MINUTES AUGUST 28, 1984 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of the City Hall, 70 N. First St., Campbell, California. ROLL CALL Present Commissioners: Kasolas, Christ, Howard, Fairbanks, Dickson; Planning Director Arthur A. Absent Corranissioner Perrine APPROVAL OF MINUTES August 14, 1984 M/S: Howard, Fairbanks -That the minutes of the Planning Comnissi_on meeting of August I4, 1984 be approved as submitted. Motion carried unanimously (5-0-1). Chairman Dickson asked that the minutes of August 14, 1984 reflect that Commissioner Kasolas' absence was excused. OO1~TitJNICATIONS Commissioner Fairbanks requested that Staff distribute her memo regarding EIR's to any commissioners or councilmen who had not received them at the August 20, 1984 Study Session. Mr. Kee noted that a letter has been received from Mr. Tom Fleischli of Prometheus Development Co. requesting a study session to present alterna- tive conceptual site plans for 920 E. Hamilton Avenue (attached hereto). Mr. Fleischli noted that he would have some very conceptual plans which could. be viewed Wednesday, August 29, in Rm. 80 of the Coitentmity Center. Commissioner Kasolas stated that he felt~~.that usually the Commission would have new plans for a development, if it has been turned down previously. He continued that the Commission's job was to review plans for conformance with the General Plan. He asked if the Commission might not be putting itself in the position of having one study session after another when someone is unhappy with a decision along the line. Commissioner Kasolas continued '__ that it is difficult to know why the enters wted against the project-- height, traffic, density. The referendum didn't specify the reasons, only the outcome. To what extent should the Comeni.ssion get involved in designing a building. Additionally, the study session should be properly noticed. -2- Commissioner Christ stated that because the original proposal was denied under the referendum, he felt the Commission has a responsibility to the conenunity to see that another similar project is not proposed.. He continued that dialogue with the developer and the residents .is necessary to deter- mine aproper use for this site, and he felt it was proper for the Commis- sion to work with the developer and community to resolve concerns. The study session provides the opportunity to input as to what the comrmnity wants. Chairman Dickson stated that he is opposed to another study session on this issue, and he felt that the developer should have adequate input from the last study session, as well as getting additional feedback from the preview of conceptual plans on August 29. Commissioner Fairbanks noted her difficulty with attending so many meetings; but stated that she is in favor of this approach in that she appreciated be- ing able to look at some concepts before final presentations are made. The Commission took action (vote of 4-1-1, with Chairman Dickson voting 'ho") to schedule a Study Session for Thursday,. September 13, 1984 at 7:30 p.m. It was the consensus of the Commission that Staff would find a location and notify interested persons. ~~~ ARC~IITECTURAL APPROVALS lei 84-20 Application of Mr. Jonathon Rowbottom for a minor Rowbottom, J. modification to allow the construction of a second story addition to an existing single family residence within 5' of the side property line on property known as 132 Carlyn Ave. in an R-1 (Single Family Residen- tial) Zoning District. Commissioner Howard reported that this item was considered by the Site and Architectural Review Committee. The Committee is recommending approval, and notes that there has been a communication from the adjacent property owner indicating he did not have a problem with the addition. Commissioner Fairbanks asked about the fireplace protruding into the side- yard setback. D'Ir. Kee indicated that this is not unusual and there are provisions in the ordinance for this situation. M/S: Kasolas, Howard -That the Planning Commission approve HNI 84-20 subject to the applicant obtaining any necessary building permits. Motion carried unanimously (5-0-1). *~~ NM 84-19 Application of Mr. Harley Standlee for a minor modi- Standlee, H, fica.tion to allow the installation of a solar hot water system on property known as 235-275 Union Ave. in an R-3-S (Multiple Family Residential) Zoning District . -3- Commissioner Howard reported that this item was considered by the Site and Architectural Review Committee. The Committee expressed concern about the location in that the accessory buildings would infringe into - the green open space area. The applicart expressed his willingness to realign the buildings so that they would appear to be part of the existing structures. The Committee is recommending approval. D'Ir. Kee indicated that the accessory buildings would be redesigned and the laundry room would be extended; that the square. footage of these buildings is very small; and, that revised plans will be coming back indicating the recommended changes. Responding to a question from Commissioner Fairbanks, the applicant indicated that the solar panels are 4" in depth. Commissioner Howard added that the accessory buildings would be blended