APPROVAL OF MINUTES March 22, 1983 It was moved by Commissioner Meyer, and seconded by Commissioner Dickson, that the Planning Commission approve the minutes of March 22, 1983, as submitted. Motion carried unanimously (5-0-2). COMMUNICATIONS Mr. Stafford noted that correspondence received pertained to agenda items, and would be discussed at that time. Attention was directed to the rescheduled Study Session -- from April 18 to May 2 at 7:30 a.m. Mr. Stafford introduced Engineering Technician Jim Penoyer, noting that Mr. Helms was attending the Study Session being held this evening in the Senior Center pertaining to traffic at Bascom and Hamilton Avenues. Commissioner Fairbanks noted that item no. 9 (GP 82-05) on this evening's agenda would most likely be continued in order that Pir. Helms could be pre- sent for the discussion. CONSENT CALENDAR TS 83-02 Tentative Subdivision Map: Lands of San Fillipo Lands of San ~ 270 N. Central Avenue APN 279-40-32 Fillipo M 83-04 Request of Mr. George L. Coggan fora minor modifi- Coggan, G. cation to a sideyard setback to allow a second-story addition to a single family residence on property known as 1150 Nadine Drive in an R-1 (Single Family __ Residential) Zoning D istrict. -2- Staff Report Continued six-month review of use permit allowing UP 82-07 an auto repossession storage yard and allowing the Schuman, R. use of a mobilehome as an office on property known as 175 Curtner Avenue in an M-2-S (Heavy Industrial) Zoning District. It was moved by Commissioner Meyer, and seconded by Commissioner Campos, that the Planning Commission approve the Consent Calendar per Staff recommendation. Motion carried unanimously (5-0-2). Commissioners Fairbanks and Dickson noted they would register a "no" vote on TS 83-02, since they had voted "no" on the original application. ARCHITECTURAL APPROVALS S 83-03 Application of Mr. Jack Nelson for approval of plans Nelson, J. and elevations to allow the construction of a 10,890 sq.ft. industrial/office building on property known as 1320 Whiteoaks Road in a M-1-S (Light Industrial) Zoning District. Commissioner Fairbanks reported that this item had been considered by the Site and Architectural Review Committee this morning. The Committee shared the same concerns expressed by Staff and is recommending a continuance to the meeting of April 26, 1983, in order that the applicant might address these concerns. She noted that the applicant is in agreement with this recommendation for a continuance. Mr. Stafford stated that Staff is recommending a continuance to April 26. It was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that S 83-03 be continued to the meeting of April 26, 1983. Motion carried unanimously (5-0-2). *** PUBLIC HEARINGS UP 83-01 Public hearing to consider the application of Mr. Giancola, C. Cosimo Giancola for a use permit and approval of plans to allow the construction of a single family dwelling on property known as 1223 Harriet Avenue in an Interim (Low Density Residential) Zoning District. Mr. Stafford reported that the applicant is proposing to construct a one-story, single family home on the 7,550 sq.ft. lot. The lot is smaller than that now required by the General Plan (less than 3.5 units per gross acre); however, because the lot was legally created prior to the General Plan change, the parcel can be built on. This item is before the Commission because the proposal is located in the San Tomas Interim Zoning area which requires the Commission to approve all projects valued at over $50,000. Staff is recommending approval, subject to conditions listed in the Staff Comment Sheet. Commissioner Fairbanks noted that Harriet Avenue is one of the streets being considered for alternative street improvements, and requested that the pro- cedure for these alternative street improvements be put into effect on this property. -3- Chairman Kotowski declared the public heaving open and invited anyone in the audience to speak for or against this item. No one wishing to speak, it was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the public hearing be closed. Motion carried unanimously (5-0-2). RESOLUTION N0. 2180 It was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the Planning Commission adopt Resolution No. 2180 approving UP 83-01, sub- ject to conditions as listed in the Staff Comment Sheet (attached hereto). Motion carried with the following roll call vote: AYES: Commissioners: Campos, Meyer, Fairbanks, Dickson, Kotowski NOES: Commissioners: None ABSENT: Commissioners: Kasolas, Howard *** UP 80-10 Public hearing to consider the application of Mr. Pen Land & Paul Nowack on behalf of Pen Land and Cattle Co. Cattle Co. for a modification to approved plans to allow the construction of 6 townhomes on property known as 1201 W. Parr Avenue in an Interim (Low-Medium Density Residential) Zoning District. Commissioner Fairbanks reported that this item had been considered by the Site and Architectural Review Committee this morning. The Committee expressed con- cern