The Planning Commission of the City of Campbell convened this day in regular
session at the regular meeting place, the Council Chambers of the City Hall,
75 N. Central Avenue, Campbell, California.

APPROVAL OF MINUTES
September 27, 1983 It was moved by Commissioner Howard, and seconded
by Commissioner Dickson, that the Planning Commis-
sion approve the minutes of September ~7, 1983 as
submitted. Motion carried Lmanimously (6-0-1).
Commissioner Fairbanks requested that items discussed under "Other Items Brought
Up By Commission" at the meeting of September 27, 1983, be included in these
minutes. The following information will be added as an amendment to the.Plan-
ning Commission minutes of September 27, 1983;

Commissioner Fairbanks asked Mr. Stafford what the status is regarding
an illegally constructed fence on T7aggio Ct.
Mr. Stafford indicated that he would look into this, and report back.
Commissioner Dickson discussed the Commission's policy on majority
votes, and the recording of these votes in the minutes, noting that
it is his understanding that a Commissioner may request his vote
be recorded.
Mr. Dempster concurred with Commissioner Dickson.
Mr. Dickson requested that the Commission consider investigating
an ordinance which would prohibit live bands in an R-1 neighborhood,
and asked that Staff come back with some information on this subject.

S 83-14 Application of Mr. Albert Evers for approval of
Evers, A, plans and elevations to construct a warehouse/
industrial building and storage yard on property
known as 454 ~ 468 McGlincey Lane in an P~-1-S

Commissioner Fairbanks reported that this item was before the Site and Archi-
tectural Review Committee this morning. The Committee is recommending a con-
tinuance in order that the applicant may address concerns expressed in the
Staff Comment Sheet.
It was rroved by Commissioner Howard, and seconded by Commissioner Meyer, that
S 83-14 be continued to the Planning Commission meeting of November 8, 1983
in order that the applicant ~y submit revised plans. Motion carried unani-

Commissioner Fairbanks reported that this item was considered by the Site
and Architectural Review Committee. The Committee is recommending approval,
subject to conditions listed in the Staff Comment Sheet.
It was moved by Commissioner Meyer, and seconded by Commissioner Howard, that
MM 83-14 be approved, subject to the following conditions: (1) Use of trailers
shall be terminated March 11, 1984; (2) Trailers shall be removed from the pro-
p erty within 15 days after their use is terminated; and (3) Applicant tb secure
any necessary Building and Fire Department approvals. Motion carried unani-
mously (6-0-1).

MM 83-10 Application of Mr. Eric E. Johnson, on behalf of
Denny's Lumber Denny's Lumber Mart, Inc., for modification to an
approved site plan to allow the addition of a

Commissioner Fairbanks reported that this item was considered by the Site and
Architectural Review Committee this morning. The Committee is recommending a
continuance in order that the applicant may submit revised plans.
It was moved by Commissioner Howard, and seconded by Commissioner Meyer, that --

T'~t 83-11 Application of Mr.Frank Becker, on behalf of
Barney's Cabinets Barney's Cabinets, for modification to an
approved site plan to allow the addition of
a cargo storage container on property known
as 60 E. Sunnyoaks Ave., ~3, in an M-1-S
(Light Industrial) Zoning District.
Commissioner Fairbanks reported that this item was considered by the Site and
Architectural Review Committee. The Committee is recommending denial, in that
this proposal does not meet the criteria established, as policy, by the Com-
mission: (1) must not adversely affect parking facilities for the project;
(2) must be architectural compatible with existing and neighboring structures;
and (3) must not impair orderly and harmonious development of a neighborhood.
Tir. Frank Becker, applicant, stated that he did not see why he could not put
the container in the parking area when he is renting these parking spaces
as part of his lease on the building; and, he is in need of the additional
room.
Chairman Kotowski asked Mr. Becker if there is any way he can address the
concerns of the Commission, and conform with the policies indicated.
''1r. Becker noted that the building owners told him that he is entitled to
a certain number of parking spaces in the lot, and he does not use these
spaces for his business. He added that there was not room to put these
containers anywhere else on the site, and that they are situated in the
front of this building.
Chairman Kotowski noted that these containers are placed in parking spaces,
thereby changing the parking ratio for this site, and possibly violating the
parking regulations. He asked A1r. Becker if he would like a continuance in
order to try to work with Staff to possibly solve the p~`oblems.
Ttr. Becker noted that he would be in concurrence with a continuance to the
November meeting.
It was moved by Commissioner Fairbanks, and seconded by Commissioner Howard,
that rff~f 83-11 be continued to the Planning Commission meeting of November 8,
1983 in order that the applicant can meet with Staff to determine if there
is a solution to his circwnstances. Motion carried unanimously (6-0-1).

