Dear Mr. Silver,
The Planning Division has reviewed your submitted business description, stamped as received
November 6, 2008, and preliminary floor plan, stamped as received November 7, 2008, for the
establishment of a massage establishment in the Pruneyard Shopping Center at 1875 S. Bascom
Avenue, Suite 650. The Planning Commission on March 13, 2007, approved a Conditional Use
Permit (PLN2007-04) for a massage establishment at this location for the Los Gatos Day Spa,
pursuant to Planning Commission Resolution No. 3800 (attached).
Based upon your business description and preliminary floor plan, the Planning Division has
found that your proposed massage establishment is similar to the use previously approved by the
Planning Commission and consequently a new Conditional Use Permit or a modification to the
Conditional Use Permit is not required. A Zoning Clearance (PLN2008-172), pursuant to the
previously approved Conditional Use Permit (PLN2007-04), is hereby issued, subject to the
original Conditions of Approval (attached).
In the event that the nature of the business changes in a manner inconsistent with the previous
approval or with the attached Conditions of Approval, you will be required to process a
modification to the prior Conditional Use Permit.
Prior to establishing the business, you must submit a signed copy of the attached Conditions of
Approval (signature line on the last page), procure a Business License from the City Clerk's
Office, obtain a Building Permit from the Building Division, and secure all necessary Police
Department Massage Permit approvals.
Please note that the previously approved Conditional Use Permit (PLN2007-04) is only valid for
one (1) massage establishment. Therefore, no additional massage establishments may be
established pursuant to this Conditional Use Permit.

Massage Envy -Franchised locations currently have over 500 open locations in 38 states.
Massage Envy has been in business for over five years, growing rapidly in the last three
years. All locations are owned and operated by franchises. There are over 15 open
locations in the Bay Area. We offer a membership based program for massage in a
comfortable and clean environment. We also welcome walk-in customers as well. Our
therapists are all CMT's with insurance.
We are proposing a location in The Pruneyard Shopping Center. The location will be just
over 3000 square feet on the ground level. The clinic will have 11 treatment rooms for
massage, a tranquility room to wait before the massage, a lobby featuring retail products,
2 restrooms, 2 offices, an employee break room, and housekeeping area.
Proposed hours could follow the franchise standard, but are free to be modified based on
city requirements and the shopping center needs.
Standard franchise hours =
Monday -Friday, Sam - l Opm, Saturday, Sam - 6pm, and Sunday l Oam - 6pm.
Proposed hours the Campbell location =
Monday -Friday, gam - 9pm, Saturday, gam - 8pm, and Sunday l Oam - 6pm.
The number of employees in the clinic at one time will vary from 3 - 25, based on the
volume of business day to day. We anticipate hiring over 20 employees to open and by
the one-year mark hope to have over 50 employees. Most employees are part time,
working anywhere from 2 - 25 hours per week.
Noise: Our business is based on relaxation; therefore, we maintain a quiet and calm
atmosphere in our clinic.
There is plenty of parking at The Pruneyard Shopping Center considering our clinic has a
flow of customers for 11 treatment rooms.
Massage Envy is considered at the top of the industry for membership based massage
