The Planning Commission of the City of Campbell convened this day in
regular session at the regular meeting place, the Council Chambers of City
Hall, 70 N. First St., Campbell, California.

Mr. Kee noted that communications received pertained to specific items on
the agenda and would be discussed at that time.
The Planning Commission adopted Resolution No. 2471 congratulating
Commission Olszewski on his recent marriage.
ORAL REQUESTS
Chairman Perrine asked if there was anyone in the audience who wished to
address the Commission on an issue that was not on the agenda.
Mr. Rollins Cushman, 1274 Walnut Dr., asked the Commission to agendize the
issue of canteen vans (specifically noise they create).

Mrs. Nancy Swenson, 1384 Walnut Dr., asked about the notification
procedures.
Planning Director Kee noted that this matter had been agendized and
discussed at the Planning Commission meeting of July 14, 1987= however, he
suggested that the matter be re-agendized for August 25, 1967, and noted
that Mrs. Swenson will be given a copy of the Staff Report.

Commissioner Dickson spoke against the motion, noting that the project has
a long, narrow driveway; the unit is completely separate from the main
unit; and, the additional unit could be better blended with the existing
unit.

Commissioner Christ reported that this application was considered by the
Site and Architectural Review Committee. The Committee is recommending
approval.
Commissioner Olszewski spoke at length regarding the retention of existing
trees on the site.
Commissioner Dickson noted that the density appeared to be at the high end
of the range.
Chairman Perrine opened the public hearing and invited anyone in the
audience to speak for or against this item.
Mr. Jere LaGufsa, applicant, reviewed the plans and answered questions of
the Commission.
M/S: Walker, Christ - That the public hearing on PD 87-05 be
closed. Motion carried unanimously
(7-0-0).
Discussion
Commissioner Olszewski spoke in favor of a continuance in order that
specific information regarding the location of existing trees and their
relation to the site plan could be provided.
Commissioner Christ noted that it is sometimes appropriate to replace
large trees, and spoke for a balance in the procedure.
Commissioner Dickson spoke against the project, citing the lack of on-site
open space and enhancements to compensate for the lack of open space;
concern with findings #2 i 8 under the Site and Architectural Approval,
noting that the landscaping plans are not yet available; and, a concern
with Finding #2 under the Planned Development Permit section, in that he
did not feel that this issue has been clearly demonstrated.
Commissioner Walker spoke in favor of the project.
Chairman Perrine spoke in favor of the project.
M/S: Christ, Walker - That the Planning Commission adopt
Resolution No. 2473, including findings
and conditions of approval as indicated
in the Staff Report of August 11, 1987,
recommending that the City Council
approve PD 87-05; and, the Finding #8 be
changed to read '...has been indicated
which adds to the aesthetics...'.

M 87-16 Continued request of Mr. Richard Flowers

Principal Planner Phil Stafford reviewed the Staff Report of August 11,
1987.
Commissioner Christ reported that this application was considered by the
Site and Architectural Review Committee. The Committee is recommending
approval.

following findings: (1) The proposed 8
ft. sideyard setback will not be
detrimental to the health, safety,
peace, morals, comfort, or general
welfare of persons residing in the

Request Request of Richard and Dorothy Aubrey
Aubrey, R. for a deviation to the Satellite Dish
Antenna Ordinance to allow a dish
antenna 17'8' in height and partially
visible from the street on property
known as 1459 E. Campbell Ave. in an
R-1-6 (Single Family Residential - 6,000
- sq.ft. minimum lot size) Zoning
District.
Planning Director Art lcee reviewed the Staff Report of August 11, 1987.
Commissioner Christ reported that this application was considered by the
_- Site and Architectural Review Committee. The Committee is of the opinion
that recommended Finding i2 should be deleted.
Mr. Patrick Bouchard, 1485 E. Campbell Ave., spoke against the request,
and asked that the applicant bring the antenna into conformance with the
City's regulations.
Mr. Mark Bara, 14 Peter Dr., spoke against the request, noting the high
visibility of the antenna.
Mr. Gordon Armstrong, 13 Peter Dr., spoke against the request, noting that
it makes the whole neighborhood look unattractive.
Mr. Richard Aubrey, applicant, explained his request: Mr. Aubrey
indicated that he had installed the antenna himself unaware of the
regulations; that his rear yard is mostly concrete, providing little space
to provide screening; that the antenna is, in his opinion, in the best
place for reception purposes.
Commissioner Kasolas spoke regarding the use of landscaping to screen the
antenna.
Commissioner Olszewski asked if there were other possible locations for
the antenna which would be less offensive to the neighbors.
Commissioner Talker asked the applicant about his familiarity with the
installation of antennas, and about the cost of his installation.
City Attorney Bill Seligmann noted that the FCC regulations provided for
deviation from the City's regulations, as indicated in the Staff Report.

