The Planning Commission of the City of Campbell convened this day in regular
session in the regular meeting place, the Council Chambers of the City Hall,
75 North Central Avenue, Campbell, California.

abstaining since they were not present at the

Commissioner Kotowski moved that the Planning Commission approve the above
two listed requests subject to the Staff Recommendation as listed in the Staff

TS 81-21 Tentative Subdivision Map: Lands of Bush
Lands of Bush APN 305-30-4 (80 Dot Avenue).
TS 81-22 Tentative Subdivision Map: Lands of Williams
Lands of Williams APN 305-30-2 (114 Dot Avenue).
Mr. Stafford reported that the applicant has submitted a revised map which
resolves all the concerns expressed by Staff for each of the above referenced
tentative subdivision maps.
Commissioner Kotowski then moved that TS 81-21 and TS 81-22 be approved
subject to the respective conditions of approval submitted by the Public
Works Department, seconded by Commissioner Fairbanks and unanimously adopted.
ARCHITECTURAL APPROVALS
S 81-25 Continued application of Mr. Ray Murdock for
Murdock, M, approval of plans and elevations to allow
construction of an 8,300 square foot office
building on property known as 201 E. Hamilton
Avenue in a C-1-S (Neighborhood Commercial)
Zoning District.
Mr. Stafford reported that after the meeting with the Site and Architectural
Review Committee this morning, the Staff is recommending a continuance of
this application to the meeting of October 6.
Commissioner Kotowski reported that the Site Committee is also recommending
a continuance of this application to the October 6 meeting, and the applicant
is in agreement with this recommendation.
Commissioner Kotowski then moved that S 81-25 be continued to the October 6
Planning Commission meeting, seconded by Commissioner Fairbanks and unani-
mously adopted.

PUBLIC HEARINGS
V 81-03 This is the time and place fora continued
Spivey, M. public hearing to consider the application
of Mr. Michael Spivey for a variance of both
sideyard and rear yard setbacks for an
additional dwelling unit on property known as
475 W. Sunnyoaks Avenue in an R-1 (Single-
Family/Low Density Residential) Zoning District.
Mr. Stafford reported that at its previous meetings of September 1 and
August 4, 1981 the Planning Commission continued this application so that
the applicant could submit revised plans. As of this writing, Staff has
not received a revised submittal, consequently, Staff is recommending denial
without prejudice so that this item may be removed from the agenda.

RESOLUTION N0. 2044 Commissioner Fairbanks then moved that the

ZC 65-20 This is the time and place for a continued public
Rolling Hills hearing to consider the City-initiated amendment
Shopping Center to Ordinance No. 522 of the Campbell Municipal
City-initiated Code, which adopted plans, elevations, and
development schedule and conditions of approval
for the shopping center located at 1225-1451 W.
Hacienda Avenue (Rolling Hills Shopping Center).
The proposed amendment would add a condition
requiring approval of a Use Permit for any new
liquor establishment at the shopping center.
Mr. Stafford gave background information on this item, explaining that at the
May 19, 1981 meeting the Planning Commission considered a City-initiated zone
change from P-D (Planned Development/Commercial) to C-1-S (Neighborhood
Commercial) for the Rolling Hills Shopping Center. At that meeting the
Commission adopted a motion that no action be taken, that the P-D zoning
remain in effect, and that this item be removed from the agenda. This motion
was approved by a 5-2-0 vote with Commissioners Dickson and Fairbanks voting
"no".
At its June 22, 1981 meeting, the City Council considered a letter from Ms.
PAargaret Estep regarding the Planning Commission's decision to take no action
on the proposed zone change from P-D to C-1-S. After considerable discussion,
the Council directed Staff to notice for public hearing the Planned Development
Ordinance for the Rolling Hills Shopping Center to include the use permit
requirement for liquor establishments.
Therefore, at this time, the Planning Commission is considering an amendment
to Ordinance 522, which adopted plans, elevations, development schedule and
conditions of approval for the Rolling Hills Shopping Center. The proposed
amendment would add a condition requiring approval of a Use Permit for any

new liquor establishment at the shopping center. The amendment to the ordinance
should impose the same use permit requirements on the Rolling Hills Shopping
Center which are currently required for new liquor establishments in the C-1-S,
C-2-S, and C-3-S zoning districts. The proposed amendment would give the
Commission more control over liquor establishments in the shopping center.
However, it would not affect the two existing cocktail lounges in the center.
He noted that Staff is recommending approval of an amendment to Ordinance No.
522 adding a condition requiring approval of a Use Permit for any new liquor
establishment at the Rolling Hills Shopping Center.

