Motion carried unanimously (6-0-1, Commissioner Kasolas being absent). CONSENT CALENDAR TS 82-02 Tentative Subdivision Map: Lands of Crafford Crafford, W. APN 305-31-001, 002 (175 & 195 W. Rincon Avenue). ZC 81-07 Request for reinstatement of development schedule Woodgate Dev. Co. for ZC 81-07, the application of Woodgate Develop- ment Co., to allow the construction~of 47 townhomes on property known as 44 East Latimer Avenue, in a P-D (Planned Development/Medium Density Residen- tial and/or Professional Office) Zoning District. It was moved by Commissioner Dickson, and seconded by Commissioner Fairbanks, that the Consent Calendar be approved as per Staff recommendations. Motion carried unanimously (6-0-1). ARCHITECTURAL APPROVALS S 82-04 Continued application of Mr. Murray James on be- James, M. half of The Refinery for approval of plans and elevations to allow the addition of a 5 unit apartment building to an existing 8 unit apart- ment building on property known as 180 & 181 Burnham Court in an R-2-S (Multiple Family Residential) Zoning District. -2- Commissioner Kotowski noted that this item had been before the Site and Archi- tectural Review Committee this morning, and that the Committee is recommending a continuance to the meeting of May 11, 1982, with the applicant's permission. Mr. Kee stated that Staff's recommendation is also fora continuance to the meeting of May 11, 1982. It was moved by Commissioner Fairbanks, and seconded by Commissioner Kotowski, that S 82-04 be continued to the Planning Commission meeting of May 11, 1982 in order that the applicant might address concerns of the Site and Architectural Review Committee. Motion carried unanimously (6-0-1). S 82-05 Application of Mr. Richard Sayer for approval of Sayer, R. plans to allow exterior modifications to an exist- ing restaurant on property known as 1805 S. Win- chester Blvd. in a C-2-S (General Commercial) Zoning District. Commissioner Kotowski reported that the applicant's representative met with the Site and Architectural Review Committee this morning and that the Committee is recommending a continuance to the meeting of May 11, 1982, with the applicant's concurrence. It was moved by Commissioner Fairbanks, and seconded by Commissioner Howard, that S 82-05 be continued to the meeting of May 11, 1982. Motion carried unani- mously (6-0-1). *** PUBLIC HEARINGS UP 82-05 Continued public hearing to consider the appli- Brown, W. cation of Mr. Warren Brown for a use permit to allow a 400 square foot living unit in a build- ing approved for industrial use on property known as 1075 Florence Way in an M-1-S (Light Industrial) Zoning District. Mr. Kee noted that at its meeting of March 23, 1982 the Planning Commission continued this item so that a member of the Fire Department could be invited to attend this evening's meeting in order to answer questions regarding that department's requirements. Since that time, the applicant has requested a con- tinuance to the meeting of April 27, 1982 so that he can meet with the Fire De- partment in an attempt to find an acceptable solution. A member of the Fire Department will attend the April 27 meeting if it is necessary at that time. It was moved by Commissioner Howard, and seconded by Commissioner Dickson, that UP 82-05 be continued to the meeting of April 27, 1982. Motion carried unani- mously (6-0-1). -3- UP 82-02 Continued public hearing to consider the appli- Bomar, L. cation of Mr. Leonard Bomar on behalf of Roofing Associates, Inc. fora use permit to allow the establishment of a roofing business on property known as 86 Railway Avenue in a PD (Planned Devel- opment/Industrial) Zoning District. Mr. Kee reported that at its previous meetings of February 23, 1982 and March 23, 1982, the Planning Commission continued this application so that the appli- cant could submit revised plans. As of this writing, Staff has not received revised plans or a communication from the applicant. Consequently, Staff is recommending denial without prejudice so that this item may be removed from the agenda. It was moved by Commissioner Fairbanks, and seconded by Commissioner Howard, that the public hearing for UP 82-02 be closed. Motion carried unanimously (6- 0-1). RESOLUTION N0. 