Commissioner Christ stated that the need for a deviation from the
ordinance has not been clearly demonstrated, nor has it been shown that
the costs to conform would be excessive.

Planning Commission meeting of September
8, 1987, in order that the applicant may
bring the antenna into conformance with
City regulations and be screened from
the neighboring properties, or clearly
• demonstrate why this is not possible.

M 87-14 Continued public hearing to consider the
Wright, T. application of Mr. Todd Wright, on
behalf of 900 E. Hamilton a Limited
Partnership, for approval of a
modification to a previously approved
Planned Development Permit to modify the
design of Phase I (175,000 sq.ft. of
office building) to allow primarily
surface parking rather than
subterranean/surface parking on property
known as 900 E. Hamilton Ave. in a PD
(Planned Development/Commercial,
-~ Public-Semi Public) Zoning District.
Planning Director Art Xee reviewed the Staff Report of August 11, 1987,
noting that the Commission has been provided with a Revised Staff Report
as a result of the Site and Architectural Review Committee meeting. Staff
is of the understanding that the Fire Department is satisfied with the
original conditions imposed on this project; and, the Public Works
Department has indicated additional conditions which are shown on the
revised report. However, the Planning Staff would feel more comfortable
with the position represented in the initial Staff Report -- that of a
continuance.
Engineering Manager Bill Helms explained that the Public Works Staff
primary concerns were with the pedestrian circulation and the phasing
approach.
Lengthy discussion ensued regarding the proposed tunnel; the pedestrian
circulation; the bicycle path; the responsibility for stabilization of the
creek bank; the phasing and it's effects on the on-site parking; and, the
change of the building materials.
Commissioner Christ reported that this application was considered by the
Site and Architectural Review Committee. The Committee discussed the fact
that there is no guarantee that the project will proceed beyond Phase i,
and if the Commission takes action on this issue this evening it should be
stipulated that the bicycle path and the landscaping needs to be ___.
consistent with the original plan. Additionally, the Architectural
Advisor noted at the Site Committee meeting that the newly proposed
building material would not appear any different from the original
material - and in some ways, is superior.

Chairman Perrine opened the public hearing and invited anyone in the
audience to speak for or against this item.
Mr. Todd Wright, applicant, briefly described the changes proposed in the
plans and discussed the financing of the project.
Mr. Jeffrey Heller, architect, described the proposed changes in detail;
and discussed the building materials; the on-site circulation during
phasing; the construction method for underground parking at a later date;
the landscaping; and the bicycle path and tunnel.
Mr. Paul Lateri, landscape architect, reviewed the landscaping areas,
noting that the majority of the landscaping will be permanent (not in
containers as previously suggested); a densely landscaped plaza is
provided; and, some of the trees will be moved to other locations when the
construction of the other phase begins.
Commissioner Kasolas asked if the necessary property has been acquired for
this project.
hr. Wright noted that property acquisition will be concluded before
construction begins.
hr. Kee indicated that the adjacent property owner, PGiE is aware of the
application; and, that the developers will have to have all the property
acquisitions completed prior to application for a building permit as a
matter of procedure. -~
Commissioner Kasolas noted that this project has been before the
Commission a number of times over the last three years and there has been
no signs of development. Commissioner Kasolas stated that this was
placing a burden on the community, and questioned the integrity of the
developer.
Discussion ensued regarding whether or not to continue the item. The
public hearing was closed, and subsequently reopened.
Commissioner Dickson expressed a concern that each time the project came
back before the Commission it appeared cheaper; and, he expressed a
concern that the applicant was presenting 'parking schemes' - not a
straight-f onward parking plan.
Commissioner Christ asked that the Architectural Advisor address the
Commission on the issue of building materials, either in person or in
writing.
Mr. Wright stated that he would, at this time, withdraw his request for a
decision this evening and agree to a continuance if that is the desire of
the Commission.

Commissioner Stanton asked if this application had been referred to the
Fire Department because of the interior vehicular parking, noting that he
is not comfortable with this type of situation.