with the density of the project, and the densities of developments in the surrounding area, and felt that this project was a balance between the high density of Bracebridge Court to the west ,and the low. density to the west. The.. modified site plan presents more open space than the original site plan, ad- dressing the open space policy and the impact on the surrounding R-1 zone. The Committee also discussed the fact that this was a use permit and that a use permit runs with the land. Staff is now conditioning similar use permits with an expiration date. The Committee is recommending approval. Commissioner Campos asked if the density of this project was comparable to the development north of this site. Commissioner Fairbanks stated that the density of this project is the same; however, there is less lot coverage. The calculated density for this project remains at 12.5 units per gross acre; however, the modified plans indicate a reduction in unit size (from approximately 1800-2200 sq.ft.) and cover less of the site, allowing for more open space. Commissioner Dickson stated his concern with the density, noting that all the lots in the area are well-defined and that this project should provide a harmonious transition between the higher density and the single family homes. He felt that this project should be developed at the lower end of the density scale. Commissioner Kasolas entered the Council Chambers at 7:55 p.m. Commissioner Fairbanks noted that earlier when the Commission started reviewing this area under the Interim Zone, this particular parcel was not one of the -4- pieces of property that the Commission had under consideration for down-zoning because there was a valid use permit on it at that time. She added that she believed the existing Low-Medium Density zoning has existed on this parcel for some time--since 1970 or so. Commissioner Campos asked how the reduction in unit size compared with the previous application. Mr. Stafford indicated that the previous plans shows 2-1/2 story structures with underground parking; the modified plans indicate a 2-story structure with at-grade parking. Additionally, the footprint of the building is smaller. Chairman Kotowski delcared the public hearing open and invited anyone in the audience to speak for or against this item. Mr. Paul Nowack, applicant, spoke in favor of the project, noting that the units now proposed are 2-story with at-grade parking, approximately 1300 sq.ft. per unit, proposed selling price around $130,000, and designed for suitability fora cross-section of the market. The open space is greater than the original proposal, as well as the setback being increased from 10 feet to 16 feet where abutting property line of the single family home. Mr. Lee Petersen, 1156 Hack Avenue, presented a petition to the Commission in opposition to the project (attached hereto); and, requested that the property be rezoned. He cited traffic and preservation of the R-1 neighborhood as reasons for opposition. Chairman Kotowski asked Mr. Petersen if he was opposed to any development in the San Tomas Area, or arguing only against this particular project. Mr. Petersen stated that he would like the house that is put on this lot to improve the quality of the neighborhood, and he felt that the higher densities affected everyone in the neighborhood. Chairman Kotowski asked Mr. Stafford if this particular site was one of the last in this area that has not been developed. Mr. Stafford noted that in the immediate vicinity, this parcel is the last undeveloped site. There are a few lots in the area that are undeveloped and are zoned for single family residential. Mr. Henry Henriksen, 1597 Hack Avenue, adjoining property owner, stated that he had no objection to this development and felt that the modified site plans were better than the original in providing a lower roof-line. He noted that the development would be for the betterment of the property. No one else wishing to speak, it was moved by Commissioner Fairbanks, and seconded by Commissioner Kasolas, that the public hearing be closed. Motion carried unanimously (6-0-1). Discussion Commissioner Dickson stated that he felt the Commission would be wrong in approving this project due to the density. -5- RESOLUTION N0. 2181 It was moved by Commissioner Kasolas, and seconded by RESOLUTION N0. 