Commissioner Fairbanks reported that this item was considered by the Site and
Architectural Review Committee. The Committee is recommending a continuance
to November 25, 1983 in order that the applicant may submit revised plans.
Additionally, Staff is going to check with the Fire Department regarding the
blockage of the driveway by the containers.
Mr. Haley noted that the Fire Department has indicated that a 20-foot wide
driveway access is necessary.
It was moved by Commissioner Howard, and seconded by Commissioner Campos, that
MD4 83-13 be continued to the Planning Commission meeting of November 25, 1983
in order that the applicant may submit revised plans. Motion carried unanimously
(6-0-1).

PUBLIC HEARINGS
UP 83-12 Public hearing to consider the application of Mr.
Baker, R. Robert Baker, on behalf of the Franciscan Apart-
ments, for a use permit and approval of plans to
allow the placement of a cargo storage container
in the parking area of property known as 601
Almarida Dr. in an R-3-S (Multiple Family Resi-
dential) Zoning District.
Commissioner Fairbanks reported that this item was before the Site and Archi-
tectural Review Committee this morning. The Committee is recommending tem-
porary approval for six months. The property owner is doing repair work on
the apartments and needs a place to store expensive plumbing materials and
other items.
Commissioner Meyer questioned the Staff concern regarding dumpsters in the
parking area.
Mr, Haley indicated that Staff is recommending that the trash enclosures be
expanded, if necessary, to accommodate all the durnpsters on site.
Commissioner Kasolas entered the Chambers at 8:05 p,m. --,
Chairman Kotowski opened the public hearing and invited anyone in the audience
to speak for or against this item.

NIr. Robert Baker, applicant, stated that the cargo containers are being
used to store renovation materials; however, the work should be finished
by the first of March 1984.
No one else wishing to speak, it was moved by Commissioner Fairbanks, and
seconded by Commissioner Meyer, that the public hearing be closed. Motion
carried unanimously (7-0-0).
Motion
It was moved by Commissioner Kasolas that UP 83-12 be approved for a
period of three months. Motion dies for lack of a second.
RESOLUTION N0. 2233 It was moved by Commissioner Howard, and
seconded by Commissioner Dickson, that
UP 83-12 be approved for a period of six
months. Notion carried by the following

Commissioner Meyer asked if Staff would be following up on this use in
six months to see that the containers have been removed.
Mr. Stafford indicated affirmatively.
Commissioner Kasolas stated that he felt the approval should be for three
months only, in that it is his understanding that the apartment complex
has complained about lack of parking in the past, and the containers are
taking up parking spaces.

Commissioner Fairbanks reported that this item was considered by the Site and _
Architectural Review Committee, and the Committee is coming to the Commission
without a recommendation.
Commissioner Dickson noted that Staff is recommending a continuance in order
that items listed in the Staff Comment Sheet can be addressed. However, the
applicant indicated he did not wish a continuance, but wished to bring the
plans before the Commission as presented. There is agreement of the
Committee for a continuance if the applicant so wishes.
Chairman Kotowski opened the public hearing and invited anyone in the audience
to speak for or against this item.
Mr. Bill Harmon, architect representing the applicant, stated that the appli-
cant feels the problems indicated in the staff report can be resolved with
the submittal of revised plans. The applicant would like an approval from
the Commission this evening in order that they can proceed with the tentative
subdivision map.
Commissioner Kasolas asked Mr. Harmon if there was a particular problem
with a two week continuance.
Mr. Harmon indicated that they feel they are close enough to satisfying the con-
cerns arxithat they would like to get moving on the project. He noted that
if it is continued, the revised plans must be submitted by this Friday, and
that would not be possible. __
Mr. Floyd Janeway, 4095 Keith Drive, Campbell, stated that they are trying to
get the project started before the rains begin. He continued that they have
beep cooperating with Staff and the Committee, and that they are close to
meeting all the necessary criteria.
Commissioner Howard asked A4r. Stafford if there are any problems with working
out the concerns under discussion at Staff level.
Mr. Stafford stated that there is a difference of opinion with regard to what
constitutes major and minor modifications. The Architectural Advisor did not
consider any one of the listed concerns to be minor.
Commissioner Kasolas asked what "5) Scale is still not in harmony with the
surrounding area." refers to.
Mr. Stafford responded that this concern was discussed by the Committee, and
it refers to the front elevations. This is a two-story building--a vertical
wall with very minor relief--and it is the Architectural Advisor's opinion
that it is not consistent with the development in the area. .
Mr. Harmon noted that the project is approximately 130 feet from a commercial
use which has an 18 foot roof-line. and he felt that the scale is in keeping
with the area. The building has design has been kept basic and matched to -
the roof lines of adjacent structures .
Commissioner Kasolas asked why the density of the project has been scaled down
from 9 units to 8 units .
Mr. Harmon noted that the Site Committee felt that the density was too high
and that there was not enough open space.