TA 81-1 This is the time and place fora continued public
City-initiated hearing to consider the City-initiated Text Amend-
ment to the Campbell Municipal Code, adding
Chapter 21.59 - Garage Conversions.
Mr. Stafford explained that under the existing code, an individual is permitted
to convert a garage or carport into additional living space provided that the
parking standards for a single-family residence are met (two parking spaces
must be provided, one of which must be covered) and all building and fire
codes are met. A Use Permit would not be required in this situation. In
many cases the inability to provide the covered parking space which meets
the 25-foot setback requirement would preclude conversion.
Under the proposed ordinance, a conversion of a garage and/or carport to
additional living space would require approval of a Conditional Use Permit
and Architectural Approval by the Planning Commission. This procedure would
give the Commission additional control over conversions and would also give
property owners in the immediate area notice and an opportunity to comment
on the conversion. This procedure is also intended to permit garage con-
versions where they would be otherwise prohibited. More specifically,
although the proposed ordinance requires two on-site parking spaces, the
Planning Commission, under Section 21.50.040 of the C.M.C., has the authority

to adjust the parking requirements, or in this case it could waive the require-
ment that the parking be covered. This might allow a garage conversion where
it would otherwise not be possible.
In summary, the intent of the ordinance is to examine potential conversions on
an individual basis, and after input from the surrounding property owners, if
the Commission finds that the conversion would not be detrimental to the neigh-
borhood or the City it could be allowed.

UP 81-13 This is the time and place for a public hearing
Wuv's International to consider the application of Wuv's International
fora use permit to allow the construction of an
addition and exterior modifications to an existing
restaurant on property known as 771 W. Hamilton
Avenue in a P-D (Planned Development/Commercial)
Zoning District.
Mr. Stafford explained that the applicant is proposing to renovate an existing
Del Taco Restaurant located on property known as 771 W. Hamilton Avenue. The
proposed remodeling will include the provision of a 160 square foot addition to
the front of the building which will enlarge the entry to the restaurant, and a
180 square foot addition to the southern elevation to enclose the restroom
entrances.
The proposed changes to the existing structure will not increase the seating
capacity of 60 seats as was originally approved for this restaurant. The
additional greenhouse windows and change in roof canopy materials are proposed
so that the restaurant image is consistent with other Wuv's Restaurants.
The Architectural Advisor is of the opinion that the building renovation is
acceptable.
Staff is recommending approval of the proposed changes in that the proposal
does not intensify the existing use and in that the elevation changes are
considered acceptable by the Architectural Advisor.
Commissioner Meyer reported that the Site and Architectural Review Committee
met with the applicant this morning, and the Committee is recommending
approval of this use permit as submitted, subject to the conditions listed
in the Staff Comment Sheet.
Chairman Kasolas opened the public hearing and invited anyone to speak for
or against this application.
Mr. Brian Woodell, representing the applicant, appeared to answer any
questions the Commission might have.

