PC Min 02/11/1986PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA 7:30 PM MINUTES FEBRUARY 11, 1986 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First. St., Campbell, California. ROLL CALL Present Commissioners: Olszewski, Christ, Perrine, Dickson, Kasolas; Planning Director A. A. Kee, Principal Planner Phil Stafford, Engineering Manager Bill Helms, Acting City Attorney Bill Seligmann, Recording Secretary Linda Dennis. Absent Commissioner Fairbanks APPROVAL OF MINUTES M/S: Dickson, Christ - That the minutes of the Planning Commission meeting of January 28, 1986 be approved as submitted. Motion carried unanimously (5-0-1). COMMUNICATIONS Mr. Kee noted that communications received pertained to specific items on the agenda and would be discussed at that time. Chairman Kasolas noted that Commissioner Fairbanks absence is excused due to illness in the family. ARCHITECTURAL APPROVALS S 85-18 Continued application of Mr. J. Michael Horton, M. Horton, A.I.A., for approval of plans and elevations to allow the construction of an 8-unit apartment complex ~n property known as 68 Sunnv~ide Ave. in an R-2-S (Multiple Fa;~ily Residential) Zoning District. Mr. Kee reported that the applicant has requ~-sted that this application be withdrawn. Consequently, Staff is recr,nmending a denial without prejudice so that the matter may be removed from the agenda. M/S: Perrine, Dickson - That the Planning Commission deny, without prejudice, S 85-18, at the applicant's request, and remove this item from the agenda. Motion carried unanimously (5-0-1). -a- PUBLIC HEARINGS PD 85-11 Continued public hearing to consider Morelan, J. the application of Mr. Jim Morelan, on behalf of Jovan Jovanovic, for approval of a Planned Development Permit; and plans, elevations, and development schedule to allow the construction of a building addition and a new office/auto related building on properties known as 75 Dillon Ave. and 40 & 48 Railway Ave. in a PD (Planned Development/Industrial) Zoning District. Mr. Kee reported that this application has been before the Commission since December 10, 1985 and revised plans have not been submitted as yet. Staff is recommending that the application be denied without prejudice in order that it might be removed from the agenda.. The applicant, however, has requested a continuance to May 13, 1986. There was brief discussion regarding the applicant's request, and the number of continuances already granted on this application. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this item. M/S: Perrine, Olszewski - That PD 85-11 be continued to the Planning Commission meeting of May 13, 1986 at the applicant's request. Motion carried with a vote of 4-1-1, with Commissioner Dickson voting "no", and Commissioner Fairbanks being absent. V 86-01 Public hearing to consider the applica- Krupp, J. tion of Mr. and Mrs. Jeffrey Krupp for a 5-foot variance to the sideyard setback requirement to allow the construction of a carport on property known as 174 Cherry Ln. in an R-1 (Single Family Residential) Zoning District. Commissioner Perrine reported that the Site and Architectural Review Committee reviewed the drawings and the Staff Report on this application; however, the applicant has requested a continuance and was not present at the Committee meeting. Mr. Kee explained that the property currently has an existing accessory building which has been converted into living quarters. Staff is recommending a continuance of this request so that the extent of permit approvals can be further investigated. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this item. -3- Mrs. Rosemary McCormick, 162 Cherry Ln., questioned the legality of the ~ rentable. unit in the single family neighborhood; asked about the length of time it takes to bring things into conformance in the City; and, noted a -- letter from the applicant stating his intentions to rent this converted garage. Mr. Kee explained that the structure was built prior to incorporation into the City, and that Staff needs additional information regarding possible permits for the converted garage. Regarding the setback issue for the carport, which is what will be considered under this variance request, Staff will be recommending against the variance. Mr. Norman McCormick, 162 Cherry Ln., requested that if the applicant's variance is approved, that the applicant be required to make a survey of the property line, since this abuts his property. Commissioner Perrine asked Mr. McCormick what his opinion would be of the requested setback variance for the carport, if everything else on the property is found to be legal. Mr. McCormick responded that he would not be opposed to the setback variance. Mr. Frank Corral, 137 Cherry Ln., asked what would happen to the additional living unit, on the assumption that there are no permits for it. He noted that he has a similar situation next door to him, and neither the City Council nor the inspectors saw fit to have the structure changed back to a garage. Mr. Kee indicated that with regard this V 86-01, steps have already been taken to inform the property owner that permits should be presented which authorize the garage conversion, otherwise the structure will have to be converted