MINUTES JANUARY 26, 1988 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: .Stanton, Olszewski, Walker, .Dickson, Christi Planning Director Arthur Kee, Principal Planner Phil Stafford, Engineering Manager Bill Helms, City Attorney Sill Seligmann, Recording Secretary Linda Dennis. Absent Kasolas, Perrine. Chairman Christ noted that~Commissioner Kasolas was excused for business purposes, and Commissioner Perrine because of illness. APPROVAL OF MINUTES M/S: Olszewski, Stanton That the minutes of the Planning Commission meeting of January 12, 1988 be approved as submitted. Motion carried unanimously (5-0-2). SPECIAL PRESENTATIONS City Manager Kevin Duggan briefly reviewed upcoming issues facing the City, including implementation of the Downtown Redevelopment Plans the developwent of the Hamilton School sites review of the Harrison/Salmar/ Page St. area= an update on the Los Gatos Creek Trails and the Community Center !!aster Plan. COMMUNICATIONS Planning Director Kee noted that communications received pertained to specific items on the agenda. ORAL REQUESTS Chairman Christ asked if anyone wished to address the Commission on an issue that was not agendized. There being no one, the Chairman proceeded with the set agenda. -2- PUBLIC BEARINGS GP 67-10 Public hearing to consider the Lippert, S. application of Mr. Stephen Lippert for a General Plan Amendment from Low-Medium Density Residential (6-13 unit per gross acre) to Medium Density Residential (14-20 .units per gross acre) for property known as 464 W. Campbell Ave. Planning Director Kee reviewed the Staff Report of January 26, 1988, noting that Staff is recommending a continuance of this item so that a traffic report may be submitted. Chairman Christ opened the public hearing and invited anyone to speak on this item. Mr. Jeff Baleczny, 120 Dot Ave., opposed the density of the project, citing tcaffic problems with the neighborhood and people using Morgan Park. 1+1/S: Stanton, Dickson - That the public hearing on GP 87-10 be continued to the Planning Commission meeting of February 23, 1988, with the applicant's concurrence. Motion carried unanimously (5-0-2). t . : PD 87-15 Public hearing to consider the Lippert, S. ~ application of Mr. Stephen Lippert for a Planned Development Permit, plans, .elevations, and development schedule to allow construction of 42 apartment units on properties known as 436 to 464 W. Campbell Ave. in a PD (Planned Development) zoning District. Principal Planner Stafford reviewed the Staff Report of January 26, 1988, noting that a continuance is recommended. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is also recommending a continuance. Commissioner Walker asked if information regarding the provision of additional on-site parking= crosswalks= signalization, etc. would be addressed fn the forthcoming traffic report. Motion carried unanimously (5-0-2). * : : TS 87-03 Continued public hearing to consider a Lands of Ern Tentative Subdivision Map to create 7 single family lots of 9,000 sq.ft. or more fn an R-1-9 (Single Family Residential) Zoning District - 1381 Harriet 1-ve. - APN 403-19-14 i 15. Planning Director lCee reviewed the Staff Report of January 26, 1988, noting that Staff is recommending a continuance so that an alternative street layout may be presented. Chairman Christ opened the public hearing and invited anyone to speak on this item. M/S: Walker, Stanton That the public hearing on TS 87-03 be continued to the Planning Commission meeting of February 23, 1988. Motion carried unanimously (5-0-2). r : S 87-10 Continued public hearing to consider the Andarch Assoc. application of Mr. 1CUrt Anderson for approval of plans to allow the construction of 7 single family homes on property known as 1381 Harriet Ave. in an R-1-9 `(Single Family Residential) toning District. Principal Planner Stafford reviewed the Staff Report of January 23, 1988, noting that Staff is recommending a continuance in order that revised plans may be submitted. Chairman Christ opened the public hearing and invited anyone to speak on this item. !9/S: Walker, Olszewski - That the public hearing on S 87-10 be continued to the Planning Commission meeting of February 23, 1988, with the applicant's concurrence. Motion carried unanimously (5-0-2). * ~ r -4- ZC 87-14 Continued public hearing to consider the PD 87-13 application of MHS Design Group for a MHS Design Group zone change from (Multiple Family Residential) to PD (Planned Development= and, a Planned Development Permit, plans, elevations, and development schedule to allow the construction of 3 townhomes on property known as 65 Shelley 1-ve. Principal Planner Stafford reviewed the Staff Report of January 26, 1988, noting that Staff is recommending a continuance in that the applicant is currently pursuing a variance application which will be