First St., Campbell, California. ROLL CALL Present Commissioners: Kasolas, Perrine, Christ, Toshach, Fairbanks; Planning Director A. A. Kee, Principal P. J. Stafford, Engineering Manager B. Helms, Acting City Attorney B. Seligmann, Recording Secretary L. Dennis. Absent APPROVAL OF MINUTES Commissioner Dickson. MJS: Perrine, .Christ - That the minutes of the Planning Commission meeting of March 12, 1985 be approved with the following amendments: Pg. 6, para. 2 - Add: the validity of the presented 10.5 trip ends per hotel room--with one parking space per room; and the EIR submitted would result in a very awkward, at best, pedestrian detour across Hamilton Avenue. Pg. 6, Add to end of page: Commissioner Toshach stated that the questions as to whether that distribution was appropriate to the study were not answered to his satisfaction. notion carried unanimously (5-0-1). Kee noted that the Commission has received a letter from the City of Saratoga regarding a meeting on April 11, 1985 at 4:00 p.m.; as well as a communication from a landscaping architectural firm requesting that it be added to the consultant list. Other items of communication received pertain to specific items on the agenda and will be discussed at that time. -z- ARCHITECTURAL APPROVALS S 85-03 Continued application of Mr. Jerry Schweitzer, J. Schweitzer for approval of plans and elevations to construct two office/warehouse buidings on properties known as 898 McGlincey Lane and 184 Veitenheimer Lane in an r1-1-S (Light Industrial) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee. The applicant has agreed to ,. correct parking problems as well as address concerns brought up by the Architectural Advisor regarding the roof-mounted equipment. These items are addressed with Condition 1 requiring revised elevations and site plan to come back to the Site Committee. Therefore, the Committee is recommending approval. Commissioner Kasolas noted past difficulties with machine shops operating adjacent to residential areas. bir. Kee indicated that Condition 7 requires the applicant to submit a letter, satisfactory to the City Attorney, limiting the use of the property. There are no provisions for a machine shop at this location. Commissioner Kasolas noted that this satisfied his concern. Chairman Fairbanks asked about the ingress/egress for the site; and the zoning for the adjacent properties. Commissioner Christ noted that there is an ingress/egress on McGlincey Lane as well as on Veitenheimer Lane. Additionally, there will be no parallel parking near the access to Veitenheimer Lane. bir. Kee added that the surrounding zoning is M-1 (Light Industrial); and, this project is in keeping with the surrounding light industrial uses along McGlincey Lane. M/S: Kasolas, Toshach - That the Planning Commission accept the Negative Declaration which has been prepared for this project; and That the Planning Commission approve S 85-03, subject to conditions indicated in the Staff Comment Sheet (attached hereto), as well as red-lining of the presented plans. Motion carried unanimously (5-0-1). _ -3- S 85-04 Application of Mr. Jim Lyle for ____ Lyle, J, approval of plans and elevations to allow the construction of a 12-unit addition to an existing apartment building on property known as 150 W. Rincon Ave. in an R-2-S (Multiple Family Residential) Zoning District. Commissioner Christ reported that this application was considered by the Site and Architectural Review Committee, and the Committee is recommending approval. Chairman Fairbanks asked if the plans presented this evening were the same exact plans that were presented in 1978, Mr. Jim Lyle, applicant, stated that the plans have a small change with the addition of 2' to one of the upper bedrooms; however, there is no change in the building elevations or lot coverage. There is also a small change in the parking layout. In response to a question from Commission Fairbanks regarding the balcony projections, Mr. Lyle indicated that the balconies project from the building approximately 4', and are approximately 10' from the rear property line. M/S: Kasolas, Christ - That the Planning Commission approve S 85-04, subject to conditions indicated in the Staff Comment Sheet (attached - hereto). Motion carried unanimously (5-0-1). PUBLIC HEARINGS UP 85-02 Public hearing to consider the applica- Sahadi, F, tion of Mr. Fred Sahadi for a use permit to allow the sale of beer and wine on property known as 675 E. Campbell Ave. (The Campbell Inn) in a PD (Planned Development/Commercial) Zoning District. Mr.Kee reported that the applicant is requesting approval of a use permit to allow the sale of beer and wine to motel guests. It is stressed that the beer and wine would be available to motel guests in their rooms only, and that no bar or lounge is proposed which would attract the public. Mr. Kee continued that the Police Department has no comments on this application; and, Staff is of the opinion that the use will not be detrimental to the area or the City, and is therefore recommending approval. Chairman Fairbanks opened the public hearing and invited anyone in the audience to speak for or against this item. -4- M/S: Toshach, Christ - That the