2182 Commissioner Meyer, that the Planning Commission adopt -- Resolution No. 2181 recommending approval of UP 80-10, modification to the previously approved use permit, allowing the construction of six townhomes subject to - conditions listed in the Staff Comment Sheet (attached); and, that the Planning Commission adopt`Resolution No. 2182 recommending that the City Council approve a Planned Development Permit for this project, once the Interim Zoning is removed from this property. Motion carried with the following roll call vote: AYES: Commissioners: Kasolas, Campos, Meyer, Fairbanks, Kotowski NOES: Commissioners: Dickson ABSENT: Commissioners: Howard Commissioner Fairbanks requested that the procedure for alternative street im- provements be initiated for this property. PD 83-02 Public hearing to consider the application of Mr. Dale Crocker, Inc. Drumm on behalf of R. L. Crocker, Inc., fora Planned Development Permit to allow the construction of a 40,800 sq.ft. mini-storage warehouse on property known as 241 W. Sunnyoaks Avenue in a PD (Planned Development/Commercial, Office, or Industrial) Zoning District. Commissioner Fairbanks reported that this item had been considered by the Site and Architectural Review Committee this morning. The Committee is recommending a continuance based on discussion contained in the Staff Comment Sheet. Mr. Stafford reviewed the project as well as Staff's concerns for the Commission. Commissioner Campos asked how far back from Winchester Blvd. is the ingress/ egress to the project. He noted that there have been concerns raised previously regarding traffic and the hazardous intersection at this site. Mr. Stafford indicated that there is approximately 80 feet from the street to the driveway, and noted that in past proposals the Traffic Engineer has required that any driveway must be as far away from Winchester Blvd. as possible. Commissioner Campos asked if the possibility of a signal at this intersection has been studied. Mr. Penoyer noted that it was his understanding that the installation of a signal at this intersection has been somewhat contingent upon the development of the site; however, the requirement of a signal has not been part of the conditions of approval for the development. Commissioner Kasolas asked what the minimal landscaping is between the property line and the footprint of the building. Mr. Stafford indicated that it is 3 feet in some places. -6- Commissioner Kasolas expressed his concern with the small amount of landscaping. He noted also that the previous proposal for an office building had a smaller footprint than this application. Mr. Stafford noted that the lot coverage is approximately 45% for this project; lof coverage in industrial areas typically approaches 40%. z Chairman Kotowski asked if there has been a traffic study done of Winchester Blvd. in the last six months in this area, and if there has been an increase in traffic on Winchester Blvd. since the last application on this property. Mr. Penoyer stated that he would report this information at the next meeting. Chairman Kotowski declared the public hearing open and invited anyone in the audience to speak for or against this item. Mr. Dale Drumm, applicant, stated that he is in the process of having George Nolte and Associates prepare a traffic study and use intensity study of the project; as well as redesigning the project to address concerns expressed by Staff. Chairman Kotowski asked that the traffic study be concerned with the present and future traffic levels, as well as traffic generated with this project. Mr. Bill Puterbaugh, 916 Old Orchard Road, asked why the .Commission kept accepting applications for mini-storage on this site. Chairman Kotowski explained that just because one application is denied the Commission does not preclude~a similar application from being considered for the property. The Commission must consider all applications .which satisfy the zoning on the property. Mr. Ernest Juhasz, 945 Robin Lane, spoke against the proposal, citing traffic as a major concern. He also questioned the financial impact on the City if the site is developed and additional easements are needed to expand the existing streets, thereby causing the City to have to purchase developed land at a higher price. Mr. Craig Cowan, 931 Old Orchard Road, noted his concern with the traffic and the line of sight around the curve coming off the expressway, and felt that the intersection needed controls. Mr. Richard McCullough, 771 Old Orchard Road, stated that he was not opposed to a mini-storage facility on this site; however, this proposal did not appear to be a mini-storage facility, but rather a warehouse of gross proportions. It appears to cover more than 45% of the site. He stated that he is opposed to this project. Commissioner Kasolas asked Mr. McCullough if he saw any difficulties with having a 20 foot high building right on the property line, relative to traffic movement in the area. Mr. P~cCullough stated that he felt a two-story building would cut out all sight distance on the curve off the expressway, thereby causing collisions when there was any congestion on Winchester. He felt that the sight distance would be totally inadequate. -7- Mrs. Pat Woodstock, 970 Old Orchard Road, questioned the number of storage units contained in the facility, and noted that there did not appear to be much of a sound barrier between this project and the residential area. She distributed a list of things she would like the project to have to the Commission, and noted that she would discuss these items at the next meeting this item is considered. (List attached hereto.) Acting City Attorney Duckworth entered the