MINUTES AUGUST 4, 1981 The Planning Commission of the City of Campbell convened this day in regular session in the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. ROLL CALL Present Commissioners: Kotowski, Campos, Fairbanks, Vice Chairman Meyer; Planning Director Arthur A. Kee, Principal Planner Philip J. Stafford, Public Works Director Joe Elliott, City Attorney J. Robert Dempster, Recording Secretary Jeannine Wade. Absent Commissioner Dickson and Chairman Kasolas. APPROVAL OF MINUTES July 21, 1981 Commissioner Kotowski moved that the minutes of the regularly scheduled meeting of the Planning Corr~nission on July 21, 1981 be approved as submitted, seconded by Commissioner Campos, and unanimously adopted. COh1MUN I CATI ONS Mr. Kee stated that items of communication relate to specified items on the agenda and would be considered at that time. CONSENT CALENDAR TS 81-17 Tentative Subdivision Map: Lands of Kimo Lands of Kimo Corporation. APN 406-16-10 and 11 (1160-1170 Corporation Steinway Avenue). Mr. Kee reported that at its meeting of June 2, 1981, the Planning Commission recommended approval of ZC 81-13, the application of Mr. Erik Crull for a zone change and approval of plans to allow the construction of four new residences and the retention of two existing residences on properties known as 1160 & 1170 Steinway Avenue. The Commission recommended approval of this application with a 6-0-1 vote, Commissioner Pack being absent. Condition N of that approval requires that the applicant process and file a tract map. The applicant has since submitted this tentative subdivision map which would allow the development of four new townhomes and create a project density of 3.9 units per gross acre for these properties. -2- He then noted Staff is recommending approval of this tentative subdivision map in that it conforms to the approved site plan and in that the proposed density is consistent with the Low Density Residential designation (less than 6 units per gross acre) as shown on the Land Use Element of the General Plan for this area. Commissioner Fairbanks inquired if other than standard street improvements are recommended for this project. Mr. Kee responded that standard street improvements had been recommended for this project. She then inquired if the timing of the approval of this project in relation to the approval of the new procedure for street improvements was the reason this project had not been recommended for other than standard street improve- ments. Mr. Kee responded affirmatively. Commissioner Fairbanks then stated for the record that she felt this is one project that could have had other than standard street improvements installed and she does have a concern about this project. Commissioner Campos then moved that the Planning Commission recommend approval of this tentative subdivision map to the City Council, as stated in the Staff Comment Sheet, seconded by Commissioner Kotowski and adopted. *** TS 81-18 Tentative Subdivision Map: Lands of Huckell Lands of Huckell APN 403-19-33 & 34 (1339-1409 Harriet Avenue). Mr. Kee reported that at its meeting of May 5, 1981 the Planning Commission unanimously recommended approval of the application of Mr. Bruce Johnson for a zone change and approval of plans to allow the construction of 5single-family homes and the retention of an existing house on property known as 1399 and 1411 Harriet Avenue (ZC 81-12). Condition L of that approval requires the applicant to file and process a tract map. The applicant has since submitted this tentative subdivision map which would allow the development of 5 additional homes on these properties. The project would be developed at a density of 4.8 units per gross acre which is consistent with the Low Density Residential designation as shown on the Land Use Element of the General Plan. He further noted Staff is recommending approval of the subject tentative subdivision map in that it is consistent with the General Plan and the approved site plan. Commissioner Fairbanks inquired if there was any discussion regarding street improvements for this project when it was considered by the City Council.. Mr. Kee responded that it was felt in this particular case that standard street improvements should be retained. __ Commissioner Kotowski then moved that the Planning Commission recommend approval of the tentative subdivision map as stated in the Staff Comment Sheet, seconded by Commissioner Campos and unanimously adopted. *** -3- ARCHITECTURAL APPROVALS S 81-17 Continued application of Mr. H. Rubinstein for Rubinstein, H. approval of plans and elevations to allow con- struction of a professional office building on - property known as 42 W. Campbell Avenue in a P-0 (Professional Office) Zoning District. Mr. Stafford reported that the applicant is proposing to construct a two-story office building to the rear of an existing building which has been converted to an office use. The proposed office