MINUTES NOVEMBER 10, 1981 The Planning Commission of the City of Campbell convened this day in regular session in the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. Absent None APPROVAL OF MINUTES October 20, 1981 Commissioner Fairbanks moved that the minutes of the Planning Commission meeting of October 20, 1981 be approved as submitted, seconded by Commissioner Kotowski and unanimously adopted. COtJSENT CALENDAR PD 80-03 Request of Mr. Clifford Beck for reinstatment of Beck, C. ~ a previous approval (PD 80-03) for an office building to be located on property known as 429 Llewellyn Avenue in a Planned Development/ Commercial Zoning District. Request Request of Environmental Science Associates, Inc., EIR Consultant for Planning Commission approval to conduct environ- mental assessments for the City of Campbell. TS 81-25 Tentative Subdivision Map: Lands of Nakamara. Lands of Nakamura APN 305-33-22 (135 Union Avenue). Commissioner Meyer moved that Items No. 1, 2 and 3 under Consent Calendar be approved subject to the respective Staff Recommendations, seconded by Commissioner Kotowski and unanimously adopted. *** ARCHITECTURAL APPROVALS S 81-31 Application of Mr. Jim Blackburn for approval of Blackburn, J. plans and elevations to allow the construction of an additional 3,430 sq. ft. warehouse building on property known as 75 Cristich Lane in a M-1-S (Light Industrial) Zoning District. -2- Commissioner Meyer reported that the Site and Architectural Review Committee met with the applicant this morning, and the Committee is recommending a continuance of this application to the Planning Commission meeting of December 8, 1981 in order to resolve the concerns expressed by Staff. Commissioner Fairbanks then moved that S 81-31 be continued to the November 24, 1981 Planning Commission meeting, seconded by Commissioner Meyer and unanimously adopted. *** PUBLIC HEARINGS S 81-32 This is the time and place for a public hearing Hindiyeh, 0. to consider the application of Mr. Omar Hindiyeh for approval of plans and elevations for the move-on of a single family dwelling on property known as 1420 Harriet Avenue in an R-1 (Single Family Residential) Zoning District. Commissioner Meyer reported that the applicant met with the Site and Architectural Review Committee this morning, and the Committee is recommending approval subject to the conditions listed in the Staff Comment Sheet as well as the fencing plan to come back to the Planning Director for approval. Commissioner Fairbanks stated this is one area where she felt that other than standard street improvements could be installed. Engineering Manager Helms reported that one of the Public tdorks Department recommendations is for installation of street improvements. He felt it would be appropriate for the Staff to come back with a report after this application is approved addressing the type of street improvements to be installed. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this application. No one wishing to speak, Commissioner Fairbanks moved that the public hearing be closed, seconded by Commissioner Howard and unanimously adopted. RESOLUTION N0. 2066 Commissioner Fairbanks moved that the Planning Commission adopt Resolution No. 2066 approving the application of Mr. Omar Hindiyeh for approval of plans and elevations for the move-on of a single-family dwelling on property known as 1420 Harriet Avenue in an R-1 (Single-Family Residential) Zoning District, seconded by Commissioner Kotowski and unanimously adopted by the following roll call vote: AYES: Commissioners: Howard, Kotowski, Campos, Meyer, Dickson, Fairbanks, Kasolas NOES: Commissioners: None ABSENT: Commissioners: None ~~ - 3- Commissioner Dickson noted he is in favor of the intent of the alternative street improvements, however he expressed concern about this causing a delay in approval of applications and hoped that the procedure to be followed would not be lengthy. Mr. Helms explained the procedure to the Commission, noting that this should not cause any delay. *** ZC 81-25 This is the time and place for a continued public Fisher, K. hearing to consider the application of Mr. Kevin Fisher for a zone change from R-1 (Single-Family Residential) to P-D (Planned Development), and approval of plans, elevations, and development schedule to allow the construction of two single- family homes on property known as 959 Emory Avenue. Commissioner Meyer reported that the applicant met with the Site and Architectural Review Committee this morning, and