back to it's original use. Mr. Kee noted that in the case cited by Mr. Corral the permits were for a different use. Chairman Kasolas noted to the audience if there were problems in their neighborhood, they should cite the instances and report the alleged discrepancies to the Planning Department. M/S: Perrine, Christ - That V 86-01 be continued to the Planning Commission meeting of March 11, 1986 so that additional information can be provided. Motion carried unanimously (5-0-1). MM 85-26 Continued application of Mr. Jim Rueter Rueter, J. for a modification to approved plans to make exterior modifications to an existing building and to convert a portion of the building from storage use to office use on property known as 155 E. Campbell Ave. in a PD (Planned Development/Commercial) Zoning District. -4- Mr. Stafford reported that, in response to concerns expressed by the Planning Commission, Staff is of the opinion that the desires of the Commission for a formal public hearing with notice to surrounding property owners, and a referral to the City Council, could be accomplished with a Use Permit application. Mr. Jim Rueter, applicant, stated his agreement with Staff's recommendations. M/S: Dickson, Perrine - That the applicant resubmit his request in the form of an application for approval of a Use Permit; and, that the $250 already paid by the applicant be applied as partial payment for the Use Permit filing fee. Motion carried unanimously (5-0-1). SA 86-08 Sign application for Sleek Travel on Sleek Travel property known as 900 E. Campbell Ave. in a PD (Planned Development/Commercial) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. A continuance is being recommended at the applicant's request. M/S: Olszewski, Christ - That SA 86-08 be continued to the Planning Commission meeting of March 11, 1986 at the applicant's request. Motion carried unanimously (5-0-1). SA 86-09 Sign application for Norman Paul's Print Center Print Center on property known as 2275 S. Winchester Blvd. in a C-2-S (General Commercial) Zoninq District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The Committee is recommending approval, subject to redlining of presented plans indicating the addition of wood trim for a "Spanish" motif to tie sign in with the building; and subject to the revised plans coming back for the Planning Diretor's approval upon recommendation of the Architectural Advisor. M/S: Dickson, Christ - That the Planning Commission adopt finding as indicated in the Staff Report and approve SA 86-09, subject to redlining of the presented plans indicating the addition of wood trim, as well as conditions indicated in the Staff Report. Motion carried unanimously (5-0-1). -5- MM 86-02 Application of Mr. Jack Weymer, on Mervyn's Store behalf of Mervyn's Store, for a modification to PD 72-09 to allow the placement of 13 storage containers on property known as 950 W. Hamilton Ave. in a PD (Planned Development/Commercial) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The applicant indicated that Mervyn's is very seriously contemplating a building addition. Mr. Weymer is essentially asking for a short term approval to allow him time to come back with plans for the proposed addition. The Site Committee is recommending a continuance to May 14, 1986 with the understanding that if these plans are not forthcoming, the request for the storage containers be denied. Commissioner Olszewski noted that the applicant indicated that the proposed expansion plans are somewhere in the corporation's bureaucracy, and this is why the Site Committee is recommending a 90-day continuance. Commissioner Dickson suggested that the Mervyn's organization knew how to move faster than what it being proposed. Commissioner Dickson noted that the subject of storage containers is a sensitive issue and the policy should be equally enforced. He proposed a 30-day continuance, rather than 90-days. M/S: Dickson, Christ - That MM 86-02 be continued for 30 days in order that Mervyn's might submit plans for a proposed addition to it's Campbell facility. Motion carried with the following roll call vote: AYES: Commissioners: Olszewski, Christ, Dickson NOES: Commissioners: Perrine, Kasolas ABSENT: Commissioners: Fairbanks Mr. Kee spoke of the excellent cooperation of Mr. Weymer with Staff, noting that Staff is of the belief that the applicant will make every effort to provide the subject plans in a timely manner. Chairman Kasolas noted Mervyn's service to the community. SA 85-51 Continued sign application of Mr. Mukuno, D. Douglas Mukuno for property known as 2970 S. Winchester Blvd. in an M-1-S (Light Industrial) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The Committee is in agreement with Staff's recommendation as indicated in the Staff Report. -6- M/S: Perrine, Olszewski - That the Planning Commission adopt findings as indicated in the Staff Report, and (1) approve the 84 sq.ft. sign reading "California Auto Polishing/Tint Shop"; (2) deny the 32 sq.ft, sign reading "California Auto Polishing/tint Shop"; and (3) approve the 32 sq.ft. sign reading "P.E.I. Automobile Accessories", subject to the applicant obtaining any necessary building permits. Motion carried unanimously (5-0-1). SA 86-02 Continued