The Planning Commission of the City of Campbell convened this day in regular
session in the regular meeting place, the Council Chambers of the City Hall,
75 North Central Avenue, Campbell, California.
ROLL CALL

APPROVAL OF h1INUTES
February 3, 1981 Commissioner Meyer moved that the minutes of the
regular meeting of February 3, 1981 be approved
' as submitted, seconded by Commissioner Campos
and adopted with Chairman Kasolas abstaining since
he was not present at that meeting.
INTRODUCTIONS
At this time the Chair introduced Acting City Attorney Lance 1~1ei1 who was
sitting in for J. Robert Dempster, and Engineering Technician I James Penoyer,
who was sitting in for Engineering Manager Bill Helms.
COMMUNICATIONS
Mr. Kee reported that communcations received relate to specific items on the
agenda and would be considered at that time.
ARCHITECTURAL APPROVALS
S 81-05 Continued application of Mr. Jack Nelson for approval
Nelson, J. of plans and elevations to allow construction of a
10,422 square foot warehouse/office building to be
located on property known as 1320 Whiteoaks Road in
an M-1-S (Industrial) Zoning District.
Commissioner Meyer reported that the applicant had met with the Site and
Architectural Review Committee this morning, and the Committee is recommending
approval subject to the wood treatment being carried all the way around the
building and the landscape plans being brought back before the Site and
Architectural Review Committee for approval.
Mr. Kee reported that Staff is recommending approval of this application.

Commissioner Meyer then moved that the Planning Commission approve S 81-05
subject to the conditions listed in the Staff Comment Sheet with the wood
treatment to be carried all the way around the building and the landscape
plan to come back before the Site and Architectural Review Committee for
approval. This motion was seconded by Commissioner Pack and unanimously
adopted. A copy of the conditions of approval are attached hereto as part
of these minutes.

S 81-06 Application of Mr. Clarence Williams for approval of
Williams, C. plans and elevations to allow construction of an
industrial/warehouse building on property known as
457 McGlincey Lane in an M-1-S (Light Industrial)
Zoning District.
Commissioner Meyer reported that the applicant had met with the Site and
Architectural Review Committee this morning, and the Committee is recommending
approval of the plans as redlined and with the condition that the landscape
plan come back to the Committee for approval.
Mr. Kee stated that Staff is also recommending approval of this project subject
to the conditions listed in the Staff Comment Sheet.
Commissioner Pack then moved that S 81-06 be approved by the Planning Commission
as redlined, subject to the conditions listed in the Staff Comment Sheet, with
the added condition that the landscape plan come back to the Site and Archi-
tectural Review Committee for approval. This motion was seconded by Commissioner
Kotowski and unanimously adopted. A copy of the Conditions of Approval are
attached hereto and made a part of these minutes.

S 81-07 Application of P~1r. Kjartan Armann for approval of
Armann, K. plans and elevations to construct an industrial
building on property known as 954 and 960 Camden
Avenue in an P1-1-S (Light Industrial) Zoning District.
Commissioner Meyer reported that there was considerable discussion of this
application at this morning's Site and Architectural Review Committee meeting.
She noted that this property is very close to the freeway, and on the back
portion is a Santa Clara Valley Water District easement. She noted that the
Committee would like to see mature landscaping planted, and is recommending
a continuance of this application for two weeks in order that all concerns
could be resolved.
Commissioner Kotowski expressed concern about the roles of the Park and
Recreation Commission and the Santa Clara Valley 4Jater District as regards
landscaping for this project. The Committee wished to see mature land-
scaping installed that would provide maximum screening. The applicant
stated that he would contact the above noted agencies and agreed to install
whatever landscaping is necessary.
Commissioner Pack inquired at this time if it would be in order to refer
this item to the Park and Recreation Commission to see if the landscape
plans are in accord with the overall general plans for the park area.

