ROW Dedication - 2009May 19, 2009 Byron Kentor Anderson, McCoy & Orta 100 N. Broadway, 26th Floor Oklahoma City, OK 73102 RE: Inv.614/41-0901439/Lloyd Square Dear Mr. Kentor, This letter is a follow-up to our telephone conversation on May 18, 2009 and in response to the a-mail, dated May 18, 2009 that you sent to Lisa Petersen regarding a proposed dedication of property frontage for a City of Campbell public works project affecting 501-531 E. Campbell Avenue, Campbell, CA 95008 (the "Property"). The City of Campbell adopted the East Campbell Avenue Master Plan which calls for street improvements along E. Campbell Avenue including wider sidewalks along the north side of Campbell Avenue. To effectuate the plan, the City needs approximately 5 feet of landscape area along the frontage of the Property, which encompasses approximately 1,530 square feet of the Property (the "Dedication") (description of the Dedication is attached herein as Exhibit A) The Dedication does not affect ingress/egress, easements or parking on the Property. Typically, the property owner would be required to install at his cost the applicable improvements at the time of redevelopment. The City has agreed to pay for and complete all applicable improvements in exchange for the Dedication. The City will be responsible for all conforms and restoration of the Property including, but not limited to replacing landscaping and irrigation. The property owner and their successors and/or assigns have no financial responsibility whatsoever in the completion of this public works project or for any restoration work performed on the Property. The zoning of the Property is currently Planned Development (PD) and General Plan designation of the Property is Central Commercial. The Dedication will not affect the PD zoning or General Plan designation of the Property. In that the Dedication is a dedication of land and not a condemnation, there are no proceeds.
