Campbell Ave. Campbell, CA 95008 Re: File No: PLN2009-144 Address: 866 Campbell Ave. -Thai Orchid Restaurant Application: Tree Removal Permit Dear Applicants: The Community Development Director has conditionally approved your Tree Removal Permit application (PLN2009-144) for the removal of one (1) multi-trunk (18" - 19'' - 24" diameter) Siberian Elm (Ulmus pumilu) tree located within the front yard of property located at the above referenced address. Your request has been approved subject to the following Condition of Approval: 1. The applicant shall plant one (1) 36-inch box Japanese Black Pine tree as indicated on the revised replanting plan. The replacement tree shall be planted within 30 days of the effective date of this approval, unless accepted horticultural practices dictate a preferential planting period for the species chosen as a replacement tree. The Tree Removal Permit has been approved based upon the City's determination, with a supporting recommendation by a Certified Arborist, that the tree has damaged the main water supply pipe that serves the principal structure, necessitating removal of the tree to allow replacement of the pipe. It has been further determined that this situation cannot be remedied through a reroute of the pipe as this would incur major root loss to the tree, compromising its health and stability. This approval is final in l0 calendar days (excluding days during the City Hall closure) of the Community Development Director's decision, unless an appeal is received in writing at the City of Campbell City Cferk's Office, on or before January 7, 2010 (due to the City Hall closure). If an appeal is received, you will be immediately notified of its receipt. Otherwise, you may remove the subject tree at the close of the appeal period. Planning Manager encl: Approved Removal and Replanting Plans CITY of CAMPBELL Communirv Development I?apartment November 20, 2009 NOTICE OF TREE REMOVAL PERMIT APPLICATION Notice is hereby given that the Community Development Director of the City of Campbell has received an application for a Tree Removal Permit (PLN2009-144) for the removal of one (1) multi-trunk (18" - 19" - 24") diameter Siberian Elm (Ulmus pumila) tree located in the front yard of property located at 866 E. Campbell Avenue (Thai Orchid restaurant), due to damage caused to the main water supply pipe running directly underneath the center of the tree. The removal of this tree is subject to the replanting requirement of the Campbell Municipal Code. The 10 day comment period for this application will begin on November 20, 2009, and end on November 30, 2009. Any comments regarding this application must be submitted in writing to the Planning Division before 5:00 p.m. on November 30, 2009, as a decision will be rendered after this time. Copies of the Arborist Report and project plans are available for review from 8:00 a.m. to 5:00 p.m. at the Community Development Department, City Hall, 70 North First Street, Campbell, California. Decisions by the Community Development Director are final in 10 calendar days following the date of approval, unless an appeal is received in writing at the City of Campbell City Clerk's Office, 70 N. First Street, Campbell, prior to the end of the appeal period. A written appeal must be accompanied with the required $105 appeal filing fee.