into the surroundings with the addition of a trellis, flower beds and walk-ways. M/S: Kasolas, Fairbanks -That the Planning Commission approve MCI 84-19 subject to (1) Applicant to submit revised plans within two weeks of approval, incorpora- ting storage tank facilit into existing laun- dry room facility; and (2~ Applicant to secure any necessary building permits. Motion carried unanimously (5-0-1). ~~~ PUBLIC HEARINGS ZC 84-01 Continued public hearing to consider the application Kobza, D. of Mr. Dennis Kobza, on behalf of Regency Monarch Development Corp., for approval of a zone change from PD (Planned Development) to C-PD (Condominiu~n- Planned Development); and, approval of plans, ele- vations, and development schedule to allow the con- struction of an office building on property known as 851 E. Hamilton Ave. in a PD (Planned Develop- ment/Commercial and/or Industrial) Zoning District. Mr. Kee reported that this item was continued from the previous meeting in order that additional traffic information could be obtained. The presented report concludes that the curm~lative traffic report of recent proposals and this project will be Iess than Io to the level of service in the reviewed intersections. Responding to questions from Commissioner Fairbanks, Mr. Kee indicated that it is a standard requirement that the widerground storage tanks be removed from the site; that there is usually l00 landscaping coverage required in a commercial zoning district, and this plan appears to have landscaped areas that are workable and maintainable; there is a condition requiring the fencing and landscaping plans to came back to the Site Committee; and, public improve- ments will have to be completed prior to occupancy of the building. -4- Chairman Dickson opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Dave Lazerus, Regency Monarch Development, appeared to answer any ques- tions the Camnission might have, and to indicate his agreement with Staff recommendations. M/S: Howard, Christ - That the public hearing on ZC 84-01 be closed. Motion carried unanimously (5-0-1). Winchester Blvd, in an R-1 (Single Family Residential), P-F (Public Facilities) and C-2-S (General Commercial) Zoning Districts. Mr. Stafford reported that the applicant is proposing to develop the site with a two-story office and research $ development complex with a total of 61,400 sq.ft. The location of the. proposed office is consistent with the "Commercial" designation of the Land Use Element of the General Plan as well as the proposed PD zoning designation. The Draft EIR which is before the Commussion at this time satisfies the Staff's requirements as indicated to the consultant in the original scope of work. Additionally, mitigating measures recommended by the consultant, as well as by Staff, have been in- cluded as conditions of approval for the project . Chairman Dickson opened the public hearing and invited anyone in the audience to speak for or against this item. Discussion Commissioner Fairbanks expressed her concern with the mitigating measure which implies the consideration of zoning additional land for high density residential, noting that in her mind this measure makes light .of the City's General Plan. Under the Circulation and Parking section of the EIR it is suggested that preferential parking be provided to encourage car and vanpool- ing. Commissioner Fairbanks continued that in her mind this is not a real mitigating measure in that it is not going to come about--it does not mitigate. Additionally the statement "promote the use of staggered work hours" is not a mitigating measure, in that it will never came about. Commissioner Fairbanks noted that there are various measures throughput this EIR that are similar to these, and she encouraged the reporters to come up with something more sub- stantial. Commissioner Christ noted his agreement with Commissioner Fairbanks, and felt that it is improper to suggest mitigating measures which are beyond our con- trol. Chairman Dickson stated that he was against the mitigating measure which suggested re-zoning additional land to high density residential. M/S: Howard, Christ - That the Planning Commission certify the Draft EIR as complete, and that mitigating measures contained therein be used in reviewing the development plans for the proposed project. Motion carried unani- mously (5-0-1) . ~~~ ZC 84-02 Public hearing to consider the application of Mr. March Development Dennis Kobza, on behalf of March Development (SES), for approval of a zone change from R-1-10 (Single. Family Residential) and C-2-S (General Commercial) to PD (Planned Development; and .approval of plans, elevations, and development schedule to allow the construction. of a research ~ development building on property known as 3101 S. Winchester Blvd. in an R-1-10 and C-2-S Zoning District. -6- Commissioner Howard reported that this item was considered by the Site and Architectural Review Committee. The Committee discussed the location of the trash enclosure and felt that the location proposed was well-shielded. Also discussed by the Committee was restricted trash pick-up times; increased landscaping to reduce noise; and the masonry wall, which is indicated for 6'. It