addition will provide an additional 6,070 square feet of gross building area. This will create a total gross square footage of 7,552 square feet. The existing and proposed structures will cover approximately 23% of the site. Building materials are indicated as stucco for walls and monray clay the for roofing. The elevations indicate the use of heavy wood trim and trellis work as architectural accents on the building. The site plan indicates that approximately 24% of the project will be landscaped. The majority of the mature redwood trees on the site have been retained. The applicant has provided 36 parking spaces (24 standard, 11 compact, 1 handicapped) for this project. The provided parking results in a parking ratio of 1:209 which is a slightly higher rate than has been previously approved by the Commission. The Commission has typically required a provision of parking at a ratio of 1:200 for office uses. To address this concern, a reduction in floor area of approximately 350 square feet would be required. He then noted that Staff is recommending approval of this application subject to the conditions listed in the Staff Comment Sheet. Commissioner Kotowski reported that the Site and Architectural Review Committee met with the applicant this morning, and the Committee is recommending approval subject to the redlining on the plans. Commissioner Kotowski then moved that the Planning Commission approve S 81-17 subject to the conditions listed in the Staff Comment Sheet (a copy of which is attached hereto and made a part of these minutes),'seconded by Commissioner Campos and unanimously adopted. *** S 81-23 Application of the Rev. Gregory Post for approval Post, G. of plans and elevations to allow the construction of an addition to an existing chapel structure located on property known as 110 W. Latimer Avenue in an R-3-S (Multiple Family/High Density Residential) Zoning District. Mr. Stafford reported that on March 21, 1978 the Planning Commission approved a --- use permit allowing the conversion of a 4,000 square foot residence into a chapel and rectory on the subject property. Seating in the chapel was limited to 49 persons and 39 parking spaces were provided. -4- At this time the applicant is requesting approval of a 473 square foot classroom addition to the building. Staff is of the opinion that the addition is accept- able and that the existing parking is adequate. The Architectural Advisor is of the opinion that the project is acceptable. Commissioner Kotowski reported that the applicant met with the Site and Architectural Review Committee this morning and the Committee is recommending approval of this application. Commissioner Kotowski then moved that the Planning Commission approve S 81-23 subject to the conditions listed in the Staff Comment Sheet a copy of which is attached hereto and made a part of this record), seconded by Commissioner Campos and unanimously adopted. PUBLIC HEARINGS Vice Chairman Meyer noted that the Commission would be considering Items No. 6, 7, and 8 next on the agenda since it is recommended that they be continued. ZC 81-22 This is the time and place for a continued public Lyle, J. hearing to consider the application of Mr. Jim Lyle for a zone Chan e from R-1 (Single Family Residential) to P-D Planned Development) and approval of plans, elevations and development schedule to allow construction of 17 single family homes on property known as 1106, 1130 and 1142 Audrey Avenue in an R-1 (Single Family Residential) Zoning District. Mr. Kee reported that one item of communication had been received on this application. He noted that it could be included in the packet when this item comes before the Commission as recommended on September 1, 1981. It was the consensus of the Commission that the letter dated August 4 from Maggie Desmond be included in the Commission packet when this item is considered. Mr. Kee then stated that, as he understood it, the applicant had met with the residents of the area. He noted that Staff is in accord with the applicant's request for an extension to the September 1 Planning Commission meeting. Vice Chairman Pleyer then opened the public hearing and invited anyone in the audience to speak for or against this application. Mr. Gardener, resident of the area, appeared to state for the record that the applicant had told the residents of the area in the meeting held that nothing new would be proposed. Mr. Lee Peterson of 1156 Audrey Avenue inquired as to whether the residents of the area could receive a notice regarding when this item would again be considered by the Planning Commission. -5- Mr.;Kee explained the public hearing noticing process; noting that no further notices would be sent out. He suggested Mr. Peterson notify his neighbors. Commissioner Kotowski then inquired if a notice would be published in the newspaper. Mr. Kee reported that the notice had been published according to law, and the City is not