First St., Campbell, California. ROLL CALL Present Commissioners: Dickson, Olszewski, Christ, Perrine, Stanton, Fairbanks, Rasolas; Planning Director A. A. Kee, Planner II Marty Woodworth, Engineering Manager Bill Helms, Acting City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent None. APPROVAL OF MINUTES M/S: Fairbanks, Christ - That the minutes of the Planning Commission meeting of March 11, 1986 be approved as submitted. Motion carried unanimously (7-0-0). COMMUNICATIONS Communications Referral from City Council regarding public hearing on issue of high rise buildings. Discussion ensued regarding adequate noticing of the issue of high rise buildings; time frames of the public hearings; and, the importance of doing a credible job in gathering testimony. M/S: Dickson, Fairbanks - That the Planning Commission set April 8, 1986 for public hearing on the issue of high rise buildings in Campbell. Motion carried unanimously (7-0-0). -2- ARCHITECTURAL APPROVALS S 86-02 Herr, J. Application of Mr. Joseph Herr for approval of plans to allow an addition to as industrial building, a fenced in storage area and a cargo storage container on property known as 950 Camden Avenue in an M-1-S (Light Industrial) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The Site Committee explored other ways of finding more space on the site; however, it appears that the applicant's proposal is the best. The applicant has agreed to use stucco siding to match the existing building. The Committee is, therefore, recommending approval. M/S: Olszewski, Perrine - That the Planning Commission adopt findings (attached hereto) and approve S 86-02, sub3ect to conditions (attached hereto) to include stucco siding to match existing building, and redlining of presented plans. Motion carried unanimously (7-0-0). S 86-03 Application of Mr. Fred Sahadi for Sahadi, F. approval of plans and elevations to allow the construction of a 79-room inn in the northerly portion of an existing shopping center (The Pruneyard) on property known as 1875 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Commissioner Perrine reported that this application was considered bq the Site and Architectural Review Committee. The Committee is of the opinion that this is a bold concept. The only concern expressed regards traffic circulation in the area; however, assuming these problems can be worked out, the Site Committee is recommending approval. Commissioner Dickson questioned the comments from the Building and Fire Departments. Mr. Kee indicated that, after talking with these departments, it has been determined that changes can be made to satisfy the building and fire codes. These changes would have to made prior to issuance of any building permits. Mr. Helms noted that Public Works is not recommending any requirements as a condition of approval. -3- Commissioner Perrine addressed the concerns listed in the Staff Report, noting that the inn's lobbq would be designed to allow pedestrian flow from the shopping center areas; improved vehicular patterns would be provided by breaking up some of the existing islands; the inn will operate under the same management as the Campbell Inn, thereby sharing it's .° exposure. Commissioner Olszewski noted that his recommendation on the Site Committee had been non-committal due to the traffic circulation problems around the Pruneyard, particularly on Bascom and Campbell. Avenues. Mr. Helms discussed existing traffic patterns; and, regarding the application before the Commission at this time, Staff has taken the position that prior approvals have authorized construction within the subject floor space, with the allowed use being more traffic intense that the proposed hotel; therefore, it would not be appropriate to require further mitigation measures as a result of this particular development. Commissioner Dickson asked about the maintaining of setbacks in a mixed-use development. Mr. Kee indicated that Staff views the hotel as a commercial type of use. Commissioner Christ asked if the proposal included designated parking for hotel guests, noting that he would not like to see this. Mr. Ree responded that there might need to be designated loading/unloading spaces; however, Staff would not be in favor of hotel only designated parking. Mr. Morris Stark, architect, appeared to answer any questions the Commission might have. Mr. Fred Sahadi, applicant, addressed overall Pruneyard development, ambian~ competition; existing parking layouts for designated hotel parking; impacts boundaries; signalization and traffic Avenues; and, vehicle trips. questions regarding market studies; ~e, and obsolesence; area at the center; possible proposals of development adjacent to Campbell circulation on Bascom and Campbell M/S: Perrine, Dickson - That the Planning Commission adopt the findings attached hereto, and approve S 86-03, subject to conditions indicated in the Staff Report (attached hereto). M/S: