Campbell Avenue Dear Mr. Small: The Campbell Planning Division has reviewed your application for a sign permit for a new internally illuminated wall sign attached to the front of the Nob Hill Grocery Store located at 1602 W. Campbell Avenue. The proposed "fete's Coffee & Tea" wall sign measures approximately 17.25 square feet. Chapter 21.30.080(A)(1) allows only one wall sign per business. Currently Nob Hill has been approved for five wall signs, which exceeds the current sign standards. Additionally, pursuant the approved Master Sign Program for Kirkwood Plaza (the shopping center which includes Nob Hill) also restricts businesses to one wall sign. The current wall signage associated with Nob Hill was approved prior to the adoption of the current sign regulations and is considered nonconforming. The application for a Sign Permit is therefore denied by the Community Development Director since the proposed sign exceeds the maximum permitted number of signs allowed under both the Sign Ordinance and the associated Master Sign Program. This decision is appealable to the Planning Commission. An appeal shall be made in writing to the City Clerk and accompanied by the $150 appeal fee within ten (10) calendar days following the date of the decision, on or before 5:00 p.m. Friday, September 18, 2009. Any decision not appealed within the ten-day period shall be final. PLN2009-115 Sign Permit Application 1602 W. Campbell Avenue Page 2 of 2 A written letter must be submitted that includes the reasons for the appeal. The Planning Commission has the authority to approve a greater number of signs when it finds all of the following: a. The signs otherwise allowed by this chapter would not be visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located; b. The signs could not be made visible and intelligible to a person of normal sight by allowing in increase in the area or height of the sign pursuant to the Sign Ordinance; c. The additional signs comply with all the requirements of this chapter, except for the limitations on the number of signs; and, d. The number of signs allowed pursuant to the Sign Ordinance shall not exceed the minimum number of signs necessary to make the signs visible to the public due to distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located, which could not be accomplished by the number of signs otherwise allowed by the Sign Ordinance.
