ~ ~ ~ GP 88-01 Public hearing to consider the application of Horton, M. J. Michael Horton, on behalf of Edwin J. Myers Associates, for approval of an amendment to the Land Use Element of the General Plan from "Low Density Residential" to "Low-Medium Density Residential" for properties known as 289 & 291 Redding Rd. in an R-1 (Single Family Residential) Zoning District. Planner II Woodworth reviewed the Staff Report of March 22, 1988, noting that Staff is recommending that the Planning Commission continue this item to the meeting of April 26, 1988 in order that adjacent parcels may be noticed to be included in the proposed change to Low-Medium Density Residential. Commissioner Dickson felt that a nice buffer existed currently, and any change in use would destroy that buffer. Additionally, he noted that all residents along Redding Rd. should be notified of this proposal because of previous testimony about traffic in the area. -8- Engineering Manager Helms noted that the primary concern is with commuters _ cutting through the neighborhood to get to Hwy. 17; and, as a result, additional controls are being installed in the area. Correspondence from Charles Sanfilippo, 1512 Parsons Ave., Campbell, and Patti Krough of 1509 Parsons Ave., Campbell, was entered into the record (attached hereto). Chairman Christ opened the public hearing and invited anyone to speak on this item. Mrs. Diane Fowler, 1454 Parsons Ave., Campbell, spoke against the proposal because of the traffic in the area. Mr. Michael Horton, applicant, agreed with Staff's recommendation, noting that the precedent appears set with the higher density already on the south side of the street. Mr. Horton felt that the traffic was really a problem of cut-through commuters, rather than residents in the area. Mr. Wayne Glenzer, 291 Redding Rd., spoke regarding the traffic in the area, noting that it is not from the neighborhood. M/S: Olszewski, Perrine - That the public hearing on GP 88-01 be continued to the Planning Commission meeting of April 26, 1988. Motion carried with the following roll call vote: Discussion on motion Commissioner Dickson opposed the motion, stating that action should be take this evening and that he did not believe there was enough consideration to justify the request. Commissioner Olszewski expressed his concern about the condominium encroaching upon the single family neighborhood. Chairman Christ stated his agreement with Commission Dickson, noting that there must be buffers and the higher densities must stop at some point. Vote on motion AYES: Commissioners: Kasolas, Perrine, Olszewski, Walker NOES: Commissioners: Stanton, Dickson, Christ ABSENT: Commissioners: None. ~ * ~ The Commission recessed at 9:45 p.m.; the meeting reconvened at 9:55 p.m. ~ ~ ~ -9- ZC 88-01 Public hearing to consider the application of PD 88-03 NADCON Development for a Zone Change from NADCON Development R-M-S (Multiple Family Residential) to PD (Planned Development); and approval of a Planned Development Permit, plans, elevations, and development schedule to allow the construction of 8 townhomes on property known as 454 W. Sunnyoaks Ave. Planning Director Kee reviewed the Staff Report of March 22, 1988, noting that Staff is recommending a continuance as a result of the Site and Architectural Review Committee meeting, and with the applicant's concurrence. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee expressed concerns with the proposed density of the project and the on-site circulation. Commissioner Dickson requested a study of the provided open space for the next meeting. Chairman Christ opened the public hearing and invited anyone to speak on this item. Ms. Karen Wright, 520 W. Sunnyoaks Ave., expressed concerns with the "tunnel" effect of the project; parking in the area; the trash enclosure; and construction noise for adjoining residents. Mr. Que Naderzad, applicant, addressed some of the design concerns noting that future improvements will be made to reduce the mass, enhance on-site circulation, and provide for open space. M/S: Stanton, Walker - That the public hearing on ZC 88-01/PD 88-03 be continued to the Planning Commission meeting of April 12, 1988. Motion carried unanimously (7-0-0). ~~~c S 88-04 Public hearing to consider the application of Hunter Properties Hunter Properties for approval of plans and elevations to construct a retail building on property known as 295 E. Hamilton Ave. in a C-1-S (Neighborhood Commercial) Zoning District. Planning Director Kee reviewed the Staff Report of March 22, 1988, noting that Staff is recommending approval of this project. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval, with the relocation of the trash enclosure to come back to the Committee with the submittal of landscaping plans. The loss of any mature trees will be mitigated with the provision of substantial landscaping. Redlining of the presented plans indicates a change in the entryway to miss a major utility fault. -10- Chairman Christ opened the public hearing and invited anyone to speak on this item. ___ Mr. Deke Hunter, applicant, indicated that he is looking to attract a major regional tenant who has ten other stores in the county. The project is about 80' from the adjacent residential area, providing a good buffer. Linda Fazio, 542 Monica Lane, requested consideration of an 8 foot wall along her property line to resolve any possible noise problems, noting all the problems that have occured with the adjacent Mt. Mike's restaurant. Mr. Hunter indicated that he did not have a problem with an 8 foot wall, and that he was willing to work with the community and with Staff. Commissioner Kasolas expressed a concern with an 8 foot wall, in that the City's policy is for a 6 foot wall or fence. Commissioner Walker noted that it would be to the City's advantage to have a firm policy on the issue of fencing/walls between residential and commercial