is the opinion of the Committee that the design is exceptional for this area, and the Committee is recommending approval. Commissioner Fairbanks asked about the parking ratio with regard to the separation of research $ development and office space. Mr. Kee indicated the plan provides 245 parking spaces; and, in the past, the Commission has approved ratios in the range of 1:225 to 1:250. Commissioner Kasolas asked if parking was permitted on Winchester Blvd., noting that the plans did not appear to present a potential of overflow parking into the residential neighborhoods. Commissioner Fairbanks asked what zoning would be applied to the small finger-shaped parcel which abuts Walnut Drive. Mr. Kee noted that the zoning on this portion, which is indicated for an --- employee's picnic area, will remain zoned R-l. Commissioner Fairbanks asked about the toxic materials on-site; the possi- bility of people using Walnut Drive to circle back to Hacienda to turn left with the light; the percentage of compact parking; the color scheme -- for the building; the lighting plan; and, if Walnut Drive was a street in- dicated for alternative improvements. Mr. Elliott reported that the developer will be rec{uired to install street improvements on Winchester Drive. These improvements must be completed prior to occupancy. Additionally, Walnut Drive is indicated for alternative improvements, and this will be noted by Staff when permits are pulled. Commissioner Howard stated that the Site Committee felt the landscaping in the parking areas needed to be increased, and this is red-lined on the plans. The Committee also discussed a 6' masonry fence with a type of lattice across the top, and the developer is agreeable to whatever is rec{uired. Chairman Dickson asked about the Planned Development zoning designation. Mr. Kee noted that the setbacks for this development are normal for a C-2-S zoning, and the PD designation is because of the 35~ research ~ development on the site. Commissioner Kasolas felt that the PD zoning was appropriate for this use in that it provided protection for the residential properties adjacent. Chairman Dickson opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Rollins Cushman, 1274 Walnut Drive, reiterated his concerns expressed in the discussion regarding the EIR for this project. Mr. Cushman empha- sized that he wanted_an 8'.fence no matter how high it appeared on his side of the site. - 7- Mr. Kee stated that Staff would have difficulty recommending an 8' wall; however, the fencing plans are to come back to the Site Committee, and perhaps something can be resolved at that time. ____ Commissioner Christ reassured Mr. Cushman that the Site Committee looked at the fence and the trash enclosure location at length, and that it was made clear to the developer that the fencing must be attractive on the side facing the residential properties. Ms. Dorothy Shattuck, 391 California St., expressed her concern that such a high wall would be unattractive from a residential property owner's viewpoint; and, noted that she would see the staggered hours as a reality. Mrs. Kathy Cardoza, 1312 Walnut Drive, expressed her concern regarding possible access from Walnut Drive to the picnic area, noting that it is right next to her home. She also asked about the staggered working hours and the trash pick-up times, all relating to noise factors. Commissioner Howard noted that the Site Committee discussed the access to the pirnic area and stated there should be no access to Walnut Drive. Additionally, it was suggested that the developer try to have the trash picked up after 6 a.m. Mr. Kobza, applicant, indicated there was no problems with arty of the suggestions made by Staff or the Site Committee. Commissioner Christ noted that he did not think there would be a problem with staggered working hours, because of the research ~ development usage -' of the building. The site is not geared for manufacturing which is usually what causes staggered working hours. D~/S: Kasolas, Fairbanks - That the public hearing for ZC 84-02 be closed. Motion carried unanimously (5-0-1). .Commissioner Fairbanks asked if there any possibility of the pirnic area being turned into a storage area. Mr. Kee indicated that he felt there were adequate provisions in the PD to preclude this from happening. M/S: Kasolas, Howard - That the Planning Commission adopt RESOLUTION NOS. 2286 and 2287 recommending that the City Council approve the requested zone change from C-2-S and R-1-10 to Planned Development; and, .that the City Council approve the plans, elevations, develop- ment schedule and conditions of approval. Sumnyoaks Ave. - M-1-S (Light Industrial) Zoning District. Commissioner Howard reported that this item was before the Site and Archi- tectural Review Committee. The Committee is recommending removal of the signs above the bays, allowance of a Babe's Muffler sign over the entrance, and allowing the re-facing of an existing 14' free-standing sign (this being a compromise in order to clean up the sign). Commissioner Kasolas asked if this amount of signing was equal to that of Midas Mufflers, across the street. Mr. Kee indicated that Midas may have more signing, and the site seems a bit