Council Chambers at 8:45 p.m. Commissioner Fairbanks asked that the Public Works Department address the site distance problems for this project at the next meeting. Commissioner Dickson stated that he would like the County to come to the meeting and give the Commission a report on what they plan to do to clean up the mess they created in this area. Mr. Drumm stated that they are proposing a multiple story building because of cost feasibility,and noted that the use is a low traffic generater. Mr. Richard Crocker stated that he appreciated the concerns of the residents and tried to take these concerns into account when designing the building. The revised plans will indicate a masonry wall between the project and the residential area, the design of the building provides no windows overlooking the residential area, and the majority of the traffic will be inside the building. Mr. Dod Woodstock, 970 Old Orchard Road, stated that he has always maintained that this piece of property cannot be developed. No one else wishing to speak, it was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that PD 83-02 be continued to the Planning Commission meeting of April 26, 1983. Motion carried unanimously (6-0-1). Discussion Commissioner Kasolas stated that he had concerns with the massive design of the building, and was not sure what putting a structure like this in the middle of a residential neighborhood might do to the neighborhood. He added that he had difficulty with a two-story building set right on the property line, on a main street, noting that everything from Hacienda to Lark Avenues is set-back off the street. He expressed a need to make Winchester Blvd. look like something other than a used-car lot. *** The Commission took a break at 9:00 p.m.; the meeting reconvened at 9:05 p.m. *** It was the consensus of the Commission to consider item 11 at this time, since the applicant was present. -8- S 83-02 Request of Mr. Joseph F. Pizzo for an extension of Anderson, K. approval and change of building materials on pre- viously approved plans allowing the construction of a 2,568 sq.ft. warehouse building on property known as 132 Kennedy Avenue in an M-1-S (Light Industrial) Zoning District. Mr. Stafford reported that the applicant is requesting a reinstatement and extension of approval of the previously approved application which expired on March 23, 1983; and, approval of a change in building materials from concrete tilt-up to concrete block. Staff expresses concern regarding~:the proposed change in building materials. The concrete tilt-up building indi- cated a combination of textured treatment and painted relief on the eleva- tions; whereas, the concrete block elevations do not indicate either of these relief treatments. Staff is recommending a continuance so that the applicant may submit revised elevations providing an approximate architectural treatment as previously approved. Staff is recommending a reinstatement and extension of approval to March 23, 1984. Chairman Kotowski asked if the Architectural Advisor had reviewed these changes. Mr. Haley noted that the Architectural Advisor concurred with Staff's concerns regarding the building materials. Commissioner Campos asked the difference between the concrete tilt-up and concrete block structure. Mr. Stafford indicated that the tilt-up is poured off-site and usually has a textured surface;whereas, the concrete block shows the block pattern. They are, essentially, two different manners of construction. Commissioner Fairbanks stated that she did not feel that this item would have to go back to Site anal Architectural Review. Commissioner Meyer stated that perhaps this item should go back to site review to insure that the building would blend into the area with the newly proposed building materials. Mr. Pizzo, applicant, noted that all the other buildings on this street are concrete block, and that he could do something around the front of the building to make it more architecturally appealing. He added that the change in building materials is necessary due to cost. Mr. Stafford noted that the reason Staff is recommending a continuance is because there are different types of block, and Staff would like the opportunity to get with the applicant to design something that would break up the concrete look of the building. It was moved by Commissioner Fairbanks that the Planning Commission approve this request subject to previous conditions with the addition of a condition regarding revised building elevations to be approved by the Planning Director. Motion dies for lack of a second. -9- It was moved by Commissioner Dickson, and seconded by Commissioner Fairbanks, that the Planning Commission approve this request subject to previous con- ditions with the addition of a condition regarding revised building elevations to be approved by the Planning Director, after submittal of comments by the Architectural Advisor. Motion carried with a vote of 4-0-1-1, with Commissioner Kasolas abstaining due to a possible