the Committee is recommending approval of this application subject to the conditions listed in the Staff Comment Sheet with the added condition that "Plans submitted to Building Department to indicate window trim on all elevations are to be approved by the Planning Director", and as redlined on the plans. Mr. Kee reported that the applicant is proposing to construct two additional single-family homes on the .99 net acre site. The project will result in the creation of four lots out of the three existing parcels. Two of the existing parcels have single-family homes on them which will be retained. The new residences will be built on flag lots behind two existing residences on Emory Avenue. The project will result in a density of 3.2 units per gross acre which is consistent with the General Plan designation of Low Density Residential (less than 6 units per gross acre). Building materials are indicated as stucco for the walls and composition shingles for the roof. Parking is provided for the residences with two-car garages. Listed below is the approximate area of each of the proposed lots: Parcel A (existing residence) - 7,920 sq.ft. Parcel B (new lot) - 10,790 sq.ft. Parcel C (new lot) - 6,800 sq. ft. Parcel D (existing residence) - 17,100 sq.ft. It should be noted by the Commission that a minimum lot size of 6,000 sq.ft. is the minimum for an R-1 Zoning District, and that flag lots are required to have additional square footage. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this application. Mr. Robert Osorio of 910 Emory Avenue spoke against this project. He inquired about the owner having to hook up to a sewage system. -4- Mr. Stafford explained that any new developments would be required to hook up to a sewage system; no septic tanks would be allowed. Discussion then ensued regarding the number of people allowed to live in single-family residences. Mr. Kee stated that there is no restriction, to his knowledge. Mrs. Hansen of 945 Emory Avenue explained the background of the sale of the subject property, noting that her property is adjacent to this parcel and one of the proposed homes would be very close to hers at the back of her property. No one else wishing to speak, Commissioner Fairbanks moved that the public hearing be closed, seconded by Commissioner Meyer and unanimously adopted. Motion Commissioner Meyer moved that the Planning Commission recommend approval of the application of Mr. Kevin Fisher for a zone change from R-1 (Single-Family Residential) to P-D (Planned Development), and approval of plans, elevations, and development schedule to allow the construction of two single-family homes on property known as 959 Emory Avenue. This motion was seconded by Commissioner Kotowski and failed by the following roll call vote: AYES: Commissioners: Kotowski, P~eyer, Kasolas NOES: Commissioners: Howard, Campos, Dickson, Fairbanks ABSENT: Commissioners: None RESOLUTION NO. 2067 Commissioner Dickson moved that the Planning Commission adopt Resolution No. 2067 recommending denial of the application of Mr. Kevin Fisher for a zone change from R-1 to P;-D, based on the finding that the proposed zone change would not be har- monious with the existing neighborhood, seconded by Commissioner Howard and adopted by the following roll call vote: AYES: Commissioners: Howard, Campos, Dickson, Fairbanks NOES: Commissioners: Kotowski, Meyer, Kasolas ' ABSENT: Commissioners: None RESOLUTION N0. 2068 Commissioner Dickson moved that the Planning Commission adopt Resolution No. 2068 recommending denial of the application of Mr. Kevin Fisher for approval of plans, elevations, and development schedule to allow the construction of two single- family homes on property known as 959 Emory Avenue based on the finding that the proposed plans would not be harmonious with the existing neighborhood. This motion was seconded by Commissioner Howard and adopted by the following roll call vote: AYES: Commissioners: Howard, Campos, Dickson, Fairbanks r NOES: Commissioners: Kotowski, Meyer, Kasolas - ABSENT: Commissioners: None -5- Commissioner Fairbanks stated that should this application be approved by the City Council, 'she would want to make certain that other than standard street improvements be considered for this development. *** V 79-1 Continued public hearing to consider the applica- Landberg, D, tion of Mr. Donald C. Landberg and Ruth & Going, Inc., fora variance from Sections 21.48.020, ' 21.48.030, and 21.48.040 of the Campbell Municipal Code to allow construction