PC Min 09/23/1986PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA 7:30 PM MINUTES S$PTEMBER 23, 1986 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Dickson, Olszewski, Christ, Stanton., Fairbanks, Planning Director A. A. Kee, Planner II riarty Woodworth, Engineering Manager Bill Helms, Acting City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent Commissioners Perrine and Kasolas. In the absence of Commissioner Kasolas, Commissioner Dickson will act as Chairman. APPROVAL OF MINUTES Acting Chairman Dickson commented, in reference to UP 86-09 (Pg. 7), that he felt .the Commission should look at a use permit to see if it is safe, i ~ i whether or not the applicant is there; and, he requested that the minutes - of September 9, 1986 reflect this comment. Mr. Seligmann noted that it should be made clear in the record that the applicant is being treated as a member of the community, and it should be demonstrated how the use proposed is the root of the detriment. M/S: Fairbanks, Christ - That the minutes of the Planning Commission meeting of September 9, 1986 be approved as amended. Motion carried with a vote of 5-0-2, with Commissioners Kasolas and Perrine being absent. COMMUNICATIONS Mr. Kee reported that a communication has been received from the Cambrian Community Council which relates to a petition regarding White Oaks Rd., referred to under the Communications portion of this evening's agenda. The Recording Secretary read the letter from the Cambrian Community Council and the petition from the White Oaks Manor Neighborhood Watch into --~ the record. Copies of these communications are attached hereto. -2- Mr. Helms reported that the Public Works Staff has been in contact with Mr. Rudolph Herz, and a meeting has taken place with the Mayor and the City Manager, as well as other City Staff members. A strategy has been developed to deal with this problem, and Staff will be bringing a series of recommendations to the City Council for their consideration. Staff would, therefore, request that this item be held in abeyance until the Council has considered these recommendations. Mr. Dirk Bailey, 1945 White Oaks Rd., submitted additional documentation which included historic documents dated from 1968, with an overview from a resident of the area since that time. Acting Chairman Dickson announced that Mr. Woodworth would be leaving the City of Campbell for a position in San Ramon. The Commission expressed its appreciation to Mr. Woodworth for his service to the City and the Commission, and congratulated him on his promotion. * ~ S 86-16 Application of Mr. Chong Kim for Kim, C, approval of plans and elevations to allow the construction of a single family residence on property known as __ 1305 Juanita Way in an R1-10 (Single Family Residential/10,000 sq. ft. i minimum lot size) Zoning District. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval with redlining indicating a 25' front yard setback. Mr. Kee reported that Staff is in concurrence with this recommendation; the applicant is in agreement with the 25' front yard setback; and, the property is considered non-conforming because it is less than the 10,000 sq.ft. zoning placed on this area. Acting Chairman Dickson asked if the neighbors had been notified of this application. Mr. Kee indicated that under the "S" approval process, neighbors are not usually notified. M/S: Fairbanks, Stanton - That the Planning Commission adopt the attached findings and approve S 86-16 as redlined, subject to conditions as indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (5-0-2) with Commissioner ^- Kasolas and Perrine being absent. -3- S 86-17 Application of Boyd Construction Co. for Boyd Construction approval of plans and elevations to allow the construction of a single family home on property known as 961 Emory Ave. in an R-1-16 (Single Family Residential) Zoning District. ) Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval. Mr. Kee reported that Staff is also recommending approval, subject to conditions indicated in the Staff Report. Commissioner Fairbanks asked about fencing on the west property line. M/S: Stanton, Olszewski - That the Planning Commission adopt the attached findings and approve S 86-17, subject to conditions indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (5-0-2). S 86-18 Application of Frank and Diane Youngblood, Frank Youngblood for approval of plans and elevations to allow the construction of a small office building, with .access off an alley, on property known as 2210 S. Winchester Blvd. in a C-2-S (General Commercial) Zoning District. