D'QNCfl'ES October 23, 1984 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of the City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Kasolas, Perrine, Christ, Howard, Toshach, Fairbanks, Dickson; Planning Director Arthur A. Kee, Principal Planner Philip J. COM~'IUNICATIONS City Manager Kevin Duggan introduced himself to the Commission, and noted that he is available to speak with Commissioners at any time. Chairman Dickson noted that a letter of resignation has been received from Mr. Bill Fisher, Architectural Advisor. D4r. Kee indicated that Mr. Fisher will be attempting to find another Advisor for the Commission through the local A.I.A. organization. ~** ARCEiTTECTCJRAL APPI~VALS M~4 84-24 Application of r'tr. Richard Sgarloto fora reinstate- R 84-10 ment and modification of approved plans to allow the Sgarloto, R. construction of an office, storage building and the establishment of a storage yard on property knozm as 888 Camden Avenue. Commissioner Howard reported that this item was before the Site and Architect- ural Review Committee. The Committee is upholding Staff's recommendation for a 3-month reinstatement and approval of modifications to plans, subject to conditions indicated in the Staff Comment Sheet, as well as redlining of the presented plans (including additional landscaping). Commissioner Kasolas asked if the 3-mo~ith time period would be adequate time for the applicant to complete the necessary work. Mr. Kee noted that the applicant is of the opinion that this is a reasonable length of time. ~- M/S: Kasolas, Perrine - That the Planning Commission approve Mai 84-24/R 84-10 subject to conditions as indicated in the Staff Comment Sheet, as well as redlining of the presented plans. Action carried unanimously (7-0-0). -2- S 84-18 Application of D'1r. Kjartan Armann for approval of a Armann, K. site and architectural application to allow the construction of two industrial buildings of approximately 40,500 sq.ft. on property known as 1436 Whiteoaks Rd. in an M-1-S (Light Industrial) Zoning District. Commissioner Howard reported that this item was before the Site and~Archi- tectural Review Committee. The Committee is recommending a continuance, in concurrence with the applicant, in order that revised plans may be submitted which address concerns expressed by Staff and the Committee. I+i/S: Fairbanks, Howard - That S 84-18 be continued to the Planning Commission meeting of November 27, 1984. Motion carried unani- mously (7-0-0). S 84-21 Application of T'Ir. Steve Evarkiou, on behalf of Pine Evarkiou, S. Bros. Properties) for approval of plans and eleva- tions to allots construction of an office building on properties known as 1875, 1885 and 1895 S. Winchester Blvd. in a C-1-S (Neighborhood Commer- cial) Zoning District. Commissioner Howard reported that this item was considered by the Site and Architectural Review Committee.-There will be a change in the presented --- plans which will result in the saving of an on-site tree and the loss of one paxking space; however, it is the opinion of the Committee that the resulting ratio of 1:203 will meet the needs of the development. Commissioner Fairbanks asked about the historic significance of the structures to be demolished; if the occupants of these houses were owners or. tenants; and, if the occupants have been notified of the proposed development. Mr. Kee explained the procedures of the Historic Preservation Board briefly, noting that this item will be considered by that Board tomorrow afternoon. Mrs. Elizabeth Haynes, 775 N. Harrison St., property owner, spoke regarding the condition of the units, noting that they have, long ago, passed the point of diminishing return. Commissioner Christ asked if the inevitable widening of Winchester at this point would render these parcels to small for residential lots. Mr. Kee indicated that the lots are very deep, however, the houses are situated very close to the front. The widening of the street would make it very difficult for these houses to function as residential structures. PQr. Steve Evarkiou, applicant, stated that he ivas asked by the City Manager to talk with neighbors prior to submitting plans. He indicated that the adjoining property ocmers said they have been expecting this for some time. Mr. Kee noted that because this is a site approval application, notices for the hearing were not sent out to surrounding property owners. -3- Coirnnissioner Fairbanks felt that the City needs to be responsive to the people who are left in the area, usually the elderly who will be in their homes for the remainder of their lives. She felt that surrounding property owners should be notified whenever possible. Commissioner Kasolas commented that the current noticing practices are really the only practical way for notifications to be done. D4otion carried unanimously (7-0-0). *** PUBLIC HEARINGS PD 84-03 Public hearing to consider the application of Kavanaugh, L. Linda Kavanaugh, on behalf of Barry Swenson Builders, for approval of a Planned Development Permit; and, approval of plans, elevations, and development schedule to allow the remodel of an existing building on property known as 600 E. Hamilton Avenue in a PD (Planned Development) Zoning District. Commissioner Howard reported that this application was before :the Site and Architectural