2104 It was moved by Commissioner Fairbanks, and second- ed by Commissioner Howard, that the Planning Com- mission adopt Resolution No. 2104 denying without prejudice the application of Mr. Leonard Bomar fora use permit to allow the establishment of a roofing business on property known as 86 Railway Avenue in a PD (Planned Development/Industrial) Zoning District, in order that this item be re- moved from the agenda. J. D. Greenfelder on behalf of Atlantic Richfield Company fora use permit to allow the conversion of the service bays of a gasoline station to a 24-hour mini-market while retaining the service islands for gasoline sales, and to allow off-sale beer and wine sales on property known as 2015 S. Winchester Blvd. in a C-3-S (Central Business District/Commercial) Zoning District. Mr. Kee stated that on April 2, 1982 the applicant met with the Planning and Public Works Departments Staff to discuss the proposal. A number of concerns from both departments were expressed. Subsequently, the applicant has requested -4- a continuance to the April 27, 1982 meeting so that he can submit revised plans which should better meet City requirements. Chairman Meyer declared the public hearing and invited anyone in the audience to speak for or against this item. Mr. Ron Harris for a zone change from PD (Planned Development/Office, Commercial, or Industrial) to CD (Condominium/Office, Commercial, or Industrial) and approval of plans and elevations to allow the construction of a 22,400 sq. ft. office condomin- ium building on property known as 241 W. Sunny- oaks Ave. and 970 Old Orchard Road in a Planned Development and Single Family Residential Zoning District. Commissioner Kotowski reported that this application had been reviewed by the Site and Architectural Review Committee this morning. The Committee is request- ing that the landscaping plans be returned to the Planning Commission for its review if the project is approved. He noted that the Committee is recommending approval of the project. However, the Committee was not aware of the petition that had been placed at each Commissioner's station prior to this evening's meeting (attached hereto and made a part of these minutes). Mr. Kee reviewed this application for the Commission, stating that this applica- tion was before the Commission at its previous meeting of March 9, 1982. How- ever, due to an improper public notice, this item has been re-noticed for this meeting. The applicant is proposing to construct a 22,400 square foot two-story office building on a 55,000 square foot lot. The proposed structure will cover approx- imately 19% of the site. Development of this project would require the removal of an existing single family residence on this lot. Building materials are indicated as a combination of vertical wood siding and cedar shingle panels for the walls, and anodized aluminum for window treatment. The plans ~he1ArchitecturaloAdvisorea~e recommendingethatrtheoroofingtbelwood Staff and t shake. The applicant has provided 111 parking spaces for this project, resulting in a parking ratio of 1:201. Staff is recommending some minor modifications to the proposed parking layout. These changes are indicated in red on the presented plans and would reduce the provided parking to 110 spaces or a parking ratio of 1:203. This ratio is consistent with previous Planning Commission approvals for office buildings. -5- The applicant has submitted revised plans since the previous submittal which indicate the following changes in the parking lot improvements: 1. Retention of an existing mature pine tree on the site; 2. Increase in landscaping areas along residential properties from 5 feet to 8 and 9 feet; 3. Indication of left-turn-only movements exiting the project to reduce potential traffic traveling north on Old Orchard Road; and 4. Reduction in the proposed parking from 112 to 111 parking spaces. These changes are considered acceptable by Staff. The Commission at its previous meeting had expressed concern regarding traffic and previous approvals on this site. The Public Works Department Staff is prepared to give an oral presentation regarding traffic in this area.' The Architectural Advisor has indicated that the proposed building is accept- able, and would be a positive addition to Winchester Boulevard. Mr. Kee concluded that Staff is recommending approval of this zone change to allow construction of an office/condominium building. Commissioner Fairbanks requested that Mr. Kee clarify the zoning on the two referenced parcels. Mr. Kee responded that the zoning on the Sunnyoaks property is currently Planned Development and the General Plan indicates "Office, Industrial or Com- mercial". The Old Orchard Road property is currently zoned Single Family Resi- dential, as well as the General Plan for this particular lot. It was noted that the applicant had obtained the Old Orchard Road site in order to develop parking for the proposed office building as well as to gain ingress/ egress away from Winchester Boulevard and/or Sunnyoaks Avenue. The zoning code does allow that an R-1 property adjacent to a commercial lot may be developed with parking. Commissioner Fairbanks questioned the height of the building. Mr. Stafford responded that the building elevation would be approximately 