Fairbanks, Olszewski - That the motion for approval be amended to include a condition that the parking plan come back to the Commission for review if designated parking for the inn ~--- is proposed. Amendment accepted by _ Commissioners Dickson and Perrine. Y ; Motion for approval, with amendment, carried unanimously (7-0-0). -4- Commissioner Olszewski commented that it is entirely untrue that the proposed use would cause less of a traffic problem in that there already `" exists a problem without the subject area being used. However, Mr. Sahadi answered his concern by stating that there are some things in the works to correct the problem on Campbell/Union Avenues. ~: S 86-04 Application of Mr. Ned Nicholas for Nicholas, N. approval of plans and elevations to allow the construction of a single family residence on property known as 1189 Steinway Ave. in an R1-10 (Single Family Residential, 10,000 sq.ft. minimum lot size) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval per Staff Recommendation. M/S: Olszewski, Stanton - That the Planning Commission adopt findings attached hereto and approve S 86-04, subject to conditions (attached hereto) as indicated in the Staff Report. Motion carried unanimously (7-0-0). The Commission recessed at 8:45 p.m.; the meeting reconvened at 9:00 p.m. PUBLIC HEARINGS UP 86-03 Public hearing to consider the applica- P~wha, P. tion of Mr. Paul Pawha for a use permit to allow the establishment of a liquor store in an existing building on property known as 875 S. San Tomas Aquino Rd. in a C-1-S (Neighborhood Commercial) Zoning District. Mr. Woodworth reported that the applicant is requesting approval of a use permit to allow the establishment of a liquor store at 875 S. San Tomas Aquino Rd. The proposed location is in the shopping center located at the corner of S. San Tomas Aquino Rd. and Elam Ave. The building was previously occupied by an art supply store. In addition to selling liquor,the store will also rent video movies. This application was referred to the Police Department, which had no comment. Staff is of the opinion that the liquor store will not have an adverse effect on the -5- neighboring residential properties. Traffic to the store between 9:00 - p.m. and 12:00 a.m. should be light, therefore it should not disturb nearby residents. The store will close at 10:00 p.m. weekdays, thereby _. further reducing late night traffic. There is another liquor store at. the corner of S. San Tomas Aquino Rd. and Hacienda Ave. so the proposed store :: will not be the only one serving the area. Staff does propose a six month review in order to evaluate the operation. Commissioner Christ asked about the legalities of selling liquor in combination with video rentals, in that minor would be frequenting the video use. Mr. Seligmann responded that there would be no problem, in that minors are allowed to enter liquor stores; however, minor may not purchase liquor. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this item. M/S: Fairbanks, Christ - That the public hearing on UP 86-03 be closed, in that no one wished to speak. Motion carried unanimously (7-0-0). M/S: Olszewski, Perrine - That the Planning Commission adopt a Resolution, with findings as indicated in the Staff Report, approving UP 86-03, -- subject to conditions indicated in the Staff Report (attached). Discussion on Motion Commissioner Fairbanks noted she would be speaking against the motion for approval in that she is familiar with this area and has a concern about this type of use being so close to residential uses, as well as the unusual access of the store that this use is being proposed for. Commissioner Fairbanks stated that this type of use is detrimental to the safety and welfare of the community. Commissioner Christ stated the same concerns as Commissioner Fairbanks, noting that he would be noting against this motion. Commissioner Dickson noted the same concerns as previously stated, and added that he felt this type of use should be thoroughly looked at. He continued that the Alcoholic Beverage Control has decreased it's controls because of funding, and the ABC has called for increased assistance from local jurisdictions. Commissioner Dickson felt that the Commission was not getting the information it needed regarding the surrounding area, i.e. the location of churches, schools. Commissioner Olszewski asked if the food stores in the area sold liquor. Mr. Joe Alek, property owner, came forth to address questions asked by the Commission. -6- M/S: Dickson, Fairbanks - That the public hearing on UP 86-03 be re-opened to receive testimony. Motion `-- carried unanimously (7-0-0). - Mr. Alek stated that there is a food store in the shoppping center which =~ sells beer and wine only, no hard liquor. The ABC requires a certain radius where liquor sales are not allowed near hopsitals, churches, schools, etc. Additionallq, the ABC requires the applicant to notify residents within 500 