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The applicant is requesting a continuance to October 28, 1986, to address concerns expressed by Staff and the Site Committee. Mr. Kee indicated that Staff is in concurrence with the recommendation for a continuance. M/S: Fairbanks, Stanton - That S 86-18 be continued to the Planning Commission meeting of October 28, 1986. Dlotion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. The Commission directed Staff to notify the adjacent property owners regarding the proposed developed. -4- MM 86-20 Application of Mr. Howard Lamcke for Lamcke, H. approval of a minor modification to a sideyard setback from 9' to 5' to allow -~ the construction of a second story addition on property known as 348 Richlee Dr. in an R-2 (Single Family Residential) Zoning District. ) Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval as redlined. The redlining indicates a slight increase in the window area, which is at the suggestion of the Architectural Advisor. Mr. Lamcke indicated that he was in agreement with the redlining on the window element. Commissioner Christ asked about the exterior access only for the proposed second story addition, noting that this did not seem appropriate for a residential use. Mr. Kee indicated that there is nothing in the Zoning Code to prohibit thi= tlpe of access; and, the Architectural Advisor had no comments regarding the access. Commissioner Olszewski noted that a letter has been received from the adjacent property owner indicating that the proposal meets with his approval. M/S: Fairbanks, Olszewski - That the Planning Commission adopt the attached findings, and approve MM 86-20 subject to conditions as indicated in the Staff Report dated September 23, 1986. Motion carried with a vote of 4-1-2, with Commissioner Christ voting "no", and Commissioners Kasolas and Perrine being absent. MM 84-16 Request of Mrs. Dolores Sheffield for a Sheffield, D. modification to allow an addition to a previously approved flower shop in the parking lot of the Campbell Plaza Shopping Center on property known as 2371 S. Winchester Blvd. in a C-2-S (General Commercial) Zoning District. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending --- approval, subject to the submittal of revised plans for the approval of the Planning Director. -5- Mr. Kee indicated that Staff is in concurrence with the Site Committee's recommendation. M/S: Fairbanks, Christ - That the Planning Commission approve the requested modification to MM 84-16, subject to conditions indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. PUBLIC HEARINGS PD 86-02 Continued public hearing to consider the Anderson, K. application of Mr. Kurt Anderson for a Planned Development Permit and approval of plans, elevations and develoFanent schedule to allow the construction of a duplex on property known as 2.74 Everett Ave. in a PD (Planned Development/Medium Density Residential) Zoning District. Mr. Kee reported that the applicant, Mr. Anderson, is requesting a continuance on this item to the meeting of November 11, 1986. Commissioner Olszewski reported that this item, and the acceptability of the units for PD zoning, was discussed by the Site and Architectural Review Committee. Acting Chairman Dickson opened the public hearing and invited anyone in the audience to speak for or against the item. No one wishing to speak at this time, it was Di/S: Fairbanks, Christ - That the public hearing on PD 86-02 be continued, at the applicant's request, to the Planning Commission meeting of November 11, 1986. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. PD 86-07 Continued public hearing to consider the Anderson, K. application of Mr. Kurt Anderson for approval of a Planned .Development Permit, plans, elevations and -- development schedule to allow an addition to an industrial building on property known as 190 Dillon Ave. in a -- PD (Planned Development/Industrial) Zoning District. -6- Commissioner Olszewski reported that this item was considered by the Site ~! and Architectural Review Committee. Discussion included, in detail, the ~ retaining wall as well as the building. The applicant, at this time, is ~ requesting a continuance to October 14 in order to meet some of the requirements necessitated by a deepening of the retaining wall. Mr. Kee indicated that Staff is in concurrence with the recommendation for continuance. Commissioner Christ asked if this item had been referred to the Parks & Recreation Commission. Mr. Kee responded that the Parks & Recreation Commission reviewed the proposal at its meeting of September 10, 1986, and found it to be acceptable, with a condition that the landscaping be incorporated into the wall design as proposed. The plans were also referred to the Los Gatos Creekside Committee; however, no comments have been received from this Committee as yet. Acting Chairman Dickson opened the public hearing and invited anyone in the audience to speak on this item. No one wishing to speak at this time, it was M/S: Fairbanks, Christ - That the public hearing on PD 86-07 be --- continued to the Planning Commission ~ meeting of October 14, 1986 at the applicant's request. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. ZC 86-09 Continued public hearing to consider the Ghiai, Y, application of Mr. Yves Ghiai for a zone change from R-2-S (Multiple Family Residential) to PD (Planned Development}; and approval of plans, elevations and development schedule to allow the construction of 6 townhomes on property known as 272 w. Sunnyoaks Ave. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The applicant is requesting a continuance to October 14 in order to revise his plans. The revisions will include relocation of the driveway and building units. Commissioner Olszewski continued that suggestions were made by the Site Review Committee regarding density and open space; however, the applicant is diligently holding on to the proposed six units. Commissioner Fairbanks asked if the applicant was made aware of the San Tomas Policy. -7- Mr. Kee responded that the San Tomas Policy is a standard part of the application packet which applicants receive. Acting Chairman Dickson opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Ernest Cook, 282 Sunnyoaks Ave., spoke against six units, noting that he was led to believe that only 5 units are possible on the site. Mr. Cook continued that the proposed units are 3 bedroom, which means there will be families living there - and, there is no place for children to play. Additionally, Mr. Cook noted that there are parking problems because of the configuration of the street. In conclusion, Mr. Cook indicated that he is not opposed to condominiums, but rather the height of the buildings surrounding his property. Mrs. Johanna Mitrovich, 321 Sunnyoaks Ave., spoke against-the project, citing the same reasons as Mr. Cook - density, no space for children to play, and area traffic. Acting Chairman Dickson noted that the General Plan and Zoning allows the number of units that the applicant is proposing. The Planning Commission is, hocLe~~er, trying to make the development harmonious with the neighborhood. Commissioner Olszewski asked Staff what the distance is to the nearest park or school. No one else wishing to speak at this time, it was M/S: Stanton, Fairbanks - That the public hearing on ZC 86-09 be continued to the Planning Commission meeting of October 14, 1986. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. GP 86-03 Public hearing to consider the applica- Carvalho, J. tion of Mr. John Carvalho to change the Land Use Element of the General Plan from Low Density Residential (less than 4.5 units per gross acre) to Low-Medium Density Residential (6-13 units per gross acre) on property known as 1075 Hacienda Ave. Mr. Woodworth reported that the applicant has submitted a petition in support of his request; that the subject property was changed from Low Medium Density to Low Density in 1982; that the surrounding area is -8- designated Low-Medium Density and developed with duplexes; that a street dedication will be required upon development; and, under the current R-1 zoning, a total of 3 homes would be allowed. Staff is of the opinion that there is justification for the General Plan change for the following reasons: 1. Low Medium Density development (duplexes) are currently developed to the east and south of the subject property. The change would facilitate duplexes facing duplexes, as opposed to duplexes facing single family homes. 2. Hacienda Ave. is designated as a 4-lane arterial street which is generally not a desirable location for single family housing. 3. The submitted petition indicates that a majority of the adjacent residents are in favor of the change. If the change is approved, the applicant would then come back for a zone change and development plan. At the time of the zone change, Staff would only support a density that would be consistent with that of the surrounding duplexes. Commissioner Olszewski asked how it can be interpreted that duplexes are a more desirable use on this street. Mr. Kee stated that Hacienda Ave, is designed to handle the higher densities; and, because of the carrying capacity of this street, Staff can support increased density along this street. Mr. Kee noted that this property was zoned Low-Medium Density prior to the San Tomas hearings and the change in zoning to a lower density in 1982. Commissioner Christ expressed a concern .with the positioning of the lot which could allow access from the residential street, rather than from the arterial street, noting that he would hate to see the backs of duplexes (usually rental housing) facing the single family neighborhood. Mr. Kee indicated that the size of the lot would provide for design flexibility; and, development plans would have to come back to the Commission for approval. Commissioner Olszewski asked how many units would be possible under the Low-Medium Density designation. Mr. Woodworth indicated that 6-12 units would be possible, depending on the zoning. Acting Chairman Dickson expressed his concern with this type of General Plan change request, noting that, in his opinion, this was more like spot zoning or a specific change, rather than a general change. -9- Mr. Seligmann noted that there is no minimum size stipulated for a General Plan Amendment application. Mr. Kee indicated that Staff views the proposal as carrying, to the west, the zoning in the immediate area, rather than as spot zoning. Acting Chairman Dickson stated that he is looking at a street being a major area or break. Commissioner Christ asked if it would be possible to split the lot and give different designations to each portion; ie. low density to the section adjoining the single family homes, and low-medium to the portion facing Hacienda Ave. Mr. Seligmann responded that the property would have to be subdivided prior to approving any General Plan amendments. Acting Chairman Dickson opened the public hearing and invited anyone in the audience to speak on this item. Mr. Bruce Edwards, 1125 Wekiva Ave., stated that the property is an eyesore; however, increasing the density may create an even greater problem. Mr. Edwards noted that, in 1980 there was a similar request to change the zoning, and a petition with 160 signatures against the change for multiple units was presented to the Council Mr. Edwards concluded that the possibility of three individual dwellings