PC Min 04/28/1987PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA 7:30 PM MINUTES APRIL 28, 1987 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Kasolas, Stanton, Olszewski, Christ, Walker, Dickson, Perrine; Principal Planner Phil Stafford, Planner II Tim Haley, Engineering Manager Bill Helms, City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent Planning Director A. A. Kee. APPROVAL OF MINUTES M/S: Dickson, Christ - That the Planning Commission minutes of the meeting of April 14, 1987, be approved as submitted. Motion carried unanimously. COMMUNICATIONS Mr. Stafford noted that communications received pertained to specific items on the agenda and would be discussed at that time. Mr. Stafford also noted that a status report regarding 900 E. Hamilton Ave. has been distributed to the Commission as an information item. The Commission may note & file this report, or agendize it for discussion at a future meeting. ORAL REQUESTS Chairman Perrine asked if there was anyone in the audience who wished to address the Commission on an issue that was not on the agenda. There being no one, the Chairman proceeded with the set agenda. ARCHITECTURAL APPROVALS MM 87-02 Continued application of Mr. George Barrows, G. Barrows for approval of a minor modification to allow the construction of a 450 sq.ft. building addition and the placement of three portable storage containers on property known as 1266 Whiteoaks Rd. in an M-1-S (Light Industrial Zoning District. -2- Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The request for the building addition has been removed. The Site Committee is recommending approval of the cargo containers, as redlined. The redlining of the presented plans includes the up-grading of landscaping, the designation of parking spaces, and a fence separating the parking area from the equipment storage area. Principal Planner Stafford indicated that Staff is in concurrence with the Site Committee's recommendation for approval as redlined. Commissioner Kasolas expressed a concern with the outside display areas, noting that it has been the policy to have businesses operate within the buildings, and with the aesthetic appearance of this site. Commissioner Kasolas commented regarding the issue of uniformity throughout the community, and the fairness to others in the community that are not allowed to have outside storage. Discussion ensued regarding the designation of the parking spaces on the site; the portion of the site to be used for storage of the rental equipment; the proposed wrought-iron fence] and, the landscaping. Commissioner Christ noted that nothing will be displayed along Whiteoaks Rd.; and, the applicant has agreed to work with the City to improve the appearance of the site. Mr. Stafford noted that outside storage is an allowed use in the M-1-S (Light Industrial) Zoning District if approved by the Planning Commission. Commissioner Olszewski expressed a concern that the conditions of approval did not specify that there was to be no display of equipment in front of the building. City Attorney Seligmann stated that this issue is addressed with the approval of a site plan. Anything not shown on the site plan would result in a violation of the approval and subject to enforcement action. Mr. Haley indicated that the plans also include redlining for a 20' driveway. The landscaping provided on the site is approximately 48, which is less than would currently be required for industrial developments. The applicant's current request is for cargo storage containers and a wider range of rental equipment. Staff is of the opinion that it would be unreasonable to ask for additional landscaping based on this type of tequest. The Planning Commission may, however, require additional landscaping. Commissioner Kasolas stated that he saw the use as being expanded, but the amenities being provided by the applicant were not expanded. He felt that this was a policy decision to be made by the Commission. Commissioner Dickson did not see where the use was being intensified. He thought that the use was being made better, with smaller equipment being offered, rather than the large U-Haul items. -3- M/S: Olszewski, Walker - That the Planning Commission adopt the attached findings, and approve MM 87-02 as redlined, subject to conditions as indicated in the Staff Report dated April 28, 1987. Motion carried unanimously (7-0-0). PUBLIC HEARINGS GP 87-01 Continued public hearing to consider a City-initiated City-initiated proposal to add an Air Quality element to the General Plan; or, to add Air Quality goals and policies to existing General Plan elements. Principal Planner Stafford reviewed the Staff Report of April 28, 1987, noting that Staff has published a display ad in the San Jose Mercury News, and notified the Campbell Chamber of Commerce, the Building Industry Association, and an interested citizen, as per the directive of the Commission at it's meeting of March 24, 1987. Mr. Stafford continued with regard to the Air Quality District's second recommendation (quantification of estimated levels of pollution), staff recommends that such quantification be made the burden of a developer as part of an EIR for a specific proposal. This quantification could then be based on an estimated level of pollution, or on actual measurement of air ___.- samples in the area - at the City's option. In summary, the draft Air Quality Element before the Commission at this time will establish certain goals, objectives and policies of the City regarding air pollution. By having an adopted Air Quality Element, these goals, objectives and policies will be readily available to persons wishing to develop projects in the City. The draft also emphasizes that the responsibility for air quality monitoring and enforcement of State and Federal air quality standards remains with the Bay Area Air Quality Management District, and the State Air Resources Board. Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Irwin Mussman, Senior Planner from the Bay Area Air Quality District (BAAQD), appeared before the Commission to discuss the Air Quality Element and to answer questions. Mr. Mussman spoke at length regarding the response to the request for consideration of an Air Quality Element from other cities; air quality monitoring activities fn the area; the levels of carbon monoxide at the Bascom & Hamilton intersection; the poor ozone quality in Los Gatos as a result of it's geographical location; the need to support reduction in automobile usage and support mass transit and alternative transportation systems; and, the organization of the BAAQD and it's powers. -4- Commissioner Stanton asked about the impact of training fires on the air quality. _, Mr. Hussman indicated that he would respond to Staff with this information. Commissioner Olszewski expressed his concern with energy to waste facilities being proposed in communities to the north of this area, and the impact of these facilities on air quality. Mr. Hussman noted that most energy facilities must have permits from BAAQD; and, a facility such as this would require computer modeling to indicate where the contaminates will go. Commissioner Dickson asked if the BAAQD issued air quality alerts. Commissioner Dickson asked Mr. Hussman how this element could be used to the City's advantage, noting that there should be a way to warn people when the air quality becomes a health issue. Mr. Hussman explained measurements used for alerts, and noted that slower traffic results in a higher level of carbon monoxide, thereby causing the problems which have been evident at Hamilton & Bascom. There is a warning system through BAAQD. From a planning standpoint, Mr. Hussman continued, the Commission can address the levels of intensity of development projects that might cause a lot of traffic, and try to have the develop provide other transportation services. This concern can be address in the environmental impact report. "-~ Commissioner Kasolas noted that a previous Staff Report referred to a telephone conversation with a Dr. Gene Leong. Dr. Leong indicated his support for the draft air quality element, however, he indicated the City should not use the element as a tool for restricting development. What type of mitigation measures would this result in, and what can Campbell do on it's own to help air quality control? Mr. Hussman responded that Campbell cannot do everything - but Campbell can do more than every other city has been doing by working over a period of time to alleviate intensity at certain intersections; begin to focus on problems that might have some mitigations; support regional approaches. Commissioner Kasolas asked if Campbell will this element affect Campbell. This is obviously Is the problem significant enough Mr. Mussmann responded that it is his belief that there are things that cities and counties (in the absence of a strong regional government) can do to make a difference; i.e. cities can pass transportation systems management rules. -5- Commissioner Kasolas stated that what is being proposed is a lofty ideal which really may accomplish nothing, noting that there are really only one or two corners, within several square miles, that have potentially significant air quality problems. Commissioner Walker asked if BAAQD was available to do air quality testing at the request of a community. Mr. Mussman indicated that testing is done around the area with no specific agenda; and, BAAQD would certainly consider any requests coming from a city. Commissioner Kasolas felt that it was obvious that the only way air quality can be addressed is on a regional basis, or with several cities banding together. He asked if more impact might be gained if we were to suggest that surrounding communities work together in doing something. Commissioner Kasolas Qxpressed a concern with uniformity throughout the valley. Mr. Mussman responded that this was a fine idea, however, it would not be easy to do. BAAQD would assist to the extent that it could with this type of effort. Chairman Perrine asked about the organization of the BAAQD; and, projected mitigation measures from indirect sources. Mr. Mussman explained that funding comes from local cities, and from fees levied against industry. Projected mitigation measures will result from __ traffic management -- trying to get people to double up in their vehicles for commutes to work, or diverting traffic away from peak traffic hours. M/S: Olszewski, Christ - That the public hearing on GP 87-01 be closed. Motion carried unanimously (7-0-0?. Commissioner Kasolas stated that it might be appropriate for Campbell to take a leadership role and contact neighboring communities to address this issue with a uniform plan that would be significant county-wide. Commissioner Kasolas added that the construction of Hwy 85 may solve some of the problems. Commissioner Christ stated that other cities may have different requirements because of specific conditions. There definitely needs to be cooperation between cities to solve the problems; however, adding this element to the General Plan would be an initial step. Commissioner Christ agreed that this element should not be used to stop development, except where the development is a direct polluter; however, this issue should be looked at even without an element. -6- Commissioner Dickson noted that Staff has tried to Kasolas' suggestion in the draft element. Campbell is in a direct line to receive air flows from as far away