Mr. Kee responded that this could be either referred in total (the entire
application) or once the landscape plans are submitted they could be referred
to the Commission. He noted that at this point a continuance is recommended
for this application.
Commissioner Pack felt that this should be referred to the Commission as well
as the Los Gatos Creek Committee prior to the Planning Commission making a
decision on this application.
At this time Commissioner Fairbanks noted she had seen gas pumps in two
various areas; she wondered if these tanks would be filled.
Mr. Kee stated that there is no mention on the plans for retention of the
tanks. He noted Staff could refer this to the Fire Department for comment.
At this time Commissioner Pack moved that the Planning Commission continue
S 81-07 to the Planning Commission meeting of March 3, 1981 in order that
the items brought up at this evening's meeting and this morning's Site
meeting could be resolved. This motion was seconded by Commissioner Fairbanks
and unanimously adopted.

S 81-08 Application of Mr. Brad Kunkel on behalf of Bradko
Bradko Enterprises Enterprises, Inc., for approval of plans and
elevations to construct 9 condominium units on
property known as 215, 223 and 229 N. Central
Avenue in a R-M (Multiple Family Residential)
Zoning District.
Mr. Kee reported that the applicant is proposing to construct 9 condominium
units on the .64 net acre site. The project results in a density of 10.2
units per gross acre, which is consistent with the General Plan designation
of Low-P1edium Density Residential (6-13 units per gross acre).
Presently, three single-family homes (which are to be removed) occupy the
site. These structures are listed on the Campbell Historic Survey. There-
fore, the Staff~is recommending that this item be continued to the March 3,
1981 meeting of the Planning Commission so that the Historic Preservation
Board can review the structures at their meeting of February 24, 1981.
Discussion then ensued regarding establishment of a policy whereby the
Commission would not act on an application which includes a building listed
on the Historic Survey List until review by the Historic Preservation Board
has been made. It was the consensus that a policy not be established at this time.
Commissioner Meyer then moved that the Planning Commission continue this
item to the March 3, 1981 Planning Commission meeting, seconded by
Commissioner Pack and unanimously adopted.

PUBLIC HEARINGS
UP 81-01 This is the time and place for a continued public
Kruse, E. hearing on the application of Mr. Ervin Kruse for
a use permit and approval of plans to establish
an office building use on property known as 155 E.
Campbell Avenue in a P-D (Planned Development/
Commercial) Zoning District.
Commissioner Meyer reported that the applicant met with the Site and
Architectural Review Committee this morning, and the Committee is recommending
a continuance to the March 3 meeting in order that problems with the parking
ratio could be resolved.
Mr. Kee reported that Staff is in accord with this recommendation.
Chairman Kasolas opened the public hearing and invited anyone in the audience
to speak for or against this application.
No one wishing to speak, Commissioner Kotowski moved that UP 81-01 be
continued to the March 3, 1981 Planning Commission meeting.

ZC 81-05 This is the time and place fora public hearing to
City-initiated consider the property known as 824 E. Campbell
Avenue in an H (Historic Preservation) Overlay
Zoning District.
qtr. Stafford reported that on January 27, 1981 the Historic Preservation Board
held a public hearing on the application of the Civic Improvement Commission
to have the "P•lorton House", located at 824 E. Campbell Avenue, declared an
Historic Landmark. After hearing all the evidence presented, the Board did
adopt a resolution recommending that the City Council designate the existing
structure as an historic landmark in the City of Campbell. He noted that the
Board did express some concern that the future street alignment at the Union
Avenue and Campbell Avenue intersection may create a special hardship on the
owners of the subject property due to the proximity of the street to the
building.
The Historic Preservation Ordinance requires that the Planning Commission
consider a zone change for historic designation after the Historic Preservation
Board has made its recommendation. The Ordinance also requires that the
Commission's recommendation and comments be forwarded to the City Council to be
considered simultaneously with those of the Board.
At this time, Commissioner Pack noted that two of the Historic Preservation
Board members were opposed to this property being designated an historic
landmark, as noted in the minutes of that Board meeting dated January 27, 1981.
Chairman Kasolas opened the public hearing and invited anyone in the audience
to speak for or against this application.
Mr. Bill Hedley,representino`the applicant, reported that he and the applicant
have been working on this project since August 1980. He noted that it is the
intent of the property owners to construct a new office building on the site;