scheduled before the Commission on February 9, 1988. Chairman Christ opened the public hearing and invited anyone to speak on this item. M/S: Stanton, Halker - That the public hearing on ZC 67-1~/ PD 87-13 be continued to the Planning Commission meeting of February 9, 1988, with the applfcant'a concurrence. Motion carried unanimously (5-0-2). ~ ~ • ZC 87-12 Continued public hearing to consider the PD 87-11 application of Mr. Alex Kotylar for a Rotylar, 11. zone change from R-3-S (Multiple Family Residential) to PD (Planned Development] and, a Planned Development Permit, plans, elevations, and development schedule to allow the construction of 23 townhomes on property known as X00 Onion Ave. Psincipal Planner Stafford reviewed the Staff Report of January 26, 1988, noting that Staff is reconuoending a continuance in order that revised plan may be submitted. Commissioner Olszewskf reported that this item waa considered by the Site and 1-rchitectural Review Committee. The Committee is also recommending a continuance in order that the applicant may address concerns expressed in the Staff Report. Chairman Christ opened the public hearing and invited anyone to speak on this ites. Mr. Ed McCandlsss, 386C Onion 11ve., Onion ]-venue Homeowner's Association, opposed the project, citing density, no open space, and insufficient parking. Mr. McCandless requested that a condition be added to address the problem of construction noise in the early morning, evening, and weekends: and, requested that the project not be approved at a density higher than the development adjacent to the subject site. - -5- M/S: Walker, Dickson - That the public hearing on ZC 87-12/PD 87-11 be continued to the Planning Commission meeting of February 9, 1988, so that revised plans may be submitted. Motion carried unanimously (5-0-2). • • : MISCELLANEOUS Request Request of Mr. Robert Bruns for a deviation to the standards required for a satellite dish antenna on property known as,850 Jones Way in an R-1 (Single Family Residential) Zoning District. Planning Director Kee reviewed the Staff Report of January 26, 1988, noting that Staff is recommending approval, subject to conditions as indicated in the Staff Report. A letter from Mrs. Arlene Podgorsek, 860 Virginia Ave., opposing the request was noted (attached hereto). _ Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is coming forward without a recommendation. Discussion of the issue included the possibility of painting the antenna, however, it was concluded that painting would not make a difference. Screening with plantings was not discussed. City Attorney Seligmann reported that the 14' height limitation, in this case, would be limiting reception because of the neighbor's tree. Because of federal regulations, the dish antennas can be as high as necessary to have reasonable reception, under the present ordinance. This would be the case unless the City adopts ordinances that limit heights of all antennas. Commissioner Dickson noted that the federal regulations are very restrictive on the local communities. Be felt that the community should have the authority to rule on all issues of harm to the health, safety, welfare of the community. Commissioner Dickson continued that it would appear that the antenna could be lowered and still have adequate reception. He challenged the 'expert' opinion provided, and requested some expert opinions on the City's options. Chairman Christ stated that the City may need to define what a reasonable amount of channels or reception is. Commissioner Walker felt that if the applicant or installer bad known about the City's regulations, they might have looked at the site more closely. 8e asked about the possibility of mailing copies of the ordinance to local installers. Mr. Eee indicated that Staff will attempt to contact a field expert to get further information for the Commission. -6- Mr. Robert Bruns, applicant, stated that the dish size is 8-1/2' and chosen to minimize the impact on the community. He continued that he would like to construct a screen for the antenna, however there is a utility easement which does not allow planting over 14'= and, other locations would make the antenna more visible from Jones Way. M/S: Olszewski, Walker - That this request be continued to~the Planning Commission meeting of March 8, 1988. Motion carried unanimously (5-0-2 ). Dear Sirs: I live at 860 Virginia Avenue, directly across from the subject Satellite Dish Antenna. It certainly isn't a very pleasant sight to walk out the front door and see the huge massive black dish on first sight. I'm embarrassed to also have my guests look at such a monstrosity. What kind of a city are we trying to achieve aesthetically? I ask each and every one of you to invasion a big black (or any other -- color) object as you walk out of your front door.