public hearing on UP 85-02 be closed. Motion carried unanimously (5-0-1). M/S: Kasolas, Toshach - Discussion of Motion That the Planning Commission adopt Resolution No. 2325 approving UP 85-02, subject to the condition that the beer and wine shall only be made available to motel guests in their rooms, and no bar/lounge be available to the public. Commissioner Christ expressed a concern that the beer and wine not be displayed or accessible to the general public, and should be limited to room service only. Chairman Fairbanks noted her agreement with Commissioner Christ. Commissioner Kasolas indicated that this approval is for a use permit which would allow the Commission to review the situation if problems should arise. Third St. in a PD (Planned Development/Medium Density Residential) Zoning District. Commissioner C hrist reported that this item was considered by the Site and Architectural Review Committee; and, with the concurrence of the applicant, the Committee is recommending a continuance to the meeting of April 9, 1985. Mr. Kee indicated that Staff is in agreement with the recommendation for continuance. Chairman Fairbanks opened the public hearing and invited anyone in the audience to speak for or against the item. -5- P4/S: Christ, Perrine - MISCELLANEOUS That the public hearing on PD 85-02 be continued to the Planning Commission meeting of April 9, 1985. Motion carried unanimously (5-0-1). MM 85-03 Continued application of Mr. Lesley Moresco, L. Moresco for approval of elevations to add a roof element to an existing office building on property known as 125 E. Sunnyoaks Ave. in an M-1-S (Light Industrial) Zoning District. tdr. Kee reviewed this application for the Commission, noting that Staff and the Architectural Adivsor are of the opinion that the proposal to add a new roof to an existing building is acceptable. Staff is recommending approval, subject to conditions as indicated in the Staff Comment Sheet. Commissioner Toshach asked about the term "new attic" as indicated on the ,plans; and, about the provision of parking facilities for alternative methods of transportation (ie bicycles). -Mr. Kee responded that this is a minor modification so the existing parking situation would not change. Additionally, the attic is an uninhabitable area which will be housing roof equipment. It is actually the construction of a completely new roof over the top of the existing one. M/S: Perrine, Christ - TS 85-02 Crafford, w. That the Planning Commission approve MA4 85-03, subject to conditions indicated in the Staff Comment Sheet (attached hereto). Motion carried unanimously (5-0-1). Tentative Subdivision t9ap - Lands of Crafford - 175-195 P7. Rincon Avenue - APt7 305-31-1 & 2. Mr. Kee reported that approval of this tentative subdivision map, allowing the conversion of 9 apartment units to condominiums, expired May 4, 1984. Consequently, the applicant is requesting reapproval of this map. Staff is recommending approval. -6- !i/S: Christ, Kasolas - SA 85-06 Hancock Fabric That the Planning Commission recommend that the City Council approve this Tentative Subdivision Map, subject to conditions as indicated in the Staff Comment Sheet (attached hereto). Motion carried unanimously (5-0-1). Continued signing request - Hancock Fabric - 651 [~1. Hamilton Ave. - PD (Planned Development/Commercial) Zoning District. Commissioner Christ reported that this item was considered by the Site and Architectural Review Committee. The applicant has agreed to lower the sign to bring it more into conformance with the signing ordinance. The Site Committee is recommending approval. Responding to a question from Commissioner Perrine regarding pruning of street trees in this area, Mr. Helms indicated that the subject tree (Australian .Willow) do not lend themselves to pruning. The only other alternative would be removal of the tree, and the removal of street trees is under the jurisdiction of the Parks and Recreation Commission. Commissioner Kasolas asked about the size of the sign, noting that it has been his understanding that this center has always had trouble attracting commercial activity, and that perhaps a larger sign is in order. Additionally, signage is not allowed on the rear of the buildings (oriented towards San Tomas Expressway). ,~ Commissioner Christ indicated that the original proposal was approximately 130 sq.ft., and that area has now been reduced down to approximately 50 sq.ft., and the applicant has also agreed to lower the sign. Commissioner Christ further explained that the existing posts will be used, but the sign will be placed lower on these posts, rather that at the top. In discussing thee..