PUBLIC HEARINGS
1. Public Hearing to consider the application of Mr. Bruce Watson
for a Conditional Use Permit (PLN2009-46) to allow the
establishment of a medical (chiropractic) office use on property
owned by Martin Herz Associates located at 2207 S. Bascom
Avenue in a C-2-S (General Commercial) Zoning District. Staff
is recommending that this project be deemed Categorically
Exempt under CEQA. Planning Commission action final unless
appealed in writing to the City Clerk within 10 calendar days.

2. Public Hearing to consider the application of Mr. David Ford for
a Sign Exception (PLN2009-50) to a previously approved Sign
Program (PLN2004-68) for the San Tomas Plaza Shopping
Center to allow for additional signage for the CVS Pharmacy
(former Long's location) to allow four wall signs for an existing
business on property owned by AI-Mor located at 100 N. San
Tomas Aquino Road in a C-1-S (Neighborhood Commercial)
Zoning District. Staff is recommending that this project be
deemed Categorically Exempt under CEQA. Planning
Commission action final unless appealed in writing to the City

3. Public Hearing to consider the application of Ms. Myrna Schultz,
on behalf of Strategic Restaurants Acquisition Company II, LLC,
for a Conditional Use Permit (PLN2009-04) to allow 24-hour
operations at an existing Burger King fast food restaurant with
an existing drive through component on property owned by Mr.
Albert Tung located at 49 W. Hamilton Avenue in a C-2-S
(General Commercial) Zoning District. Staff is recommending
that this project be deemed Categorically Exempt under CEQA.
Planning Commission action final unless appealed in writing to
