First St., Campbell, California. ROLL CALL Present Commissioners: Dickson, Olszewski, Christ, Stanton, Fairbanks, Kasolas; Planning Director A. A. Kee, Principal Planner Phil Stafford, Planner II Tim Haley, Engineering Manager Bill Helms, Acting City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent - Commissioner Perrine. APPROVAL OF MINUTES M/S: Christ, Olszewski - That the minutes of the Planning Commission meeting of September 23, 1986 be approved as submitted. Motion carred with a vote of 5-0-1-1, with Commissioner Perrine being absent, and Chairman Kasolas abstaining due to absence from the September 23 meeting. COMMUNICATIONS Mr. Kee noted that communications received pertained to specific items on the agenda and would be discussed at that time. * * t ARCHITECTURAL APPROVALS MM 86-21 Application of Mr. William Gissler, on Gissler, W. behalf of County Sanitation District No. 4, for approval of plans and elevations to allow the construction of an office addition to an existing building located on property known as 100 E. Sunnyoaks Ave. in an M-1-S (Light Industrial) Zoning District. Commissioner Olszewski reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval. -2- Mr. Stafford reported that Staff is recommending approval, subject to conditions as indicated in the Staff Report. M/S: Dickson, Christ - That the Planning Commission approve MM 86-21, subject to conditions as indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (6-0-1). * * : MM 86-22 Application of Mr. Rodric Hansell for Hansell, R. approval of a minor modification to allow the construction of a workshop/storage room addition to an existing single family residence on property known as 1405 .Harriet Ct. in a PD (Planned Development/Low Density Residential - less than 4.5 units per gross acre) Zoning District. Commissioner Olszewski reported that this application was considered by the Site and Architectural Review Committee. The Committee is recomner::iing approval. Mr. Stafford reported that Staff is recommending approval, subject to conditions as indicated in the Staff Report. M/S: Christ - Stanton - That the Planning Commission approve MM 86-22, subject to conditions indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (6-0-1) . MM 86-24 Application of Hedley & Stark for Sahadi, F. approval of a modification to a previously approved 94-unit motel to allow the construction of a 116-unit motel with related service facilities (breakfast room, conference room, and gift shop) on property known as 1875 S. Bascom Ave. in the northerly portion of the Pruneyard Shopping Center in a C-2-S (General Commercial) Zoning District. Commissioner Dickson stated that, as a point of order, he did not think this application should be treated as a minor modification, but rather as a Site and Architectural application. He noted that the application increases the number of proposed rooms by 25$, and suggested that a condition of approval be added to provide for the applicant submitting the additional fees necessary to have the application processed as a Site and Architectural approval. -3- Mr. Stafford responded that the only difference, according to the City Attorney, between the way the Minor Modification and the Site and ~~. Architectural applications are processed is in the fee charged. There is ~ a difference of $375; however, the review process is identical, there~is ~- no public hearing, and no notification of neighbors. Commissioner Fairbanks agreed with Commissioner Dickson. Commissioner Olszewski reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval with redlining of the presented plan. Mr. Stafford indicated that initially Staff had recommended a continuance; however, the applicant has submitted a traffic report which satisfies concerns of the Public Works Department, and concerns of the Architectural Advisor were addressed at the Site and Architectural Review Committee meeting. Therefore, Staff is in agreement with the recommendation for approval. Discussion ensued regarding the tower and designated parking. Commissioner Dickson. indicated that the applicant is going to fill in the ~-ia^~- bel^~•~ the tower, and address the lower tower area which appears unfinished with textured material. The tower will be a logo for the proposed inn. Designated parking is planned for the rear area of the shopping center. Additionally, there will be no pedestrian traffic flow through the inn to the shopping center. M/S: Olszewski, Stanton - That the Planning-Commission approve MM 86-24, subject to redlining of presented plans, and subject to conditions as indicated in the Staff Report dated September 23, 1986, with an additional condition that this application be processed as a Site and Architectural application and the applicant be required to pay the additional