required to notice a second time. No one else wishing to speak, Commissioner Fairbanks moved that ZC 81-22 be continued to the Planning Commission meeting of September 1, 1981, seconded by Commissioner Kotowski and unanimously adopted. *** V 79-1 This is the time and place for a continued Landberg, D. public hearing to consider the application of Mr. Donald C. Landberg and Ruth & Going, Inc., fora variance from Sections 21.48.020, 21.48.030, and 21.48.040 of the Campbell Municipal Code to allow construction of a parking structure on property known as 350 Budd Avenue in an R-3-S (Multiple Family/ High Density Residential) Zoning District. Mr. Kee stated that a communication had been received from the applicant concurring with the Staff's recommendation fora continuance of this application to the Planning Commission meeting of October 6, 1981. He noted that the property owners in the area would be notified of the meeting. Vice Chairman Meyer opened the public hearing and invited anyone in the audience to speak for or against this application. Mr. Kee reported that Staff is recommending a continuance of this item and the applicant is in concurrence with the recommendation. Vice Chairman Meyer opened the public hearing and invited anyone in the audience to speak for or against this application. No one wishing to be heard, Commissioner Fairbanks moved that S 79-25 be continued to the October 6, 1981 Planning Commission meeting, seconded by Commissioner Kotowski and unanimously adopted. *** -6- S 81-22 This is the time and place for a public hearing LaGuisa, J. to consider the application of Mr. Jere LaGuisa for approval of plans and elevations to allow construction of three condominium units on ' property known as 270 N. Central Avenue in an R-M-S (Multiple Family Residential) Zoning ~ i District. i t Mr. Stafford reported that the applicant is proposing to construct three two-story condominiums on the .21 acre parcel. This project would be developed at a density t of 12 units per gross acre and would require removal of the existing single-family residence on the site. i Building materials are indicated as grooved plywood for siding and medium cedar shakes for roofing. i The site plan indicates that approximately 37% of the project will be landscaped. , ~ There are a variety of fruit trees which will be removed with the development of this project, however, Staff is of the opinion that these trees are not of the size or type to warrant retention. The applicant has provided 8 parking spaces (6 standard, 2 compact) for this project. The provided parking satisfies the requirement of 2.5 spaces per unit as specified for two-bedroom condominiums. The Architectural Advisor is of the opinion that the elevation and site plan are acceptable. Mr. Stafford further noted that Staff is recommending approval of this application. Commissioner Fairbanks expressed opposition to the approval of this application, since she felt the project is being proposed at the high end of the density range. RESOLUTION N0. 2032 Commissioner Kotowski moved that the Planning Commission adopt Resolution No. 2032 approving S 81-22, application of Mr. Jere LaGuisa, seconded by Commissioner Campos and adopted by the following roll call vote: AYES: Commissioners: Kotowski, Campos, Meyer NOES: Commissioners: Fairbanks ~~ ABSENT: Commissioners: Dickson, Kasolas 1. .1. .4 -7- V 81-03 This is the time and place for a public hearing Spivey, M. to consider the application of Mr. Michael Spivey fora variance of both sideyard and rear yard setbacks for an additional dwelling unit on property known as 475 W. Sunnyoaks Avenue in an R-1 (Single Family/Low Density Residential) Zoning District. Mr. Kee reported that the applicant is requesting a variance to both rear yard and side yard setbacks for a proposed garage and dwelling unit on the rear portion of the 13,200 square foot parcel. The proposal indicates the provision of a 5-foot setback for the western side yard and northern rear yard. The open space chapter of the Zoning Ordinance would require the provision of a 9.5 foot setback for the proposed structure. Staff is of the opinion that exceptional or extraordinary circumstances have not been demonstrated in this application which would create an unnecessary hardship for this property. The proposed structure could be accommodated on this site and still conform to setback requirements with little difficulty. Therefore, it has been concluded that: 1. The application of these particular setback requirements does not create a hardship for this property. 2. The granting of such a variance would establish an undesirable precedent. 