feet of the store. Mr. Alec noted that no one in the area has protested this proposed use; and, the use is similar to the liquor store on Hacienda ~ San Tomas Aquino Rd., with residences nearby. He continued that the combination of liquor sales and videos is a relatively new combination, and noted that the adult videos must be kept separate from the general stock. M/S: Olszewski, Fairbanks - That the public hearing on UP 86-03 be closed. Motion carried unanimously (7-0-0). M/S: Olszewski, Perrine - That the Planning Commission adopt a Resolution, with findings as indicated in the Staff Report, approving UP 86-03, subject to conditions indicated in the Staff Report (attached). Motion carried with the following roll call vote: AYES: Commissioners: Olszewski, Kasolas, Perrine, Stanton NOES: Commissioners: Dickson, Christ, Fairbanks -- ABSENT: Commissioners: None. PD 84-06 Public hearing to consider a Development Fleischli, T. Agreement for a previously approved office/hotel complex on property known as 920 E. Hamilton Ave. in a PD (Planned Development) Zoning District. Commissioner Olszewski asked if a continuance of this item would affect the residents of the park adversely. Mr. Kee responded that any deadlines indicated in the Staff Report probably dealt with noticing procedures, and to his knowledge, there was no requirement that the park residents move out at this time. Commissioner Stanton asked if the developer could build the hotel first. Mr. Kee indicated that a change in the phasing of the proposal would require a new development schedule being approved by the Planning Commission and the City Council. Chairman Kasolas opened the public hearing and invited anyone in the _ audience to speak for or against this item. -7- M/S: Stanton, Fairbanks - That the public hearing on a Development Agreement for PD 84-06 be continued to - the Planning Commission meeting of April 8, 1986 at the applicant's request. . Motion carried unanimously (7-0-0). - ~~ Commissioner Dickson expressed a concern about the decision of the Council to accept a development agreement. Chairman Kasolas indicated that there appeared to be some urgency in the matter; however, he felt Commissioner Dickson's concerns were well-taken due to the prominence of the project. MISCELLANEOUS MM 86-08 Application of Mr. Bruno Bicocca for a Bicocca, B. modification to an existing development to construct a flower stand in the parking area of a commercial center on property known as 75 N. San Tomas Aquino Rd. in a C-1-S (Neighborhood Commercial) Zoning District. M/S: Stanton, Olszewski - That MM 86-08 be continued to the Planning Commission meeting of April 22, 1986. Motion carried unanimously (7-0-0). TS 86-02 Lands of Polyplan Tentative Subdivision Map - Lands of Polyplan, Inc. - 75 Union Ave. - APN 413-10-33. Mr. Kee reviewed this tentative subdivision map, noting that at its meeting of January 14, 1986, the Planning Commission recommended approval of the applicant's proposal to construct 13 townhomes on the subject property. The City Council, subsequently, approved-this project at its meeting of February 18, 1986. Condition 22 of that approval required the applicant to file and process a tract map for this project. M/S: Olszewski, Fairbanks - That the Planning Commission find the proposed map in conformance with the General Plan; and, that the Planning Commission recommend that the City Council approve TS 86-02, subject to conditions indicated in the Staff Report. Motion carried unanimously (7-0-0). -8- R 86-01 Request of Mr. Terry McElroy for PD 81-04 reinstatement of previous approved TS 82-16 plans for 5 townhomes, and exten- McElroy, R. sion of approval for tentative subdivision map for property known as 4i~. & 51 Mission Way in a PD (Planned Development/Medium Density Residential) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval as redlined. M/S: Olszewski, Stanton - That the Planning Commission recommend that the City Council reinstate its previous approval of this project, subject to the attached conditions and redlining of presented plans; and, that the Planning Commission recommend that the City Council grant an extension of its approval for the subject tentative subdivision map, subject to the attached conditions. Discussion of Motion Commissioner Christ stated that he would be speaking against the motion. Due to the lapse of time since the original application, he would like to see a new submittal. Commissioner Dickson noted that the application has been treated like a new submittal, and was reviewed by the Site and Architectural Review Committee. What would be different, except additional fees for the applicant? Mr. Kee responded that the applicant could resubmit the same plans--the difference would involve a public hearing. Vote on Motion Motion carried with a vote of 6-1-0, with Commissioner Christ voting "no". MM 86-OS Application of Pacific Aerospace for a Pacific Aerospace modification