The Planning Commission of the City of Campbell convened this day in regular
session at the regular meeting place, the Council Chambers of the City Hall,
70 N. First St., Campbell, California.

April 10, 1984 It was moved by Commissioner Meyer, and seconded by
Commissioner Perrine, that the minutes of April 10,
1984 be approved as submitted. Motion carried unani-
mously (4-0-3).

?~r. xee reported that communications received pertained to specific items on
the agenda and would be discussed at that time.
Chairman Dickson noted that a letter of resignation has been received from
Commissioner Meyer, and stated that he has appreciated serving on the
Commission with her and she will be missed.
Commissioner Meyer stated that she wished to thank the Commission, the City
Council, and Staff for their support and special friendship over the last
five years. She has learned at great deal, met many lovely people, and
enjoyed serving the City.
ARCHITECTURAL APPROVALS
S 83-16 Continued application of Economy Lumber for approval
Economy Lumber of plans and elevations to allow the construction of
a sales building on property known as 720 Camden Ave-
nue in an M-2-S (Heavy Industrial) Zoning District.
Mr. Kee reported that Staff is recommending a continuance of this application
in that the applicant is pursuing a resolution to access concerns to this site.

S 83-20 Continued application of r-1r. Frank Oley, on behalf
U-Haul of tT-Haul, to allow the construction of a 4500 sq.
ft. addition to an existing rental facility on pro-
perty known as 1266 tiVhiteoaks Rd.
Commissioner Perrine reported that this item was considered by the Site and
Architectural Review Committee. The applicant has addressed concerns expressed
by Staff and the Committee, and the Committee is recommending approval subject
to the applicant bringing back revised plans to the Planning Director within
30 days.
Commissioner Ka.solas expressed a concern about the existing signing on the site,
particularly the size of the electric sign that says "U-Haul". Tie asked if the
sign would be reviewed as part of this "site" application, and indicated that
the existing signage may not have been what he thought he was voting for. This
is probably one of the largest signs in the City, and would appear to be more
signage than most businesses in the City have.
Mr. Kee indicated that there is a reader board. sign on-site that has not been
approved; although the issue before the Commission is not one of signs, but
rather for a site approval. I.f the Commission desires, Staff can come back
with a report on the signing for this property.

Dumas, J. Vanderson Construction, Inc., .for approval of plans
and elevations to allow the construction of an office
building on property known as 476 to 486 E. Campbell
Avenue in a C-2-S (General Commercial) Zoning District.
Mr. Kee reported that Staff is recommending a continuance with the concurrence
of the applicant, in order that revised plans may be submitted.

S 84-09 Application of Mr. Steve Evarkiou, on behalf of Pinn
Evarkiou, S. Brothers Properties, for approval of plans and ele-
vations to allow the construction of an office build-
. ing on property known as _440 N. Central A. in an
M-1-S (Light Industrial) Zoning District.
Commissioner Perrine reported that this item was considered by the Site and
Architectural Review Committee. The applicant produced drawings att the
meeting which addressed the concerns indicated in the Staff Comment Sheet.
The Committee is, therefore, recommending approval subject to revised plans _
coming back to the Site and Architectural Review Committee within 30 days of
approval. It was further noted that the glass material for the building will
be of a non-reflective type--gray in color.

Commissioner Meyer asked if anycof they.existing trees would be retained.
Mr. Evarkiou indicated that the existing trees will be retained.

S 84-10 Application of A4r. Paul McAllister for approval of
McAllister, P, plans and elevations to allow the construction of
an industrial building on property known as 1025
Florence Play in an M-1-S (Light Industrial) Zoning
District.
Commissioner Perrine reported that this item was before the Site and Archi-
tectural Review Committee. The. applicant was agreeable to changes suggested
by the Committee regarding the parking and red-lining on the plans. The
Committee is recommending approval with :the added condition that revised
plans be submitted to the Planning Director within 30 days of approval.

PiTBLIC HEARINGS
UP 84-03 Continued public hearing to consider the application
Sanchez, X, of Mr. Xavier Sanchez for a use permit to allow the
move-on of a single family residence onto property
known as 75 S. Second St. in a PD (Planned Develop-
meet/Medium Density Residential) Zoning District.
Pis. Kee reported that Staff is recommending a continuance in order that the
applicant might submit revised plans.
Chairman Dickson opened the public hearing and invited anyone to speak for
or against this item.
Commissioner Kasolas noted he would question the move-on of a used house
to a medium density property, specifically in the downtown area,. under
the current conditions of having insufficient space to house people.

V 84-OZ Public hearing to consider the application of
~~ Noyes, P1. P~illiam and Judy Noyes for a variance to reduce
'~~ the sideyard setback of an existing house from
5' to 1.7' and to reduce the front yard setback
of an existing carport .from 25' to 8' so as to
allow the creation of a separate parcel on pro-
perty known as 1035 Hazel Avenue in an R-1 (Single
Family Residential) Zoning District.