appleal of Planning Director's Play It Again Viedo denial of sign application for "Play it Again Video" on property known as 2091 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The Committee met with the applicant and his attorney, and tried to present to them that the Committee would really like to see a new signing proposal, rather than a continuance of the existing one. They indicated that they would approach -- the other tenants in the building and try to work something out; therefore, a continuance is being recommended. M/S: Olszewski, Perrine - That SA 86-02 be continued to the Planning Commission meeting of March 25, 1986 in order that the applicant might work out a signing program with other tenants in the building. Motion carried unanimously (5-0-1). SA 86-06 Continued sign application of Mr. Fred Razzamatazz Washington, on behalf of Razzamatazz Hair Design Studio, for property known as 2188 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Mr. Kee reported that Staff is of the understanding that the applicant has contacted the new adjacent tenants, however they have not pursued a signing program at this time. Staff would recommend a continuance because Staff is of the opinion that a signing program is important for-this development. Mr. Perrine noted that the applicant does not have a sign up at this - point. The Site Committee asked him to work with the other tenants. Mr. Fred Washington, applicant, noted that he has spoken with the adjacent tenants and they are not able to pursue a signing program at this time because of the expense. Mr. Washington continued that he would like to go -~- ahead with his proposed sign, and would have no problem with the other tenants adding on to his sign when they were able to do so. The sign is designed to allow additional tenants without enlarging the size. Commissioner Olszewski questioned the size of the sign's foundation, noting that the Site Committee has discussed the foundation being lowered. M/S: Olszewski, Christ - Staff Report That the Planning Commission adopt the findings as indicated in the Staff Report and approve SA 86-06, subject to conditions as indicated in the Staff Report as well as the revised plans coming back to Staff for final approval (showing a lower height for the foundation); and, a condition that the applicant submit a letter indicating his willingness for other tenants to add on to his sign. Motion carried unanimously (5-0-1). Staff Report regarding setting date for public hearing to consider proposed amendments to the Zoning Ordinance. M/S: Olszewski, Perrine - That the Planning Commission set the date of March 25, 1986 for public hearing on proposed amendments to the Zoning Ordinance. Motion carried unanimously (5-0-1). OTHER ITEMS BROUGHT UP BY COMMISSION There was discussion regarding the proposed referendum regarding building heights, and the Planning Commission's possible involvement in the procedures. It was the consensus that the Commission might have valuable input on the issue for the Council, and suggested that perhaps a memo to the Council offering the Commission's assistance might be appropriate. M/S: Dickson, Perrine - That a memo be sent to the City Council suggesting that the Planning Commission could provide service to the Council on obtaining information from the Commission and/or the public on the height limitation issue, if the Council so desires. The proposed sign uses compatible materials to the building materials. 2. The requested sign height is not excessive and is needed to achieve a reasonable exposure for this sign. 3. The requested 30.7 sq. ft. sign area is 20 sq. ft. less than the maximum permitted. CONDITIONS OF APPROVAL 1. Applicant to submit a revised sign design incorporating wood treatment into the sign design. 2. Applicant to obtain any necessary building or electrical permits. That the applicant's signing proposal is compatible to the scale and architecture of this project. 2. That the proposed wall sign square footage of 84 sa.ft. can be supported due to the size of the building and the distance of 175' to the street frontage. CONDITIONS OF APPROVAL FILE NO: SA 85-51 APPLICANT: MUKUNO, D. SITE ADDRESS: 2970 S. WINCHESTER BLVD. P.C. MTG.: 2-11-86 1. Applicant to obtain any necessary building permits. FILE NO.: SA 86-06 ADDRESS: 2188 S. BASCOM AVE. APPLICANT: RAZZAMATAZZ P.C. MTG.: 2-11-86 RECOMMENDING FINDINGS 1. The proposed freestanding sign is architecturally compatible with the existing buildings on this site. 2. The proposed square footage of 13.35 sq, ft. and sign height of 5 ft. is substantially less than the permitted 26 sq. ft. and 14 ft. height. 3. Due to the 130 feet of frontage on Bascom Ave. and the size of the proposed sign, a second freestanding sign can be supported. CONDITIONS OF APPROVAL 1. Any additional freestanding signage for this project must be accomodated on the proposed sign. 2. The phone number shall be removed from the signing proposal. 3. Applicant to obtain any necessary building permits. - 4. Applicant to submit revised plans indicating a reduction in the height I of the sign foundation. 5. Applicant to submit a letter indicating his willingness to work with other tenants to add their sign when appropriate.
