Use Permit - Withdrawn - 2009ITEM N0.3 Staff Report • May 12, 2009 Public Hearing to consider the application of Ms. Ann Duong for a PLN2009-45 Conditional Use Permit (PLN2009-45) to allow the establishment of a Duong, A. massage use on property owned by Pries & Paul Koula located at 393 E. Hamilton Avenue, Suite 201 in the C-2-S (General Commercial) Zoning District. STAFF RECOMMENDATION That the Planning Commission take the following action: 1. Remove this item from the agenda. DISCUSSION On April 29, 2009, Ms. Ann Duong, the applicant, submitted a letter to the Community Development Department requesting that the Conditional Use Permit application (PLN2009-45) be withdrawn. ANALYSIS In that a public hearing notice was provided in the newspaper the item was kept on the agenda. In light of the letter to withdraw (reference Attachment 1, Letter of Withdraw), staff requests that this item be removed from the agenda. Attachments 1. Letter of Withdraw 2.