of a parking structure on property known as 350 Budd Avenue in an R-3-S (Multiple Family/High Density Residential) Zoning District. Mr. Kee explained that this application has been continued on numerous occasions since it was filed in June of 1979. The main reasons for these continuances centered around the fact that standards for condominium conversions were not adopted by the City, and the fact that an EIR for this project had not been prepared by the applicant. At its meeting of November 3, 1981, the City Council gave first reading to a C-D, Condominium Zoning District, which will establish procedures and standards for new construction of condominiums as well as the conversion of existing apartment units to condominiums. It is expected that second reading of the C-D ordinance will take place at the City Council meeting of November 17, 1981. Since the Council indicated unanimous support for the ordinance at its November 3 meeting, Staff is recommending that this application be denied without prejudice in order that it can be removed from the agenda. By removing the item from the agenda, the path will be cleared for the applicant to submit a new application which conforms to the guidelines currently being considered by the Council. Mr. Stafford reported that a telephone call had been received from the applicant this afternoon and he is in concurrence with Staff's recommendation. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this project. RESOLUTION N0. 2069 Commissioner Dickson moved that the Planning Commission adopt Resolution No. 2069 denying the application of Mr. Donald C. Landberg and Ruth & Going, Inc., for a variance from Sections 21.48.020, 21.48.030, and 21.48.040 of the Campbell Municipal Code to allow con- struction of a parking structure on property known as 350 Budd Avenue in an R-~-S (Multiple Family/High Density Residential) Zoning District, seconded by Commissioner Campos and unanimously adopted by the following roll call vote: AYES: Commissioners: Howard, Kotowski, Campos, Meyer, Dickson, Fairbanks, Kasolas NOES: Commissioners: None ABSENT: Commissioners: None *** -6- ARCHITECTURAL APPROVALS S 79-25 Continued application of Mr. Donald C. Landberg Landberg, D. and Ruth & Going, Inc.,~for approval of plans to construct a parking structure 'and convert an apartment complex into condominiums on property known as 350 Budd Avenue in an R-3-S (Multiple Family/High Density Residential) Zoning District. Mr. Kee explained that this item is directly related to the previous item considered (V 79-1), and Staff is also recommending denial of this application at this time. The Chair noted that this is not a public hearing, however if anyone should wish to speak regarding this application they were welcome to do so at this time. No one wishing to speak, the Chair called for a motion on this item. RESOLUTION N0. 2070 Commissioner Dickson moved that the Planning Commission adopt Resolution No. 2070 denying the application of Mr. Donald C. Landberg and Ruth & Going, Inc., for approval of plans to construct a parking structure and convert an apartment complex into condominiums on property known as 350 Budd Avenue in an R-3-S (Multiple Family/High Density Residential) Zoning District, seconded by Commissioner Kotowski and unanimously adopted by the following roll call vote: AYES: Commissioners: Howard, Kotowski, Campos, Meyer, Dickson, Fairbanks, Kasolas NOES: Commissioners: None ABSENT: Commissioners: None PUBLIC HEARING GP 81-10 This is the time and place for a Public City-initiated Hearing to consider a City-initiated application for an amendment to the Land Use Element of the General Plan from Low Density Residential (less than 6 units per gross acre) to Professional Office for properties known as 289 Browning Avenue and 2005 Whiteoaks Road. Mr. Stafford reported that at its meeting of October 6, 1981, the Planning Commission adopted Resolution No. 2054, by a 4-3-0 vote, (Commissioners Howard, Dickson and Fairbanks voting "no") recommending approval of a General Plan amendment to change the Land Use Element from Low Density Residential to Professional Office on property known as 2015 Whiteoaks Road. (The corner of Whiteoaks and Browning Avenue.) Additionally, the Planning Commission adopted Resolution No. 2055, by a 4-3-0 vote, (Commissioners Howard, Dickson and Fairbanks voting "no") setting November 10, 1981 as the date of a public hearing to consider amending the Land Use Element from Low Density Residential ~''' -7 - to Professional