at the time they applied fora demolition permit they were informed that this
building is indicated as a potential historic landmark. He noted that with the
proposed improvement to the corner of Union and Campbell Avenues by the Public
Works Department there would be only three feet between the existing structure
and the proposed street. He further noted that this would create a real hardship
to this property.
No one else wishing to speak, Commissioner Pack moved that the public hearing
be closed, seconded by Commissioner Kotowski and unanimously adopted.
RESOLUTION fd0. 1979 Commissioner Pack moved that the Planning Commission
adopt Resolution No. 1979 recommending that 824 E.
Campbell Avenue not be included in an H (Historic
Preservation) Overlay Zoning District for the
following reasons:
1. It is not felt that the structure at 824 E.
Campbell Avenue is of significant historic
value;
2. It is felt that even though the Mortons were
involved in City affairs, it is not felt that
they were any more involved than many others
(Morton did live in this house, however, he was
not mayor at the time);
3. L,lith the plans for realignment of Union Avenue
at Campbell Avenue allowing for only three feet
between the street right-of-way and the building,
it was felt that this would create a real hardship
on the property owners.
This motion was seconded by Commissioner Meyer.
Discussion of h1otion
Commissioners Kotowski and Campos spoke in favor of this motion.
Commissioner Fairbanks spoke in favor of this motion, noting she did feel
this particular structure has historical significance, however there are
such restrictions on this property with the necessary right-of-way for
the Union and Campbell intersection that there is an undue hardship placed
upon the property owner. She felt the City should be very careful in
placing such historical designations and placing restrictions on properties
such as the one under consideration.

ZC 81-06 This is the time and place for a public hearing to
City-initiated consider a City-initiated zone change to include
the property known as 35 and 45 S. First Street in
an H (Historic Preservation) Overlay Zoning District.
Mr. Stafford reported that on January 27, 1981 the Historic Preservation Board
held a public hearing to consider the application of P1ark and Edna Stevensen,
owners of the subject property, to declare the "Grizzle Court Duplex" an
historic landmark. After hearing the evidence presented, the Board did adopt
a resolution recommending that the City Council designate the subject structure
as an historic landmark in the City of Campbell.
The Historic Preservation Ordinance requires that the Planning Commission
consider a zone change for Historic designation after the board has made
its recommendation. The Ordinance also requires the Commission to forward
its recommendations and comments to the City Council, so that the Commission's
and the Board's recommendation can be considered simultaneously.
Chairman Kasolas opened the public hearing and invited anyone in the audience
to speak for or against this item.
Mr. Mark Stevensen, property owner, appeared before the Commission to give
background on the Grizzle Court Duplex. He noted that the cannery workers
occupied these dwellings prior to the depression; it was intended to construct
additional units, however once the depression hit it was not economically feasible.
He noted that this designation would be beneficial for tax purposes.
Commissioner Pack inquired if the City has plans for the parcel located adjacent
to this site.
Mr. Kee responded that no plans have been proposed for this parcel, which is
in a P-D (Commercial) Zoning District.
No one else wishing to speak, Commissioner Meyer moved that the public hearing
be closed, seconded by Commissioner Kotowski and unanimously adopted.
Motion
Commissioner Pack moved that the Planning Commission recommend that 35 and
45 S. First Street be included in an H (Historic Preservation) Overlay Zoning
District. This motion was seconded by Commissioner Fairbanks.
Discussion of Motion
Commissioner Dickson expressed concern about how much of the City would be
designated this way. He spoke against this motion.
Commissioner Campos also spoke against this motion, noting he did not see the
rationale of the findings as presented by the Historic Preservation Board.
He also expressed concern about a lack of direction and/or policy regarding
these zone changes.

This motion failed.
RESOLUTION N0. 1980 Commissioner Pleyer moved that the Planning Commission
adopt Resolution No. 1980 recommending that the ,City
Council not include 35 & 45 S. First Street in an H
(Historic Preservation) Overlay Zoning District.
This motion was seconded by Commissioner Campos.
Discussion of Resolution
Commissioner Pack noted that she would be in favor of this motion after _.
hearing the comments-of her feloi~i commissioners,-and noted there would be
a more unanimous vote to go on to the City Council.
Commissioner Kotowski spoke against this motion, noting that the property
owner had applied for this designation; he felt there would not be a problem
in granting this request.