would better fit into the area. Mr. William Frye, 1160 Sonuca Ave., stated that he is very familiar with the subject property's problems. At this time, the people living close to the site are very disenchanted and would welcome almost anything to improve the property. The neighbors have been asked to vote on the property, and they are in favor of a zone change. Mr. Frye concluded that the property is currently a detriment to the community. Commissioner Christ commented that he is aware of the problems at this location and he would like to see them taken care of also; however, he would like to see development which will not be detrimental in any way to the neighborhood. Mr. Jimmy Fox, 245 Glenridge, Los Gatos, architect representing the applicant, stated that area residents feel that new housing would revitalize the area and possibly provide housing for some young adults emerging from the area families. Additionally, Mr. Fox cited information from an article referring to the Bay Area in general, which indicated that ABAG is encouraging higher densities on certain properties. Mr. Joe Paxton, 1169 Sonuca Ave., stated that he had no objection to rezoning the property; and, noted problems with rental units in the area. -10- No one else wishing to speak, it was M/S: Olszewski, Fairbanks - That the public hearing on GP 86-03 be closed. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. M/S: Christ, Olszewski - That the Planning Commission accept the Negative Declaration which has been prepared for GP 86-03. Discussion on motion Discussion ensued regarding the implications of accepting the Negative Declaration. Mr. Seligmann explained that the Negative Declaration indicates that this proposal is not substantial enough to require an Environmental Impact Report. Commissioner Fairbanks stated that, based on the City Attorney's explanation, she will speak in favor of the motion in order to move the issue along by not requiring an EIR. Acting Chairman Dickson noted his agreement with Commissioner Fairbanks' statement. Vote on motion ~ , AYES: Commissioners: Olszewski, Christ, Stanton, Fairbanks, Dickson NOES: Commissioners: None ABSENT: Commissioners: Kasolas, Perrine M/S: Christ, Olszewski - That the Planning Commission adopt a Resolution,recommending that the City Council deny GP 86-03. Discussion on motion Commissioner Olszewski commented regarding the upkeep of the property, and noted that the property owner still has an opportunity to develop the site; however, he would prefer to see it developed at a lesser density than what is being requested. Acting Chairman Dickson noted that he is concerned about the presented petition; however, he felt that, because of the condition of the property, the area residents would sign anything. that represented a potential --- improvement. Additionally, Commissioner Dickson felt that this request was a specific change, rather than a General Plan change. He felt that -11- the entire area should be considered, not just a single lot, in that this type of change is very serious. Commissioner Dickson suggested that the ,-_- issue of general plan vs. specific plan be discussed at a study session. In conclusion, referring to statements made by Mr. Fox regarding housing availability, Commissioner Dickson .noted that Campbell has one of the best housing balances in Santa Clara County. Third St. Mr. Woodworth reported that Staff is recommending a continuance of this item because revised plans have not yet been submitted. SA 86-35 Continued sign application of Mr. Ed Arioto, E. Arioto for property known as 441 N. Central Ave. #2, in a C-1-S (Neighborhood Commercial) Zoning District. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee, and approval is being recommended. -12- M/S: Olszewski, Christ - That the Planning Commission adopt the attached findings and approve SA 86-35, subject to conditions indicated in the Staff Report dated September 23, 1986. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. SA 86-42 Continued sign application of Anastasia's Anastasia's Fitness Center for property known as 2931 S. Winchester Blvd. in a C-2-S (General Commercial) Zoning District. Mr. Kee reported that Staff is, again, recommending approval of the applicant's request, due to the proximity of his building to the street frontage and the reduced visibility of his building, as compared to the neighboring uses. Co~u issioner Olszewski stated that he viewed the lot as unique, in that it naturally attracts the eye's attention because of being recessed between two other structures. Additionally, there is already a large freestanding sign on the site. Therefore, he felt that there was not a demonstrated need for the requested square footage on the awning sign. M/S: Olszewski, Christ - That the Planning Commission deny SA 86-42, based on the following findings: (1) the applicant has not demonstrated a need for extra signage; (2) the property is unique in that it naturally attracts the eye's attention because of being recessed between two other structures, and does not necessitate additional signage; and, (3) the requested signage exceeds the square footage allowable under the Sign Ordinance. Discussion on motion Commissioner Fairbanks noted that she has difficulty considering signs that have been erected without permits, in that people in business must be