MINUTES AUGUST 27, 1985 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Perrine, Christ, Olszewski, Toshach, Dickson, Fairb auks; Planning Director A.A. Kee, Principal Planner P.J. Stafford, Engineering Manager Bill Helms, Acting City Attorney Bill Seligman, Recording Secretary Louise Pena. Absent Commissioners: Kasolas (Arrived after roll call - 7:35•p.m.) APPROVAL OF MINUTES M/S: Dickson, Christ - That the Planning Commission minutes of the August 13, 1985 Planning Commission meeting be approved with the following amendment: Page 14 - Second Paragraph... "Public Works was asked to check out the intersections of Bucknam & Sonuca and Peggy & Bucknam for visibility vroblems." Motion carried unanimously (7-0-0). COMMUNICATIONS Mr. Kee noted that communications received vertain to specific items on the agenda and would be discussed at that time. Chairman Fairbanks advised the Commission that a letter from the City of Sunnyvale was received pertaining to amendments that were adopted to that city's General Plan. Commissioner Dickson asked that consideration be given regarding the cancelling of the 2nd meeting in September, due to the City Council meeting schedule being amended. Discussion ensued regarding the feasibility of cancelling the Planning Commission meeting on September 24, 1985. Mr. Kee advised that Staff would have to take action to notify any applicants that would be affected by the cancellation. -Z- COMMUNICATIONS - Contd. M/S: Dickson, Kasolas - That Staff be directed to take necessary action to cancel the Planning Commission meeting, of September 24, 1985; and that public hearing notices be amended to re- flect the amended meeting schedule. Motion carried unanimously (7-0-0). Chairman Fairbanks asked that a letter from Cathy and Brad Loewen, 1391 Hoffman Lane, Campbell, and a petition submitted by the neigh- bors of 175 Redding Road regarding Item ~~3, ZC 85-06, be entered into the record. ARCHITECTURAL APPROVALS R 85-02 Continued request of Mr. Paul McAllister S 84-10 for previously approved plans and eleva- McAllister, P. tions allowing the construction of an industrial building on property known as 1025 Florence Way in an M-1-S (Light Industrial) Zoning District. Mr. Kee reported that this item was continued from the previous Planning Commission meeting of .Tu1y 23, 1985, so that additional information could be provided regarding a PG&E easement on this property. Commissioner Christ reported that this request was considered by the Site and Architectural Review Committee. The Committee is recommending approval, subject to the Conditions of. Approval. Motion carried unanimously ~ ~ PUBLIC HEARINGS PD 85-06 Continued public hearing to consider .the Hester, L. application of Mr. Larry Hester ,for a Planned Development Permit and approval of plans, elevations and development schedule to allow the construction of a warehouse building on property known as 86 Railway Ave. in a PD (Planned Develop- ment/Industrial) Zoning District. -3- • PD 85-06 ` Hester, L. (Cont'd.) Mr. Kee asked that the Commission refer to the applicant's letter of August 15, 1985, in which he is requesting the opportunity of reviewing the project with the Commission, in hopes of obtaining their input or objectives for the project at 86 Railway Avenue. After discussion, Commissioner Kasolas advised the applicant that the Commission can only review applications as they come forward for approval; and that to make a determination before revised plans or a focused EIR could be prepared would be inappropriate. He further indicated that the applicant's request could not be granted in that it would be asking the Commission to take part in the design of the project. Mr. Larry Hester, 400 Industrial St., Campbell, applicant for this proposal, appeared before the Commission to speak in favor of his project indicating that his project would provide aesthetic improve- ment in this location. Mr. Hester further stated that with clari- fication from the Commission as to their objectives for this property, he could come back to the Commission with revised plans that would be more compatible to their objectives. Chairman Fairbanks suggested that the applicant meet with Staff to discuss. various alternatives for his proposal prior to considera- tion by the Planning Commission. Mr. Hester expressed concern regarding the expense of obtaining a focused EIR and stated that he would rather redesign and come back with revised plans. Commissioner Kasolas asked when the applicant would be