PC Min 07/14/1987PLANNING COMhIISSION CITY OF CAMPBELL, CALIFORNIA 7:30 PId MINUTES JULY 14, 1987 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Kasolas, Stanton, Olszewski, Christ, Walker, Dickson, Perrine; Planning Director A. A. Kee, Principal Planner Phil Stafford, Engineering Manager Bill Helms, City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent None. APPROVAL OF t1INUTES M/S: Stanton, Christ - That the minutes of the Planning Commission meeting of June 23, 1987, be approved as submitted. Motion carried unanimously (7-0-0). COMt7UNICATIONS t•Zr. Kee noted that communications received pertained to specific items on the agenda and would be discussed at that time. ORAL REQUESTS Chairman Perrine asked if there was anyone in the audience who wished to address the Commission on an issue that was not on the agenda. Ms. Leesa Loftus, 671 Nello Dr., Campbell, asked why no one received a notice of hearing for construction of a building at 3255 S. Winchester Blvd. ~;s. Loftus noted that the building was very unattractive. Mrs. Nancy Swenson, 1384 Walnut Dr., asked why some people received notice of hearings and other did not. Chairman Perrine requested that this matter be agendized for the Planning Commission meeting of July 28, 1987. -2- ARCHITECTURAL APPROVALS MM 87-11 Application of Mr. Edmond Yuen, on Yuen, E. behalf of Plaza Car Wash, for modifications to the front elevation of an existing car wash on property known as 1667 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a 30-day continuance in order that the applicant may submit revised plans. Planning Director Kee stated that Staff concurs with this recommendation for continuance. Commissioner Kasolas requested that the record show that he has reviewed the comments of the Architectural Advisor on this project is in complete agreement with him. Discussion ensued regarding the guidelines and procedures for a minor modification; and, the existing signage on the subject site. It was the consensus of the Commission that the next Staff Report contain a review of the signage on this site. M/S: Olszewski, Stanton - That MM 87-11 be continued to the __. Planning Commission meeting of August 25, 1987. t4otion carried unanimously (7-0-0). PUBLIC HEARINGS MM 87-12 Public hearing to consider the Nilsson, E. application of Ms. Eleanor P7ilsson, on behalf of Eleanor's of California, for approval of a modification to an approved building usage to allow the establishment of a clothing store, and a plant food processing operation, on property known as 3165 S. Winchester Blvd. in a PD (Planned Development/ Commercial) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a continance to August 11, 1987, in order that the applicant may have time to submit a traffic report, as requested by the Public P7orks Department. Principal Planner Stafford noted that Staff is also recommending --- continuance. -3- Chairman Perrine opened the public hearing and invited anyone in the audience. to speak for or against this item. Mr. Rollins Cushman, 1274 Walnut Dr., Campbell, stated that the original approval determined the building's usage as research & development. Mr. Cushman presented a petition (pertaining to the original application) and a list of people contacted about the current proposal (both attached hereto). Mr. Cushman expressed concern about the proposed uses being open on weekends; different kind of people that would be coming with research & development; noise generation; hours and noise from canteen vans; depreciation of adjoining residential properties; chemicals; odors; possible garbage disposal change; any type of structural changes; additional burgler alarms; residue; public nuisances that are unknown at this time; and, some people were opposed to "used" clothing. Leslie Ross, March Development (property owner), appeared to answer questions. Commissioner Kasolas suggested that the applicant talk with the neighbors regarding her proposed usage of the property. c~7/S: Kasolas, Walker - That the public hearing on MM 87-12 be continued to the Planning Commission meeting of August 11, 1987. Motion carried unanimously (7-0-0). MA4 87-14 Public hearing to consider the Wright, T. application of Mr. Todd Wright, on behalf of 900 E. Hamilton a Limited Partnership, for approval of a modification to a previously approved Planned Development Permit to modify the design of Phase I (175,000 sq.ft. of office building} to allow primarily surface parking rather than subterranean/surface parking on property known as 900 E. Hamilton Ave. in a PD (Planned Development/Commercial, Public-Semi Public} Zoning District. Planning Director Kee reported that the applicant has indicated, by telephone, his concurrence with Staff's recommendation for a continuance to August 11, 1987. Dicussion ensued regarding the designation of "tit~i" for this application. The Planning Commission requested that Staff prepare a report on the guidelines used to determine if an application is a minor modification. Mr. Kee noted that in this particular case, this application was noticed as a public hearing as though it were a new application. The modification is actually relating to the overall plan and the end result is the same as originally approved by the City Council. -4- Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. David (no last name used), General Delivery, Campbell, asked about the number of cars projected for this project. Mr. Kee indicated that the plans were available in the Planning Office and Staff would be happy to review these plans with the speaker. M/S: Walker, Stanton - t9ISCELLANEOUS That the public hearing on tdM 87-14 be continued to the Planning Commission meeting of August 11, 1987. P4otion carried unanimously (7-0-0). Mtd 87-13 Request of Mr. Dennis Ray for approval Ray, D, of a minor modification to a sideyard setback to allow the construction of a second story addition with a 5-foot setback rather than a 10-foot setback on property known as 1160 Glenblair ~4ay in an R-1-8 (Single Family/Low Density Residential) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval. Commissioner Christ noted that he is acquainted with the applicant; however, this does not impact his decision on the matter. Principal Planner Stafford stated that Staff is also recommending approval. M/S: Kasolas, Dickson - That the Planning Commission adopt the following findings, and approve Pit4 87-13 subject to the condition that the applicant secure all necessary permits from the Building Department. 