37 feet above ground, with an additional 5 feet underground for underground parking area. He further noted that the distance between the corner of the R-1 lot to the corner of the proposed building is approximately 40 feet. Mr. Helms extensively reviewed the traffic situation pertaining to ingress/ egress, traffic counts, speed limits, and site distances with the Commission. -6- Commissioner Kotowski asked Mr. Helms if he had reviewed the petition presented this evening, and, if so, did Mr. Helms feel that there would be any changes in the City Staff's position in light of the information presented in questions one through four in the petition. Mr. Helms responded that he had reviewed the petition and that those items ex- pressed in questions one through four had been taken into account when the traf- fic study for this site was conducted. Commissioner Dickson queried as to the effect routing the traffic from this project into the residential section might have on the residents. Mr. Helms stated that Staff would prefer the access off Old Orchard Road in or- der to reduce the Sunnyoaks traffic; however, Staff would recommend that traffic leaving the site be allowed only left-turns onto Old Orchard Road. At this time Chairman Meyer noted that a letter had been received prior to this evening's meeting addressing this item, and requested Recording Secretary Dennis read the letter into the minutes. A letter dated April 13, 1982 from Mr. Joseph R. Paterewic of 983 Robin Lane, Campbell was read into the minutes (copy attached hereto). Chairman Meyer declared the public hearing open and invited anyone in the audi- ence to speak for or against this item. Mr. Gerald Tunney, 985 Old Orchard Road, appeared before the Commission to speak in opposition to the proposed development, stating that the area is already hazardous with regard to traffic conditions and this development presents possi- bilities for additional danger. Commissioner Kotowski asked Mr. Helms if there is an abnormally high accident rate at these intersections. Mr. Helms responded that Staff did not consider the accident rate to be exces- sively high, noting that in 1979 there was one recorded accident, in 1981 there were three, and none as yet for 1982. Staff has these figures available be- cause they have only recently completed a study to consider a traffic signal at this particular intersection. Mr. Helms continued that Staff did recognize the problem of merging traffic coming off the southbound lane of the Expressway. However, the experience has been that vehicles handle this very well. It may be necessary, though, at some point in the future, to install signalization. Commissioner Campos asked Mr. Helms what the peak traffic hours were in this area. Mr. Helms noted that hand turning counts were available for this area and that each particular turn movement was at a different peak time. -7- Mr. Helms added that for the proposed type of office building use, the peak traffic movements do not occur at normal traffic hours. The range of peak read- ings for various types of commercial offices indicate peaks usually occur be- tween 8:00 and 9:00 a.m. and 3:30 and 5:00 p.m. Generally, the peak movements from the rest of the stores are different from the peak movements of a general office complex. Commissioner Campos noted that the petition spoke to critical speeds in the area. Mr. Helms stated that the critical speed for southbound Winchester Boulevard is 38 m.p.h.; and 42 m.p.h. for northbound Winchester. It is 35 m.p.h. for Sunny- oaks Avenue. Mr. Ernest Juhasz, 945 Robin Lane, spoke against the proposed project, citing traffic as his reason. Mr. Murray Dey, 810 Old Orchard Road, spoke against the project, citing traffic problems. Mr. Richard McCullough, 771 Old Orchard Road, spoke against the project,citinq traffic problems. Mr. Harlan Andrews, 860 Old Orchard Road, spoke against the project, citing traf- fic problems. He noted that there have been several vehicles that have run off the road in this area, and subsequently crashed into the wooded area behind his house. Mr. Helms noted that these accidents have all occurred slightly north of the property that is before the Commission this evening. He added that another reason Staff is recommending approval of this project is that the entire develop- ment is "depressed" in elevation, thereby allowing better visibility at this intersection. Mrs. Bobbi Luoto, 733 Old Orchard Road, spoke against this development because it was not compatible with the current "rural" atmosphere of the neighborhood. Mr. John Kelley, 809 Old Orchard Road, spoke against the project. Mrs. Sally S cobbey, 865 Robin Lane, spoke against the project. Mrs. Pat McCullough, 771 Old Orchard Road, spoke against the