able to report back to the Commission with revised vlans. Mr. Hester advised that the October 8, 1985 Planning Commission meeting would be agreeable to him. Motion carried unanimously (7-0-0). ~ ~ ~ ZC 85-06 Continued public hearing to consider the Kunkel, B. application of Mr. Brad Kunkel for a zone change from R-M-S (Multiple Family Resi- dential) to PD (Planned Development), and approval of plans, elevations and develop- ment schedule to allow the construction of 27 townhomes on property known as 175 Redding Road. - 4- ZC 85-06 Kunkel, B. (Cont'd.) Commissioner Christ reported that this item was heard before the Site and Architectural Review Committee. The Committee is recom- mending a continuance to the Planning Commission meeting of September 10, 1985. Mr. Kee advised that Staff is in accord with the Committee's recom- mendation. Commissioner Christ cited several concerns brought up at the Committee level regarding setback along the property line, garage setback, density and also concern regarding trees on the property. Mr. Christ indicated that some of the trees are dead and would be removed. The applicant has also requested a color change. Mr. Christ advised that the applicant felt that he could deal with Staff's .recommendations and would like to come back to address these concerns. The applicant is in agreement with a continuance to September 10, 1985 and would like an opuortunity to address these concerns . Chairman Fairbanks opened the public hearing and invited anyone in the audience to speak for or against this item. - Mr. Gene Riggs, 205 Redding Road, Campbell spoke in regard to fencing along Hoffman Lane and requested that consideration be given to installing curbs and gutters to facilitate drainage on the lower part of Hoffman Lane . Mr. Brad Loewen, 1391 Hoffman Lane, spoke against this project citing parking concerns, negative impact on the neighborhood of Hoffman Lane; indicating that several of the condominium units would have an un- restricted view into his property. Principal Planner indicating Stafford reviewed these findings for the Commission, that this item was continued from the meeting of August 13, 1985, in order that the applicant could submit a revised proposal. The applicant has submitted a revised proposal indicating a planter area which blocks off the driveway of the right half of the four car garage. Mr. Stafford further stated that there was concern regarding visibility when backing out of the right side driveway. The revised proposal as submitted mitigates these concerns. Chairman Fairbanks opened the public hearing and invited anyone in -the audience to speak for or against this item. Mr. Frank Anzalone, 1020 Hedegard Avenue, Campbell, spoke in favor of the proposed application. Several concerns were expressed by the Commission regarding the possibility of redesigninidered,vroject in order that a variance would not have to be cons Mr. Anzalone indicated that he felt that his proposal would be a major improvement to his property. Campbell spoke in favor of Mr. James C. Malone, 1021 Hedegard Ave., the proposed project citing aesthetic improvement to the neighborhood. M/S: Toshach, Dickson - That~ed unanimouslyr(7gOb0)closed. (Cont'd.) Commissioner Toshach requested a legal interpretation regarding variance requirements. Acting City Attorney Seligman responded. Commissioner Dickson stated that he is in disagreement with Staff's recommendation, and could not see that the applicant is suffering an undue hardship in this case and felt that revised plans could be submitted. Commissioner Perrine suggested that other design solutions be ex- plored and would not be in favor of supporting Staff_'s recommendation. Commissioner Kasolas indicated that the Commission should consider this proposal on its own merit; and not place such a strong emphasis on whether hardshiv has been incurred by the applicant. Commissioner Kasolas made reference to past actions by the Commission on variance approvals, wherein if there were no objections by the neighborhood then usually the Commission would-move forward with the proposal and grant the variance. He further asked that the Commission unite on these issues and consider the application solely on its merit and not necessarily adhere to a strict constructionist viewpoint. Commissioner Toshach stated that he would support Staff's recommen- dation and vote in favor of the proposed project. Mr. Kee advised the Commission. that Staff has recommended continuance on this item to the meeting of September ~4t 1985; however, action was taken by the Commission to cancel the afore- mentioned meeting; so therefore would recommend continuance to the meeting of October 8, 1985. Commissioner Christ advised that this item was- heard by the Site and Architectural Review Committee. Gerald Biblex fox a Bibler, G. modification to approved plans to allpw the placement of 4 cargo storage containers and the conversion of a portion of an exis- ting building to office use on property known as 520 Westchester Dr. in an 1~-1-S .