larger. Mr. Kee continued that it is his understanding that the appli- cant for Babe's Mufflers is in agreement with the recommendation of the Site Committee. M/S: Howard, Christ -.That the Planning Commission approve SA 84-I2 as recommended by the Site Committee:. removal of signs above service bays, allowance of sign over entrance door, and allowing re-facing of existing 14' free- sign, subject to the condition that the applicant obtain any necessary permits. Motion:carried unani- mously (5-0-1) . ~~~ Referral Referral from City Council regarding reinstatement GP 77-2 of development schedule - Campbell Inn Motel - Campbell Inn 675 E. Campbell Ave. - PD (Planned Development/ Commercial) Zoning District. Commissioner Howard reported that this item was discussed by the Site and Architectural Review Committee. The Committee is reco~rtnending reinstate- ment and approval of a revised development schedule, which indicates com- pletion in February 1985. Commissioner Howard noted that the developer is going back to the original construction plans, and it is the opinion of the Co~rtnittee that the project does warrant reinstatement. Commissioner Christ asked about the alignment of sidewalks in this area. Mr. Elliott indicated that sidewalks would align, and continue across the frontage of this site. M/S: Howard, Fairbanks - That the Planning Commission reinstate GP 77-2 and approve the revised development schedule (attached hereto). Bascom S 84-11 Ave. in a C-2-S (General Commercial) and R-3-S Lincoln Property (Multiple Family Residential/High Denaity Residential) Zoning District. Commissioner Howard reported that this item was discussed by the Site and Architectural Review Committee. The Committee is recommending apppproval of the revised plans, subject to conditions listed in the Staff ~teport. The building has been reduced from 4-stories to 3-stories; and, there were two different parking proposals presented. The Committee is recom- mending that the parking ratio of 1:250 would be more advantageous, allowing for more landscaping and Iight wells in the parking area. Additionally, there will be limited access to Michael Drive for emergency vehicles only. This drive area will be landscaped with a turf stone which can be driven on. Chairman Dickson expressed his concerns with the parking structure and the. compact parking ratio shown, as well as with the residential area being used for raised parking so close to residential. ~.Ha felt that this would have an impact on the residential harmony. Additionally, Chairman Dickson stated that he felt the use of this type of parking indicated that the pro- ject is too dense. Commissioner Howard noted that there is a study included in the traffic information which supports the applicant's 48~ compact parking ratio. Commissioner Kasolas noted that there is -also :a parking structure in the middle of a residential area in do~mtown Campbell, and added that many cities don't permit parking in the business districts in order to encourage the use of public ~~ ransportation. In my view, the key to developing a concensus plan for the property requires active involvement by the Planning Commission and members of the community early on in the planning process. It is my sincere hope that with this involvement, the final plan for the property will be acceptable to all parties. In this regard, I respectfully request the opportunity to present alternative conceptual site plans to the Planning Commission during a study session to be held at your earliest convenience. At this study session, conceptual site plans would be presented for your preliminary comments. Based on this feedback, we could proceed with the refined design of a preferred site plan or plans for further review. Through this process, the ultimate plan for the property will respond to the extent possible to the concerns of the Planning Commission and members of the community. I sincerely appreciate the effort you and members of the Planning Commission have made to assist us in developing a successful plan for the property, and I believe through continued dialogue .and study we will be successful in achieving that end. The site is within the San Tomas Aquino Creek and Page Ditch watersheds and not subject to flooding from any District facility. The property is also adjacent to the Page Percolation System Pond as shown on the enclosed marked site plan. The site's drainage should be incorporated into an existing storm drainage system. :1o drainage into the percolation pond can be allowed. In accordance with District Ordinance 75-6, the owner should show any exist- ing well(s) on the plans and inform us regardins their proposed use. Please contact PIr. David Zozaya at 265-2600, extension 416, for information about well permits. I;ecause it can affect the operation and maintenance of the percolation pond, grading adjacent to the right of way should be done in accordance with District Detail Sheets 20-20B. The details of the grading should include cro:~-sectional views at the right of way and be shown on the improvement plans. As a condition of Land development approval, the District right of way should be fenced ~~ause of tre potential hazard associated with the pond.