fee ($375) . Discussion on motion Commissioner Christ stated that he is still concerned with the proposed designated parking. The parking that is supposed to be available is quite a distance from the shopping center. Commissioner Christ continued that he would like to see a more comprehensive layout of the parking for the entire center, and an improvement in the lighting to make it more conducive for people to use the outlying areas. Commissioner Christ concluded that he would not be supporting the motion, although he felt the quality of the project was excellent. Chairman Kasolas commented that in the last 12 years that he has spent looking over the parking area at this shopping center, he has only seen a parking problem one day of the year - the day after Thanksgiving. Chairman Kasolas encouraged the project, noting that it would provide jobs and necessary revenue to the community. -4- Roll Call Vote on motion r AYES: Commissioners: Dickson, Olszewski, Stanton, Kasolas NOES: Commissioners: Christ, Fairbanks ABSENT: Commissioners: Perrine. POBLIC HEARINGS TA 86-03 Public hearing to consider a proposed City-initiated text amendment to Sections 21.41.130 & 21.41.140 of the Campbell Municipal Code modifying the review procedure of applications for change of use, construction, demolition., relocation or material change in an Historic District. Mr. Haley reviewed the Staff Report for the Commission. Commissioner Olszewski questioned Item H on the revised Draft; and, the procedure for replacing items on a home in the historic district (ie. wood fr8fi° rrinaoF~s with aluminum frames) . Chairman Kasolas questioned the definition of a material change. Commissioner Fairbanks questioned Item I on the revised Draft, noting that it appears that if a homeowner needs an additional bedroom, he would have to demonstrate that he is correcting an unsafe condition or prove that the '_~ denial of the bedroom would result in an immediate hardship. Commissioner Fairbanks expressed her concern with this situation. Mr. Haley responded to the concerns of the Commission, noting that replacing maintenance items would have to be addressed by the Historic Preservation Board; and, under Item I, the word "or" would indicate that not all four items must be found, with the intent being not to preclude additions, but rather to consider that the addition is sensitive to the existing structure. Commissioner Dickson stated that the revised Draft includes subtle changes from the original Draft, and he suggested a continuance in order to allow the Commission additional review time before discussing the issue at a public hearing. Motion carried unanimously (6-0-1). * ~ ZC 86-10 Continued public hearing to consider a HPB 86-01 City-initiated zone change from R-1 (Single Family Residential) and/or P-O (Professional Office) to R-1-H and/or P-O-H (Historical Overlay Zoning District) for the Alice Avenue Neighborhood (all properties having frontage on Alice Ave.: 20 through 235 Alice Ave., 235 S. First St., 189 & 190 S. Third St., 2200 S. Winchester Blvd.). Mr. Haley reviewed this item for the Commission. Chairman Kasolas asked what the impact of adopting this district would be on the homeowners in the area. Mr. Haley responded that the district would be subject to the review procedures indicated in Chapter 21.41, as proposed under TA 86-03. Commissioner Christ. asked if the district would allow homeowners to remodel or repaint their homes. Mr. Haley indicated that the homeowner could remodel and maintain his property. Although these procedures would be reviewed by the Historic Preservation Board and commission, the ordinance does not preclude changes to the properties. Commissioner Fairbanks asked if a homeowner would be charged a fee for any procedures under this ordinance, noting that she understands that fees are not generally the concern of the Commission. Mr. Haley noted that under the present ordinance, a use permit (which is subject to a fee of $350) would be required; however, the City Council could establish a policy for waiving such fees. Chairman Kasolas asked if there was a professional office structure on Alice Avenue that is part of this application. Mr. Haley indicated that there is a hair salon on the corner, and although that particular property is not historic, it is the entrance to the street with a visual effect on the street. I_ Chairman Kasolas noted that 26 of the 41 properties on the street have historic significance, and asked if they are all the same level or grade. -6- Mr. Haley responded that the 26 properties all vary in degrees of historic significance; and, the remaining 15 properties were determined to have no historic significance at the time they were reviewed. Chairman Kasolas asked if it was usually the property owner that requested