At this time discussion ensued regarding direction from the City Council in
regard to charges of the Historic Preservation Board.
It was the consensus of the Commission that a formal referral be sent to the
City Council requesting clarification of policy on consideration of historical
structures, and any order of priority that might be considered.

TS 81-01 Tentative Subdivision Map: Lands of Fitzpatrick and
Lands of Fitzpatrick Santoro. APN 406-03-23 & 24 (1165-1169 Smith Avenue)
and Santoro
t~tr. Kee reported that this item is directly related to UP 80-30, the application
of P~ir. NJarren Jacobsen for a use permit and approval of plans and elevations to
allow construction of 12 town homes on property known as 1165 & 1169 Smith Avenue
in an Interim (Low-hledium Density Residential) Zoning District.
The City Council approved UP 80-30 on December 22, 1980. One of the conditions
of this approval is that the applicant file and process a tract map. This map
has been submitted and conforms to the approved site plan.

Commissioner Meyer then moved that TS 81-O1 be recommended for approval by
the City Council and that the Planning Commission find this tentative subdivision
map in accord with the General Plan. This motion was seconded by Commissioner
Kotowski and adopted with Commissioners Dickson and Fairbanks voting "no".
Commissioner Dickson stated he is opposed to the subject project because of the
high density involved. Commissioner Fairbanks stated she had opposed the
project, and therefore is opposing the subject map.

Request for Minor Request from Mr. David Gilchrist fora minor modi-
Modification fication to the front yard setback on property
known as 448 Memphis Drive.
t~9r. Kee reported that the applicant is proposing to construct a 200 square
foot addition to an existing house.. The existing house has a 10 foot setback
from Boise Drive and the applicant is requesting to have the addition con-
structed with a 10 foot setback from the street.
Staff is of the opinion that the 10 foot setback is reasonable considering
that the existing house has this setback and that Boise Drive deadends at
the rear of the applicant's property. No traffic or visibility problems
will result.
Commissioner Meyer then moved that the Planning Commission approve this
request fora minor modification to the front yard setback for 448 Memphis
Drive, seconded by Commissioner Dickson and unanimously adopted.
Staff Report Report from Staff regarding the letter addressed
to the Planning Commission from Nts. Margaret Estep,
received December 17, 1980.
It was the consensus of the Commission that this report be acknowledged and
filed. After lengthy discussion regarding the number of complaints received
and the concerns expressed about commercial developments next to residential
areas, Commissioner Fairbanks moved that the Planning Commission recommend
that when the next General Plan hearings are held (May 19, 1981) that the
City Council consider a change in the General Plan from P-D to C-1-S based
on the fact that the surrounding area to this site is Residential and some
of the uses allowed in the P-D zone would not be allowed within the C-1-S
Zoning District. This motion was seconded by Commissioner Kotowski and
adopted with Commissioner Kasolas voting "no".
Commissioner Campos stated that he would like to see a report come back to
the Commission regarding this problem sometime in April.
Mr. Kee stated that Staff could come back with an updated report at that
time.

Appointments to Planning Commission Committees for 1981.
At this time Chairman Kasolas appointed Vice Chairman Meyer to serve on the
Special Citizens' Advisory Committee.
Items Brought Up By Commissioners
Commissioner Pack inquired about the manufacturing establishment next to
the Chamber of Commerce.
It was the consensus of the Commission that Staff report back at the next
meeting regarding the status of this establishment.

At this time Commissioner Dickson inquired about the landscaping plans for
San Tomas Aquino Road where it makes a turn to the south.
Mr. Kee stated Staff would report back at the next meeting on this inquiry.

An inquiry was then made regarding the house on stilts located on Campbell
Avenue near Victor.
Mr. Kee noted that an inquiry had been made in the past to the County
regarding this house; Staff will follow up on this once again.

ADJOURNMENT
Commissioner Fairbanks moved that the meeting be
adjourned, seconded by Commissioner Dickson, and
unanimously adopted.
The meeting adjourned at 10:05 p.m.