(.Light Industrial) Zoning District. Commissioner Christ reported that this item was heard before the Site and Architectural Review Committee. The Committee is recom- -8- MM 85-20 Bibler, G. (Cont'd.) mending approval of this application for one year, subject to the Conditions of Approval. Commissioner Christ advised that Condition ~kl should be amended to read: 1. Prior to placement of containers on property, applicant to submit an agreement, satisfactory to the City Attorney, stating that the containers will be removed within one (1) vear (by August 27, 1986) . Principal Planner Stafford reviewed the application indicating that a storage unit was placed on the north side of. the subject property without permits. The owner of the property was notified to remove the structure or submit application. The owner deter- mined that it was not feasible to bring the structure up to building code and therefore plans to remove it. In order .to house the equipment he has stored in the building, he is proposing to - locate 4 cargo containers on the property. Mr. Stafford further indicated that according to ordinance, approval of cargo storage containers is a temporary approval for a period of one year. The proposed storage units would be located on the south -', side of the property to the rear. They are hidden from view by a building on the adjacent property. The applicant is also proposing to convert a portion of the industrial building to office. Commissioner Toshach expressed concern regarding the possibility of the applicant eventually allowing the storage containers to remain on the property as a permanent fixture and stated that he could not support Staff's recommendation. He indicated that stronger verbage on time limit should be included ~,n the condition of approval. Mr. Kee advised that the condition of .approval, as it is stated, allows for the period of one year only and that .should a violation occur in this.~instance the applicant would be cited. Commissioner Toshach stated that he felt that this application in effect is being considered as a variance, wherein within one year the applicant could reapply, thus making it a permanent situation. M/S: Kasolas, Perrine - That-the Planning Commission adopt the findings. as indicated in Exhibit A and approve the placement of 4 cargo containers subject to the Conditions of Approval. Motion carried with a vote of 6-1-0, Commissioner Toshach voting "no". ~ ~ ~ -9- MM 85-21 Application of Ms. Betty Atencio for a SA 85-34 sign and minor modi~fi~catimns to building Atencio, B. on property known as 275 E. Campbell Ave. (The Silver Buckle) in a PD (Planned Development/Industrial) Zoning District. Modifications: Commissioner Christ advised that this item was heard before the Site and Architectural Review Committee. Commissioner Christ reported that the Committee is not making a recommendation at this time as the applicant was not present at the meeting. The Archi- tectural Advisor indicated at the Site meeting that he had concerns regarding the added windows and felt that they are not architecturally compatible. Commissioner Perrine suggested that due to the .concerns of the Site and Architectural Review Committee that this item be continued, in order that the applicant can respond. M/S: Kasolas, Toshach - That the Planning Commission approve the modifications to the building, subject to the Conditions of Approval. Motion failed with the following roll call vote: AYES: Commissioners: Kasolas, Perrine, Toshach NOES:- Commissioners: Christ, Olszewski, Dickson, Fairbanks ABSENT: Commissioners: None Discussion: Commissioner Dickson expressed concern regarding the position of the Commission in approving building modifications. and signage on an application without the applicant receiving prior City approval. Commissioner Kasolas indicated that the applicant has made changes which enhance the appearance of this otherwise unattractive building; and has been notified of~the violations and has applied