project, stating that the parking area would be a "hang-out" place for undesirables when not in use. Mr. Pedro Silva, 894 Robin Lane, spoke against the development because of traffic problems. He added that he would like to see the City change the off-ramp of the expressway so that it was not as dangerous. Mr. Herb Killmeyer, 696 Emery Avenue, spoke against the project because of traf- fic problems and that it would ruin the neighborhood. He added that this proper- ty and its inherent problems were created by the County. He noted that the City -8- should consider amending its code to provide fora landscaped "buffer" zone of 50 to 100 feet between commercial and residential uses. Mr. Bill Puterbaugh, 916 Old Orchard Road, stated he was concerned about his privacy since his property backed up to the proposed development. Mrs. Bette Lee, 842 Old Orchard Road, spoke against the project, stating that the potential traffic would restrict the already limited movements of her children, who are in wheelchairs. Mr. William Burns, attorney for Mr. Ron Harris (applicant), appeared before the Commission to state that his client is concerned with the needs of the sur- rounding property owners and has worked very closely with the City Staff in try- ing to work out potential problems. He added that this development is a "class" project and that Mr. Harris is very willing to work with the neighborhood. Commissioner Fairbanks asked Mr. Burns if his client had received a copy of the Council policy regarding development in the San Tomas Area. Mr. Harris replied that he had received a copy of the Council policy. Commissioner Kotowski asked Mr. Harris if he had done any kind of environmental study for this site. Mr. Harris replied that he had not, but rather had relied on City figures re- garding traffic and past history of the site. Commissioner Kasolas asked Mr. Kee if there has been any discussion by the City regarding buying this site for a park. Mr. Kee stated that it is his understanding that there are not funds available for the purchase of property. Mr. Ray Cobb, architect, spoke regarding the privacy issue raised earlier by Mr. Bill Puterbaugh. He noted that the building would be approximately 47 feet away from the rear property line and that there would be a wide planter area in- stalled with relatively mature landscaping. The building has been designed so that its style will not compete with homes in the area, and it will probably act as a noise buffer, blocking out traffic noise from the Winchester Blvd. area. Commissioner Kasolas asked Mr. Cobb if, because the office building would be condominiums and owned by several people, he felt the traffic would be staggered throughout the day. Mr. Cobb stated that it has been his experience with similar developments that he has designed that traffic has not been a problem. No one else wishing to speak, it was moved by Commissioner Fairbanks, and second- ed by Commissioner Kotowski, that the public hearing be closed. Motion carried unanimously (7-0-0). -9- Discussion Commissioner Dickson requested information concerning the estimated number of "trips" per day for the proposed use. Mr. Helms reported that it is estimated that this project would add 334 trip ends per day (or 170 round trips), with approximately 15% of these trips being during peak traffic hours and with an approximate 10% increase in total traffic. Commissioner Kasolas noted that this situation involved what the General Plan states can be done with this parcel; and, the political aspect with regard to the wishes of the neighborhood. He cautioned the Commission that it is the job of the Planning Commission to make a recommendation to the City Council from a planning standpoint only--leaving the political decisions to the City Council. Commissioner Dickson stated that this proposal was probably the best project that has been presented thus far for this site from an aesthetic standpoint. How- ever, he added that he was concerned about putting a commercial development right next to a prime residential area. He stated he would be opposing this application because of the facts that have been presented this evening regard- ing traffic safety. Commissioner Kotowski stated that he was impressed with the concern of the neighborhood as well as their knowledge of the problems of this particular site. He complimented the architect and the developer for the concern they have shown. He felt, however, that there were still some ingress/egress problems that need- ed to be addressed. Commissioner Campos noted that he was concerned that if this project was not approved, what other possibilities would be left for this parcel? He felt that any traffic problems could be resolved, adding that it is almost impossible to have any kind of control factor when people are using public streets. Commissioner Fairbanks stated that she felt that this proposal does not address the City Council policy for development in this area; it is not compatible with the surrounding area; it does not address the needs of privacy of the residents; and it has substantial traffic impact. RESOLUTION N0. 