properties. M/S: Dickson, Stanton - That the public hearing on S 88-04 be closed. Motion carried unanimously (7-0-0). M/S: Dickson, Stanton - That the Planning Commission accept the Negative Declaration which has been prepared __ for this project; and, that the Planning Commission adopt the findings and conditions of approval as indicated in the Staff Report of March 22, 1988, and approve S 88-04 with Condition 4 to be amended to provide for revised plans to be submitted to the Planning Department unless plans are provided for an 8 foot wall, then the plans must go back to the Planning Commission for approval. MISCELLANEOUS SA 88-09 Sign application - The Pruneyard Inn - Pruneyard Inn 1901 S. Bascom Ave. - C-2-S (General Commercial) Zoning District. Planning Director Kee reviewed the Staff Report of March 22, 1988, noting that -- Staff is recommending approval of this signing request. -11- Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval of both proposed signs, with the landscaping for the freeway-orientated sign to come back to the Committee for approval. M/S: Stanton, Perrine - That the Planning Commission recommend that the City Council adopt the attached findings and approve this signing proposal, subject to the attached conditions of approval as indicated in the Staff Report of March 22, 1988. Motion carried with a vote of 6-1-0, with Chairman Christ voting "no". ~ ~ ~ Staff Report Continued staff report regarding Crockett Ave. area study. Planner II Woodworth reviewed the Staff Report of March 22, 1988, noting that it is difficult for the City to do much in the area until such time as applications come forth for development. City Attorney Seligmann noted that a declaration has been obtained from old time residents that the auto use has been in the area since 1939; and, there is no evidence as to anything else. Commissioner Kasolas stated that he did not recall the additions that are on the property; the people living in trailers; and, the cargo containers. However, he does recall a number of units being built since 1963. Commissioner Kasolas continued that he believed that the statement for rural atmosphere was meant for more single family development - not maintaining what is in existence. The Commission should make some recommendations for improvements in this area, particularly that it now appears that the neighbors are willing to have something done. Commissioner Kasolas suggested that a public hearing be set and that the neighborhood be invited to respond. Commissioner Stanton noted that the whole San Tomas Area should be restudied in that there have been changes in philosophy. Ms. Susan Maj, 948 Crockett Ave., requested that a public hearing be set to discuss the area of Crockett Ave. and issues relating to traffic, large number of parked cars in the area, number of business uses in the area, the Bird property, flooding problems, trash problems, and blighted properties. Ms. Maj felt that this area should be discussed separately from the whole San Tomas Area becuase the residents are going to want to speak at length. Mr. Woodworth briefly explained the Nuisance Ordinance. M/S: Kasolas, Dickson - That the Staff come back to the Commission with a boundaried area for discussion; and, that a public hearing be set within the next 4-6 weeks to discuss the Crockett Ave. area, specifically the neighborhood's problems and possible solutions. Revised elevations and/or site plan indicating reduction. in building size at the front by 400 sq.ft. and upgraded elevations to be submitted to the Planning Department and approved by the Site and Architectural Review Committee and/or the Planning Commission prior to application for a building permit. 2. Property to be fenced and landscaped as indicated and/or added in red on the plans. Landscaping and fencing shall be maintained in accordance with the approved plans. 3. Landscaping plan indicating type and size of plant material, and location of irrigation system to be submitted to the Planning Department and approved by the Site and Architectural Review Committee and/or Planning Commission prior to issuance of a building permit. 4. Fencing plan indicating location and design details of fencing and wall to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. 5. Applicant to either (1) post a faithful performance bond in the amount of X5,000.00 to insure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file _ written agreement to complete landscaping, fencing, and striping of parking areas. Bond or agreement to be filed with the Planning Department prior to application for a building permit. 6. Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. 7. Applicant to submit a letter to the Planning Department, satisfactory to the City Attorney, prior to application for building permit, limiting the use of the property as follows: 350 sq.ft. of office use; and, 3,000 sq.ft. of industrial/warehouse use. 8. All mechanical equipment on roofs and all utility meters to be screened as approved by the Planning Director. 9. Building occupancy will not be allowed until public improvements are installed. 10. All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. 11. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. 13. Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). 14. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. 15. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. 16. Applicant shall comply with. all appropriate State and City requirements for the handicapped. 17. The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Sect. 11.201 & 11.414, 1979 Ed. Uniform Fire Code. BUILDING DEPARTMENT 18. Retaining walls at property lines are limited to a height of 15 inches if constructed of wood. PUBLIC WORKS DEPARTMENT 19. Dedicate additional right-of-way to widen McGlincey Lane to 30 feet from centerline. 20. Install standard street improvements across the frontage. 21.
