Rincon Avenue Dear Mr. Schnell, On January 2, 2009, the Community Development Director conditionally approved your Tree Removal Permit application (PLN2008-149) for the removal of fifty (50) protected trees in conjunction with a comprehensive new landscaping plan, as indicated on the approved Tree Removal Plan (enclosed), dated as received by the Planning Division on December 1, 2008, for property located at 400 W. Rincon Avenue. Your application has been approved subject to the following Condition of Approval: 1. The applicant shall plant sixteen (16) 24 inch box, and forty-nine (49) 15-gallon trees as indicated on the approved Replanting Plan, dated as received by the Planning Division on January 14, 2009. The Tree Removal Permit has been approved based upon the City's determination, with a supporting recommendation by a Certified Arborist, that the trees are inflicted by disease or structural defect, or have been planted in inappropriate locations leading to damage to adjacent structures. It has been determined that this situation cannot be controlled or remedied through tree trimming or pruning as this will accelerate the decline of the trees or be ineffective at preventing future property damage. Please note that this approval does not pertain to trees located within the public right-of--way. This approval is final in 10 calendar days of the Community Development Director's decision, unless an appeal is received in writing at the City of Campbell City Clerk's Office, on or before Thursday, February 12, 2009. If an appeal is received, you will be immediately notified of its receipt. Otherwise, you may remove the subject tree at the close of the 10 day appeal period. January 22, 2008 NOTICE OF TREE REMOVAL PERMIT APPLICATION Notice is hereby given that the Community Development Director of the City of Campbell has received an application for a Tree Removal Permit (PLN2008-149) for the removal of 50 trees of various species and sizes located within the `Rincon Gardens' senior living community. The applicant has proposed to plant 16 24-inch box and 49 15- gallon replacement trees as part of a new comprehensive landscaping plan. The 10 day comment period for this application will begin on January 23, 2009 and end on February 2, 2009. Any comments regarding this application must be submitted in writing to the Planning Division before 5:00 p.m. on February 2, 2009 as a decision will be rendered after this date. Copies of the Arborist Report and project plans are available for review from 8:00 a.m. to 5:00 p.m. at the Community Development Department, City Hall, 70 North First Street, Campbell, California. Decisions by the Community Development Director are final in 10 calendar days following the date of approval, unless an appeal is received in writing at the City of Campbell City Clerk's Office, 70 N. First Street, Campbell, prior to the end of the appeal period. A written appeal must be accompanied with the required $105 appeal filing fee.
