The Planning Commission of the City of Campbell convened this day in
regular session at the regular meeting place, the Council Chambers of City
Hall, 70 N. First Street, Campbell, California.

APPROVAL OF MINUTES:
M/S: Dickson, Olszewski - That the minutes of the Planning
Commission Meeting of March 24, 1987 be
amended to reflect a correction to page
8: 'Commissioner Christ reported that
this application was considered by the
Site and Architectural Review Committee.
The Committee is recommending approval
of 6 directional signs, which includes
one automatic teller sign.' This
correction should also be reflected in
the motion for approval. Motion carried
unanimously (7-0-0).

COMMUNICATIONS:
Mr. Kee noted that communications received pertained to specific items on
the agenda and would be discussed at that time.
ORAL REQUESTS:
Chairman Perrine asked if there was anyone in the audience who wished to
address the Commission on an issue that was not on the agenda. There
being no one, the Chairman proceeded with the set agenda.

UP 87-06 Continued public hearing to consider
Milano, M the application of Manual and Javier
Milano for a Use Permit to allow auto
sales on property known as 2420 S.
Winchester Blvd. in a C-2-S (General
Commercial) Zoning District.
Commissioner Christ reported that this application was considered by the
Site and Architectural Review Committee. The Committee is recommending
approval with redlining on the drawings indicating two parking spaces
adjacent to the building to be designated customer parking and four
parking spaces adjacent to the fence line which would also be signed as
customer parking.
Planning Director Kee reviewed the Staff Report dated April 14, 1987,
noting that Staff conc~irs with the Committee's recommendation.
Commissioner Dickson asked that Staff look into the signage that is
currently being used on the site and also landscaping plans for the site.
There was concern expressed in that it has been noted that there is a sign
being used and it appears as if business is being conducted. The sign
indicates "auto repair." Mr. Kee indicated that the site has had an
approved auto repair use for some time; however, the issue before the
Commission at this time is auto sales. Mr. Kee further stated that as of
this date, there is no approved signage on the property and that Staff
would look into the signage to ensure that it complies with current
regulations.
Chairman Perrine opened the public hearing and invited anyone in the
audience to speak for or against this item.
M/S: Kasolas, Walker - That the public hearing on UP 87-06 be
closed.
Commissioner Dickson requested that the applicant be allowed to address
concerns of the Commission prior to the close of the public hearing.
Commissioners Kasolas and Walker both consented to withdraw their motion.
The public hearing continued.
Javier Milano, applicant, appeared before the Commission indicating that
the sign in question refers to a 'grand opening.'
Following discussion, the applicant was advised by the Commission that
signage on this site would require Planning Commission approval.

UP 87-03 Public hearing to consider the
California Auto application of California Auto Tinting &
Tinting Polishing, Inc. for a Use Permit to
allow auto tinting, polishing, and the
installation of auto alarms and phones
in an existing building on property
known as 1610 #S Dell Ave. in a CM
(Controlled Manufacturing) Zoning
District.
Commissioner Christ reported that this application was considered by the
Site and Architectural Review Committee. The Committee is recommending
approval.
Planning Director Ree indicated that Staff is in concurrence with the
recommendation of the Committee.
Commissioner Olszewski indicated that the applicant is proposing to
operate an auto tinting and polishing business and also, to his
understanding, installing stereos. He further stated that he had concern
regarding the percentage of the building being used for this purpose and
also expressed concern regarding parking on this site.
Commissioner Kasolas questioned whether the auto stereo installation
portion of the building was adjacent to other businesses or residences,
and whether or not any restrictions were placed on the hours of operation.
Planning Director Kee responded that rather than limit the hours of
operation, that Staff would contact the owner of the property, should a
problem arise and would attempt to resolve the noise problem.

Commissioner Dickson questioned whether the application included auto
stereo installation in the description.
Planning Director Kee indicated that the statement that is given in the
Staff Report and their description of what they propose to do would be
their intent as far as the Use Permit is concerned.
Chairman Perrine opened the public hearing and invited anyone in the
audience to speak for or against this item.
Dean Westly, attorney for the applicant, appeared before the Commision to
address concerns regarding the percentage of the building that would be
used for auto sound system installation.
Mr. Westly introduced Greg Weber, applicant, to the Commission to answer
questions regarding percentage of the business that would be auto stereo
installation. Mr. Weber indicated that due to the expense and time
involved, that at the most there would be no more than 4 installations of
this type per month.
Commissioner Olszewski questioned Mr. Westly regarding whether auto stereo
installation was indicated in this application for a use permit.
Planning Director Kee responded that zoning in this particular area
requires that any auto-related use be brought before the Planning
Commission for consideration.
Commissioner Dickson stated that he understood that the legal notification
was for installation of auto alarms and phones.
City Attorney Seligmann stated that auto stereo installation fs reasonably
related to the other installations that were noticed; however, if the
Commission determines that the installation of stereos is not reasonably
related, then the public hearing would need to be renoticed.
Attorney Westly reported that tenants surrounding the auto stereo portion
of the building were questioned regarding noise problems.
At this point reference was made to three letters from surrounding
neighbors in which all three tenants had no complaints or objections
regarding the business operation of California Auto Tinting. These
letters are from Pacer Technology, 1800 Dell Avenue; Advance Media
Technology, 1640 Dell Avenue; and, Heighten Manufacturing, 1610-R Dell
Avenue and will be included as part of the minutes.