Office for the properties to the north (2005 Whiteoaks Road) and west (289 Browning Avenue) of 2015 Whiteoaks Road (GP 81-10). The two properties in question are located in an unincorporated area, but within Campbell's "Sphere of Influence Boundary." At the present time, the Land Use Element indicates the following uses for the surrounding properties: NORTH: Low Density Residential SOUTH: Professional Office EAST: Commercial WEST: Low Density Residential The present surrounding land uses are as follows: NORTH: Single-family residence SOUTH: Office EAST: Office WEST: Single-family residence Mr. Staff ord'further noted that the Staff had previously recommended approval of a change in the Land Use Element from "Low Density Residential to Professional Office for the one lot at the northwesterly corner of Browning Avenue and Whiteoaks Road (Application of K. Follmar, GP 81-07). The basis for Staff's recommendation for GP 81-07 was the fact that the property (2015 Whiteoaks Road) was directly across from professional or commercial uses. In the Staff's opinion, the land use designation for the two parcels which are the subject of this City-initiated application should not be changed. The main reason for making this recommendation is that there would be little justification to prevent the spread of the professional office use along Browning Avenue or along. Whiteoaks Avenue. Mr. Kee then explained the application of Mr. Follmer which is before the Council at this time, and the fact that the City is trying to prezone the properties in this area at this time (also before the Council). He further noted that the Council has postponed taking action on the Follmer application and prezoning of the Whiteoaks area pending the outcome of this public hearing in order that they could all be considered at the same meeting. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this application. Mr. Milton Sugarman of 1121 Holmes Avenue gave background information on the 2005 Whiteoaks property, noting that Dr. Reedy had obtained a building permit for an addition to the home--which ultimately turned out to be a medical office. He felt that if these two lots are not rezoned the corner parcel should not be rezoned to Professional Office. Mr. Richard Florence of 1171 Holmes expressed opposition to the rezoning to P-0; he felt this property should remain Low Density Residential. -8- Mr. Edward Mayeda, owner of 289 Browning expressed his opposition to the ; Professional Office designation. Patricia Warner of 1172 Holmes Avenue appeared to speak in favor of retention of the Low Density Residential designation. Joy Cox of 1168 Longfellow Avenue appeared before the Commission to present a petition signed by residents and property owners in the neighbor- hood who are in favor of retention of the Low Density Residential designation A copy of the petition is attached hereto and made a part of this record. No one else wishing to speak, Commissioner Fairbanks moved that the public hearing be closed, seconded by Commissioner Meyer and unanimously adopted. Motion Commissioner Howard moved that the Planning Commission not take action to amend the Land Use Element of the General Plan from Low Density Residential to Professional Office, seconded by Commissioner Kotowski and unanimously adopted by the following roll call vote: AYES: Commissioners: NOES: Commissioners: ABSENT: Commissioners: MISCELLANEOUS Howard, Kotowski, Campos, Meyer, Dickson, Fairbanks, Kasolas None None *** SA 81-38 Continued appeal of decision of Planning Price, R. Director denying request for signing on property known as 155 E. Campbell Avenue. Mr. Kee reported that the applicant has requested a continuance of this appeal to the Planning Commission meeting of November 24, 1981. Commissioner Fairbanks then moved that SA 81-38 be continued to the Planning Commission meeting of November 24, seconded by Commissioner Meyer and unanimously adopted. *** ITEMS BROUGHT UP BY COMMISSIONERS Commissioner Howard reported he had concern with the fact that no action had yet been taken on the weed abatement problem at 1600 Winchester Boulevard; the building appears to be very unsafe, and felt something should be done. Mr. Kee stated that Staff would report the conditions to the Fire Department for further action. -9- Chairman Kasolas then announced that the Planning Commission/Staff Christmas get-together would be held at Jane Meyer's home, and Staff _ would be contacting each Commissioner regarding a date for this festivity.