2105 It was moved by Commissioner Fairbanks, and secon- ded by Commissioner Dickson, that the Planning Commission adopt Resolution No. 2105 recommend- ing denial of ZC 82-02, application of Mr. Ron ne change from PD (Planned Develop- f or a zo Harris, ment/Office, Commercial or Industrial) to CD (Condominium/Office, Commercial or Industrial) and approval of plans and elevations to allow the construction of an office condominium build- ing on property known as 241 W. Motion carried for denial by the following roll call vote: AYES: Commissioners: Dickson, Kotowski, Fairbanks, Campos NOES: Commissioners: Kasolas, Howard, Meyer ABSENT: Commissioners: None -10- The Commission took a break at 9:45 p.m.; the meeting was reconvened at 10:05 p.m. *** ZC 82-03 Public hearing to consider a City-initiated zone City-initiated change from R-M (Multiple Family Residential) to P-D (Planned Development) for property known as 295 Union Avenue (Paseo de Palomas Mobile Home Park) in an R-M (Multiple Family Residential) Zoning District. APN 413-51-11 Mr. Kee reported that on February 23, 1982, the Planning Commission adopted Reso- lution No. 2096 which recommended that the City Council amend the Land Use Element of the General Plan from "Low-Medium Density Residential" to "Mobile Home Park (6-13 units per gross acre)" for the Paseo de Palomas Mobile Home Park. At the meeting, the Commission also took action, in Resolution No. 2097, to set April 13, 1982 as the date of a public hearing to consider a zone change from R-M (Multiple Family Residential) to P-D (Planned Development). Both reso- lutions were adopted by a 5-2-0 vote, with Commissioner Kasolas and Howard voting "no". On April 6, 1982, the Council gave second reading to the ordinance amending the General Plan as described above. At this time, a recommendation to change the zoning for this site from R-M to P-D would be consistent with past actions of both the Planning Commission and City Council. Chairman Meyer declared the public hearing open, and invited anyone in the audi- ence to speak for or against this application. Mr. Ted Moller, 295 Union Avenue #53, appeared before the Commission to ask what tonight's P-D zoning would mean to the residents of Paseo de Palomas Mobile Home Park and what the ramifications would be if the zoning were approved by the City Council. Mr. Kee stated that Planned Development is a zoning district compatible with the use on the land. The City does not have a Mobile Home Park zoning and one was not recommended. The ordinance was set up so that we could have a mobile home park in any zoning district. The ramifications, if adopted by the Council, would be that the Planned Development zoning would require a public hearing on any land use change before the Planning Commission and before the City Council. In addition, since the General Plan and the zoning must be consistent, another two public hearings would be required to change the general plan if any land use change were proposed. No one else wishing to speak, it was moved by Commissioner Kasolas, and second- ed by Commissioner Campos that the public hearing be closed. RESOLUTION N0. 2106 It was moved by Commissioner Campos, and second- ed by Commissioner Dickson, that the Planning -11- Commission adopt Resolution No. 2106 recommending approval of the City-initiated zone change from R-M (Multiple Family Residential) to PD (Planned Development) for property known as 295 Union Avenue. Motion carried with the following roll call vote: AYES: Commissioners: Dickson, Kotowski, Fairbanks, Campos, Meyer NOES: Commissioners: Kasolas, Howard ABSENT: Commissioners: None *** ZC 82-04 Public hearing to consider the City-initiated zone City-initiated change from P-F (Public Facilities) to R-1 (Single Family Residential) or P-D (Planned Development/ Low Density Residential) for property known as 690 S. San Tomas Aquino Road. Mr. Kee reported that at its meeting of March 2, 1982, the Planning Commission took action to schedule a public hearing to consider a zone change from P-F (Public Facilities) to P-D (Planned Development) for the subject property. The Commission may recall that the Council had previously taken action to leave the "Low Density Residential" designation on the Land Use Element of the General Plan. Since the surrounding area is all zoned R-1 (Single Family Residential), Staff noticed the public hearing for