>problem.with the applicant, everyone was in agreement that the size of the sign would not help exposure because of the tree problem in the area, Lowering the sign would actually help make the sign more visible. Mr. Kee indicated that the applicant is in agreement with the proposal. Additionally, the height of .the sign will be approximately 23-1/2 feet to the top. M/S: Perrine, Christ - That the Planning Commission approve SA 85-06, subject to the conditions that the applicant obtain any necessary building permits prior to erecting the sign. Motion carried unanimously (5-0-1). -~- SA 85-13 Signing Request - Apple Computer Co. - Apple Computer 600 E. Hamilton Ave. - PD (Planned Development/Commercial) Zoning District. Commissioner Christ reported that the item was before the Site and Architectural Review Committee. There is a total of 8 signs proposed, and the Committee has strong concerns. The Committee is of the opinion that the directional signs with a logo on them are inappropriate. There is also a concern about the lettering size of the directional signs, in that difficulties could arise for trucks arriving at the wrong docks and having to turn around. The applicant has requested a continuance in order that he might discuss the concerns with Apple Computer. Commissioner Kasolas felt that the purple wall was also a sign. M/S: Perrine, Christ - Request That the SA 85-13 be continued to the Planning Commission meeting of April 9, 1985. Motion carried with a vote of 4-1-1, with Commissioner Kasolas voting .. no..) . Request of Mr. Steve Thomas for a trailer on property known as 30 S. Central Avenue. Mr. Kee reported that the applicant is requesting approval to place a mobile office (trailer) next to the building at 30 S. Central (Zapp's). The applicant has submitted a letter to the Commission explaining that the trailer is needed because of the anticipated loss of storage and office space with the remodeling of this building. It has been the City's policy to allow trailers as construction offices in conjunction with projects. Staff is of the opinion that because construction will be taking place on this building that a trailer should be allowed for a six-month period. Commissioner Kasolas asked if the trailer was already in place; and, if -- the-area where, the trailer is located is used for an alleyway. Mr. Kee indicated that the trailer was already in place. Mr. Helms noted that there is an alleyway adjacent to the railroad tracks, however it terminates just north of this building. M/S: Christ, Perrine - That the Planning Commission approve this request, subject to the conditions indicated in the Staff Comment Sheet, for a period of six months. -8- Discussion of Motion Commissioner Toshach asked when the six month period would begin--from the time of approval, or from the time that the trailer was first located on the site. Further, if the approval was for the time period to commence when permits were issued, suppose the permits were not issued for another six months. Air. Kee indicated that if no building permits are obtained, Staff would proceed with code enforcement. Amendment to Motion M/ Toshach - That the motion for approval be amended to state that the six month approval time commence from the date the trailer was first located on the site. Diotion died for lack of a second. Discussion Mr. Steve Thomas, 14380 Oka Lane, Los Gatos, stated his agreement that the six-month time period begin whenever the Commission felt appropriate. Dir. Thomas explained that he has already lost his storage space because of the impending remodeling of the building. Additionally, Mr. Thomas indicated that the trailer has been on the site for four or five days. Commissioner Kasolas suggested that the approval time begin this evening. -Amendment to t4otion M/S: Toshach, Perrine - That the motion for approval be amended to state that the six month approval time commence from this date, Diarch 26, 1985. Motion carried unanimously (5-0-1). P;c.-„cc;"„ Commissioner Christ noted that the reason he motioned for the time to begin when the permits are issued, is that a shorter time period could result in the applicant running out of time before the renovation, and then coming back for an extension. Commissioner Christ stated that he was not in favor of granting extensions in these situations. Vote on Motion for Approval With Amendment Motion for approval, with six month time period to begin this date, March 26, 1985, carried unanimously (5-0-1). -9- Staff Report Staff Report regarding EIR consultants to be added to the existing list of City-approved consultants. Mr. Kee reported that the firms of Parsons Brinckerhoff Quade and Douglas, Inc., has requested to be added to the list of consultants qualified to prepare EIR's for the City. Staff has reviewed the firm's qualifications and believes that the firm is well qualified to prepare EIR's for the City. Commissioner Christ asked if there was any consideration given to the fact that one of the reasons this firm is requesting to be approved for the list is that they have a development going forth in Campbell, and they want to be able to work on it. Commissioner Christ stated that this concerned him. Mr. Kee felt that this was not the intent. He continued that the main thing is .the firm's qualifications. They could be used for other projects if they are acceptable and do an adequate job for the City. Responding to a question from Commissioner Perrine regarding the criteria for placing--a- firm on the consultant list, Mr. Kee indicated that Staff looks at experience, training, and background. There is, however, no written rules, although the Commission has indicated in the past that there is a preference for local firms. Commissioner Toshach