UP 87-07 Public hearing to consider the
Sams, N. application of Messrs. Neill Sams,
and Tom Landers for a Use Permit and
approval of plans and elevations to
allow the construction of an additional
living unit on property known as 661
Kenneth Avenue in an R-1-10 (Single
Family Residential - 10,000 sq.ft.
minimum lot size) Zoning District
Commissioner Christ reported that this item was considered by the Site and
Architectural Review Committee, and is recommending approval with
-- redlining in regard to setback requirements, from 5 1/2 feet to 6 feet on
the northwest sides of the proposed unit, also there were changes to the
elevations from 16 feet to 14 feet, a water heater enclosure that
protruded into the north setback has been relocated, also applicant has
indicated a change from T-111 siding to cedar siding. Commissioner Christ
indicated that the Committee is recommending approval of only the
secondary unit and the addition to the carport.
There were some proposed additions to the house and driveway in the front;
however, the Committee is not recommending approval, and are being removed
from this application,.
Planning Director Kee reviewed the Staff Report of April 14, 1987,
indicating that due to recent State requirements that allowed second units
on single family R-1 zoned lots, the City of Campbell Zoning Ordinance was
amended to bring it into conformance.
The Commission questioned whether or not one of the units had to be
owner-occupied. City Attorney Seligmann responded in the affirmative.

Chairman Perrine indicatd that there are three letters concerning this
item, which are to be made a part of the minutes; one of which is from _
Messrs. Nevin and Neill Sams and Mr. Tom Landes which describes the scope
of the project. The remaining letters, one of which is a petition in
which. 25 signatures were obtained objecting to the project and the other
is a letter from Ms. Genevieve Baker also objecting to the project.
Chairman Perrine opened the public hearing on UP 87-07, and invited anyone
in the audience to speak for or against this item.
Nancy Winters, 677 Kenneth Avenue, appeared before the Commission
indicating concern regarding the use of the driveway. Ms. Winters
indicated that she would like to see that landscaping is installed near
the driveway and that some type of automatic gate be looked into, as the
wrought iron gates that are being used now are very noisy. She further
stated that she is opposed to the location of the driveway as it fronts
three of her bedroom windows.
Commissioner Christ suggested that any neighbors who have adjoining
property meet with the applicant to discuss fencing of the site.
Discussion ensued regarding the rental of secondary units and the legal
implications involved in making decisions on the property based on the
idea that one of the units may be a rental.
Gordon Leinhart, addressed the Commission indicating opposition to the
proposed project citing the close proximity of the project to adjacent
properties and traffic concerns.
Oscar Hart, 633 Kenneth Ave., appeared before the Commission and
questioned whether the owner would live in one of the units.
B. Budzinski, 690 Sobrato, appeared before the Commission and expressed
concern regarding the long-term plans for the property should it be sold
or rented and questioned whether the new owner would be required to live
in one of the units.
Concerns were expressed regarding the general maintenance of the property,
indicating that the residents in this area are very conscientious of
property maintenance and take a great deal of pride in their homes.
Commissioner Kasolas stated that the new owner would be required to live
on the premises in one of the units, should the property be sold.
Genevieve Baker, 666 Sobrato, appeared before the Council stating that she
has several concerns regarding privacy, in that one of the bedrooms in the
secondary unit is approximately 20 feet from her fence; secondly, the
noise level generated from the construction and the length of time
involved.

~ Neill Sams, owner of the property, appeared before the Commission to
f address concerns, indicating that one of the owners of the property will
'._ be living in one of the units and there are no immediate plans to sell the
property. He mentioned ,that a considerable amount of time and money has
been invested in the. property and will continue efforts to upgrade and
maintain the property.
Discussion ensued regarding the setback requirements and harmony of the
development with the existing neighborhood.
There was a general concensus of the Commission for Council clarification
of the ordinance regulating secondary living- units in the City and that
this item be agendized for discussion at a later date.
Bill Chivers, 571 Kenneth, appeared before the Commission to state that he
has been a resident of this area since 1951 and was not sent a public
hearing notice on this item. He indicated that due to .the fact his
property lies outside the 300 foot radius of the proposed development he
was not sent a public hearing notice; and, would like the City to change
the legal noticing requirements to include notification to property owners
within a larger radius than what is currently be used.