Mr. Kee reviewed this application noting that Staff is recommending denial,
in that Staff is of the opinion that a hardship unique to this property does
not exist. There are a number of other lots in the City tahere the houses are
so sittaated that they would not meet the sideyard setback if a flag lot was
to be created. Staff is concerned that approval of this variance could set a
precedent for the. approval of similar variances so as to allow flag lots.
Commissioner Kasolas asked if this property was within .the San Tomas Area, and
what the minim~un lot size was as approved by the City Council.
Z~r. Kee responded that the property taws within the San Tomas Area, and the
minimum lot size in this area was 6,000 sq.ft.
Chairman Dickson opened the public hearing and invited anyone in the audience
to steak for or against this item.
A'[r. Bill Noyes, applicant, spoke in favor of this request explainir_a the con-
figuration of his property as well as the existing layout of the residence.
Mr. Noyes continued that he wished to subdivide the property and build a
small residence on it for his parents. The subdivision would allow his
parents to own the property and not have to be concerned should P4r. Noyes
want to move or sell the front portion.
Commissioner Kasolas asked what problems would be encountered if the applicant
wished to construct a "granny flat" rather than subdivide this parcel.
Mr. Kee indicated that Staff would not have a problem with the addition of a
"granny flat" if the lot was a minimum of 12,000 sq.ft. The applicant could
apply for a Ilse Permit to allow another unit on the property, however the
parcel could not be subdivided for sale later on. l`~~r. Kee added that Staff's
position on this application is that if a variance is granted for the creation
of a flag lot, there twill be many more of these type of applications coming
before the Commission.
Mr. Noyes noted that "granny flats" are limited in size to approximately 600
sq.ft., and his parents are hoping to build a 800-950 sq.ft. house.
P4r. Bruce Reid, 1509 Iaalnut Drive, spoke against this proposal, stating what
this is exactly what the residents of the San. Tomas Area nave been fighting
for years and that approval would open a .rlood gate for lot splits. He con-
tinued that there is a referral before the Commission to consider changing
setback requirements in this area, and if these were increased the proposed
lot split before the Commission this evening would be even fixrther out of
line. ?'Jr. Reid stated that if this item is continued he will he able to
bring forth a petition in opposition.
~~'Ir. Noyes noted that r:~any of his neighbors know what he is proposing and
have not voiced any objections. Additionally, V,'alnut .Drive is not anywhere
near his property. rlr. Noyes continued that his lot is larger than the
average lot in his area.
Mr. Jim Campbell, 802 Century Drive, spoke in favor of this application.
No one else wishing to spew:, it was moved by Commissioner Kasolas, and
seconded by Commissioner Meyer, that the public hearing be closed. Ivlotion
carried unar_imously (4-0-3).

2269 denying V 84-02.
Discussion on Motion for Denial
Commissioner Kasolas stating that he would be speaking against the motion
for denial. He felt that derYying development or progress was really re-
gression, and the Commission has a duty to lool: forward to see that there
will be adequate housing available. He continued that there was no ques-
tion that this application has a problem hri.th regard. to the setbacks;
however, this is an issue which has to be readdressed at the Council
level as it pertains to the San Tomas Area.
Chairman Dickson stated that he would like to speak for the motion, in
that the Council has already made a decision regarding the minimum lot
size in this area and there is an ordinance to be used in guiding the
Commission. The variance is a very powerful tool in that it can set
precedents. Chairman Dickson noted that he did not feel there could
be any establishment of a finding of hardship in this case.

T~ir, Kee reported that Staff is recommending denial of this application, or
a continuance to A~ay 8, 1984 in order that the applicant might be able to
work something out regarding this sign. res. Kee continued that Staff's main
concern. is that there not he a free-standing sign for every user along Hamil-
ton Avenue.
Mr. Jim Campbell, representing ASOOM, stated that this signing situation is
causing a hardship on the company; that they have been very b~zsy and have not
the tine ao pursue an arrangement with Pace (?ptical to combine signs; that they
have already submitted a pet2tion of surrounding businesses indicating no ob-
jections to their signing and/or the antennas; that if an agreement is worked
out with Pace (?ptical, the top of ASCOM's sign will be cut off by the tree next
door; that anything they do in the City of Campbell isn't going to make much
difference because. they are dealing on an international level. Tyr. Campbell
concluded that they will need more time, and that they are losing customers
while they are taking the time. Additionally, they would like to have two
signs--ASCCk~1 and ANTEC.
Commissioner Perrine asked how the sign which was approved on March 13, 1984
was working out .
P~[r. Campbell stated that this sign hats not been erected as yet.
Chairman Dickson stated that he felt the applicant was causing a hardship on
the Staff and the Commission. The applicant is saying that customers are unable
to locate him, and yet he has not erected the signing that has been approved for -
this business. Chairman Dickson noted that he would not oppose a continuance
for one more meeting; however, after that he felt this application should be
denied.

Mr. Kee reported that correspondence has been received from the applicant
requesting a continuance. The Recording Secretary read this letter into the
record (attached hereto).

Chairman Dickson reported that this item was reviewed by the Site and Archi-

ject to conditions of approval as stated in the Staff Report.

Commissioner Perrine reported that this item was before the Site and Architectu-
ral Review Committee. There appears to be a clear violation of the harking re-
gulations, and after investigation by the Fire Department, this application is
before the Commission as a way for the owner to try to resolve the matter.
A4r. ICee indicated that a problem exists with the intensity of uses along
~Uhiteoaks Rd., and even though there has been a change in the parking
requirement for these types of uses, the applicant will still be short
approximately four spaces. ?ir. Kee noted that the applicant's representa-
tive, Mr. Deanis Burrows, has requested a continuance.

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with Ordinance of the City of
Campbell and Laws of the State of California..
~ All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate concrete curbs or bumper guards.
B Underground utilities to be provided as required by Section
20.16.070 of the Campbell ~4unicipal Code.
~ Plans submitted to the Building-Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and tele-

D Sign application to be submitted in accordance with provisions of