Review Committee. The Committee is supporting Staff's recom- -._ mendation for coa~tinuance in order that further information regarding truck traffic may be submitted. Chairman Dickson opened the public hearing and invited anyone in the audience to speak for or against this item. NIr. Danny O'Neill, 1937 Bechelli Ln., Redding, stated that he would reserve his comments for the November meeting. Chairman Dickson noted that he felt the compact parking ratio was a little high for this project, and he would like to hear some justification come back to the Commission. A'1/S: Howard, Toshach - That PD 84-03 be continued to the Planning Commission meeting of November 13, 1984 in order that additional traffic information may be submitted. Notion carried unanimously (7-0-0). *~* UP 84-15 Public hearing to consider the application of 'D~edlin, R. Robert Nfedlin for a use permit and approval of plans and elevations to allow the conversion of a single family home to an office on property known as 2305 S. Winchester Blvd. in a C-2-S (General Commercial) Zoning District. -4- Commissioner Howard reported that this item was before the Site and Archi- tectural Review Committee. The Committee is recommending a continuance in ___ that Cityr.~Counc~.l Eo~riC+y 8.5 provides that further processing of this application cannot proceed until the office use which is being conducted is terminated. - Nir. Kee explained the Council Policy, and stated that Staff has irtform~ed the applicant that he could appear before the City Council and request a variance to this policy. Otherwise, the property would need to be in accord with the policy before Staff could continue consideration of the use permit application. Part of the problem with the continuation of this use illegally is one of liability on the City's part in relation to safety. Commissioner Christ asked how long the use had to be discontinued, and noted that he would like to see the property not used as an office at all until it has been approved for this use. Commissioner Howard noted that the applicant is renting the property and was not aware that the property had not been approved for a commercial use. Kee reported that Staffi~is~xecomnending approval of this request, and noted that the Police Department had no comments regarding the use. Hamilton Avenue in a C-2-S (General Commercial) Zoning District. Commissioner Howard reported that this item was considered by the Site and Architectural Reviela Committee. The Committee recommended~'that the bottom half of the sign be done in brown color or wood. The applicant is looking into the possibility, but noted that it may be too expensive. Further discussion regarding the sign included the lighting for the bottom of the sign, and sign materials. h'Ir. Kee noted that the plans indicate the removal of the interior lamps in the bottom section; and, the plastic material for the sign should be fairly resistant to vandalism. r4/S: Kasolas, Howard - That SA 84-49 be approved, subject to the applicant submitting a revised proposal modifying the lower portion of the sign. Nbtion carried unanimously (7-0-0). Staff Report Staff report regarding setbacks in Residential Zoning Districts. Pir. Kee reported that Staff is reoomnending this item be continued until after the Study Session scheduled for October 30, 1984. M/S: Howard, Christ - That the Staff Report regarding residential setbacks be continued to November 13, 1984. l~btion carried unaniirously (7-0-0). a Staff Report Staff report regarding follow-up on concerns expressed by the Commission at previous meeting of October 9 , 1984. Gates at Franciscan Apartments Chairman Dickson asked if there is any way to determine if the fence is having an adverse affect--are apartment residents parking on the street, and where do guests park? Commissioner Kasolas stated that he would like to know what planning and building permits were obtained. He continued that it is impossible for _-_ this site to have any parking available for guests, and that any permits granted should be seriously looked into. Commissioner Kasolas noted that commercial uses are required to provide on-site parking, and that this ---- situation was not fair. The parking on the street impacts Almarida and David Drives. -6- Mr. Kee explained the origin of the fence being erected at the apartments, that being the harassment of the apartment residents by patrons of Baja Saloon. Mr. Kee noted that this situation was unusual, and not co~rmn throughout the City. He continued that it~would be a simple matter to check to see what steps were taken regarding the permits for the fence; however, Mr. Kee indicated, the Baja Saloon is not governed by a Use Permit which might be rewked--but rather a strait Site Approval." Staff will come back with a report regarding the concerns expressed this evening. Mr. Dempster noted that extensive-work has been done by himself and Staff to come to some solution to this problem, and to avid litigation. Parking~st Baja Saloon Commissioner Perrine noted that he was pleased to see that the Baja has made arrangements with Bruener's for parking, and asked if there was some way of encouraging Bruener's secia~ity guards to have people park in the lot rather than on the street. He indicated that he has seen the guard turn people away from Bruener's lot.