historic designation; and, if there were any tax benefits. Mr. Haley indicated that the historic designation is usually initiated by the property owner; however, this application is for a historic district. Additionally, there have been properties the City has initiated the landmark status. Staff is unsure of tax benefits for historic designation on residential properties at this time. Chairman Kasolas asked if, in light of the questions being presented by the Commission, a Negative Declaration is appropriate for this application; and, if this item has been referred to the Redevelopment Agency for comment. Mr. Haley noted that Staff's rationale for preparing a Negative Declaration is that the properties are zoned R-1 and will continue to be zoned R-1; however, any proposed changes will be more difficult to obtain. The uses remain the same, and the environmental consequences are not significant. The application has not been referred to the Redevelopment Agency in that it is not in their review area. Commissioner Stanton asked if this proposal created another hurdle for the homeowner when he tries to do something with his property. ~-- Mr. Haley responded that this is correct, although it also provides protection for people sensitive to changes along the street. Commissioner Olszewski felt that he would prefer the word "tool" rather than "hurdle", noting that the proposed ordinance may have some very positive attributes for the community from the sense of preserving its heritage; however, this item should probably be continued until there is resolution of TA 86-03. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this item. Motion carried unanimously (6-0-1). * * ~ The Commission recessed at 8:35 p.m.; the meeting reconvened at 8:50 p.m. -7- ZC 86-09 Continued public hearing to consider the Ghiai, Y. application of Mr. Yves Ghiai for a zone change from R-2-S (Multiple Family Residential) to PD (Planned Development) and approval of plans, elevations and development schedule to allow the construction of 6 townhomes on property known as 272 W. Sunnyoaks Ave. Commissioner Olszewski reported that this application was considered by the Site and Architectural Review Committee. It is the opinion of the Committee that the presented revisions address previous concerns, therefore, approval is recommended. Mr. Stafford reported that Staff is also recommending approval. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this item. No one wishing to speak, it was M/S: Stanton, Olszewski - That the public hearing on ZC 86-09 be closed. Motion carried unanimously (6-0-1) . M/S: Olszewski, Dickson - Discussion on motion That the Planning Commission recommend that the City Council accept the Negative Declaration which has been prepared for this project; and that the Planning Commission adopt the attached findings and adopt Resolutions recommending that the City Council approve a zone change from R-2-S to PD for this property, and approve a Planned Development Permit, plans, elevations, and development schedule, subject to the attached conditions. Commissioner Christ stated that he would be speaking against the motion because he felt the density of the project was too high, and because of the lack of parking on the street. Commissioner Fairbanks indicated she had the same comments as Commissioner Christ, with the additional comment that if the development along Sunnyoaks continues in this manner, it will soon be another Apricot Ave. Commissioner Fairbanks stated she would also be speaking against the motion. -8- Commissioner Dickson stated that he would be speaking in favor of the motion, although he is usually against density of this kind. He continued that the applicant has tried to address all the concerns and shows an extremely nice looking project with an interesting design which exceeds minimum setbacks. Commissioner Olszewski noted that the applicant has exceeded the required parking spaces by 2. MISCELLANEOUS SA 86-46 Sign application of Mr. Henry Hom, on Baskin-Robbins behalf of Baskin-Robbins 31 Flavors, for property known as 1720 W. Campbell Ave. in a C-2-S (Neighborhood Commercial) Zoning~Dstrict: Commissioner Olszewski reported that this appl.