Ouellette and Sons, Inc. 2767 Aiello Drive San Jose, CA 95111 Re: Fence Exception Application -File No: PLN2009-41 -- 88 Llewellyn Avenue Dear Applicant, Thank you for your submittal of a Fence Exception application for a new one foot lattice extension to the existing rear and side fences of the property. The Community Development Director has determined that the requested Fence Exception is acceptable in that it: 1. Will not impair vehicular or pedestrian safety; 2. Will result in a more desirable site layout by improving privacy from the raised rear deck on the northern edge of the property and provides a consistent fence design around the rear yard; 3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of the change; and 4. Will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Therefore, your request for a Fence Exception has been conditionally approved, subject to the following conditions of approval: 1. The development of the project shall substantially conform to the plans stamped as approved on April 21, 2009. 2. The applicant shall obtain a Building Permit from the Campbell Building Division prior to installation of the approved fence. This action is effective in ten calendar days, unless appealed in writing to the City Clerk by 5:00 p.m. on May 1, 2009.