to approved plans to allow the construction of a storage building on a site with an existing industrial building on property known as 354 McGlincey Lane in an M-1-S (Light Industrial) Zoning District. -9- Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The water clarifying unit is a necessity for proper waste management, and if this application is denied _ the outlook for this business would be dismal. The Site committee would like to recommend approval with the added conditions as follow: '. That the applicant submit an agreement, satisfactory to the City Attorney, assuring the complete removal of the subject storage building and its equipment in the advent of Pacific Aerospace vacating the site. That the applicant agree, in writing, that parking may be inspected by Staff. Mr. Robert Dixon, applicant, responded to questions from the Commission, noting that the business would not be able to operate without the water clarifying equipment, according to water pollution authorities; there is no other location on the site to put this equipment; and, the business has 22 employees. M/S: Perrine, Stanton - That the Planning Commission adopt findings attached hereto, and approve MM 86-OS/S 69-54 subject to conditions as indicated in the Staff Report, as well as conditions indicated by the Site and Architectural Review Committee. Discussion of Motion Commissioner Fairbanks commented that she appreciated the Site Committee's attempt to deal with this situation; however, she was concerned about things being done in the City without permits. Commissioner Olszewski commented that he was willing to move ahead on this application, and that the applicant appeared to be entangled in the bureaucratic process. Chairman Rasolas stated that he will be opposing the motion because of the parking issue. He felt the Commission should be consistent with it's requirements, asking how one can accommodate 22 employees with 12 parking spaces. Additionally, Staff is recommending denial. Commissioner Dickson noted that the Site Committee considers that a workable plan has been presented, and he did not see the issue as being inequitable. M/S: Dickson, Perrine - That the motion for approval be amended to include a condition for a one year review of the parking. Amendment accepted by Commissioners Perrine and .~ Stanton. -10- Vote on Motion Motion for approval, with amendment for -- one year review, carried unanimously. (7-0-0). SA 86-02 Continued appeal of Planning Director's Play It Again Video denial of sign application for "Play It Again Video" on property known as 2091 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District. M/S: Fairbanks, Olszewski - That SA 86-02 be continued to the Planning Commission meeting of April 8, 1986 at the applicant's request. Motion carried with a vote of 6-1-0, with Commissioner Dickson voting "no". PUBLIC HEARINGS TA 86-01 Public hearing to consider a City- City-initiated initiated text amendment to revise the Zoning Ordinance of the City of Campbell. M/S: Fairbanks, Olszewski - That TA 86-01 be continued to the Planning Commission of April 22, 1986. Motion carried unanimously (7-0-0). OTHER ITEMS BROUGHT UP BY COMMISSION Chairman Rasolas requested Staff to report back on the allegation made at the last meeting regarding junk cars in parking lots on Winchester Blvd. Commissioner Dickson commented on the issue of liquor usage, noting that he has a real concern when it's combined with video rentals. Now, regarding UP 86-03 on this evening's agenda, it seems that the videos are to be adult movies. The only way the City can attack such a problem is through the use permit process. Commissioner Dickson felt that the matter should be studied further. Chairman Kasolas suggested that the City Attorney address that issue from the standpoint of the First Amendment. -11- Commissioner Fairbanks felt that the video use made the liquor use, at that location, more palatable to her because the videos go home, and the - liquor with them. This site is of particular concern because it is very near to low-income housing, thereby creating further problems in the area. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area ad3acent to the trash enclosure area to service these containers. 16. Applicant shall comply with all appropriate State and City requirements for the handicapped. PLANNING DEPARTMENT 17. Cargo storage container to be removed from property by June 10, 1986. 18. Applicant to submit plans to the Building Department for the canopy structure over the fenced-in storage area by May 1, 1986. 19. Stucco to match existing building. BUILDING DEPARTMENT 20. The building design, with modifications as recommended by the Architectural Advisor, is similar to the remainder of the Pruneyard Shopping Center. 3. The proposed motel use requires the provision of 88 parking spaces versus the previously approved retail use which required the provision of 115 parking spaces.