RESOLUTION N0. 2048 Commissioner Kotowski then moved that the
Planning Commission adopt Resolution No. 2048

GP 81-06 This is the time and place fora public hearing
Harrison, J. to consider the application of Mr. John Harrison
for an amendment to the Land Use Element of the
General Plan from "Low Density Residential" to
"Low-Medium Density Residential".
Mr. Stafford reported that the applicant is proposing to amend the Land Use
Element of the General Plan from "Low Density Residential" (less than 6 units
per gross acre) to "Low-Medium Density Residential" (6-13 units per gross
acre) in order to accommodate a 9-unit condominium project which has been
proposed for this site. The closest area shown for multi-family land use
is the area north of Smith Avenue.
The property was annexed to the City of Campbell under the MORGA annexation
program of 1980. The developer had received approval from the County to
build 9 units on this property; however, building permits were not obtained
prior to the annexation by Campbell. On being annexed, the property owner
requested the Council to recognize the County site approval and to allow
development to go ahead. The City Council denied this request, indicating
its policy for development in the San Tomas Area. Once the City Council
denied the request, the property owner filed a court action against the
annexation, and in so doing the County resumed jurisdiction over the entire
annexation (Lovell 79-16) pending the outcome of the lawsuit.
Subsequently, the property owner approached the Council for permission to tie
into a storm sewer. This request was also denied.
Staff is recommending denial of this application to amend the Land Use Element
of the General Plan based on the City Council's previous action as stated
herein. In addition, the Council and Commission have denied similar applications
to increase residential density in this area. Also, Staff could not support a
higher density on this one lot, with all adjacent lots a lower density.
Due to an error in the published notice, there was no indication that a change
of zoning would be considered on this agenda. If the Commission recommends
approval of the requested General Plan Amendment, then Staff is recommending
the zoning and development plans be heard at the meeting of October 6, 1981,
in order that the published notice may be corrected.
Chairman Kasolas then opened the public hearing and invited anyone in the
audience to speak for or against this application.
Mr. John Harrison, representing the applicant P~1rs. Carol Kanawyer, appeared
before the Commission to once again explain the history of this application.
He noted that at the time this application was being considered by the County
it was referred to the City for response, and the City responded that there
would not be a problem with this application as presented. Since that time

the owners have expended approximately $25,000 to $30,000 in fees, and the map
is now ready to record. He noted that the applicant does not have approval
from the City for storm sewer connections. The applicant is asking for an
exception for this application, and that it revert to where it was when
originally submitted to the County for approval, with the City's response
that it would not present a problem. He further urged the Commission for
a favorable rendering on this matter.
Commissioner Kotowski inquired of the City Attorney as to the status of the
area known as Lovell 79-16.
City Attorney Dempster responded that the area has reverted back to the
County pending the outcome of the litigation.
After brief discussion, and no one else wishing to speak on this matter,
Commissioner Meyer moved that the public hearing be closed, seconded by
Commissioner Fairbanks and unanimously adopted.
Motion
Commissioner Fairbanks moved that the Planning Commission recommend denial
of this application based on the City Council's previous action.
This motion died for lack of a second.
RESOLUTION NO. 2049 Commissioner Meyer moved that the Planning
Commission adopt Resolution No. 2049 recommending
approval of the application of Harrison and Kong,
Inc., for a General Plan Amendment to change the
Land Use Element from Low Density Residential
to Low-Medium Density Residential on property
known as 956 San Tomas Aquino Road. This
motion was seconded by Commissioner Campos.
Discussion of Motion
Commissioner Fairbanks spoke in opposition to this resolution, noting this
zone change is in conflict with what public hearing and committees recommenda-
tions over a long period of time have recommended for this area; i.e., a low
density area.
Chairman Kasolas relinquished the Chair to Vice Chairman Meyer, then stated
that he is in favor of this resolution since he felt it would be the most
equitable solution due to the circumstances; there has been no opposition
from the neighborhood; and, each project should be judged on its own merit.

Mr. Stafford reported that the applicant has requested a continuance of this
application to the meeting of October 6, 1981.

to speak for or against this application.