consideration of either P-D or R-l for this site. Either zoning district would be compatible with the General Plan. Due to the fact that the Council has previously expressed concern over the location of this property with respect to the sharp curve in San Tomas Aquino Road, Staff is recommending the P-D zoning over the R-1. The P-D zoning would provide the City with the opportunity to review any proposed new develop- ment at a public hearing. On April 6, 1982, the City Council gave second reading to Ordinance 1408, which adopted the Interim Zone over the San Tomas Area. For this reason, Staff is recommending that if this zone change is approved, it should not become effec- tive until the Interim Zone is lifted. Chairman Meyer declared the public hearing open and invited anyone in the audi- ence to speak for or against this item. No one wishing to speak, it was moved by Commissioner Dickson, and seconded by Commissioner Campos, that the public hearing be closed. Motion carried unanimous- ly (7-0-0). RESOLUTION N0. 2107 It was moved by Commissioner Dickson, and second- ed by Commissioner Campos, that the Planning Commission adopt Resolution No. 2107 recommend- ing approval of the City-initiated zone change from P-F (Public Facilities) to PD (Planned Development/Single Family Residential) fore property known as 690 S. San Tomas Aquino Road once the Interim Zone is lifted. Mr. Kee noted that at its meeting of February 17, 1981 the Planning Commission approved (by unanimous vote) plans and elevations to allow construction of a 10,422 sq. ft. warehouse/office building on the subject property. This ap- proval has since expired and the applicant is now requesting a reinstatement. There have been no changes to the General Plan in this area. Therefore, Staff is recommending that the Commission reinstate the plans for a one year period. It was moved by Commissioner Dickson, and seconded by Commissioner Campos, that the previously approved plans allowing the construction of a 10,422 sq.ft. warehouse/office building on property known as 1320 Whiteoaks Road (S 81-05) be reinstated as requested fora period of one year, subject to previous con- ditions of approval. Motion carried unanimously (7-0-0). *** S 80-19 Application of Mr. L. R. Cockrell fora modifi- Cockrell, L. cation to the previously approved plans for three to four condominium units on property known as 1408 W. Latimer Avenue in an R-2-S (Multiple Family/Medium Density Residential) Zoning District. Commissioner Kotowski reported that the applicant had met with the Site and Architectural Review Committee this morning, and that the Committee is recom- mending a continuance of this item to the meeting of April 27, 1982 with the applicant's consent. This continuance would allow the applicant to address concerns expressed by Staff and the Committee. Mr. Kee noted that Staff is in concurrence with the Committee's recommendation for continuance. It was moved by Commissioner Fairbanks, and seconded by Commissioner Howard, that S 80-19 be continued to the Planning Commission meeting of April 27, 1982. Commissioner Kotowski reported that the Site and Architectural Review Commit- tee is recommending approval of this application, subject to the conditions listed in the Staff Comment Sheet (attached hereto and made a part of these minutes). He noted that the applicant has agreed to remedy all concerns ex- pressed by Staff. Mr. Kee briefly reviewed this application for the Commission, stating that at its meeting of June 5, 1979, the Planning Commission recommended approval of TS 79-8 and UP 79-13 which would allow the subdivision of the property known as 1110 W. Hacienda Avenue and the creation of eight single-family lots on the subject property. The subdivision map indicated that an existing house would be retained on Lot 3 of this subdivision and that an existing garage would be relocated on the lot. The applicant at this time is requesting that this previous garage be approved as an accessory building on this lot and that a proposed carport be approved so that a covered parking space be provided per City standards. Staff considers this proposal acceptable and is recommending approval of this proposal subject to the following conditions: 1. That the applicant provide an agreement satisfactory to the City Attorney restricting use of accessory building to uses permitted for accessory buildings on R-1 (Single Family Residential) lots. 2. That proposed improvements be installed by May 13, 1982. It was moved by Commissioner Kotowski, and seconded by Commissioner Howard, that TS 79-8/UP 79-13 be approved subject to the conditions listed above, with a completion date changed to June 13, 1982. Motion carried unanimously (7-0-0). SA 82-13 Appeal of the Planning