Commissioner Kasolas stated that he would like to make it clear that the
Committee was not speaking for him in this matter.
Commissioner Fairbanks noted that in studying these plans originally, the
Committee indicated a concern about a harmonious kind of blending in this
area, especially with this project in that it is pretty much the first to
go into this area. Additionally, this property has approximately 30 trees
on it and very few of them are indicated .for retention on the plans.
The elevations indicate a massive structure, and Commissioner Fairbanks
indicated that she did not feel it balanced with the neighborhood.
Chairman Kotowski asked about the status of a historical district for
Alice Avenue.
Mr. Haley noted that at this time there has been no district formed,
although there has been a meeting with the neighborhood.
Commissioner Dickson noted that this is a request for a condominium-planned
development, and the Commission is essentially voting on an ordinance. As
such, there should be complete plans and elevations before the Commission
before a decision is made.
Chairman Kotowski asked the applicant, Mr. Janeway, if he would like a
continuance .
Mr. Janeway stated that it would not be possible to get revised plans to the
Staff in two days, and he felt that all the concerns could be taken care of
to the Commission's satisfaction. Additionally, Mr. Janeway stated that all
the trees on the property are small and of no significance; the structure is
not as massive as it appears on paper; and, that he felt the units were com-
patible with the area. Fie concluded that he would be willing to do anything
to circumvent further delays. Mr. Janeway then indicated that they would like
a decision from the Commission this evening.
No one else wishing to speak, it was moved by Commissioner Fairbanks, and seconded
by Commissioner Meyer, that the public hearing be closed. Motion carried unani-
mously (7-0-0).
RESOLUTION N0. 2234 It was moved by Commissioner Fairbanks, and second-
ed by Commissioner Dickson, that the Planning Com-
mission adopt Resolution No. 2234 recommending~~
denial of ZC 83-09 due to the fact that concerns
expressed by the Architectural Advisor have not
been satisfactorily addressed in the presented
plans. Motion carried with the following roll
call vote:

UP 83-13 Public hearing to consider the application of
Wheeler, D. Mr. Damon Wheeler, on behalf of Mark Barton,
Inc., for a use permit to allow a muffler shop
in the service bays of an existing service sta-
tion, and approval of plans to add a metal stor-
age building on property known as 1387 Camden
Avenue in a C-1-S (Neighborhood Commercial)
Zoning District.
Commissioner Fairbanks reported that this. item was not considered by the Site
and Architectural Review Committee in that Staff has received a request for a
continuance from the applicant to October 25, 1983.
Chairman Kotowski opened the public hearing and invited anyone in the audience
to speak for or against this item.
No one wishing to speak at this time, it was moved by Commissioner Fairbanks,
and seconded by Commissioner Dickson, that UP 83-13 be continued to the Plan-

GP 83-09 Continued public hearing to consider possible
City-initiated City-initiated text amendments to the Housing
Element of the General Plan.
Mr. Stafford reported that comments have been received from the State Depart-
ment of Housing and Community Development which indicate several necessary
revisions to the Housing Element in order to bring it into conformance with
Article 10.6 of the Government Code. Staff is recommending a continuance in
order that these revisions may be made and submitted to the State for comment.
Chairman Kotowski opened the public hearing and invited anyone in the audience
to speak for or against this item.
No one wishing to speak at this time, it was moved by Commissioner Howard,
and seconded by Commissioner Dickson, that GP 83-09 be continued to the
Planning Commission meeting of November 22, 1983. D4otion carried unani-
mously (7-0-0).