to October 6, 1981, seconded by Commissioner Fairbanks and unanimously adopted.
GP 81-08 This is the time and place for a public hearing to
ZC 81-29 consider the application of Lampe Construction for
Lampe Construction a General Plan Amendment from Low Density Residen-
tial to Medium Density Residential, and a zone
change from R-1 (Single Family Residential) to
R-2-S (Multiple Family Residential) and approval
of plans, elevations, and development schedule to
allow the construction of 40 condominiums on
property known as 440 & 456 Llewellyn Avenue
in an R-1 (Single-Family Residential) Zoning
District.
Mr. Stafford reported that a revised Staff Comment Sheet had been placed at
each Commissioner's station. He noted that Staff is recommending the following:
1. That the Planning Commission adopt a resolution recommending approval
of an amendment to the Land Use Element of the General Plan from
"Low Density Residential" to "Medium Density Residential" for the
subject properties.
2. That the Planning Commission adopt a resolution recommending
approval of a zone change from R-1 (Single-Family Residential)
to R-2-S (P~ultiple Family Residential).
3. Continuance of the development plans to the Planning Commission
meeting of October 6, 1981, so that revised plans may be submitted.
Commissioner Meyer reported that the Site and Architectural Review Committee
considered this application this morning. The Committee is concerned with the
high density proposed for this project, but would recommend approval of a zone
change to Medium Density Residential (R-2-S).
City Attorney Dempster reminded the Commission that in January 1981 the Planning
Commission adopted Resolution No. 1970 which recommended a zone change from Low
Density Residential to Medium Density Residential. He stated that if the Commission
should decide to change their position on this recommendation, findings should be
made justifying the change in position.

Chairman Kasolas opened the public hearing and invited anyone in the audience
to speak for or against this application.
Mr. Bruce Johnson, representing the applicant, stated that he is in concurrence
with Staff's recommendations of the R-2-S zoning, as well as a continuance of
the development plans. He noted that the plans as presented have been prepared
to be consistent with the approval that had been recommended by the Commission
in January. He explained the surrounding uses in the neighborhood, noting that
this property would be used as a buffer between the commercial and residential
uses. He noted that at this morning's meeting concerns were expressed about
placement of windows, balconies, and line of sight. He noted that these concerns
will be taken into consideration when revised plans are prepared for the site.
Ms. Suzanne C. Auger of 453 N. Carlyn appeared before the Commission to present
a petition against this proposed subject, signed by approximately 91 residents.
A copy of this petition is attached hereto and made a part of this record. She
gave an overview of the neighborhood, noting it still has a rural character and
the homes are still on septic tanks. She noted that it is the desire of the
adjacent property owners to retain a low density zoning for this area.
Mr. Johnson appeared once again to address some of the concerns expressed by
Ms. Auger.
Mr. Alvin Beckett, speaking on behalf of his mother Mrs. Virginia Beckett of
441 N. Carlyn Avenue, expressed concern about this entire neighborhood being
zoned at a higher density. His mother is in favor of retaining a lower
density for this area.
Mr. Fred Morie of 440 Carlyn also spoke against the proposed project noting
he is also in favor of a low density zoning for this area.
Mrs. Virginia Beckett, 441 N. Carlyn, then appeared to speak against this
project and the high density. She stated that her property is directly in
back of the parcel proposed for development and did not wish to have windows
looking down into her backyard. She also expressed concern about the increased
traffic caused by the development of this parcel.
Mr. Herbert Bicowski of 310 W. Hamilton Avenue spoke against the proposed zone
change; he is favor of R-1 zoning for this area.
Mr. Art Martinez of 317 Carlyn noted that he is against any increase in density
for this area; he has been vandalized twice, and noted that any increase in
density would only increase the possibility of crime and vandalism in this
area. He also expressed concern about the safety on the street with additional
traffic created by the development of the proposed site.
No one else wishing to speak regarding this project, Commissioner Meyer moved
that the public hearing be closed, seconded by Commissioner Fairbanks and
unanimously adopted.
Commissioner Fairbanks inquired of Mr. Helms about the traffic pattern in this
area, and inquired of the kind of impact a project of the proposed nature would
have on this area.

