The Planning Commission of the City of Campbell convened this day in regular
session at the regular meeting place, the Council Chambers of the City Hall,
75 N. Central Ave., Campbell, California.

APPROVAL OF MINUTES
October 11, 1983 It was moved by Commissioner Fairbanks, and seconded by
Commissioner Howard, that the Planning Commission approve
the minutes of October 11, 1983 as submitted. Notion
carried unanimously.
COMMChNI CATIONS
A4r. Kee noted that a letter from Mrs. Patricia Woodstock, regarding 241 W.
Sunnyoaks Avenue, has been received and is at the Commission's station
(attached hereto). Additionally, other correspondence received relates to
specific items on this evening's agenda and will be discussed at that time.
ARCHITECI2JRAL APPROVALS
M61 83-10 Continued application of Mr. Eric E. Johnson, on behalf
Denny's Lumber of Denny's Lumber Mart, Inc., for modification to an
approved site plan to allow the addition of a cargo
storage container on property known as 1217 Dell Avenue
in an M-1-S (Light Industrial) Zoning District.
Commissioner Fairbanks reported that this item was reviewed by the Site and
Architectural Review Committee. The Committee is recommending approval, sub-
ject to the conditions listed in the Staff Comment Sheet, as well as redlining
of the plans. The container is to be moved further back on the site, behind
the fence and adjacent to another building. The repositioning provides ade-
quate clearance for moving trucks on-site; and, the structure has been painted
a brown tone, thereby making it more architecturally compatible.
Commissioner Kasolas entered the chambers at 7:35 p.m.
It was moved by Commissioner Fairbanks, and seconded by Commissioner Howard,
that MM 83-10 be approved, subject to conditions listed in the Staff Report
as well as redlining of plans. Motion carried unanimously (6-0-1).

MM 83-13 Continued application of Mr. William Franco for
~'~~, W. modification to an approved site plan to allow the
addition of a cargo storage container on property
known as 920 Camden Avenue in an M-1-S (Light
' Industrial) Zoning District.
Mr. Kee reported that Staff is recommending a continuance, at the applicant's
request., in order that revised plans may be submitted.
Discussion ensued regarding the use of containers during the application
process, and that the longer the application process was continued the
longer the container could be illegally in use. It was the consensus of
the Commission that Staff come back to the Commission with a possible
policy limiting the number of times an application of this type can be
continued.
It was moved by Commissioner Fairbanks, and seconded by Commissioner Howard,
that MM 83-13 be continued to the Planning Commission meeting of November 8,
1983 in order that revised plans may be submitted. Motion carried unanimously
(6-0-1) .
Commissioner Dickson noted that the applicant should be notified of the
Commission's concern with the delays in submitting revisions.

MCI 83-14 Application of Rev. Gregory Post for a modification
Post, G. to approved plans to allow the placement of two
trailers in a parking area on property known as
110 W. Latimer Avenue in an R-3-S (Multiple Family
Residential) Zoning District.
Commissioner Fairbanks reported that the Site and Architectural Review Committee
is recommending denial of this application, based on the concerns expressed in
the Staff Comment Sheet. In light of the Commission's past policy on the
use of trailers, a temporary use of one year was not discussed.
Mr. Richard Ahern, representing the applicant, stated that the trailers were
constructed for industrial use, rather than as housing, and they meet OSHA
standards. They will be in use approximately one hour a week on Sundays.
If parking is a problem, perhaps the trailers can be repositioned end to
end, thereby taking up only five spaces. He noted there is parking available
in the area, off-site. Mr. Ahern presented pictures to the Commission which,
he felt, illustrated that the trailers were architecturally compatible with
the surrounding area. He added that the trailers are not visible from the
street; the trailers have been on-site for about 3 weeks, and have not been
used thus far. Mr. Ahern continued that the church does have a building
fund going and they are looking for a larger site for their use; however,
this takes time. He concluded that the group is willing to do whatever is
necessary to use the trailers, and is agreeable to a~temporary approval
which would allow the use for one year; and, that the trailers were bought -
under the assumption that there would not be a problem since they were
industrial trailers.
Discussion ensued regarding the requirements of the Building Department and
the Fire Department, as well as the most appropriate placement of the trail-
ers.

Commissioner Kasolas stated that he agrees with the Site Committee's
recommendation, based on the information they had before them; and,
that he did not like to see trailers used in the downtown area. How-
ever, if the problems could be solved and the use is only for a short
time, he would recommend approval of this request.
Commissioner Campos asked if approval of this request could jeopardize
the City or the Commission if these units do not meet code requirements.
Ntr. Kee responded that it is his understanding that the trailers would
have to meet all the codes and conditions of approval before they can
be used.
Commissioner Dickson expressed his concern that the trailers are not
architecturally compatible with the area, and that there is not a
binding parking agreement with the adjacent property owners.
It was moved by Commissioner Kasolas, and seconded by Commissioner Howard,
that MM 83-14 be approved subject to conditions listed in the Staff Comment
Sheet, as well as the addition of a condition requiring a six-month review.
The trailers are to be properly placed in accord with Planning Department
requirements; there should be an agreement with the adjoining property
owner regarding parking, and if a problem arises with parking, it should
be looked into immediately; and the approval is temporary--for one year.
Notion carried (4-2-1, Commissioners Fairbanks and Dickson voting 'ho").