Director's decision deny- Campbell Veterinary Clinic ing a 32 ft. sign on the rear of a building located at 1575-B Winchester Blve. in a C-1-S (Neighborhood Commercial) Zoning District. Mr. Kee stated that the applicant has requested a continuance of this item. It was moved by Commissioner Fairbanks, and seconded by Commissioner Kotowski, that SA 82-13 be continued to the Planning Commission meeting of April 27, 1982 at the applicant's request. Motion carried unanimously (7-0-0). *** -14- SA 82-15 The application of Arrow Graphics fora sign per- Arrow Graphics mit to sllow the placement of approximately 149 temporary signs in the public right-of-way so as to direct the public to 5 housing developments within the City. Commissioner Kotowski stated that the applicant met with the Site and Architec- tural Review Committee this morning. The applicant noted to the Committee that they have had no problems with other cities regarding their signing proposals, and that the City of Milpitas has written an ordinance addressing their particu- lar problem and restricting the size and numbers of signs as well as the hours and placement. The Committee is recommending that this item be continued to the meeting of May 11, 1982, and is asking the applicant to come back with a proposal for fewer signs. The Committee has suggested to the applicant that he pull the signs in closer to the referenced developments. It was moved by Commissioner Fairbanks, and seconded by Commissioner Kotowski, that SA 82-15 be continued to the Planning Commission meeting of May 11, 1982. Motion carried unanimously (7-0-0). Because of the lateness of the hour, and because the applicant was in the audi- ence, it was the consensus of the Commission to take Item No. 18, MM 82-03, out of order. MM 82-03 Request of Mr. Gary Dawes for a minor modification Dawes, G. to the sideyard setback requirement from 9 feet to 6 feet to allow the construction of a second story addition at property known as 869 Ebbets Drive in an R-1 (Single Family Residential) Zoning District. Mr. Kee stated that the applicant is requesting a minor modification to the side- yard setback requirement to allow construction of a second story addition. Typically, the addition would require a 9 foot setback. The proposed plan in- dicates a setback of 6 feet from the north property line. The Planning Commission may permit a minimum sideyard setback of 5 feet for two story residences when it finds that the second story addition and the less-than- standard sideyard will not be detrimental to persons residing in the neighbor- hood or to the general welfare of the City. The Planning Department has received a letter from the adjacent property owner which states that she approves of the addition (attached hereto). Staff is of the opinion that the requested sideyard setback would not be detri- mental and that it should be approved. It was moved by Commissioner Kotowski, and seconded by Commissioner Kasolas, that MM 82-03 be approved. Motion carried unanimously (7-0-0). *** -15- Staff Report Staff Report regarding proposed revisions to the Condominium Conversions Condominium Conversion Zoning District. Commissioner Fairbanks noted that she has prepared a written report on this item that she would like to have copied for each Commissioner. She therefore would like to request that the Commission continue this item. It was moved by Commissioner that this item be continued unanimously (7-0-0). Fairbanks, and seconded by Commissioner Dickson, to the meeting of May 11, 1982. Motion carried *** Staff Report San Tomas Area Study Staff Report regarding the San Tomas Area General Plan and Zoning Study. Mr. Kee noted that at its meeting of April 6, 1982, the City Council gave second reading to Ordinance No. 1408 adopting an Interim Zoning District for the San Tomas Area. This ordinance will become effective May 6, 1982. Staff is, at this time, requesting some direction from the Commission as to how it would like to proceed with the General Plan and Zoning Review; and an indication as to the number of meetings that should be scheduled, their dates and locations. Commissioner Fairbanks suggested using the San Tomas Center for the meetings, and felt that there should be a series of hearings spread over the time that the Interim Zone is in effect. Commissioner Kasolas noted that the Commission should consider agenda items for these proposed hearings, and also that the Commission should re-define the San Tomas Area, since he felt there were some neighborhoods in this area that should not be included in the current "San Tomas Area" boundaries. Mr. Kee stated that if the Commission so desired, Staff could come back with a suggested approach in holding these hearings, as well as a suggested schedule.