conflict of interest. *** GP 83-01 Continued public hearing to consider City-initiated City-initiated amendments to the Land Use Element of the General Plan. Per. Stafford reviewed the proposed amendments to the Land Use Element for the Commission, indicating which policies are newly proposed. Commissioner Kasolas asked how poiiicy number 10 "A~:yariety of housing types and densities shall be encouraged" fit in with the San Tomas policy with its 12,000 sq.ft. lots. Mr. Stafford responded that the Housing Element contains a statement that the City of Campbell shall provide housing opportunities for all economic segments of the community. Commissioner Kasolas asked if it is appropriate in the Land Use Element to have a policy for a specific area within the community, as opposed to a specific district; and, don't you have to treat all segments of the community equally. Chairman Kotowski noted that a similar problem was presented at the Planning Commissioner's conference in Monterey, and the answer was that a city can establish a pattern if they want to maintain a particular atmosphere in a section of their community, they can actually introduce islands into the community if they find that they are actually maintaining a character. Mr. Duckworth asked Commissioner Kasolas if he was concerned with possible discriminations. Commissioner Kasolas stated that he was more concerned that everyone be treated equally. He continued that he saw inconsistency in policy number 10--within the San Tomas Area, noting that the San Tomas Policy should be specifically limited to each immediate neighborhood or immediate lots (i.e. Audrey Avenue). To apply that same policy throughout the whole community means that people are either going to have to be very wealthy or very poor to live in the average neighborhood, with the poor areas being blighted. He felt that the San Tomas; Policy was too broad, and that the Commission had not really heard from the total community--only a few specific people from a few specific areas. He questioned what would happen if an apartment house burned down, and the re- placement density is no less than what the original structure was built at -- can it be rebuilt at the old density, or will there be people out of housing because it must be rebuilt at the lower density. Commissioner Kasolas stated that he felt the San Tomas Area should be divided up and considered on a con- sidered on an area by area basis. Mr. Stafford noted that, in reference to the hypothetical apartment house, he can think of a number of instances where the developer has come in fora rein- statement of plans and it cannot be given because of a change in~;the density. -10- Mr. Stafford continued that in the case of a single family home, if the lot was a legal lot prior to the adoption of the General Plan, it can be rebuilt on. In the case of multiple family zoning, you may not be able to build the same number of units if the structure is destroyed. Commissioner Fairbanks expressed concern with policy number 6 "The City shall investigate means to utilize (on a long term basis) the high school property to serve as the City's Community Center", noting that the policy 'is not totally consistent with the Open Space Element, and would ask that Staff have the Open Space Element available for the Council when this item is being considered by them. She added that she was referring in particular to closed school sites; and, noted that the City has two community centers (Campbell High School, and San Tomas School). Chairman Kotowski asked about the Open Space Overlay zone on schools. Mr. Stafford responded that to his knowledge it was not applied to the school sites, in that it was not adopted by the Council. Commissioner Campos asked if policy number 5 "The City shall pursue a redevelop- ment program for the central Campbell area." locked the City into the central area only, or if the need should arise to modify this area, could it be done. Mr. Stafford stated that modifications could definitely be done. Commissioner Campos asked if policy number 4 "Means to revitalize the downtown area shall be investigated" excluded the task forces that have participated in projects in the past. Mr. Stafford indicated that he did not interpret this statement to exclude the former task forces, however, if the Commission wished, a clarification could be added. Commissioner Campos stated~;that he would prefer the policy contain a state- ment to include citizen participation. Chairman Kotowski declared the public hearing open and invited anyone in the audience to speak for or against this item. No one wishing to speak, it was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the public hearing be closed. Motion carried unani- mously (6-0-1). RESOLUTION N0. 