as Richmond. The ability of other communities to lessen our air quality is a real concern, and this element is an opportunity to make a statement that Campbell wishes to do something to improve the situation. Commissioner Olszewski thought that this element should be adopted, and that Campbell should demand that other cities consider adopting similar elements (particularly Union City and Fremont, where waste to energy facilites are being considered). Commissioner Kasolas asked if an environmental impact report would have aided in the decision-making process for this issue. Mr. Stafford responded that, in Staff's opinion, an EIR would not have brought out anything that-has not already been discussed. Staff took the position that the Air Quality Element, if adopted, will require more detailed review of the environmental impacts of a project requiring an EIR. In the Staff's opinion, the Air Quality Element qualified for a Negative Declaration. M/S: Olszewski, Walker - That the Planning Commission adopt Resolution No. 2454 recommending that the City Council: (1) Accept the Negative Declaration which has been prepared for GP 87-01; (2) Accept the findings attached hereto; and (3) Adopt the Draft Air Quality Element to the General Plan. Motion carried by the following roll call vote: Discussion on motion Commissioner Kasolas stated that he would not be voting in favor of the motion, noting the 'Appendix" as the reason for his negative vote. Vote on motion AYES: Commissioners: Olszewski, Chrfst, Walker, Dickson, Perrine NOES: Commissioners: Kasolas, Stanton ABSENT: Commissioners: None. t -7- The Commission recessed at 8:55 p.m.; the meeting reconvened at 9:05 p.m. • PD 87-01 Public hearing to consider the applica- Bonnett, R. tion of Mr. Robert Bonnett for approval of plans, elevations, and development schedule to allow a commercial office development on property known as 145 Dillon Ave. in a PD (Planned Development/Industrial) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a continuance to May 26, 1987, with the applicant's concurrence. Principal Planner Stafford noted that Staff is in agreement with this recommendation. Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Robert Bonnett, applicant, appeared before the Commission to review his application. Mr. Bonnett stated that there is no parking problem for his development because the tenants are usually. not there; he is asking the City to assist him in his endeavors; this development is a start-up community of small offices, providing a needed environment in the community; and, the site is well-maintained. Mr. Bonnett noted that he is willing to participate in a parking district. Commissioner Olszewski indicated that there was discussion in the Site Review Committee meeting about the applicant trying to acquire parking near his site; in particular, some property owned by Southern Pacific Railroad. This effort seems to be entangled in bureaucracy. Commissioner Olszewski asked if Staff could explain this situation. Engineering Manager Helms explained that the area under discussion is currently owned by Southern Pacific, and the City has been in contact with this agency to see if that property might be for sale or lease. No response has been forthcoming at this time. Apparently, it is not a simple matter, which has been further complicated by the perspective merger of Southern Pacific with Sante Fe Railroad. Additionally, it has not been made clear by the Council, at this point, what use this area would be put to if it were available for sale or lease. One other complication is the possibility of a light-rail facility along this corridor. Commissioner Kasolas noted that the Commission recently approved an ambulance service in a portion of this development, and he asked why it was not brought to the Commission's attention that a problems existed at that time. -8- Mr. Stafford reported that the ambulance service use was brought before the Commission as part of a code enforcement action. Staff did advise the Commission at that time that there were problems with the site, as a whole, and that there was legal action being taken against the applicant. Staff considered the ambulance use appropriate because the original Planned Development application for this property established office use as acceptable. Commissioner Christ noted that the Site Review Committee felt there was a distinct possibility of working out the problems with this site, therefore the recommendation for a continuance. Commissioner Dickson asked if there have been parking complaints filed for that particular area. Mr. Stafford indicated that the Planning Staff has had no complaints. Planner II Haley explained the existing parking on the site and in the immediate area. Commissioner Dickson asked if the subject property is within the Redevelopment Area. Mr. Stafford noted that the site is in the Redevelopment Area, however, it is not within the Downtown Interim Zoning area. M/S: Olszewski, Christ - That the public hearing on PD 87-01 be continued to the Planning Commission meeting of May 26, 1987. Motion carried unanimously (7-0-0). r ZC 87-02 Public hearing to consider the applica- Anderson, K. tion of Mr. Kurt Anderson for a zone change from R-M-S (Multiple Family Residential) to PD (Planned Development/Low-Medium Density Residential); and, the approval of plans, elevations, and development schedule to allow the construction of 3 townhomes on property known as 235 N. Third St. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. Discussion in the meeting centered on concerns expressed in the Staff Report. The applicant is addressing these concerns; therefore, a continuance to May 12, 1987, with the applicant's concurrence, is being recommended. Principal Planner Stafford indicated that Staff is in agreement with the ,_ recommendation for continuance. -9- Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. M/S: Stanton, Dickson - That the public hearing on ZC 87-02 be continued to the Planning Commission meeting of May 12, 1987. Motion carried unanimously (7-0-0). UP 87-08 Public hearing to consider the applica- Kong, A. cation of Mr. Andrew Kong for approval of a Use Permit to allow on-sale beer and wine in an existing Chinese restaurant on property known as 845 S. San Tomas Aquino Rd. in a C-1-S (Neighborhood Commercial) Zoning District. Principal Planner Stafford reviewed the application, noting that Staff is of the opinion that on-sale beer and wine is typically provided with a restaurant operation; therefore, approval is being recommended. Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. Commissioner Kasolas asked if it might be appropriate to restrict the hours of operation, in that this use is adjacent to residential. Mr. Stan Yem, representing Mr. Kong, noted that the area is quiet after 10 p.m.; and, the previous use at this location was a chinese restaurant, without beer b wine. M/S: Kasolas, Christ - M/S: Kasolas, Christ - That the public hearing on UP 87-08 be closed. Motion carried unanimously (7-0-0). That the Planning Commission adopt Resolution No. 2455, including findings and conditions indicated in the Staff Report dated April 28, 1987, approving UP 87-08. Said approval would include the hours of operation being limited as follows: Sunday through Thursday - 6 a.m. to 10 p.m.; Friday & Saturday - 6 a.m. to 11 p.m.; and the Eves of all Holidays - 6 a.m. to 11 p.m. Motion carried with the following roll call vote: Discussion on motion -10- Commissioner Dickson stated that he would be opposing the motion, in that there are already several other uses in the immediate vicinity which sell alcohol. There is a child care facility, as well as a church, near this location. Commissioner Dickson was of the opinion that this area is saturated with businesses providing alcohol sales. UP 87-09 Public hearing to consider the applica- Giancola, M. tion of Mr. Mike Giancola for approval of a Use Permit to allow the construction of an additional living unit and detached garage on property known as 1287 Munro Ave. in an R-1-9 (Single Family Residnetial - 9,000 sq.ft. minimum lot size) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The applicant was not present at the meeting; however, the applicant is in concurrence with the recommendation for a continuance to May 12, 1987. Principal Planner Stafford noted that Staff is also in agreement with a recommendation for continuance. Commissioner Kasolas asked if it was appropriate, in these cases, to look at the overall development to make sure that the existing structure is in conformity and meets the architectural standards, etc. Mr. Stafford responded that Staff reviews the site for illegal additions or accessory structures which may have been built without permits. In terms of the architectural standards of a single family residence, it has not been the policy of the Commission to review these; however, the policy could be changed. Commissioner Kasolas continued that if someone comes through the process, under the Use Permit procedure, to add a structure, and does not have a home that would meet the standard, this Commission could look at requiring the existing structure to be brought up to standard. -11- Mr. Stafford noted that there are a number of buildings, which were built under the County's jurisdiction, that have lesser setbacks than Campbell currently requires. Staff's position is that if it was constructed legally in the County, we would consider it legal in the City. Commissioner Kasolas asked that photographs of the existing structures and site be provided for these types of applications. Commissioner Christ noted that the Architectural Advisor does review the existing structure for architectural compatibility for the proposed structure, therefore, this issue is reviewed by the Site and Architectural Review Committee. Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. UP 87-10 Public hearing to consider the applica- Scott, J. tion of Mr. John Scott for approval of a Use Permit to allow the establishment of a medical massage school in a 900 sq.ft. portion of the Campbell Plaza Shopping Center, located on property known as 2509 S. Winchester Blvd. in a C-2-S (General Commercial) Zoning District. Principal Planner Stafford reviewed the application, noting that Staff is of the opinion that the operation of a massage school itself would not be detrimental to the neighborhood or the City. However, anytime a massage use is considered, concerns of illicit activity must be considered. This type of massage school should not cause problems; however, because a Use Permit goes with the land, and not with the current owner or applicant, the City must be cautious and try to prevent possible future problems. Staff has recommended a number of conditions to assure that the approved activities are very clearly defined and limited. Commissioner Christ asked if the students must also be licensed. Mr. Stafford indicated that this issue is determined by the Police Department. Chairman Perrine opened the public hearing and invited anyone in the audience to speak for or against this item. -12- Mr. John Scott, applicant, appeared to answer questions regarding his application. Responding to questions from the Commission, Mr. Scott indicated that he has been operating a massage school since 1984. This school is located just outside Campbell's city limits, on Whiteoaks Ave. Mr. Scott's intention is to upgrade the massage profession; 98$ of