3. The applicant has not demonstrated a hardship which would be created by strict enforcement of these zoning regulations. Chairman Meyer opened the public hearing and invited anyone in the audience to speak on this item. Mr. Michael Spivey, applicant, appeared before the Commission to explain his project. Mr. Bernard Barrett of 928 Emory Avenue appeared before the Commission to speak against this project. No one else wishing to speak, Commissioner Fairbanks moved that the public hearing be closed, seconded by Commissioner Kotowski and unanimously adopted. At this time Commissioner Kotowski inquired of Mr. Kee and Mr. Spivey if a continuance might be in order so that possibly revised plans could be submitted. Mr. Kee stated that Staff would be agreeable to a continuance; Mr. Spivey agreed to a continuance. Commissioner Kotowski then moved that the public hearing be reopened, seconded by Commissioner Fairbanks, and unanimously adopted. Commissioner Kotowski moved that V 81-03 be continued to the Planning Commission meeting of September 1, 1981, in order that revised plans could be submitted, seconded by Commissioner Fairbanks and unanimously adopted. -8- UP 81-12 This is the time and place for a public hearing McQuade, P. to consider the application of Ms. Patricia McQuade fora use permit to allow the rental of sailboats (windsurfers) and lessons on property known as Los Gatos Creek Park in a PF/OS (Public Facilities/Open Space) Zoning District. Mr. Kee explained that the applicant is applying for a use permit to allow the rental of sailboats (windsurfers) and lessons at Los Gatos Creek Park. The Public Facilities Zoning District, in which this park is located, requires approval of a use permit for this type of activity. The applicant has obtained a two-year lease with the County to operate this business. The lease states the specific scope of the operation including limiting the number of sailboats for rental to 25. The lease also requires the applicant to provide liability insurance. This application has been reviewed by the Fire and Police Departments. The Fire Department has no comment on the application. The Police Department expressed concern that this operation could limit the use of the park by other citizens for other uses and could also create parking problems. Staff is recommending approval of this application subject to the condition that the use be reviewed at the end of the summer to determine if any changes or restrictions should be placed on the use permit. ' Commissioner Kotowski inquired if this application had been referred or should be referred to the Los Gatos Creek Streamside Park Committee or the Park and Recreation Commission. Public Works Director Elliott responded that this had not been referred to the Park and Recreation Commission. Chairman Meyer opened the public hearing and invited anyone in the audience to speak for or against this application. Ms. Pat McQuade, 1832 Curtner Avenue, San Jose (applicant) explained the operation to the Planning Commission. She noted that her school is one of the largest and most respected in the country. Also, most of the instructors are certified and have CPR training. She further noted that the perc pond is the safest place for training. Mr. Kee noted that this could be reviewed by the Commission, if approved, in October and if any problems existed the use permit could be revoked or conditions of approval added. He further noted that the County has issued a permit for this use. Commissioner Fairbanks expressed concern about this application not having been referred to the Park and Recreation Commission. She stated she would feel more comfortable with this being referred to the Commission. Commissioner Campos felt that this is not the best place for this type of k use; he felt the area is being oversaturated. -9- After further discussion, Commissioner Fairbanks moved that the Planning Commission refer this application to the Park and Recreation Commission for review, and that this be continued to the August 18 meeting and reviewed by the entire Commission. This motion was seconded by Commissioner Campos and unanimously adopted. *** The Commission took a break at 8:58 p.m.; the meeting reconvened at 9:17 p.m. * ~ PD 81-09 This is the time and place for a public hearing Peters, J. to consider the application of Mr. John Peters for a planned development permit and approval of plans, elevations, and development schedule to allow construction of an additional dwelling unit on property known as 116 S. Fourth Street in a P-D (Planned Development/Medium Density Residential) Zoning District. Mr. Stafford reported that the applicant is proposing to construct an additional dwelling unit on the subject property. A single family home presently exists on the 7,500 square foot site. The duplex will result in a density of 10 units per gross acre which is consistent with the General Plan's designation in this area of Medium Density Residential (14-20 units per gross acre). Building materials are indicated as stucco for the walls and composition shingles for the roof. The new unit will match the existing residence. The applicant has provided four parking spaces (2 covered in an existing garage, 2 uncovered) which