aware of signing regulations and the need for permits. Commissioner Fairbanks added that she will be speaking against the motion; in that she felt that an 84 sq. ft. sign is acceptable in this case; however; she was not in agreement with the applicant's approach. -13- Vote on motion Motion carried with a vote of 4-1-2, with Commissioner Fairbanks voting "no", and Commissioners Kasolas and Perrine being absent. SA 86-43 Sign application of Hagstrom Properties Hagstrom Properties for McDuff Electronic Super Center on property known as 1658 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Commissioner Olszewski reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval based on the fact that this particular business is located approximately 280 ft. off the street, and that the sign is actually a replacement of the facing for the "Consumer's Distribution" store. Additionally, other signs in this shopping center are of similar size. Commissioner Fairbanks asked if the previous sign was approved or is in accord with the Sign Ordinance. Mr. Kee responded that the previous sign was in accord with the Sign Ordinance in effect at the time it was constructed. In this case, Staff has taken a strict interpretation of the ordinance. Commissioner Christ asked if the verbage "Super Center" is part of the business name or an identification of services. Mr. Jerry Barnes, representing McDuff Electronic, Super Center, indicated that the "Super Center" identifies a store which has been expanded to include appliances and electronic equipment, and distinguishes the gender of the store. Acting Chairman Dickson asked how many businesses are in the center, and how is the signing controlled. Mr. Kee indicated that the property owner was contacted in the past to develop a signing program for the shopping center. Commissioner Fairbanks stated that she would be in favor of a continuance on this item, noting that she is inclined to agree with Staff's recommendation for denial on this application for reasons similar to those indicated by Commissioner Christ. Mr. Barnes indicated that he would prefer a decision this evening because there is a push to open the store before Christmas. He felt that reducing the sign size would have a negative effect on the entire center. -14- Commissioner Olszewski noted that Staff's recommendation is based on the strictest interpretation of the ordinance; and, he also noted that there are other stores in the center with substantially larger signs. M/S: Stanton, Olszewski - City Council Referral Air Quality Element That the Planning Commission adopt the following findings, and approve SA 86-43: (1) The applicant has demonstrated that this business would lack adequate identification if a smaller sign was proposed; (2) The submitted plans have demonstrated that this business location is unusually difficult to locate or identify; and (3) The requested signing is consistent with existing signing in the shopping center. Motion carried with a vote of 4-1-2, with Commissioner Fairbanks voting "no", and Commissioners Kasolas and Perrine being absent. Staff Report regarding the Air Quality Element of the General Plan. Mr. Kee reported that the City Council is referring this matter to the Planning Commission for review and recommendation. Staff is recommending that neighboring jurisdictions be contacted to determine the approach being used to respond to the Air Quality District's request. The results of this survey will be presented to the Commission at the October 28 meeting; and, if the Commission determines that an Air Quality Element is desirable, then Staff would request that the Commission set January 23, 1987, as the time for a hearing to consider this matter. Acting Chairman Dickson asked Staff to look for comments from the League of California Cities on this issue. M/S: Fairbanks, Christ - That the Planning Commission direct Staff to conduct a study to determine how neighboring jurisdictions have responded to the Bar Area Air Quality Management District's request that cities consider the addition of an Air Quality Element to the General Plan; and, that this issue be continued to the Planning Commission meeting of October 28, 1986. Motion carried unanimously (5-0-2), with Commissioners Kasolas and Perrine being absent. -15- OTHER ITEMS BROUGHT UP BY COMMISSION Mr. Kee noted that there will be a Planning Commissioners' Forum on Thursday, October 30, from 4-6 p.m. Commissioner Dickson asked that the issue of General Plan and Specific Plan be scheduled for discussion at a Study Session. Council voted 8-0 to endorse the White Oaks Ma Watch's request to redesignate White Oaks Road rather than a collector Toad. to support the White and addendum Recently the nor Neighborhood as a residential The Cambrian Community Council is a public advisory group comprised of 'homeowners and residents in the south west area of•San Jose. It has made extensive efforts to contact residents in the area and has been successful in creating a forum .for those concerned about our neighborhoods. At present there are ten active •councilmembers. Members of the Council have reviewed documentation dated as early as 1968 regarding traffic problems directly impacting this neighborhood. We strongly urge some relief be afforded this community and would appreciate a recommendation from your department.