for the necessary applications. Commissioner Toshach stated that he could support the modifications and signage as recommended by Staff and felt that the. application should be considered on its own merits, and would support a motion to continue this item in order that concerns could be addressed. Signing: Commissioner Christ reviewed the concerns o.f the Site and Archi- tectural Review Committee regarding signage. Principal Planner Stafford reviewed Staff's recommendation for the -10- MM 85-21 SA 85-34 Atencio, B. (Cont'd.) Commission indicating that Staff could support the substitution of the front awning sign for the previously approved 48 sq.ft. sign. However, Staff cannot support moving the 48 sq.ft. sign to the side of the building. M/S: Dickson, Christ - That MM 85-21 and SA 85-34 be continued to the Planning Commission meeting of_ September 10, 1985 in order that the applicant could address the concerns of `the Site and Architectural Review Committee. Motion carried with a vote of 6-0-1, Commissioner Kasolas abstaining. ~ ~ ~ SA 85-36 Sign .application of Joe Escobar Diamonds, Escobar, J. C.C.A., on property known as 990 E. Hamilton Ave. in a C-2-S (general Commercial) Zoning District. Commissioner Christ reported that this item was heard before the Site and Architectural Review Committee. The Committee is recom- mending. approval subject to Conditions of Approval. Principal Planner Stafford reported that the applicant is requesting approval of signage to identify 3 tenants o.f an existing building located on the southwest corner of S. Bascom Ave: and E. Hamilton Ave. The building is currently occupied by Citti florist which has a freestanding sign and a wall sign which was previously approved by the Planning Commission. The applicant at this time is requesting approval of_ six wall signs. Three of the proposed signs would be placed on the stairwell facing S. Bascom Avenue. The proposed signs would be individual channel letters with a green face and a white return. Mr. Stafford stated that Staff is recommending approval of the applicant's request in that the signage as proposed complies with the ordinance require- menu and is in Staff's opinion architecturally compatible. M/S: Toshach, Olszewski - That the Planning Commission approve SA 85-36 on property known as 990 E. Hamilton Avenue. Motion carried unanimously (7-0-0). ~ ~ ~ _11- Request Request of Mother of Perpetual Help Church for an extension of time for the use of two temporary structures on proerty known as 110 W. Latimer Ave., in an R-3-S (Multiple Family Residential) Zoning~District. Mr. Kee advised that the Staff recommendation is to grant a six-month extension, subject to Conditions of Approval. Mr. Kee indicated that at the Planning Commission meeting of October 25,.1983, it granted a one-year approval for the use of two trailers to be used as meeting rooms for the church. These trailers are located in the rear of the perking area of the church. At the Planning Commission meeting of March 12,..1985 the Commission granted an extension until August 26, 1985. At this time the applicant has submitted a letter requesting that the trailers be allowed an indefinite period or at least until the church can find a new location. Discussion ensued regarding the kind of uses allowed for this type of structure as pertains to school use versus church use. Commissioner- Dickson inquired if it would be possible to allow the same use for the church as would be allowed for a school. Mr. Kee responded that the school use falls under a different state .law and would not apply to church use in this case. Commissioner Kasolas asked if the applicant would be more comfortable with a recommendation of one or two years. Mr. Richard Ahern, 2969 Vivian Lane, Campbell, stated that a longer period would be more agreeable. Mr. Aheren further stated that the structures are being used as classrooms on a parttime basis. M/S: Perrine, Toshach - That the Planning Comnmission grant the request of the Mother of Perpetual Help Church for an extension of 6-months for the use of two temporary structures on ..property known as 110 W. Latimer Ave., subject to Conditions of Approval. Motion carried unanimously (7-0-0). M/S: Kasolas, Toshach - That the Planning Commission amend the extension to a period of 12-months for the use of two temporary structures on property known as 110 W. Latimer Ave. Motion carried unanimously. (7-0-0). Staff was requested to report back at the October 8, 1985 Planning Commission meeting.