satisfies the code requirement of 2 spaces per unit for duplexes, one of which must be covered. However, the two uncovered spaces are located in front of the garage. Staff is of the opinion that these spaces create an unacceptable parking layout, and therefore Staff is recommending that the applicant submit revised plans which indicate the relocation of the two uncovered spaces. The Architectural Advisor is of the opinion that the project is acceptable, however he has recommended some interior modifications as indicated on the plans. Commissioner Kotowski reported that the applicant met with the Site and Architectural Review Committeethis morning, and the Committee is recommending approval with a change in the development schedule to~allow construction to begin within one year after approval. Chairman Meyer opened the public hearing and invited anyone in the audience to speak for or against this application. Mr. John Peters, applicant, appeared before the Commission to state that he is in accord with Staff's recommendation and the conditions listed. No one else wishing to speak, Commissioner Kotowski moved that the public hearing be closed, seconded by Commissioner Fairbanks and unanimously adopted. -10- RESOLUTION N0. 2033 Commissioner Fairbanks moved that the Planning Commission adopt Resolution No. 2033 approving PD 81-09 subject to revised plans being submitted to the Planning Director in order to resolve parking concerns, and development schedule to read "Construction to begin within one year of approval," and subject to the conditions listed in the Staff Corhment Sheet. This motion was seconded by Commissioner Campos and adopted by the following roll call vote: AYES: Commissioners: Kotowski, Campos, Fairbanks, Meyer NOES: Commissioners: None ABSENT: Commissioners: Dickson, Kasolas *** PD 81-10 This is the time and place for a public hearing Kadjevich, R. M. to consider the application of Mr. R. M. Kadjevich for a planned development permit and approval of plans, elevations, and development schedule to allow construction of a 6,022 square foot industrial/warehouse building on property known as 200 and 222 Dillon Avenue in a P-D (Planned Development/Industrial) Zoning District. Mr. Stafford reported that the applicant is proposing to construct a 6,022 square foot industrial/warehouse building on the .36 acre site. The building will be divided into 5 shop condominium units. Two existing structures on the site will be removed. Building materials are indicated as concrete block for the walls and the for the roof. The applicant has provided 17 parking spaces (12 regular, 4 compact, 1 handicapped) which exceeds by one the parking requirement for this combination of office, industrial, and warehouse space. The site plan indicates that 15% of the project will be landscaped. A large redwood tree at the front of the project will be retained. Staff is concerned that a 500 square foot area between the rear of the building and the rear property line has the potential of becoming an outside storage area. Staff is recommending that this area be landscaped or made into a lunch yard or patio area to insure that it is not used as a storage area. The Architectural Advisor is of the opinion that the project is acceptable. Commissioner Kotowski reported that the Site and Architectural Review Committee met with the applicant this morning, and the Committee is also recommending approval of this application. Chairman Meyer opened the public hearing and invited anyone to speak for or against this application. -11- Mr. Bob Ferguson, applicant, appeared before the Commission to state that he concurs with the conditions of approval. Commissioner Kotowski then moved that the public hearing be closed since no one else wished to speak on this item. This motion was seconded by Commissioner Campos and unanimously adopted. RESOLUTION N0. 2034 Commissioner Campos moved that the Planning Commission adopt Resolution No. 2034 recommending approval of PD 81-10, subject to the conditions listed in the Staff Comment Sheet, seconded by Conromissioner Kotowski and adopted by the following roll call vote: AYES: Commissioners: Kotowski, Campos, Fairbanks, Meyer NOES: Commissioners: None ABSENT: Commissioners: Dickson, Kasolas *** ZC 81-24 This is the time and place for a public hearing Fleming, J. to consider the application of Mr. Jeff Fleming for a zone change from R-2-S (Multiple Family Residential) and approval of plans, elevations, and development schedule to allow construction of 6 townhomes on property known as 1444 W. Latimer Avenue in an R-2-S (Multiple Family Residential) Zoning District. Mr. Stafford reported that the Planning Commission, at its meeting of January 6, 1981, approved the applicant's plans for the construction of six condominium units on property known as 1444 W. Latimer Avenue. The applicant has since chosen to construct six townhomes on this property; consequently, this