~cation was considered by the Site and Architectural Review Committee. The sign is actually smaller than 6.25 sq.ft., and there is presently no sign on the building itself. Therefore, the Committee is of the opinion that the proposal is acceptable and is recommending approval. M/S; Olszewski, Stanton - That the Planning Commission adopt the attached findings and approve SA 86-46 subject to conditions as indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (6-0-1) PUBLIC HEARINGS EIR 86-01 Continued public hearing to consider the Sahadi, F. Environmental Impact Report which has been prepared for the application for expansion of the Campbell. Inn, on property known as 675 E: Campbell Ave. -9- Mr. Stafford reported that the application for which this EIR is required was filed with the City on November 14, 1985. Section 21100.2 and 21151.5 of the California Public Resources Code requires the lead agency (Campbell) to complete and certify the EIR within a one-year time period. In addition,. these Sections of the Public Resources Code provide for a "reasonable extension" of this time limit "in the event that compelling circumstances justify additional time and the project applicant consents thereto." Staff is of the opinion that an extension of time to allow the preparation of an EIR is warranted due to the sensitive nature of the project. Chairman Kasolas opened the public hearing .and invited anyone in the audience to speak for or against this item. No one wishing to speak at this time, it was M/S: Fairbanks, Christ - That the Planning Commission adopt a Resolution recommending that the City Council adopt a Resolution incorporating the attached findings and extending the period of time for completion of an EIR for an additional nine months (August 14, 1987); and, that the item be continued to the Planning Commission meeting of May 11, 1987. .Motion carried unanimously (6-0-1). PD 85-12 Continued public hearing to consider Sahadi, F. the application of Mr. Fred Sahadi for approval of a Planned Development Permit and approval of plans, elevations and development schedule to allow the expansion of an existing motel accommodating 73 additional units, breakfast room, conference rooms and related service facility on property known as 675 E. Campbell Avenue in a PD (Planned Development/Commercial and Public, Semi-public) Zoning District. Mr. Stafford reviewed this application, noting that as indicated. in the previous item on this agenda, the applicant has requested an extension of time to complete the EIR for this project. With this in mind, Staff is recommending that this application be continued to the meeting of May 11, 1987. M/S: Fairbanks, Christ - That this item be continued to the Planning Commission meeting of May 11, 1987. Motion carried unanimously (6-0-1) . -10- PD 86-07 Continued public hearing to consider the- Anderson, K. application of Mr. Kurt Anderson for approval of a Planned Development Permit, plans, elevations and development schedule to allow an addition to an industrial building on property known as 190 Dillon Ave. in a PD (Planned Development/Industrial) Zoning District. Commissioner Olszewski reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a continuance. Mr. Stafford indicated that Staff is in agreement with the recommendation for continuance, and that the applicant is also in concurrence. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this item. Motion carried unanimously (6-0-1). # w MISCELLANEOIIS TS 86-04 Lands of Devland Tentative Subdivision Map - Lands of Devland Construction Co. - APN 413-78-26 & 27 - 104 & 120 Redding Rd. Mr. Stafford reviewed this item for the Commission noting that the requested subdivision map is a condition of approval under ZC 86-08. Commissioner Fairbanks commented that she would be voting yes on the map, in that she did not have a choice; however, she was of the opinion that the density of this project was too intense. M/S: Olszewski, Dickson - That the Planning Commission find the - proposed map to be in accord with the General Plan; and that the Planning Commission recommend that the City Council approve this Tentative Subdivision Map, subject to the attached conditions. Commissioner Olszewski reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending a continuance with the applicant's concurrence. M/S: Fairbanks, Olszewski - That SA 86-34 be continued to the Planning Commission meeting of November 11, 1986. Motion carried unanimously (6-0-1) . MM 86-24 S 84-06 Spiering Constr. One year review of parking - 841 & 847 McGlincey Lane - M-1-S (Light Industrial) Zoning District. Mr. Stafford reported that at its meeting of October 8, 1985, the Planning Commission approved MM 85-24, which permitted the applicant to increase the area of office use in the building from 1413 sq. ft. to 2518 sq. ft. The balance of the 8891 sq. ft. building is indicated for warehouse/manufacturing uses. A condition of the Planning Commission's approval was that the project be reviewed in one year to insure that a parking problem does not exist. Staff has inspected the site on two occasions recently, at different times of the day. At both times, there was ample parking available on the site. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. 7. PLANNING DEPARTMENT 18. A conditional use permit shall be required to permit sale of alcoholic beverages in the motel. 19.
