MINUTES OCTOBER 20, 1981 The Planning Commission of the City of Campbell convened this day in regular session in the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. ROLL CALL Present Commissioners: Howard, Kotowski, Campos, Meyer, Dickson, Fairbanks, Chairman Kasolas (7:40 p.m.); Planning Director Arthur A. Kee, Principal Planner Philip J. Stafford, Engineering Manager Bill Helms, City Attorney J. Robert Dempster (7:40 p.m.), Recording Secretary Jeannine Wade. Absent None APPROVAL OF MINUTES October 6, 1981 Commissioner Dickson noted two corrections to the minutes: On Page 2, the fifth paragraph under S 81-25, he recollected voting "no" on that motion. Secondly, on Page 15, the first para- graph should have included "...specifying the difference between condominiums, townhouses, and apartments."--apartments being the key word. Commissioner Dickson then moved that the minutes of the Planning Commission meeting of October 6, 1981 be approved as corrected, seconded by Commissioner Fairbanks and unanimously adopted. CONSENT CALENDAR TS 81-24 ~ Tentative Subdivision Map: Lands of Kadjevich Lands of Kadjevich and Central Valley Corporation. 200 Dillon Avenue, APN 413-8-70 & 71. Request of Zilog Request of Zilog Corporation for approval of use of three trailers to temporarily house personnel during construction of new facilities on property known as 200 Hacienda Avenue in a CP~:B-80 (Controlled Manufacturing) Zoning District. Mr. Kee explained that the Staff recommendation for these two items under the Consent Calendar is for approval. Commissioner Kotowski then moved that TS 81-24 and the Request of Zilog Corporation be approved subject to the conditions listed in the Staff Comment Sheets, seconded by Commissioner Campos and unanimously adopted. *** -2- ARCHITECTURAL APPROVALS S 81-26 Continued application of Mr. Allan Walter and Walter, A. Associates for approval of plans and elevations ' to construct a 4,000 square foot retail building on property known as 1600 S. Winchester Blvd. in a C-1-S (Neighborhood Commercial) Zoning District. Mr. Kee reported that Staff is recommending approval of this application. Commissioner Kotowski reported that the Site and Architectural Review Committee had reviewed this application this morning, and the Committee is recommending approval of this item. He noted that a copy of the des- cription of the roll-up grilles has been placed at each Commissioner's station. He futher noted that it was requested that the applicant speed up the weed abatement program for this site. Commissioner Kotowski then moved that the Planning Commission approve S,81-26 subject to the conditions listed in the Staff Comment Sheet, seconded by Commissioner Howard and unanimously adopted. S 81-29 Continued application of the Hamilton Group, Ltd. Hamilton Group, Ltd. for approval of plans and elevations to allow the construction of an office building for property known as 260 W. Hamilton Avenue in a P-0 (Professional Office) Zoning District. Mr. Kee reported that Staff is recommending approval of the subject project subject to the conditions attached to the Staff Comment Sheet. Commissioner Meyer reported that the Site and Architectural Review Committee is recommending approval of this application, noting that all concerns expressed by Staff have been resolved. She noted that the parking spaces have been ad- justed so that back-up area is sufficient. Commissioner Fairbanks inquired about the setbacks in reference to the R-1 property to the south. Mr. Stafford responded that the P-0 Zoning District requires the same setback as the adjacent residential zoning district. He also explained the ingress and egress to the site. Commissioner Meyer then moved that S 81-29 be approved subject to the conditions listed in the Staff Comment Sheet, seconded by Commissioner Kotowski and unanimously adopted. *** S 81-25 Continued application of Mr. Ray ~1urdock for Murdock, R, approval of plans and elevations to allow the construction of a 7,884 square foot office building on property known as 201 E. Hamilton Avenue in a C-1-S (Neighborhood Commercial) Zoning District. ;, ,: - 3- Commissioner Meyer reported that the Site and Architectural Review Committee is recommending approval of this project subject to the conditions listed in __ the Staff Comment Sheet. Mr. Kee stated that Staff is recommending approval of this application. He noted that the adjacent property owners had been notified of this project, however, no comments had been received. A copy of the letter to the adjacent property owners was placed at each Commissioner's station, and a copy is attached hereto and made a part of these minutes. Commissioner Kotowski moved that the Planning Commission approve S 81-25 subject to the conditions listed in the Staff Comment Sheet, seconded by Commissioner Meyer and unanimously adopted. PUBLIC HEARINGS S 81-30 This is the time and place for a public hearing to Lampe Construction consider the application of Lampe Construction for approval of plans, elevations, and development schedule to allow the construction of 40 condo- miniums on property known as 440 & 456 Llewellyn Avenue in an R-2-S (Multiple Zoning Residential) Zoning District. Mr. Kee reported that Staff had received a letter from the applicant requesting a continuance of this application to the Planning Commission meeting of November 24, 1981. t Chairman Kasolas opened the public hearing and invited anyone in the audience '° to speak for or against this application. No one wishing to speak, Commissioner Fairbanks moved that S 81-30 be continued to the Planning Commission meeting of November 24, 1981, seconded by Commissioner Howard and unanimously adopted. *** PD 81-12 This is the time and place fora continued public Hedley & Stark hearing to consider the application of Hedley & Stark Associates for a Planned Development Permit and approval of plans, elevations, and development schedule to allow the conversion of two existing residences to offices on property known as 824 & 840 E. Campbell Avenue in a P-D (Planned Develop- ment/Commercial) Zoning District. Commissioner Meyer reported that the applicants met with the Site and Architectural Review Committee this morning, and the Committee is recommending approval of the project since the concerns related to traffic circulation expressed by Staff have been met. Mr. Kee reported that Staff is also recommending approval of this application. -4- P~Ir. Helms then explained the traffic circulation and the ingress/egress to the site. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this application. Mr. Bill Hedley, architect representing the property owners, appeared to state that the applicant is in agreement with the conditions recommended. No one wishing to speak, Commissioner Fairbanks moved that the public hearing be closed, seconded by Commissioner Campos and unanimously adopted. RESOLUTION N0. 2063 Commissioner Meyer moved that the Planning Commission adopt Resolution No. 2063 recommending approval of PD 81-12 allowing conversion of two existing residences to offices on property known as 824 and 840 E. No one else wishing to speak, Commissioner Kotowski moved that the public hearing be closed, seconded by Commissioner Meyer and unanimously adopted. r -5- RESOLUTION N0. 2064 Commissioner Kotowski moved that the Planning Commission adopt Resolution No. 2064 approving the application of Union Avenue Associates to allow the construction of a 28-unit condominium project at 135 & 143 Union Avenue, seconded by Commissioner Meyer and unanimously adopted by the following roll call vote: AYES: Commissioners: Howard, Kotowski, Campos, Meyer, Dickson, Fairbanks, Kasolas NOES: Commissioners: None ABSENT:Commissioners: None Commissioner Dickson complimented the developer on the density proposed, he noted it is like a breath of fresh air for someone to come in with a proposal of a density less than that allowed. UP 81-15 This is the time and place for a continued public Muzinich, C. hearing to consider the application of Ms. Constance Muzinich fora use permit to allow the conversion of a residence to an infant care center on property known as 3245 S. Winchester Blvd., in a C-2-S (General Commercial) Zoning District. Commissioner D1eyer reported that the Site and Architectural Review Committee met with the applicant this morning, and the Committee is recommending approval of this application subject to the conditions of approval listed in the Staff ~"'µ Comment Sheet. ~,, Mr. Kee stated that Staff is also recommending approval of this application. Chairman Kasolas opened the public hearing and invited anyone in the audience to speak for or against this application. Dolores Wallach appeared to inquire of the total number of children proposed ; to be cared for. Connie Muzinich, applicant, stated that there would not be more than 19 children at any given time. Commissioner Dickson inquired about the hours of operation. Mrs. P~luzinich replied that the hours of operation would be from 6 a.m. to 12:00 midnight. No one else wishing to speak, Commissioner Meyer moved that the public hearing be closed, seconded by Commissioner Howard and unanimously adopted. RESOLUTION N0. 2065 Commissioner Meyer moved that the Planning Commission adopt Resolution No. 2065 approving a use permit to __ allow the conversion of a residence to an infant care center at 3245 S. Winchester Blvd., seconded by Commissioner Howard and adopted by the following roll call vote: -6- AYES: Commissioners: Howard, Kotowski, Campos, Meyer, Dickson, Kasolas NOES: Commissioners: Fairbanks ABSENT: Commissioners: None UP 81-12 Review of UP 81-12, Use Permit approved by the McQuade, P. Planning Commission on August 18 , 1981, allowing the rental of sailboats (windsur'fers) and lessons on property known as Los Gatos Creek Park, in a PF/OS (Public Facilities/Open Space) Zoning District. Mr. Kee reported that at its meeting of August 18, 1981 the Planning Commission approved a use permit to allow a windsurfing operation at Los Gatos Creek Park. This approval stipulated that the use was to be reviewed in October 1981 and upon evaluation of the operation, the Park and Recreation Commission and the Planning Commission could impose any additional conditions which are deemed appropriate. At its regular meeting of October 14, 1981 the Park and Recreation Commission voted unanimously to recommend to the Planning Commission that the use be _ allowed to continue. Attached hereto and made a part of this record is a copy of the Public Works Director's memo to the Planning Director, dated October 15, 1981 explaining the action taken at the October 14 meeting. This item was referred to the Police and Fire Departments, and neither had any comments. The windsurfing operation has been observed on several occasions by the Planning Staff and no problems were apparent. Commissioner Dickson felt since there was a concern expressed about the problems that might arise between the fishermen and windsurfers by the Park & Recreation Commission, the Planning Commission may want to review this use permit again in three months. Commissioner Howard stated that he fishes at the perk ponds, and does not feel that the windsurfers present any problem. He did not feel there was a need for this application to be reviewed once again. He stated that the only problem there might be is with parking, since the entrance is blocked from time to