2183 It was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the Planning Commission adopt Resolution No. 2183 recommending that the City Council adopt the Land Use Element as amended; and, that transcripts of these minutes be included in the information presented to the City Council. ~iccuscinn Commissioner Kasolas proposed an amendment to the motion which would delete Section E, San Tomas Policy; and'~.that the policy bla returned to Staff level for obtaining facts and figures regarding those parcels of property that are -11- presently vacant or underdeveloped. Additionally, the City should encourage development to accommodate the various lifestyles of it's residents in accord- ance with policy number 10; and, this should be done on a section by section basis--not on the entire San Tomas Area. Motion died for lack of a second. Discussion on Original Motion Commissioner Dickson stated that he would like to see a policy similar to the San Tomas Policy in effect for the entire City, not just the San Tomas Area, that would protect whatever rural character is left in the entire city. Commissioner Kasolas noted that one of his concerns is that many of the parcels in the city should be redeveloped for the betterment of the community, and this must be economically feasible, which would mean 6-9 units per acre in some areas-- not 3. Commissioner Dickson stated that he is not in favor of higher densities, and felt that economics would take care of the redevelopment. He felt that any policy adopted should be a "city" policy, not an "area" policy. He added that he did not find policy number 10 out of line, but noted that a neighbor- hood should be carefully looked at when applying the policy. Commissioner Fairbanks commented that on this presented document, part of the goals and objectives have been before the Commission for a long time; and, part of these goals and objectives is to recognize the distinct character of an area of our city. Mr. Stafford noted that the Traffic Engineer is unable to be present at this evening's meeting due to a study session with the Council. Therefore, Staff is recommending a continuance of this item. Chairman Kotowski declared the public hearing open and invited anyone in the audience to speak for or against this item. No one wishing to speak, it was moved by Commissioner Dickson, and seconded by Commissioner Fairbanks, that GP 82-05 be continued to the meeting of May 10, 1983. Motion carried unanimously (6-0-1). *** -11- TA 83-01 Continued public hearing to consider possible text City-initiated amendments to Sections 21.08 (Single Family Resi- dential) and 21.56 (Exceptions to Area Provisions) of the Campbell Municipal Code. Mr.- Stafford reported that, in response to concerns expressed by the Commission at its last meeting regarding this item, Staff has proposed a modification to the Home Occupation Permit regulations. This addition would specify limitations for commercial vehicles that may be kept on the residential premises. He added that if a use was in effect prior to annexation, that use is permitted. Mr. Stafford continued that Staff is recommending that the existing section 21.56.080 be deleted and that the matter of additional dwelling units be addressed at the public hearing scheduled for April 26 regarding "companion units". There was brief discussion regarding the number of vehicles a resident may have parked on his property, as well as legal parking spaces. Chairman Kotowski declared the public hearing open and invited anyone in the audience to speak for or against this item. No one wishing to speak, it was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the public hearing be closed. Motion carried unanimously (6-0-1). RESOLUTION N0. 2184 It was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the Planning Commission adopt Resolution No. 2184 recommending that the City Council approve the revised R-1 text, and delete Section 21.56.080 of the Campbell Municipal- Code. Motion carried with the following roll call vote: AYES: Commissioners: Kasolas, Campos, Meyer, Fairbanks, Dickson, Kotowski NOES: Commissioners: None ABSENT: Commissioners: Howard It was the consensus of the Commission that the matter of additional dwelling units in an R-1 zoning district be considered under discussion of "companion units", scheduled for public hearing on April 26, 1983. *** Staff Report Staff report regarding items brought up by the Planning Commission at its meeting of March 22, 1983: trash on Steinway & Peggy Avenues, and roof equipment on Vandell Way. It was the consensus of the Commission that the Staff report be noted and filed. *** -12- ITEMS BROUGHT UP BY COMMISSIONERS There was discussion regarding obtaining the services of a Landscape Architect for assistance to the Site and Architectural Review Committee. Commissioner Fairbanks noted that she has given Staff the name of a Landscape Architect they may wish to contact who may be available to offer his assistance. It was the concern of the Commission that some guidelines be established:=for the selection of the advisor, as well as to clarify the advisor's role. *** AD.I(111RNMENT It was moved by Commissioner Fairbanks, and seconded by Commissioner Meyer, that the meeting be adjourned.