indicated that the Commission may wish to discuss, again, the method with which a consultant is chosen. Commissioner Toshach continued that the issue is where the apparent privity is. The consultant is a consultant to the City--not the developer; however, the appearance seems to be that the privity is between the developer and the consultant. Commissioner Kasolas suggested that the Commission take action on whether or not to approve this firm for the consultant list; and, if the Commission wished to discuss the consultant issue further, it could do so at a later time. Chairman Fairbanks asked if this firm has given a sample EIR to Staff. Pir. Kee noted that no sample EIR had been received, only a list of projects that the firm has done. M/S: Y.asolas, Christ - That the firm of Parsons Brinckerhodd Quade and Douglas, Inc. be added to the list of consultants qualified to prepare EIR's for the City of Campbell. Discussion of Motion Chairman Fairbanks stated that she would have preferred to have a sample EIR to review; and, because she feels so strongly on this issue, she will be voting against the motion. -10- Commissioner Christ noted that he would also like to see a copy of an EIR prepared by this firm. Additionally, if this firm is approved, he would like Staff to send them a letter indicating the method by which consultants are chosen in the City of Campbell. Commissioner Kasolas commented that all that is being done is adding someone to a list--the issue is are they qualified or not to prepare EIR documents for the City. Commissioner Toshach stated that he would agree that there are two issues being discussed at this time. Regarding the matter of a particular firm being qualified, evidence presented would indicate that they are so qualified. Examining another EIR done for another jurisdiction would not help because information. regarding the charter being addressed would be missing. Vote on Motion Motion to add firm of Parsons Brinckerhoff Quade and Douglas, Inc. to list of consultants carried with a vote of 4-1-1, with Chairman Fairbanks --- -~ ~~~-- voting "no". OTHER ITEMS BROUGHT UP BY COMMISSION Commissioner Toshach thought that the matter of EIR consultants needs to be revisited. The issue is who is it that actually makes the approach to the consultant for the actual hiring--is it the City (Staff) or is it the developer. Commissioner Toshach felt that it should be the City who makes the approach. Commissioner Kasolas felt that it was inappropriate to make any decisions on this issue without additional background information. He continued that the procedure might be reviewed, as well as the reasons for the procedure. Commissioner Kasolas added that he is comfortable with the procedure as it exists. Commissioner Christ indicated that his concern was that someone seeing the letter received from the firm discussed earlier on the agenda could arrive at the conclusion that this firm was just going through some paperwork so that they could work for whatever company had already retained them within the City. He would like to see this type of situation avoided. Commissioners Christ and Perrine indicated that they were satisfied with the existing procedure. It was the consensus of the Commission that Staff would bring back a report, as an informational item, discussing the procedures and the reasoning for the procedures, at a later date. It was suggested that this be done the second or third meeting after the new commissioner is aboard. -11- Commissioner Christ noted his concern with the availability of the fire extinguishers in the Council Chambers in that they are being blocked by stacking chairs. Chairman Fairbanks noted that she had received a request to participate in a questionnaire regarding planning issues for Stanford University. Commissioner Perrine reported on the Downtown Committee, noting that to date there has been discussion only. No plans or recommendations have been formulated. Commissioner Kasolas noted that the main concern of the downtown merchants is parking and traffic flow--not underground utilities. He asked if the Committee has had an economic study prepared. Commissioner Christ stated that he would be interested in a traffic circulation report, in general, for this area. Additionally, he asked if Public Works could report on the effects of the two new traffic lights on First St. Pir. Helms indicated, regarding a general traffic circulation report, that ~ Staff suggested last year that a consultant be retained. The necessary funding was approximately $50,000, and the Council turned it down. Regarding the two new signals, Staff will come back with information in about 3 or 4 months. Chairman Fairbanks asked that the current commissioners on the Site and Architectural Review Committee (Perrine and Christ) would continue in this capacity until the new commissioner comes, and the situation can be looked at further. t"~r. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department, All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. 16. Applicant shall comply with all appropriate State and City requirements for the handicapped. 17. The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences.