time in one area. Commissioner Dickson inquired as to which pond is being used for windsurfing-- he recalled that the northernmost pond was approved. Commissioner Howard responded that the northernmost lake was approved for windsurfing, and it is the pond which is stocked with fish for the fishermen. Once again, he stated he did not feel the windsurfers were a hindrance to the fisherman. Commissioner'Dickson then moved that UP 81-12 be approved subject to review in three months-in order to review any possible problems between fishermen in the area and windsurfers. This motion was seconded by Commissioner Fairbanks and unanimously adopted. ~' -7- Ms. Pat McQuade, applicant, appeared before the Commission and asked that she be able to speak. Commissioner Howard moved that the Planning Commission rescind its previous motion for approval with a three-month review in order that PAs. McQuade could address the Commission. This motion was seconded by Commissioner Dickson and unanimously adopted. Ms. McQuade stated that she would like approval of her application for a use permit and not have to come back before the Commission for review. She stated that her people police the parking area; if they were not there, there would be much greater parking problems. She noted that she would like to schedule her classes through the Community Services Department of the City and without approval this would be more difficult to do. She felt that their past record over the last few months warrants approval of this use permit without review. She would like her business to be given some credibility and respect; she feels they have earned it. Commissioner Campos stated that the fishermen had use of the ponds prior to the windsurfers and he felt the fishermen should not be disrupted, nor any of the prior uses of the ponds should be disrupted by the windsurfers. He felt the surfing was in conflict and still has some concerns. Commissioner Campos then stated that he would be in agreement with a 3-month review. Commissioner Howard argued against the 3-month review period. He stated he frequently uses the park and feels the windsurfers do a commendable job. He felt if a review period is deemed necessary, the minimum should be six months. Mr. Kee reminded the Commission that it does have the authority to revoke a use permit should there be problems down the line. He noted that a public ~ hearing could be set to determine if the use should be allowed if problems should occur. Commissioner Fairbanks inquired which months are the most active for the sport. Ms. McQuade responded that June, July and August are the busiest months. Commissioner Fairbanks then stated that possible a 9-month review would be in order based on Ms. McQuade's response, and so moved that the Planning Commission approve this application subject to a 9-month review. This motion died for lack of a second. Commissioner Howard stated that there is not that big a conflict with the fishermen, and therefore moved that this application be approved without the stipulation of a review period. This motion was seconded by Commissioner Kotowski and adopted by the following roll call vote: AYES: Commissioners: Howard, Kotowski, Meyer, Kasolas NOES: Commissioners: Campos, Dickson, Fairbanks ABSENT: Commissioners: None Commissioners Dickson and Campos noted they were not in favor of this motion for the reasons previously stated. *** -8- SA 81-38 Appeal of decision of Planning Director denying Price, R. request for signing on property known as 155 E. Campbell Avenue. Mr. Kee reported that the applicant has requested a continuance of this applies. cation to the Planning Commission meeting of November 10, 1981. Commissioner Fairbanks then moved that SA 81-38 be continued to the Planning Commission meeting of November 10, 1981, seconded by Commissioner Dickson and unanimously adopted. SA 81-27 Application of Denny's Restaurant for approval Denny's Restaurant of an expressway-oriented sign for property known as 580 W. Hamilton Avenue. Commissioner Meyer reported that the Site and Architectural Review Committee reviewed this item this morning. She then stated she would turn this report over to the former member of the Sign Review Committee. Commissioner Kotowski reported that this is one of the very few times that the Committee has disagreed with Staff's recommendation on an application. He does not feel that this is a freeway-or expressway-oriented sign. This sign faces Hamilton Avenue, not the expressway, traffic. The applicant wants to move the sign closer to the Hamilton-San Tomas intersection, and out of the tree line. Commissioner Meyer noted that the sign located across the street, "Potpourri" is approximately at the same location as the one proposed. Again, it was not felt that this is a freeway-oriented sign. Commissioner Kotowski then moved that condition listed in the Staff Comment and unanimously adopted. SA 81-37 be approved subject to the Sheet, seconded by Commissioner Meyer Mr. Kee then clarified his understanding of the Planning Commission's action noting that this is not a free-oriented sign since it faces Hamilton Avenue and not the expressway. It is not felt that it is freeway-oriented or expressway-oriented. The Commission was in full consensus with Mr. Kee's understanding. He noted that the Staff's recommendation was based on past actions of the City Council. He further noted that Staff does not have a problem with the action taken by the Planning Commission on this application. *** Staff Report Consideration regarding the appointment of an Architectural Advisor. Mr. Kee stated that Mr. Rodrigues was suggested and recommended as a possible candidate by the current Architectural Advisor.