Mr. Bob Aviles, architect, indicated that the Fire Department has
expressed no concern with the plan.
Planning Director Ree noted that the request has been routed to the Pire
Department; however, no written comments have been received as yet.
Discussion ensued regarding possibly stipulating that the matter be
referred to the Fire Department regarding parking underneath a mezzanine;
the possibility of no occupancy until approved by the Fire Department;
and, a stipulation that the interior parking will not be used for vehicle
storage.

We .are new to the neighborhood and one reason we purchased
this particular house Is because of the beautiful street
with large. elegant homes and well cared for yards. We feel
that a large roof-mounted satellite dish is out of place
with the residential look of this neighborhood. We are
concerned about maintaining the property values of this area
and we feel that It has a negative effect on the overall ap-
pearance of our street.
We are also currently landscaping our backyard and hope to
make much use of lt. The dish, which sits at a height of
17'8". !s 12' above and only about 15' west of our shared
fence. It dominates our view of that side of the yard.
Because of its location and height, !t is Impossible to
block our view of lt.
A local satellite dish dealer told us that a dish only needs
an unobstructed view of the southern sky to function. A
common mounting position fs on the ground and ft looks to us
like the dish will function better if It were mounted In the
rear of the yard.
We feel that the City of Campbell made a wise decision !n
the passing of this code. Its apparent intention was to

indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables, etc.
12. Sign application to be submitted in accordance with provisions of the
Sign Ordinance fqr all signs. No sign to be installed until
application is approved and permit issued by Planning and Building
Departments (Section 21.68.030 of the Campbell Municipal Code).
13. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet
garbage and rubbish produced within the limits of the City of Campbell
shall be made with Green Valley Disposal Company. This requirement
applies to all single-family dwellings, multiple apartment units, to
all commercial, business, industrial, manufacturing, and construction
establishments.
14. Trash container(s) of a size and quantity necessary to serve the
development shall be located in steals) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and have
_ self-closing doors of a size specified by the Fire Department. All
' ~ enclosures to be constructed at grade level and have a level area
adjaccnt to the trash enclosure area to service these containers.
15. Applicant shall comply with all appropriate State and City
requirements for the handicapped.
16. The applicant is hereby notified that the property is to be waintained
free of any combustible trash, debris and weeds, until the time that
actual construction commences. All existing structures shall be
secured by having windows boarded up and doors sealed shut, or be
demolished or removed from the property. Sect. 11.201 i 11.414, 1979

The applicant is hereby notified, as part of this application, that he/she
is required to meet the following conditions in accordance with the
Ordinances of the City of Campbell and the Laws of the State of
California. Additionally, the applicant is hereby notified that he/she is
required to comply with all applicable Codes or Ordinances of the City of
Campbell and the State of California which pertain to this development and
are not herein specified.
1. Revised elevations and/or site plan to be submitted to the Planning
Department and approved by the Site and Architectural Review Committee

garbage and rubbish produced within the limits of the City of Campbell
shall be made with Green Valley Disposal Company. This cequirement
applies to all single-family dwellings, multiple apartment units, to
all commercial, business, industrial, manufacturing, and construction
establishments.
16. Trash containerts) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Onless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and have
self-closing doors of a size specified by the Fire Department. All
enclosures to be constructed at grade level and have a level area
adjacent to the trash enclosure area to service these containers.
17. Applicant shall comply with all appropriate State and City
requirements for the handicapped.
18. The applicant is hereby notified that the property is to be s~aintained
free of any combustible trash, debris and weeds, until the time that
actual construction commences. All existing structures shall be
secured by having windows boarded up and doors sealed shut, or be

25. Water Supply:

on the site plan (C.F.D. office copy).
26. Fire Protection:
A. Provide a fully supervised sprinkler system to be monitored by a
central station alarm company. System shall be designed in
accordance with NFPA Standard 13; Ordinary Hazard (Group 3) in
all areas and Extra Hazard (Group 2) in areas using
flammable/combustible liquids.
B. Sprinkler System shall include 1-1/2 inch hose outlets for
Campbell Fire Department use.
27. Hazardous Materials:
A. All storage, handling and use of hazardous materials shall
conform to require~aents of the City of Campbell Hazardous
Materials Ordinance (C.M.C. Title 17) and the Uniform Building
Code.
B. All necessary permits required in item 11 (above) shall be
obtained prior to building occupancy.