Engineering Manager Helms responded that Latimer Avenue is a minor collector
street in the city. He then explained the traffic pattern in the area. He
noted that the last traffic count conducted in this area was taken in February
1980. He noted that with the development proposed there would only be a total
of 150 trip ends per day. He did not feel that this amount is a significant
volume increase for that street. He stated that there would be very little,
if any, increased traffic volume on Carlyn Avenue; but there would be some on
Latimer.
Commissioner Fairbanks then inquired about the Professional Office designation
which had been recommended in January of this year.
Mr. Stafford responded that the applicant at that time requested "Medium Density
Residential or Professional Office" in order to allow more flexibility in develop-
ing the property. The current applicant has requested only consideration of the
"Medium Density Residential" designation.
The City Attorney then suggested that the Staff Comment Sheet of January 20,
1981 be read into the record for the benefit of the audience to have a clear
understanding of what took place at that time.
Recording Secretary Wade then read into the record the Staff Comment Sheet
dated January 20, 1981. A copy of this report is attached hereto and made
a part of this record.
Since there were other persons in the audience wishing to be heard, Commissioner
Meyer moved that the public hearing be reopened. This motion was seconded by
Commissioner Kotowski and unanimously adopted.
Mr. Jim Steward of First Street expressed concern about this property being
compared to the site of Wesley Manor.
Mr. Morie appeared once again to state that the Best Products store is quite a
distance from the site being discussed, and did not feel this had any relation
to being a buffer.

hearing be closed, seconded by Commissioner Meyer and unanimously adopted.

At this time Commissioner Fairbanks moved that the Planning Commission recommend
to the City Council consideration of "Professional Office" Zoning as well as
"Multiple Family Residential" for property known as 440 and 456 Llewellyn

GP 81-09 This is the time and place for a City-initiated
City-initiated public hearing to consider the Land Use Element
of the General Plan.
Mr. Stafford reported that the property identified as APN 424-43-1 through
424-43-63 (Tract 6571) is presently unincorporated. The parcel is indicated
on Campbell's current Land Use Element of the General Plan for both "Professional
Office" and "Low Density Residential" uses. At the present time a 63-unit condo-
minium development exists on the 3.4 gross acre site, resulting in a density of
approximately 18 units per gross acre. At this time Staff is recommending an
amendment to "Medium Density Residential" for this property in order to keep the
General Plan and density development in conformance with one another.

RESOLUTION NO. 2051 Commissioner Kotowski moved that the Planning
Commission adopt Resolution No. 2051 recommending

adopted by the following roll call vote:

ZC 81-28 This is the time and place for a public hearing
City-initiated to consider a City-initiated prezoning of un-
incorporated properties within Campbell's Urban
Service Area between Highway 17 and Bascom Avenue
and south to Wanda Lane.
Mr. Stafford reported that the area under consideration (as displayed on an
exhibit to the Commission) is the only remaining area of unincorporated land
within Campbell's Urban Service Area which has not been prezoned. Prezoning
is the formal notification to property owners of the zoning that would be
placed on their property if it were to be annexed to the City. He further
noted that the City does not have any plans at present to initiate annexation
proceedings for this area. However, individual property owners, especially
along Bascom Avenue, have initiated annexations. In each case, the City must
then prezone these parcels before the annexation will be considered by the Local
Agency Formation Commission. The prezoning process adds approximately 90-120
days to the annexation process.
It is the Staff's opinion that by prezoning the entire unincorporated area
at this time, a substantial amount of time could be saved for any subsequent
annexations.
Chairman Kasolas opened the public hearing and invited anyone in the audience
to speak for or against this prezoning.
Janet Repozzi inquired as to when the last speed survey was performed in this
area.
Engineering Manager Helms responded that the City recently conducted a survey
near Redding and Shelley, however he did not have any information~as to what the
County has surveyed.
Ruth Irvine of 178 Kilmer spoke against high density in this area.

ITEMS BROUGHT UP BY COMP1ISSIONERS
Commissioner Fairbanks inquired as to how long construction can go on when
building a single-family residence. There is a residence being constructed
on Bedal Lane which has been in the construction stage for some time.
Mr. Stafford replied that there is no absolute time limit which a building
must be completed.
Commissioner Fairbanks then inquired about the old two-story home located
at 1110 Hacienda Avenue; she asked if the setbacks are in order.
Mr. Stafford reported that there is an existing porch which must be removed
prior to occupancy of the last unit constructed.