the school's business is by doctor's prescription; demonstrations for training purposes are 'hands-on•, with students working only with each other; students do not work on the public; the school works with medical doctors, and has a physical therapist on the staff. The school does not have any type of medical degree; instructors have 5-14 years of experience, with training through state recognized schools; 100 hours of training is required for a certificate. The general public is admitted, without a doctor's prescription, for the purpose of medical/therapeutic massage only. Mr. Scott further explained the certification process; and, the types of ailments treated. Responding to a question regarding the proposed floor plan for the location, and how it would function with the number of classes and treatment rooms being proposed, Mr. Scott noted that the floor plan provided is that of the existing building. A detailed floor plan, accommodating the massage school, is being designed by a contractor, and will be provided to the Building Department. Commissioner Dickson indicated that a floor plan for this specific request was essential. Commissioner Kasolas noted that the request is for a Use Permit to determine if the massage school is an appropriate use at this location. The Commission has not previously required a specific floor plan for this type of request. Commissioner Dickson felt that if there is a need to make the determination that this use is not detrimental to the health, safety, and welfare of the community, a floor plan should be provided showing how the operation will function. Mr. Stafford indicated that Staff concurs with Commissioner Kasolas' understanding that a detailed floor plan will be required by the Police Department when the application is filed for appropriate permits. Chairman Perrine asked what means does the City have to correct a situation, should an operation such as this not be legitimate. Commissioner Olszewski asked if the Commission has the authority to impose additional review periods, if determined necessary. Mr. Stafford responded that the Police Department has the authority to immediately close down any operation it suspects as being illegitimate; and, certainly the Commission has the authority to impose additional review periods. M/S: Kasolas, Oklszewski - That the public hearing on UP 87-10 be closed. Motion carried unanimously -, (7-0-0). -13- M/S: Kasolas, Walker - That the Planning Commission adopt Resolution No. 2456, incorporating the findings indicated in the Staff Report of April 28, 1987, approving UP 87-10 subject to conditions of approval as indicated in the Staff Report; and, with the added condition that 'Additional review periods may be stipulated as deemed appropriate.' Motion carries with the following roll call vote: Discussion on motion Commissioner Dickson stated that he would be opposing the motion. He expressed concern with the lack of definitions for terminology discussed (ie. physical therapist), and the lack of a specific floor plan, which he felt is necessary to make a determination required under the Use Permit process. Commissioner Christ agreed with Commissioner Dickson regarding the floor plan, noting that it should be provided in the interest of .public safety and privacy. Commissioner Christ also noted that he did not understand how a school could be open to the general public, and he was not sure how this would work. Commissioner Christ stated that he was not in total opposition to this use; however, he would prefer more detail and a floor plan. Commissioner Olszewski stated that he did not recall looking into the __ inner workings of businesses in the past - not even housing developments. Commissioner Olszewski continued that he does, however, see massage as a medical operation and that through the testimony given this .evening regarding the licensing and credential program, it is clear what type of operation this is; therefore, he is speaking in favor of the motion. Commissioner Kasolas stated that it is true that normally a site plan is provided, however, not for the interior. What is being asked is to make a determination that a use is allowable at this location. It is not the Commission's job to police situations. The added condition allows for an open-ended review process; and, the fact that the school is located in a shopping center polices the situation. Commissioner Christ stated that he is looking at the request as three uses -- school, medical therapy, and therapy to the general public -- and, he is not sure how this will work, especially all at the same time. Commissioner Walker stated that he is in favor of the motion, noting that this school has been in operation nearby for some time. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a continaunce to the meeting of May 26, 1986, in that revised plans have not been submitted at this time. Principal Planner Stafford noted that Staff is in agreement with this recommendation. M/S: Stanton, Christ - That SA 87-09 be continued to the Planning Commission meeting of May 26, 1987. Mitchell to convert Mitchell, O. warehouse/industrial space to automotive-type use in an existing building located at 1360 Whiteoaks Rd. in an M-1-S (Light Industrila) Zoning District. _ Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a continuance, with the applicant's concurrence, to the meeting of May 26, 1987. Principal Planner Staff noted that Staff is in agreement with this continuance. It was the consensus of the Commission that the Chairman work with Staff on a plan for setting study sessions, and that the matter be agendized for the meeting of May 12, 1987. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified Dy the Fire Department.