MISCELLANEOUS
SA 83-35 Continued appeal of the decision of the Planning
Erbert, C. Director denying signing request on property known
as 579 E. Campbell Avenue (Carpet Charlie's In- __
teriors) in a C-2-S (General Commercial) Zoning
District.
Mr. Stafford stated that no further information has been received from the
applicant, therefore, Staff is recommending that the Planning Commission

uphold the decision of the Planning Director, and deny this request.

that SA 83-35 be denied without prejudice. Motion carried unanimously
(7-0-0).

SA 83-44 Request of Tor. 1Vade McClure, on behalf of San
San Jose Jose Tfercury News, to reface an existing sign on
r9ercury News property known as 2165 S. Bascom Avenue in a
C-2-S (General Commercial) Zoning District.
Commissioner Fairbanks reported that this item was before the Site and Archi-
tectural Revieta Committee this morning, and the Committee is recommending
approval.
Tir. Stafford noted that the applicant has provided a colored rendering of
the proposed sign. Staff's recommendation would eliminate the two color
bars and leave only the lettering portion of the sign. The existing sign
is approximately 15 feet in height, with the upper panel belonging to the
Dolor-Rite Plaza. Nir. Stafford concluded that the Commission does have the
authority to approve larger signs.
;~9r. Jim Cassidy, 15247 Via Pinta, hbnte Serreno, sign representative, noted
that the color bars of blue and green are a very important part of the San
Jose Mercury's logo. The San Jose Tlercury News wishes to be visible in the
community, and if the sign is reduced down to the recommended size, it will
be virtually useless. rfr. Cassidy added that there will be no other signing
on the building; and, that there is overgrown landscaping blocking a portion
of the sign.

Tt was moved by Commissioner Howard, and seconded by Commissioner Kasolas,
that SA 83-44 be approved as presented, complete with color bars, subject
to obtaining any necessary building permits.
Discussion of 1~'btion
Commissioner Kasolas stated that it was important to encourage people to
go through the proper steps to get sign approval, as has been done in this
instance.
Commissioner Dickson stated his concern about the motion for approti-al in
that he felt it weakened the ordinance. He added that the logo color
bars are self-imposed in this case and do not have to be on the sign.
Commissioner Howard indicated he would be voting in favor of the motion
because it concerns an existing sign that is being refaced, and he did
not see any change being made except in the print.
Commissioner Kasolas requested a roll call vote on this item.

Commissioner Fairbanks asked r9r. Helms about the status of standards for
industrial sidewalks and streets.
Commissioner Fairbanks stated that the Commission had attempted to come up
with different kinds of standards or alternatives to the required City-
standard, similar to the "rural" alternatives for the San Tomas Area.
rtr. Helms indicated the design recommended for the Whiteoaks area is a
seven foot wide walkway beyond the curb which allows for street lights, etc.
Commissioner Howard noted that he felt that it was important to develop some
alternative standards which would combine landscaping and rolling walkways--
so that it is a sidewalk but doesn't look like the standard walk.
T1r. Helms noted that it had been his understanding that the Commission had
desired sidewalks in the industrial areas and that Staff could come back to
the Commission with some ideas.
Commissioner Fairbanks requested that Staff report back on this subject,
noting that she would like to see alternatives such as those developed
for the San Tomas Area, and would also like Staff's advise and feelings
on the incorporation of these possible alternatives. She added that it
would be helpful to have some text on this matter.
Dir. Helms noted that he would put something together to bring back to the
Commission for their consideration.
Commissioner Dickson requested Staff to come up with recorrmlendations to
abate the problems with the Baja Saloon. •
Commissioner Kasolas stated that it was unclear to him why the density was
reduced on ZC 83-09, which was before the Commission this evening. He did
not believe that it is the intention of the Commission, as a whole, to allow
any committee to redesign any project before the Commission. He felt that it
was inappropriate for the Committee to redesign a project when it is not in
public hearing.

Commissioner Dickson stated that in the situation under ZC 83-09, the appli-
cant had been very close to, or over, the maximum density; and, did not
meet the open space requirement. The recommendation of the Architectural
Advisory was to reduce the density. Commissioner Dickson continued that
he felt the Site Committee has the right to look at a project in relation
to neighborhood harmony. He concluded that the developer has the right
to bring his project before the Commission regardless of the recommendation
of the Site Committee.
Commissioner Howard noted that the Site Committee did not have a choice
regarding density on this particular project, in that the project did
not meet the minimum open space requirements.
Commissioner Kasolas stated that the Commission must look at the fact that
there is no place for people ~aho are coming into the area to live, except
in the downtown area.
Chairman Kotowski noted that the City has reached a stage in its development
tifiere all projects are of a sensitive nature.