1. The 5-foot sideyard setback will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing in the neighborhood or to the general welfare of the City. 2. The consent of the adjacent property owners has been obtained. Motion carried unanimously (7-0-0). -5- Mt•9 87-15 Request of Mr. and i9rs. R. Bebee to Bebee, R. allow a 6 foot sideyard setback, in lieu of an 8 foot sideyard setback as required, on the left side of the house so as to allow a second-story addition on property known as 403 Sobrato Dr. in an R-1 (Single Family Residential) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval as red-lined. The red-lining indicates the elimination of one second-story window and the addition of another window above eye level. Principal Planner Stafford stated that Staff is also recommending approval. M/S: Kasolas, Christ - That the Planning Commission adopt the following findings, and approve MM 87-15, subject to the condition that the applicant obtain all necessary permits from the Building Department. 1. The 6-foot sideyard setback will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing in the neighborhood or to the general welfare of the City. 2. The consent of the adjacent property owners has been obtained. Motion carried unanimously (7-0-0). PM 87-02 Request of tdr. Richard Terril for Terril, R, approval of a Tentative Parcel Map and an exception to the Subdivision Regulations to allow subdivision of property known as 1593 Hacienda Ave. in an R-1-9 (Single Family Residential, 9,000 sq.ft. minimum lot size) Zoning District. Commissioner Christ reported that this item was before the Site and Architectural Review Committee for information only, and no recommendation is forthcoming. Planning Director Kee noted that the applicant is in the State of Washington and has requested a continuance if he is needed to answer questions; however, Staff is certain that the applicant would have no objection to the Commission making a favorable decision on the item this evening. -6- Commissioner Walker noted that he would be opposing this item in that he has a concern with the garage detail and the proposed shared driveway. Commissioner Christ stated that he would also be opposing this item. M/S: Kasolas, Dickson - That the Planning Commission adopt the following findings and recommend that the City Council approve this Tentative Subdivision Map, subject to conditions as indicated in the Staff Report of July 14, 1987, tlotion carried with a vote of 5-2-0, with Commissioners Christ and Walker voting "no". Findings: 1. There are special circumstances involving the parcel due to the narrowness of the existing lot width in relation to lot depth. 2. The existing parcel has sufficient land area to develop two units in accord with the residential density range specified in the Land Use Element of the General Plan. 3. The granting of the exception will not be detrimental to the public welfare or injurious to other property in the territory in which the property is situated. SA 87-32 Appeal of decision of Planning Director Gibbons Automotive denying signing request - Gibbons Automotive - 940 Dell Ave. - M-1-S (Light Industrial) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending that the Planning Commission uphold the decision of the Planning Director denying the proposed signage. Commissioner Christ noted that the applicant was unable to attend the Site Committee meeting because of a conflict in schedules. Principal Planner Phil Stafford reviewed the Staff Report of July 14, 1987, noting that Staff is recommending that the Commission uphold the Planning Director's decision. Mrs. Marlene Gibbins, applicant, stated that the signage is very important to the business because of the location of the site; and, noted visibility __ problems and competition problems. -7- Commissioner Christ noted that approximately one-third of the subject sign actually identifies the business, and that he would have less trouble with this application if the signing were smaller (even if it were larger than what the ordinance allowed) and just identified the business. Commissioner Kasolas suggested that the matter be continued, and that the applicant work with Staff to develop an appropriate signing program which will identify the business without breaking the rules. Commissioner Olszewski stated that he did not feel it necessary to have signage over and above that allowed by the Sign Ordinance. A7/S: Stanton, Kasolas - That SA 87-32 be continued to the Planning Commission meeting of August 25, 1987 in order that the applicant might work with Staff to develop an acceptable signing program. Motion carried unanimously (7-0-0). Reports Reports from Planning Commission Subcommittees. Commissioner Kasolas indicated that the subcommittee reviewing the Site and Architectural Review Committee process anticipates that a report and recommendations will be prepared in time for the next Commission meeting. City Attorney Seligmann noted that the individual subcommittees should be listed on the following agenda. It was the consensus of the Commission that this item be continued to the Planning Commission meeting of July 28, 1987. Chairman Perrine, for the record, designated Commissioners Christ and S•Jalker to serve on the Site and Architectural Review Committee, and Commissioner Olszewski as the alternate member of this Committee. File a parcel map in accordance with the provisions of the State Subdivision Map Act. 2. Install standard street improvements in Hacienda Ave. 3. Pay storm drain area fee of $938.00. 4. Pay fee in lieu of dedication of lands for parks in the amount of $1,132.00. PLANNING DEPARTMENT 5. Development of the rear parcel (Parcel B) will require Site and Architectural approval by the Planning Commission. 6. Prior to application for Building Permit to develop Parcel B, applicant to submit evidence, satisfactory to the City Attorney, that an easement for ingress/egress over Parcel B and favoring Parcel A, has been recorded. 7. Eliminate "existing parking area" at southeast corner of Parcel A. Area to be landscaped as approved by Planning Director. 8. Plans and elevation for 'proposed garage & driveway" on Parcel A to be approved by Planning Director prior to issuance of a Building Permit.