application for a zone change to allow the development of townhomes on this property is before the Commission at this time. The proposed site plan and elevations have not changed from the original submittal. The only changes which must be taken to allow the construction of townhomes are a modification to wall details, the processing of a new subdivision tract map, and a zone change from R-2-S to P-D. Staff is of the opinion that the proposed zone change is consistent with the Land Use Element of the General Plan and is recommending approval at this time. Commissioner Kotowski reported that the Site and Architectural Review Committee is also recommending approval of this application. Chairman Meyer opened the public hearing and invited anyone in the audience to speak for or against this item. Dorothy L. Fair of 1715 Mendenhall, San Jose, appeared before the Commission to express concern about her street being used as a speedway, and the added tr~ffic ~hi~ ~ro~e~t would genes pu~lich~ear~nrted that some of her neighbors had no receive n tice about this g. Mr. Kee explained the background of this area, noting the General Plan hearings which had been held to effectuate the present density. -12- No one else wishing to speak, Commissioner Campos moved that the public hearing be closed, seconded by Commissioner Kotowski and unanimously adopted. Commissioner Fairbanks expressed concern about residents of the area not receiving public hearing notices regarding proposed projects. She asked that Staff prepare a report documenting the procedure used for notification. Mr. Kee stated that Staff will prepare a report regarding the legal procedure currently used. RESOLUTION N0. 2035 Commissioner Kotowski moved that the Planning Commission adopt Resolution No. 2035 recommending approval of a zone change from R-2-S (Multiple Family Residential) to P-D (Planned Development) for property known as 1444 W. Latimer Avenue. This motion was seconded by Commissioner Fairbanks and adopted by the following roll call vote: AYES: Commissioners: Kotowski, Campos, Fairbanks, Meyer NOES: Commissioners: None ABSENT: Commissioners: Dickson, Kasolas RESOLUTION N0. 2036 Commissioner Kotowski then moved that the Planning Commission adopt Resolution No. 2036 recommending approval of plans, elevations, and development schedule to allow construction of 6 townhouse units on property known as 1444 W. Latimer Avenue, seconded by Commissioner Fairbanks and adopted by the following roll call vote: AYES: Commissioners: Kotowski, Campos, Fairbanks, Meyer NOES: Commissioners: None ABSENT: Commissioners: Dickson, Kasolas MISCELLANEOUS TS 81-19 Tentative Subdivision Map: Lands of Antonicic Lands of Antonicic APN 306-47-31 (1444 W. Latimer Avenue). Mr. Stafford reported that this item is directly related to the application of Mr. Jeff Fleming (ZC 81-14) for approval of plans to construct 6 townhomes on property known as 1444 W. Latimer Avenue. Condition I of this approval requires the applicant to file and process a tract map. The applicant is now requesting approval of the subject tentative map. The General Plan indicates Medium Density Residential (14-20 units per gross acre) for this area. The proposed project would be developed at a density of 16.3 units per gross acre. Staff is recommending approval of this map in correlation with the Commission's approval of ZC 81-24. -13- Commissioner Fairbanks then moved that the Planning Commission recommend approval of this tentative subdivision map to the City Council. This motion was seconded by Commissioner Kotowski and unanimously adopted. *** Staff Report Setting date for public hearing to consider prezoning of unincorporated area within Campbell's Urban Service Area between Highway 17 and Bascom Avenue and south to Wanda Lane. Mr. Stafford reported that in 1980, when the City was involved with the MORGA annexation program, all of the areas within the City's urban service area were prezoned according to Campbell's General Plan, with the exception of the area shown on the map attached to the Staff Comment Sheet. At the present time there has been interest expressed to the south of the current City boundary to have his LAFCO policy requires that property be prezoned prior Staff is recommending that a hearing be set to consid~ entire area, rather than on a lot-by-lot basis. Once prezoned, subsequent annexations will be facilitated. by a property owner property annexed. Mr. Stafford reported that Staff has investigated the tanning booth at the Campbell Racquet Ball Club, and there appears to be only one tanning booth. He noted that Staff is of the opinion that one tanning booth does not constitute a tanning studio. City Attorney Dempster stated he also felt that one tanning booth does not constitute a tanning studio, however he would research this item and report back to the Commission. *** a 7 a -14- Staff Report Appointment to Historic Preservation Study Committee.