EIR 83-03 Public hearing to consider the Draft Environmental
EquiReal Develop- Impact Report which has been prepared for the pro-

Mr. Kee reported that Staff is recommending a continuance to November 22 on
.this item in order to respond to questions from Cal-Trans. and the City _.of
San Jose in that both of these entities have authority over several of the
intersections in the area affected by this proposed development.
Chairman Kotowski opened the public hearing, and invited anyone in the
audience to speak for or against this item.
Mr. Mark Disbrow, applicant, requested that the Commission accept Staff's
recommendation for a continuance.
No one else wishing to speak at this time, it was moved by CommissionEr
Kasolas, and seconded by Commissioner Howard, that EIR 83-03 be continued
to the Planning Commission meeting of November 22, 1983. Nootion carried
unanimously (6-0-1).

Commissioner Fairbanks reported that the Site and Architectural Review Committee
is recommending a continuance on this item to the meeting of November 22, 1983.
The Committee did discuss, with the applicant, the comments that were made by
the Architectural Advisor with regard to the site plan in order to give the
applicant some idea of what the Commission will be looking for regarding the
design of the project.
Mr. Mark Disbrow, applicant, requested a continuance of this item to November 22,
1983.
Mr. Jack Petersen, speaking for property owner on Wild Cat Lane, noted that
the entrance to this project is proposed to go across private property, and
that there is no easement across the frontage of his property.
Mr. Kee noted to the Commission that in terms of easements, there would be
conditions attached to any approval which would require all easements to
be properly provided for before any construction could move ahead.
It was moved by Commissioner Fairbanks, and seconded by Commissioner Kasolas,
that S 83-13 be continued to the Planning Commission meeting of November 22,
1983, Motion carried unanimously (6-0-1).
PUBLIC HEARINGS ~ ~ ~
UP 83-13 Continued public hearing to consider the application
Wheeler, D. of Mr.~ Damon Wheeler, on behalf of Mark Bartan, Inc.,
for a use permit to allow a muffler shop in the ser-
vice bays of an existing service station, and appro-
val of plans to add a metal storage building on pro-
perty known as 1387 Camden Avenue in a C-1-S (Neigh-
borhood Commiercial) Zoning District.
Mr. Kee reported that Staff is recommending a continuance of this item at
the applicant's request. The applicant is looking into possible alternatives
to meet some of the conditions of the Fire Department and needs additional
time.
Chairman Kotowski opened the public hearing, and invited anyone in the
audience to speak for or against this item.
No one wishing to speak at this time, it was moved by Commissioner Kasolas,
and seconded by Commissioner Fairbanks, that UP 83-13 be continued to the
Planning Commission meeting of November 22, 1983. Motion carried unani-
rrously (6-0-1).

GP 83-11 Continued public hearing to consider City-initiated
City-initiated amendments to the Land Use Element of the General
Plan for the San Tomas Area.
Mr. Kee reported that recent zoning hearings for the San Tomas Area have
resulted in an inconsistency between the General Plan and the Zoning Map.
The purpose of the proposed General Plan amendments indicated tinder GP
83-11 is to bring the General Plan and the Zoning Map into conformance.
Chairman Kotowski o~aened the public hearing, and invited anyone in the
audi alce to speak for or against this item.
Mr. Bruce Reid, 1509 Walnut Drive, requested clarification tinder Discussion
Area 1.
After brief discussion, it was the consensus of the Commission ~d Staff
that this item be continued in order that more detailed docwnentation might
be provided for the Commission.
It was moved by Commissioner Howard, and seconded by Commissioner Fairbanks,
that GP 83-11 be continued to the Planning Commission meeting of November 8,
1983. Motion fails (3-3-1).
It was moved by Commissioner Dickson, and seconded by Commissioner Kasolas,
that GP 83-11 be continued to the Planning Commission meeting of November 22,
1983. Motion carries tmanimously (6-0-1).

Request Request of Mr. Charlie O'Neill .that auto sales be an
allowed use within a C-1-S (Neighborhood Commercial)
Zoning District with a use permit. (Preferred Sales
and Leasing.)
Mr. Kee reported that Staff is recommending approval of this request, in that
there are areas on major arterial streets zoned C-1-S which may be appropriate
for an auto sales/leasing use. By allowing this type of activity, subject
to a use permit, the Commission would be able to take adequate safeguards to
protect adjoining areas.
Commissioner Fairbanks asked what types of activities result from an auto
sales/leasing use regarding noise and traffic.
Mr. Kee stated that a leasing use would be an office use, and that cars
would not necessarily be on-site.
RESOLUTION N0. 2235 It was moved by Commissioner Kasolas, and seconded by
Commissioner Howard, that the Planning Commission
adopt Resolution No. 2235 making a determination that
auto sales be an allowed use within a C-1-S (Neighbor-
hood Commercial) Zoning District with a use permit.
Motion carried unanimously (6-0-1):