M/S: Kasolas, Christ - That the Planning Commission adopt the
findings as indicated in the Staff
Report of April 14, 1987 and, adopt

subject to conditions as indicated in
the Staff Report.
Discussion on the Motion:
Discussion ensued regarding the fencing requirements for this property.
Commissioner Olszewski requested that the motion be amended to include
that the property owner submit fencing plans along with landscaping plans
for approval. Both Commissioners Kasolas and Christ stated that they
would remove their motion in order to amend the motion to read:

findings as indicated in the Staff
Report of April 14, 1987, and that the
applicant submit landscaping and fencing
plans for approval; and, Adopt
Resolution No. 2453, approving UP 87-07
subject to conditions as indicated in
the Staff Report. Motion carried with
the following-roll call vote:

Commissioner Olszewski spoke in favor of the proposed project, indicating
that with fencing and landscaping plans coming back for approval, he felt
that this development would not present a large impact on the
neighborhood.
Commissioner Dickson spoke in opposition to the motion, indicating that
with a long-common driveway it appears to be like that found in an
apartment complex and is not harmonious with the surrounding residential
neighborhood. He also indicated that the secondary living unit is of a
different design.
Chairman Perrine reviewed the appeal process and indicated that if there
was anyone in the audience who wished to appeal the Planning Commission
decision, a letter would need to be submitted to the City Clerk within 10
days.

5. Scheduling of study sessions on a regular basis (5th Tues.)

As the owner of Heighten Manufacturing, a machine shop
in Campbell that shares a common wall with California
Auto Tinting and Polishing, I would like it to be known
that there are absolutely no complaints on my behalf
concerning their operation.
They are clean, thoughtful, and hardworking individuals.
I am aware there is question regarding their right to stay
at their current location.
It is my opinion that they deserve all consideration to
which they may be entitled.

Statement of Purpose:
we the owners of 661 Kenneth Ave., Nevin Sams, Neill Sams, and Tom
Landes, are proposing to add a "granny" cottage to the property in order to
provide residence for one of the owners and his future bride.
As we are sensitive to the property values of the neighborhood and
the concerns of our neighbors, we intend to apply the highest standards to
the proposed improvements, including appealing landscaping, high shrubs
against the fence along the perimeter of the back yard, contemporary arch-
itectural design, and a general layout that is not imposing and meant to

The proposed structure is to be located at the rear of our 12,750 sq.
ft. lot and contains 640 sq. ft. of living space. It will have a maximum --
height of 14 ft., and will conform to all offset requirements. The inter-
ior layout is: 1 bedroom, 1 small bathroom, 1 small kitchen, and a living
room area. A carport will be provided at the rear of the main house, aside
the garage, to allow parking out of view from the front yard. Pleasing
landscaping will be provided in front and back to help integrate the prop-
erty into a harmonious and functional living space.

Re: UP 87-07 -- 661 Kenneth Aue. -Application for a Use Permit and
approval of plans and elevations to allow the construction of a
secondary lining unit on property known as 661 Kenneth Aue. in an

We the undersigned object to the plans to construct a secondary living
unit on property known as 661 Kenneth Ave. in an R-1-10 (Single Family
Residential) Zoning District. Reasons for our objection are as follows:
• Single family Residential - As residents of this neighborhood, use
specifically chose to purchase a home and reside in a zone
designated Single Family Residential; Construction of the above
plans is in conflict with the integrity of such zone and
neighborhood.
• Property Values -Property values of a single family residential
zone will inevitably be negatively affected by the presence of
rental unit(s) in such a zone.
• Quality of Life -Approval of such plans would intrude on the
spacious rural atmosphere, quality of life, and character of the
neighborhood (increased noise and traffic, additional street
parking problems, etc.) primarily by increasing the population
and number of living unit structures for which the lots, homes
and street were designed.
• Neighborhood Character -Approval of above plans would be the
beginning of a change in neighborhood character.
' • Neighborhood Appearance -Rental unit(s) would introduce
persons of a more carefree and transient attitude towards the
appearance and atmosphere of the present neighborhood.
QUESTION: Re:21.61.030 D.1.F. - `No more than 1 dwelling unit on the
parcel shall be rented or leased." - We the undersigned would like
to know if or where the owner(s) shall reside on the parcel if the
above plan is approved. Currently 1 /2 of the current living unit is
being rented, the other 1 /2 is "said" to be occupied by the owner.
